<section id="HE8CF6E245BA7409FA9CD9AFC6EFB9B5D" section-type="section-one" commented="no"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Housing Accessibility and Voucher Expansion Now Act</short-title></quote> or the <quote><short-title>HAVEN Act</short-title></quote>. </text></section> <section id="H17A07D54E2464657B5AE7F6D6DFD976F"><enum>2.</enum><header>Adjustments to rental payments with respect to certain Federal rental assistance programs</header> <subsection id="H63CCE62EE4BE4757B464C7F2C8A5F005"><enum>(a)</enum><header>In general</header> <paragraph id="H7927E50F4BBD4C27B3C249CB77B9176D"><enum>(1)</enum><header>United States Housing Act of 1937</header><text>The United States Housing Act of 1937 (42 U.S.C. 1437 et. seq.) is amended—</text> 
<subparagraph id="H91B36E795FC840CE91F5F083A2B22EFD"><enum>(A)</enum><text display-inline="yes-display-inline">in section 3(a)(1)(A), by striking <quote>30</quote> and inserting <quote>20</quote>; </text></subparagraph> <subparagraph id="H8F09BE42FCFB49C2B9E8EA7AF4E75F60"><enum>(B)</enum><text display-inline="yes-display-inline">in section 8(o)(2)(A)(i), by striking <quote>30</quote> and inserting <quote>20</quote>; and</text></subparagraph> 
<subparagraph id="HA7C045D62A05443C802206FF923E96BA"><enum>(C)</enum><text display-inline="yes-display-inline">in section 9(e)(2)(A)—</text> <clause id="HBF689FE54D8D4290A0E49543A8FEC83C"><enum>(i)</enum><text>in clause (vi), by striking <quote>and</quote> at the end;</text></clause> 
<clause id="H61F26F030D1F47E380E6D97BC219F47A"><enum>(ii)</enum><text>by redesignating clause (vii) as clause (viii) and by moving such clause 1 em to the right; and</text></clause> <clause id="HD55A90DF775847379F4898C9C5F9D3A8"><enum>(iii)</enum><text>by inserting after clause (vi) the following:</text>

<clause id="HFE97DA62AA0C48128844EF8B15E52BAE"><enum>(vii)</enum><text display-inline="yes-display-inline">the amount of public housing rental income forgone by the public housing agency as a result of lowering the percentage of monthly adjusted income for the calculation of rental payments; and </text></clause><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph> <paragraph id="HCF8D3E52FF794CC5A444827AB8B3B4B4"><enum>(2)</enum><header>Housing Act of 1949</header><text display-inline="yes-display-inline">Section 521(a)(3) of the Housing Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/42/1490a">42 U.S.C. 1490a(a)(3)</external-xref>) is amended by striking <quote>30</quote> in each place it occurs and inserting <quote>20</quote>. </text></paragraph> 
<paragraph id="H86B09D8A4BAA490B80A36420C462D136"><enum>(3)</enum><header>Housing Act of 1959</header><text display-inline="yes-display-inline">Section 202(c)(3) of the Housing Act of 1959 (<external-xref legal-doc="usc" parsable-cite="usc/12/1701q">12 U.S.C. 1701q(c)(3)</external-xref>) is amended by striking <quote>30</quote> and inserting <quote>20</quote>.</text></paragraph> <paragraph id="H173A259107484FD48C2969050C3FAD67"><enum>(4)</enum><header>Cranston-Gonzalez National Affordable Housing Act</header><text display-inline="yes-display-inline">Section 811(d)(3) of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/8013">42 U.S.C. 8013(d)(3)</external-xref>) is amended by striking <quote>30</quote> and inserting <quote>20</quote>.</text></paragraph></subsection> 
<subsection id="H9FDC206463C544EFB1854036AF39FF77"><enum>(b)</enum><header>Effect on recipients of assistance</header><text>To the extent practicable, the Secretary of Housing and Urban Development shall ensure that the adjustments made by subsection (a) do not reduce the number of recipients of the Federal rental assistance programs described in subsection (a). </text></subsection></section> <section id="H4615935112634233964E572629397962"><enum>3.</enum><header>Authorization of appropriations with respect to certain Federal rental assistance programs</header> <subsection id="H455A080053654D148FB949FC7158DE49"><enum>(a)</enum><header>United States Housing Act of 1937</header><text display-inline="yes-display-inline">The United States Housing Act of 1937 (42 U.S.C. 1437 et. seq.) is amended—</text> 
