R. 3131</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250501">May 1, 2025</action-date><action-desc><sponsor name-id="T000467">Mr. Thompson of Pennsylvania</sponsor> (for himself and <cosponsor name-id="B001278">Ms. Bonamici</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and Workforce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend and reauthorize the Community Services Block Grant Act.</official-title></form><legis-body id="H7834F554D7CD47EFA67F3B9A6D4DE8DA" style="OLC"><section id="H58D429CBFB914A7FB3E8F600A241B6AD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Community Services Block Grant Improvement Act of 2025</short-title></quote>.</text></section><section id="H3DD03F8CE4ED4680A048E53A7B766992"><enum>2.</enum><header>Purposes and goals</header><text display-inline="no-display-inline">Section 672(1) of the Community Services Block Grant Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9901">42 U.S.C. 9901(1)</external-xref>) is amended to read as follows:</text><quoted-block id="H866DF57DCD24413A953930ED1B6D3A30" style="OLC"><paragraph id="HF512435D87814F6B8445DA9C67D64BCF"><enum>(1)</enum><text>to reduce poverty in the United States by supporting the activities of community action agencies and other community services network organizations that improve the economic security of low-income and working individuals and families, empower them to become fully sufficient, and create new economic opportunities in the communities where they live; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H27B6A1430D57487E929F637FB6914C60"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 673 of the Community Services Block Grant Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9902">42 U.S.C. 9902</external-xref>) is amended by striking paragraphs (1) through (5), and inserting the following:</text><quoted-block id="H379FD8C2745147499F36A57F3C2AF8E0" style="OLC"><paragraph id="H3D49F53D23474D47A15113552C510F5B"><enum>(1)</enum><header>Agency-wide strategic plan</header><text>The term <quote>agency-wide strategic plan</quote> means a plan that has been adopted by an eligible entity in the previous 5 years and establishes goals that include meeting needs identified by the entity in consultation with residents of the community through a process of comprehensive community needs assessment.</text></paragraph><paragraph id="HEE1ACEED6E1C4EBC87FF21944ECA4020"><enum>(2)</enum><header>Poverty line</header><subparagraph id="H1377FF5E6BA94718907C792F99547FE1"><enum>(A)</enum><header>In general</header><text>The term <quote>poverty line</quote> means the official poverty guideline calculated by the Secretary from the most recent data available from the Bureau of the Census. The Secretary shall revise the poverty line annually (or at any shorter interval the Secretary determines to be feasible and desirable). The required revision shall be accomplished by multiplying the official poverty thresholds from the Bureau of the Census by the percentage change in the Consumer Price Index for All Urban Consumers during the annual or other interval immediately preceding the time at which the revision is made.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block><paragraph id="LEXA-Repairid253e8bef22c84e9b98249f9869c1e61f"><enum/><subparagraph id="HA764CD2CDDD74B1E9C424904B78797EE"><enum>(B)</enum><header>Eligibility criterion</header><text>200 percent of the poverty line shall be used as a criterion of eligibility for services, assistance, or resources provided directly to individuals or families through the grant program established under this subtitle.</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF4DE10500A2646DEA55D5D626DD44CFD"><paragraph id="H1686D6A18F114422890AE1DC9A1205A1"><enum>(3)</enum><header>Community action agency</header><text>The term <quote>community action agency</quote> means an eligible entity (which meets the requirements of paragraph (1) or (2), as appropriate, of section 676B) that delivers multiple programs, projects, and services to a variety of low-income individuals and families.</text></paragraph><paragraph id="H364D967D602547278A5F075AE964BD5B"><enum>(4)</enum><header>Community action plan</header><text>The term <quote>community action plan</quote> means a detailed plan, including a budget, that is adopted by an eligible entity, for expenditures of funds appropriated for a fiscal year under this subtitle for the activities supported directly or indirectly by such funds.</text></paragraph><paragraph id="HDB62B7235AFE452E9ADE88840F230291"><enum>(5)</enum><header>Community services network organization</header><text>The term <quote>community services network organization</quote> means any of the following organizations funded under this subtitle:</text><subparagraph id="H0344B114F5E54395A34C1EE9EAB321A3"><enum>(A)</enum><text>A State.</text></subparagraph><subparagraph id="H1F715BF859264A29AE2932BEB22B62B1"><enum>(B)</enum><text>An eligible entity.</text></subparagraph><subparagraph id="HBB0A38F68EE9470B922EB1FD62739CC5"><enum>(C)</enum><text>An association with a membership composed primarily of States, eligible entities, or associations of States or eligible entities.</text></subparagraph></paragraph><paragraph id="HA945FFE126574C23B8F477CA99B70B6B"><enum>(6)</enum><header>Eligible entity</header><text>The Term <quote>eligible entity</quote> means an entity that—</text><subparagraph id="H63FA3B25D3E44B799754CD4050AB4622"><enum>(A)</enum><text>is an eligible entity described in section 673(1) (as in effect immediately before the date of the enactment of the Community Services Block Grant Improvement Act of 2025), or has been designated by the process described in section 676A (including an organization serving migrant or seasonal farm workers that is so described or designated); and</text></subparagraph><subparagraph id="H958F9D51FF384C32ACC0B36DF5E872FA"><enum>(B)</enum><text>has a tripartite board described in paragraph (1) or (2), as appropriate, of section 686B.</text></subparagraph></paragraph><paragraph id="H0D392E89E9E44C40A07D530DA77ACC51"><enum>(7)</enum><header>Private, nonprofit organization</header><text>The term <quote>private, nonprofit organization</quote> includes a religious organization, to which section 679 applies.</text></paragraph><paragraph id="H69FCF3F2CBA04F3A91615184612A0A2D"><enum>(8)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Health and Human Services.</text></paragraph><paragraph id="H936F2382CC934F4194A881FD0C8B23FF"><enum>(9)</enum><header>State</header><text display-inline="yes-display-inline">The term <quote>State</quote> means each of the several States, the District of Columbia, the Commonwealth of Puerto Rico, Guam, the United States Virgin Islands, American Samoa, and the Commonwealth of the Northern Mariana Islands.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="H8250ACC269374A7A8FB89394075935A2"><enum>4.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">Section 674 of the Community Services Block Grant Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9903">42 U.S.C. 9903</external-xref>) is amended—</text><paragraph id="H19E85673FED9456086F7DF0AEDC87033"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="HADC3C1C8DEF84855AF9DE7FD7E4B82FA"><enum>(A)</enum><text>by striking <quote>such sums as may be necessary for each of fiscal years 1999 through 2003</quote> and inserting <quote>$1,000,000,000 for each of fiscal years 2026 through 2032</quote>, and</text></subparagraph><subparagraph id="H5D58C5EC4EF5459BA150A0EAEA1DE69C"><enum>(B)</enum><text>by striking <quote>sections 681 and 682</quote> and inserting <quote>section 680</quote>,</text></subparagraph></paragraph><paragraph id="HAE73106BA43843D489ACF4D7C09565A3"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="H036C5D0598824BED817A691822229346"><enum>(A)</enum><text>in paragraph (2)—</text><clause id="H9B5DF5C10CBE40649EC15F1DBFD10299"><enum>(i)</enum><text>by striking <quote>1½ percent</quote> and inserting <quote>1 percent</quote>,</text></clause><clause id="H99FF955680F14A0D9BE85F026255B5A0"><enum>(ii)</enum><text>in subparagraph (A)—</text><subclause id="H024CC80D3CB548288580711488345116"><enum>(I)</enum><text>by striking <quote>entities,</quote> and inserting <quote>entities and other community services network