<paragraph id="HAC1CDA0FB48B40BD8934E42D5D0BA168"><enum>(1)</enum><text display-inline="yes-display-inline">in section 9(c)(2)(A), by striking <quote>, and 2003</quote> and inserting <quote>2003, 2026, and each fiscal year thereafter</quote>; and</text></paragraph> <paragraph id="H7C9C94EC74614AB285B3B34811FC6A99"><enum>(2)</enum><text>in section 9(c)(2)(B), by striking <quote>, and 2003</quote> and inserting <quote>2003, 2026, and each fiscal year thereafter</quote>.</text></paragraph> </subsection> 
<subsection id="H339C16229F6E4B1F87F38F25DCC5CDFD"><enum>(b)</enum><header>Housing Act of 1959</header><text display-inline="yes-display-inline">Section 202(m) of the Housing Act of 1959 (<external-xref legal-doc="usc" parsable-cite="usc/12/1701q">12 U.S.C. 1701q(m)</external-xref>) is amended to read as follows:</text> <quoted-block style="OLC" id="H620084CEB91749CF8AF6A8C53F7FA1E8" display-inline="no-display-inline"> <subsection id="H36C96603632A427A89BD758C22F53474"><enum>(m)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated such sums as may be necessary to carry out this section. </text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H81FDD78782BD4A3DB5CE9D304D0AA962"><enum>(c)</enum><header>Cranston-Gonzalez National Affordable Housing Act</header><text display-inline="yes-display-inline">Subsection (m) of section 811 of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/8013">42 U.S.C. 8013(m)</external-xref>) is amended by striking the period at the end and inserting <quote>, and such sums as necessary for fiscal year 2026 and each fiscal year thereafter</quote>.</text></subsection></section> <section id="HEDE35A58C1B847749E7D7C8F53F2DC05"><enum>4.</enum><header>Unlawful discrimination based on source of income</header><text display-inline="no-display-inline">The Fair Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3601">42 U.S.C. 3601 et seq.</external-xref>) is amended—</text> 
<paragraph id="H02858173CC2748A8B888331FA337A5B5"><enum>(1)</enum><text>in section 804, by striking <quote>or national origin</quote> each place it appears and inserting <quote>national origin, or lawful source of income</quote>;</text></paragraph> <paragraph id="HDEB7D068C25849ADB8E8AE979FD5B464"><enum>(2)</enum><text>in section 805—</text> 
<subparagraph id="H13CE65981D6B4A769B073AC350A9AB21"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a), by striking <quote>or national origin</quote> and inserting <quote>national origin, or lawful source of income</quote>; and</text></subparagraph> <subparagraph id="H5B6F83520F7D48868C14F22C41D22881"><enum>(B)</enum><text display-inline="yes-display-inline">in subsection (e), by striking <quote>or familial status</quote> and inserting <quote>familial status, or lawful source of income</quote>;</text></subparagraph></paragraph> 
<paragraph id="H2D37DC492CA24E678C89D6BE72C75F40"><enum>(3)</enum><text display-inline="yes-display-inline">in section 806, by striking <quote>or national origin</quote> and inserting <quote>national origin, or lawful source of income</quote>;</text></paragraph> <paragraph id="HBC38E05B824F41149B889319279DB1A7"><enum>(4)</enum><text>in section 807(a), by striking <quote>or national origin</quote> and inserting <quote>national origin, or lawful source of income</quote>; and</text></paragraph> 
<paragraph id="HD7B8AF6ACBDE4F71B872E76B49398D95"><enum>(5)</enum><text>in section 808(e)(6), by striking <quote>and family characteristics</quote> and inserting <quote>family characteristics, and lawful sources of income,</quote>. </text></paragraph></section> <section id="H5F52940F54CD4278A30AE7587733C309"><enum>5.</enum><header>Housing navigation grant for housing choice voucher program</header><text display-inline="no-display-inline">Section 8(o) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(o)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H4F630D47F48F4F4697461138834B1967" display-inline="no-display-inline"> 