organizations</quote>, and</text></subclause><subclause id="H98BAB3B06DF14E55B71108C1667BF62E"><enum>(II)</enum><text>by striking <quote>organizations or associations</quote>, and</text></subclause></clause><clause id="HAC2AC5DE389D4779B8E96DD3949CB2B8"><enum>(iii)</enum><text>in subparagraph (B) by striking <quote>and</quote> at the end and inserting a period, and</text></clause></subparagraph><subparagraph id="HD77A6D4F8391437FBDCAA44E98F5EDBB"><enum>(B)</enum><text display-inline="yes-display-inline">by striking paragraph (3), and</text></subparagraph></paragraph><paragraph id="H9ABD2E836EAA416FB06131A2BAC4423C"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H84A0E19BE41745529FE90F9DD3946FE4" display-inline="no-display-inline"><subsection id="HC096A53D54AA49F1BC1E64294A78193D"><enum>(c)</enum><header>Discretionary programs</header><text display-inline="yes-display-inline">There are authorized to be appropriated $40,000,000 to carry out section 680(a)(2) and 680(a)(3) for each of the fiscal years 2026 through 2032.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HDBB2C4C31A4B4C378472D6CCE3985152"><enum>5.</enum><header>Establishment of block grant program</header><text display-inline="no-display-inline">Section 675 of Community Services Block Grant Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9904">42 U.S.C. 9904</external-xref>) is amended by striking <quote>through</quote> and all that follows through the period at the end, and inserting <quote>for the purposes described in section 672.</quote>.</text></section><section id="HD2633E97E40043CFA45C298647F31B7F"><enum>6.</enum><header>Allotments and payments to States</header><text display-inline="no-display-inline">Section 675B of the Community Services Block Grant Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9906">42 U.S.C. 9906</external-xref>) is amended—</text><paragraph id="H495FD855D2254848A912356B79A5DEEF"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H0EE48F8266C94F468308BD49C2B8FDCE"><enum>(A)</enum><text>by striking <quote>except—</quote> and inserting <quote>except as provided in subsection (b).</quote>, and</text></subparagraph><subparagraph id="H54FF531D708F4B34895FFA381622B7F7"><enum>(B)</enum><text>by striking paragraphs (1) and (2),</text></subparagraph></paragraph><paragraph id="H13E5FF8C8DD9438AA5868CFD68C9A938"><enum>(2)</enum><text>by amending subsection (b) to read as follows:</text><quoted-block id="H05D7A5CD5AB44CFFAD61473D3648741F" style="OLC"><subsection id="H0386474DB804497EB1362D4F7FBA122D" display-inline="no-display-inline"><enum>(b)</enum><header>Minimum allotments</header><paragraph id="H00AE0D9AF98F4989A031448EC0E70189"><enum>(1)</enum><header>In general</header><text>No State shall receive less than ½ of 1 percent of the amount appropriated under section 674(a) for a fiscal year that remains after the Secretary makes the reservations required by section 674(b).</text></paragraph><paragraph id="H63A056BF672041F7BE9604D7771B4922"><enum>(2)</enum><header>Years with greater available funds</header><text>Notwithstanding paragraph (1), if the amount appropriated under section 674(a) for a fiscal year that remains after the Secretary makes the reservations required in section 674(b) exceeds $900,000,000, no State shall receive under this section less than ¾ of 1 percent of the remaining amount.</text></paragraph></subsection><after-quoted-block>, and</after-quoted-block></quoted-block></paragraph><paragraph id="H17FFA91734C6474F8366AD73DADF919A"><enum>(3)</enum><text>by amending subsection (c) to read as follows::</text><quoted-block id="H1ECA97F925BE4345842DA675EA6BB246" style="OLC"><subsection id="HA67B73747E714A718033C844B58E2C62"><enum>(c)</enum><header>Grants and payments</header><text display-inline="yes-display-inline">Subject to section 677, the Secretary shall make grants to eligible States for the allotments described in subsections (a) and (b). The Secretary shall make payments for the grants in accordance with section 6503(a) of title 31, United States Code. The Secretary shall allocate the amounts allotted under subsections (a) and (b) on a quarterly basis at a minimum, notify the States of their respective allocations, and make each State’s first allocation amount in a fiscal year available for expenditure by the State no later than 30 days after receipt of an approved apportionment from the Office of Management and Budget and, for subsequent allocation amounts in the fiscal year, not later than 30 days after the start of the period for which the Secretary is allocating the funds.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H1935DBFEEA2243C58078B0234059DB60"><enum>7.</enum><header>Uses of funds</header><text display-inline="no-display-inline">Section 675C of the Community Services Block Grant Act (42 U.S.C.. 9907) is amended—</text><paragraph id="HE15C3804DB3040549F56ADDA4B85C5A6"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H695196AFAEC54C649C8A6FE4ACB75895"><enum>(A)</enum><text>in paragraph (1) by striking <quote>for the purposes described in section 672 to eligible entities</quote> and inserting <quote>to eligible entities that enable the entities to implement programs, projects, and services for the purposes described in section 672</quote>,</text></subparagraph><subparagraph id="H0C8BF1B87F544FC49188CB81310AD9EF"><enum>(B)</enum><text>by amending paragraph (2) to read as follows:</text><quoted-block id="H00FD94F173BF48D1BEDBD0A1A9CA12B5" style="OLC"><paragraph id="H1ECB5DB8AD514F1FA038A77EA566819B"><enum>(2)</enum><header>Obligational requirements</header><subparagraph id="H68A6D83DD9854E1EB8E7C41743A84C5E"><enum>(A)</enum><header>Date of obligation</header><text>The State shall obligate the funds for grants described in paragraph (1) and make such grants available for expenditure by eligible entities not later than the later of—</text><clause id="HBF001B45A12C42BE83E96B110214DF35"><enum>(i)</enum><text>the 30th day after the date on which the State receives from the Secretary a notice of funding availability for the State’s application under section 676(b) for a first or subsequent allocation for a fiscal year; or</text></clause><clause id="H8C7E4BD141D54FC1A4D161A7150AA25C"><enum>(ii)</enum><text>the first day of the State program year for which funds are to be expended under the State application.</text></clause></subparagraph><subparagraph id="HC5515FCFE7FE45F5ACE694E32209C563"><enum>(B)</enum><header>Exception</header><text>If funds are appropriated to carry out this subtitle for less than a full fiscal year, a State may request an exception from the Secretary from the requirement to make grants available for expenditure by eligible entities in accordance with subparagraph (A), except that a State may not accumulate more than one fiscal quarter’s worth of funding without making such funds available for expenditure by eligible entities.</text></subparagraph><subparagraph id="HA748E700DF39419B8965035E142B9AA6"><enum>(C)</enum><header>Availability</header><text>Funds distributed to eligible entities through grants made in accordance with paragraph (1) for a fiscal year shall be available for obligation by the eligible entity during that fiscal year and the following fiscal year.</text></subparagraph></paragraph><after-quoted-block>, and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H057EED6E2A924994BD76AC5DB45D5EF2"><enum>(C)</enum><text>by striking paragraph (3),</text></subparagraph></paragraph><paragraph id="H1BB6CC0C95664605B4A671F0B8926E82"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="H66BFD97E536C4D8F97AF21926DC7BC5B"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="HF75F8E26F7BF473592F66415AB6769C5"><enum>(i)</enum><text>by striking <quote>(subject to paragraph (2)) for activities that may include—</quote> and inserting <quote>for activities described in the State’s application and plan under section 676(b), as described in paragraph (2), and for administrative expenses subject to the limitations in paragraph (3).