<paragraph id="H75FFEBE4A6CD4506905BE6F93575DBCC"><enum>(23)</enum><header>Housing navigation grant</header> 
<subparagraph id="H650A083A93B54AADB6F7ADB458D6A3D3"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this paragraph, the Secretary shall establish a grant program to award housing navigation grants to public housing agencies. </text></subparagraph> <subparagraph id="HD9E249783C5D4445A8056E806AACE554"><enum>(B)</enum><header>Eligible uses</header><text>A public housing agency that is awarded a grant under this paragraph shall use such grant to—</text> 
<clause id="H76C6E5DE20A747018B435462EA6294CF"><enum>(i)</enum><text>assist families receiving tenant-based assistance with the search to find a suitable dwelling unit; or</text></clause> <clause id="H53E8BEFA6DB6438684DB46C4640F5B50" commented="no"><enum>(ii)</enum><text>engage with owners of dwelling units for the purpose of assisting such families in such search.</text></clause></subparagraph> 
<subparagraph id="H6CBCDE8E42144F408DDEC44A02D82FF4"><enum>(C)</enum><header>Subgrants</header><text>A public housing agency that is awarded a grant under this paragraph may use such grant amounts to provide subgrants to nonprofit organizations to carry out the eligible uses described in subparagraph (B).</text></subparagraph> <subparagraph id="H3C32AAE7D88943E5822615AA49726B63"><enum>(D)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out this paragraph $20,000,000 for fiscal year 2026 and each fiscal year thereafter.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H2A57D57B4E27484EA8D2E70DC83467DC"><enum>6.</enum><header>Use of small area fair market rents for housing choice voucher program</header><text display-inline="no-display-inline">Section 8(o)(1) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(o)(1)</external-xref>) is amended—</text> <paragraph id="HD4B2FACD117340EC899B85455B954BA5"><enum>(1)</enum><text>in subparagraph (B), by striking <quote>subparagraph (D)</quote> and inserting <quote>subparagraphs (D) and (F)</quote>; and</text></paragraph> 
<paragraph id="HDB67AABB79604AE9B33667CA7E596F35"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="HD8ADFD45F68B45ACBB21CC575673FF0F" display-inline="no-display-inline"> <subparagraph id="H85E75FF865054E5FA2E52F104F3A5472" commented="no"><enum>(F)</enum><header>Use of small area fair market rents</header><text display-inline="yes-display-inline">Effective for fiscal year 2026 and each fiscal year thereafter, the area fair market rents used for purposes of subparagraph (B) shall be established by the Secretary by zip code areas. </text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H90323842CD73427883069B762E3A3EFE"><enum>7.</enum><header>Technical assistance for applicants for admission to a public housing project</header><text display-inline="no-display-inline">Section 9(h)(1) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437g">42 U.S.C. 1437g(h)(1)</external-xref>) is amended by inserting <quote>applicants for admission to a project,</quote> after <quote>organizations,</quote>.</text></section> <section id="HB5565C184D4D46CE9B1FE5F61C65D57E"><enum>8.</enum><header>Expansion of housing choice voucher program</header> <subsection id="H990089A25C29406892B09DC921219482"><enum>(a)</enum><header>Expanded vouchers</header> <paragraph id="HA05F4F2FA01940588A985D30495CA555"><enum>(1)</enum><header>Funding</header><text>There is appropriated, out of any money in the Treasury not otherwise appropriated, for providing incremental vouchers for rental assistance under section 8(o) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(o)</external-xref>) in accordance with this section for each of fiscal years 2026 through 2029, the amount necessary to fund—</text> 