</quote>, and</text></clause><clause id="H9A63347F545B453CA89B4D3CAF85B015"><enum>(ii)</enum><text>by striking subparagraphs (A) through (H), and</text></clause></subparagraph><subparagraph id="HA66A79E4304449A09DDF7B2C2895D9FD" display-inline="no-display-inline"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="HCFC77D537C7B43E49158B43154DDDB8E"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>the greater of $55,000, or 5 percent,</quote> and inserting <quote>5 percent</quote>,</text></clause><clause id="HC3D96CAFEB5843C0AA951F5254D0F23C"><enum>(ii)</enum><text>in the 2d sentence by inserting <quote>under section 675B</quote> after <quote>allotment</quote>,</text></clause><clause id="H0B3EBC2147EB4F7C8735A5BD463873E0"><enum>(iii)</enum><text>in the 3d sentence by striking <quote>paragraph (1)(A)</quote> and inserting <quote>paragraph (2), other than monitoring,</quote>,</text></clause><clause id="H8812D8F0DE6343AFBF0EED1E0A1874EA"><enum>(iv)</enum><text>by striking the last sentence,</text></clause><clause id="HB5BDA2452D294B5A8E900F4C731D15F8"><enum>(v)</enum><text>by redesignating paragraph (2) as paragraph (3), and</text></clause><clause id="HEBD89105D7A14FB0851434C1CCBE3914"><enum>(vi)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block id="HADE0BAD7570B44E88664024420614ABF" style="OLC"><paragraph id="H82B4B60EE0354B0780701DF87CC5BDE3"><enum>(2)</enum><header>Training and technical assistance</header><text>After the application of subsection (a), the State may use the remaining grant funds for the purposes of—</text><subparagraph id="H92149E695D84431699ACE2D360BEC572"><enum>(A)</enum><text>providing training and technical assistance and resources to eligible entities, including to—</text><clause id="H93958D5B890A4640B6D25E5C75A38454"><enum>(i)</enum><text>assist eligible entities to respond to statewide or regional conditions that create economic insecurity, including emergency conditions; and</text></clause><clause id="H72FB00202967460D98D182FADB1249A4"><enum>(ii)</enum><text>support innovative programs and activities conducted by eligible entities for a purpose described in section 672, including assistance to eligible entities in building and using evidence of effectiveness in achieving such purpose;</text></clause></subparagraph><subparagraph id="HD5A291D9CB8D4E9D9CF4AE36011254C3"><enum>(B)</enum><text>supporting information and communication resources for the comprehensive community needs assessments described in section 676(b)(3)(B);</text></subparagraph><subparagraph id="HC42CA8AFCA644076BC1A3D1CA32EBBEE"><enum>(C)</enum><text>supporting performance measurement systems consistent with the requirements of section 678E;</text></subparagraph><subparagraph id="HCF79E9F459C94C4B8EEFB7F5E5CCCB01"><enum>(D)</enum><text>coordinating State-operated programs and services, and at the option of the State, locally-operated programs and services, targeted to low-income children and families with services provided by eligible entities and other organizations funded under this subtitle, to ensure increased access to services provided by such State or local agencies;</text></subparagraph><subparagraph id="H7C23BFCBB6334852B6F152507705A95C"><enum>(E)</enum><text>supporting statewide coordination and communication among eligible entities in the State, including supporting activities of a statewide association of community services network organizations; and</text></subparagraph><subparagraph id="H2E88206144E54BA2AF3F15D87073F64C"><enum>(F)</enum><text>analyzing the distribution of funds made available under this subtitle within the State to determine if such funds have been targeted to the areas of greatest need.</text></subparagraph></paragraph><after-quoted-block>, and</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="H755F4629900F40EF87F42C83E52D8334"><enum>(3)</enum><text>by striking subsection (c).</text></paragraph></section><section id="H9E08C7879ED64E3EA9DA72F408F81013"><enum>8.</enum><header>Application and plan</header><text display-inline="no-display-inline">Section 676 of the Community Services Block Grant Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9908">42 U.S.C. 9908</external-xref>) is amended—</text><paragraph id="HD4C947EC2EF74351BA7A50B88C257593"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a) by amending paragraph (2) to read as follows:</text><quoted-block id="H74891FE512A94CA4AA4CD2445BFB8B5C" style="OLC"><paragraph id="H3B4F1A316F9547E6B8213176B04F2899"><enum>(2)</enum><header>Duties</header><text>The lead agency—</text><subparagraph id="HDC1C1D5D569B4553A46A58BD6969BA82"><enum>(A)</enum><text>shall be authorized by the chief executive officer to convene State agencies and coordinate information and activities funded under this subtitle;</text></subparagraph><subparagraph id="HE844E82AC15F44E0883D3217400E2EBB"><enum>(B)</enum><text>shall develop the State plan to be submitted to the Secretary under subsection (b), which shall be based primarily on the community action plans of eligible entities submitted to the State as a condition of receiving funding under this subtitle;</text></subparagraph><subparagraph id="H3F3CD6D9156E4B9B97D2665AE026DC79"><enum>(C)</enum><text>may revise an existing State plan for submission to the Secretary, subject to the notice and distribution requirements in subparagraph (D)(iii);</text></subparagraph><subparagraph id="H46FE793A96E148C1BC6E4068C7C1BB3C"><enum>(D)</enum><text>in conjunction with the development of the State plan as required under subsection (b)—</text><clause id="HBAF0864DEDD5494DA184764DB0586226"><enum>(i)</enum><text>shall hold at least one hearing in the State on the proposed plan, to provide to the public an opportunity to comment on the public record on the proposed use and distribution of funds under the plan;</text></clause><clause id="H5F0F09059E9C4660A66CC4D4CFDD4033"><enum>(ii)</enum><text>not less than 15 days before the hearing, shall distribute notice of the hearing and a copy of the proposed plan statewide to the public and directly to the chief executive officer and board chairperson of each eligible entity and other community services network organization in the State; and</text></clause><clause id="HFAC5292D11824D2EA6CD67F46E0932FC"><enum>(iii)</enum><text>in the case of any proposed plan revision, shall notify and distribute a copy of the proposed revision directly to the chief executive officer and board chairperson of each eligible entity and other community services network organization in the State, before submission of such proposed revision to the Secretary; and</text></clause></subparagraph><subparagraph id="H742C3756AF094844AD9959C90E9AA2D1"><enum>(E)</enum><text>shall conduct reviews of eligible entities under section 678B.</text></subparagraph></paragraph><after-quoted-block>,</after-quoted-block></quoted-block></paragraph><paragraph id="HF0913548EE58473CA11BC9B01730B2E6"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="H1D0EE4ABDBC444638CD95B3C24094AB5"><enum>(A)</enum><text>in the matter preceding paragraph (1)—</text><clause id="H0BFCE5882D224269AC87656B3825AB86"><enum>(i)</enum><text>by striking <quote>2000</quote> and inserting <quote>2026</quote>, and</text></clause><clause id="HAEB0760344F34535B99398C3C7CA362C"><enum>(ii)</enum><text>by striking <quote>30</quote> and inserting <quote>60</quote>,</text></clause></subparagraph><subparagraph id="HF2A18F676C634D4ABE6735FE9F54E4ED"><enum>(B)</enum><text>in paragraph (1)—</text><clause id="HD8F2C0AFF07C4D1D982A2759B86614DD"><enum>(i)</enum><text>by striking <quote>made available through the grant or allotment will be used</quote> and inserting <quote>provided to an eligible entity under section 675C(a) shall be used by such entity for</quote>,</text></clause><clause id="H86E079CE166B42C893BB8A5D99A04789" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking <quote>to support activities that are designed</quote> and all that follows through <quote>will enable the families and individuals</quote>, and inserting <quote>programs, projects, and services that will enable low-income and working individuals and families</quote>,</text></clause><clause id="H9C7AE88E564D41FFBD316C9B5070967C"><enum>(iii)</enum><text>in subparagraph (B) by striking <quote>and</quote> at the end,</text></clause><clause id="HDBB527797C2046EBB7A4BBB878A86DF8"><enum>(iv)</enum><text>in subparagraph (C) by adding <quote>and</quote> at the end, and</text></clause><clause id="H6B6117AE217D49FD9834D24BA72E33E5"><enum>(v)</enum><text>by adding at the end the following:</text><quoted-block id="HB07821EBE6884A2280096C4817CD863D" style="OLC"><subparagraph id="H21D69C5AB3604690B50C1A7D40108556"><enum>(D)</enum><text>to address the educational and economic needs of low-income individuals, families, and communities by providing assistance through trained navigators to help facilitate access to affordable high-speed broadband service, internet-enabled devices, digital literacy training, technical support, and other services to meet the broadband and digital needs of such individuals, families, and communities.