<subparagraph id="H346A4FC4BBF84EB0AFAF030ACD444474"><enum>(A)</enum><text>the number of incremental vouchers required to be allocated under paragraph (2);</text></subparagraph> <subparagraph id="H39DF1E6DC8EE4FECBF61F2D02A7FBA46"><enum>(B)</enum><text>annual renewals of the vouchers allocated under paragraph (2); and</text></subparagraph> 
<subparagraph id="HEAE9986D739B4A14B7A36D903A5E28A4"><enum>(C)</enum><text>administrative fees for vouchers allocated under paragraph (2).</text></subparagraph></paragraph> <paragraph id="H6C612D13B1754CC98886267E6EABB0B8"><enum>(2)</enum><header>Allocation</header> <subparagraph id="H7C76FECF4A804329AA69913A8A2F1996"><enum>(A)</enum><header>Incremental vouchers</header><text>The Secretary shall allocate 500,000 incremental vouchers in fiscal year 2026 and 1,500,000 incremental vouchers in increments of 500,000 in each calendar year from 2027 through 2029 under this section to public housing agencies pursuant to section 213(d) of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/1439">42 U.S.C. 1439(d)</external-xref>).</text></subparagraph> 
<subparagraph id="HAF0BBA2312694007A0C55558C1A174E7"><enum>(B)</enum><header>Selection criteria</header><text>The Secretary shall, by notice in the Federal Register, establish selection criteria under section 213(d) of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/1439">42 U.S.C. 1439(d)</external-xref>) that prioritizes housing needs among eligible households and severe housing hardship, such as experiencing homelessness, overcrowding, or evictions.</text></subparagraph></paragraph></subsection> <subsection id="H29890A47F6EF451F83AF0ED14D2E9FF0"><enum>(b)</enum><header>Entitlement to vouchers</header> <paragraph id="HB2F396ACE30546F9816F0E12D75E3D60"><enum>(1)</enum><header>In general</header><text>On and after the date that is 5 years after the date of enactment of this Act, any family that is otherwise eligible for tenant-based rental assistance under section 8(o) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(o)</external-xref>) shall be entitled to that rental assistance during any period that the family is an eligible household.</text></paragraph> 
<paragraph id="HBB3E209F61ED487192A18423ADD0452D"><enum>(2)</enum><header>Funding</header><text>There is appropriated, out of any money in the Treasury not otherwise appropriated, such sums as may be necessary—</text> <subparagraph id="HEB05F373BB4A49AD905779DDD5009E01"><enum>(A)</enum><text>to provide assistance under section 8(o) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(o)</external-xref>) in accordance with the entitlement under paragraph (1) of this subsection for each eligible household in the amount determined under such section 8(o); and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HE3D72E1BE32649679E8F315D85E81555"><enum>(B)</enum><text>to provide administrative fees under section 8(q) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(q)</external-xref>) in connection with each voucher for assistance provided pursuant to subparagraph (A) of this paragraph.</text></subparagraph></paragraph></subsection> <subsection id="HE2E1DDE68F6E4363946D771841BCC905"><enum>(c)</enum><header>Eligible household defined</header><text display-inline="yes-display-inline">In this section, term <term>eligible household</term> means a family who has an income that does not exceed 80 percent of the area median income, as determined by a public housing agency.</text></subsection></section> 
<section id="H1A3C51EA804D420989B65DE8342E0AF2"><enum>9.</enum><header>Section 8 Management Assessment Program</header><text display-inline="no-display-inline">Not later than 1 year after the date of the enactment of this Act, the Secretary of Housing and Urban Development shall issue a rule to consider the timeliness of approval for both eligible families and landlords with respect to the Section 8 Management Assessment Program (SEMAP) or any successor assessment program, as described in part 985 of title 24, Code of Federal Regulations. </text> </section> </legis-body></bill>