</text></subparagraph><after-quoted-block>,</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H658397E4A3BD43BCA8B73EF00517DF60"><enum>(C)</enum><text display-inline="yes-display-inline">in paragraph (2) by striking <quote>related to</quote> and inserting <quote>and the building and use of evidence of effectiveness in achieving</quote>,</text></subparagraph><subparagraph id="HC1CC234115D549278345B7B8D7D26EF8"><enum>(D)</enum><text>in paragraph (3)—</text><clause id="H8A96C4FDA74A4F8EBE0F7A8C1744A873"><enum>(i)</enum><text>by inserting <quote>a description summarizing the community action plans and</quote> after <quote>(3)</quote>, and</text></clause><clause id="H6CDE94F8F0E04DB0903367083768896E"><enum>(ii)</enum><text>in subparagraph (D) by striking <quote>fatherhood initiatives </quote> and inserting <quote>whole family approaches</quote>,</text></clause></subparagraph><subparagraph id="H59C45466F5CB40A8B1D0272DC4F137B8"><enum>(E)</enum><text>by amending paragraph (11) to read as follows:</text><quoted-block id="H0462174108594BE2B587B570F726EB29" style="OLC"><paragraph id="HDDEEC0A1707C4882BF83B62CAE9DDED9"><enum>(11)</enum><text>an assurance that the State will secure from each eligible entity in the State, as a condition of receipt of funding by the entity under section 675C(a), a community action plan that—</text><subparagraph id="H35CCA560149C4486B2F2DEEEDC17478E"><enum>(A)</enum><text>contains information on the intended implementation of the entity’s activities;</text></subparagraph><subparagraph id="HBFF38EBE23174B3DA0780BDB53C1C9D3"><enum>(B)</enum><text>demonstrates how such activities will meet needs identified in the most recent comprehensive community needs assessment conducted by the entity in the previous three years, which may be coordinated with community needs assessments conducted for other programs; and</text></subparagraph><subparagraph id="HDE9A4794445C4F0883A0401525ACFD50"><enum>(C)</enum><text>demonstrates how such activities will achieve the purposes of this subtitle;</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph><subparagraph id="H28DB245F172C45B0A3D86D13DAE050F7"><enum>(F)</enum><text>in paragraph (12)—</text><clause id="H4B8B737B96AC49468F0102B0C786612E"><enum>(i)</enum><text>by striking the comma and <quote>, not later than fiscal year 2001,</quote>,</text></clause><clause id="HAC690BB54EC8444FACFD56C391F50BFD"><enum>(ii)</enum><text>by striking <quote>promoting</quote> and inserting <quote>achieving the goals of the State plan and community action plans of eligible entities, respectively, and the purposes of this subtitle, including</quote>, and</text></clause><clause id="H511AEFF387F0434EADB76E14A486AF45"><enum>(iii)</enum><text>by striking <quote>and</quote> at the end,</text></clause></subparagraph><subparagraph id="H22C477CBB8BF4594B255B4CFBF01C369"><enum>(G)</enum><text>by amending paragraph (13) to read as follows:</text><quoted-block id="HFFF5878D68294B3FB7F71E83ACD69E81" style="OLC"><paragraph id="HF8D0990581A1470B80A65D6AF813159A"><enum>(13)</enum><text>an assurance that each eligible entity in the State shall make available to the public on the entity’s publicly available website the entity’s most recent agency-wide strategic plan, comprehensive community needs assessment, and community action plan;</text></paragraph><after-quoted-block>, and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H7D36B1D2323040F7896C8C853B8FBCC6"><enum>(H)</enum><text>by adding the following at the end:</text><quoted-block id="H645BFAF7C2BF4A6F827A0997B25524D7" style="OLC"><paragraph id="H873F9F53A3124E378C76464FB6B21888"><enum>(14)</enum><text>an assurance that State personnel who conduct monitoring activities under section 678B will have expertise in the programs, projects, and services carried out under this subtitle and in the unique structure and role of eligible entities in their local communities;</text></paragraph><paragraph id="HE725EDFD1F8248748429E637CB05119F"><enum>(15)</enum><text>an assurance that the State will make payments to eligible entities in accordance with section 675B(a);</text></paragraph><paragraph id="H06AFDF0317B84E4FA234A73A0521F7B6"><enum>(16)</enum><text>an assurance that the State will develop a policy on board vacancies in accordance with section 676B(d) and provide guidance to assist eligible entities in filling board vacancies; and</text></paragraph><paragraph id="H8B7678DB7F8A435EB96EC46C90E32045"><enum>(17)</enum><text>information describing how the State will carry out the assurances described in this subsection.</text></paragraph><after-quoted-block>,</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HB4E6A8C3524D4D7192E5196EF80D092D"><enum>(3)</enum><text>by amending subsection (e) to read as follows:</text><quoted-block id="H4D416C5F982D4CA9A17FA4AAE36E5597" style="OLC"><subsection id="HD80A7510D74F408B99937A921AEC66F5"><enum>(e)</enum><header>Public inspection</header><text>Each State plan prepared under this section shall be made available on the lead agency’s website and distributed for public inspection and comment. A hearing on such plan shall be held as required under subparagraphs (C) and (D) of subsection (a) (2).</text></subsection><after-quoted-block>, and</after-quoted-block></quoted-block></paragraph><paragraph id="HF5139331FC164333828A8C57DF72AEAE"><enum>(4)</enum><text>in subsection (f)—</text><subparagraph id="H53C5740417D340569F3F5CE3A7A23E96"><enum>(A)</enum><text>by striking <quote>2000</quote> and inserting <quote>2026</quote>, and</text></subparagraph><subparagraph id="HD5922BDDD9C34137B731DF3E4F77A722"><enum>(B)</enum><text>by striking <quote>Coats Human Services Reauthorization Act of 1998</quote> and inserting <quote>Community Services Block Grant Improvement Act of 2025</quote>.</text></subparagraph></paragraph></section><section id="H96C3081989514B7BAEB2040642164FD3"><enum>9.</enum><header>Designation and redesignation of eligible entities in unserved areas</header><text display-inline="no-display-inline">Section 676A(a) of the Community Services Block Grant Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9909">42 U.S.C. 9909(a)</external-xref>) is amended to read as follows:</text><quoted-block id="HCFEC299EB0AB4B0690B5F39401988F88" style="OLC"><subsection id="HC4B4BAE4138D4831936A6804C59734FF"><enum>(a)</enum><header>Qualified organization in or near area</header><paragraph id="HCAD115DDB0A048CC931CFF2F23354750"><enum>(1)</enum><header>In general</header><text>If any geographic area of a State is not, or ceases to be, served by an eligible entity under this subtitle, the State lead agency may, in consultation with local officials and organizations representing the area, solicit one or more applications and designate a new community action agency to provide programs, projects, and services to the area, that is—</text><subparagraph id="HC5A3EF83CDFF4A7F85237F2B9A51D237"><enum>(A)</enum><text>a community action agency that is a private, nonprofit organization and that is geographically located in an area in reasonable proximity of, or contiguous to, the unserved area and that is already providing similar programs, projects, and services, and that has demonstrated financial capacity to manage and account for Federal funds; or</text></subparagraph><subparagraph id="HDFD41D15EBFA4C3FA7A219E30A3DBDD3"><enum>(B)</enum><text>if no community action agency described in subparagraph (A) is available, a private, nonprofit organization (which may include an eligible entity) that is geographically located in, or is in reasonable proximity to, the unserved area and that is capable of providing a broad range of programs, projects, and services designed to achieve the purposes of this subtitle as stated in section 672.</text></subparagraph></paragraph><paragraph id="H67C8F72CBD6A469DAB657FD301EDA446"><enum>(2)</enum><header>Requirement</header><text>In order to serve as the eligible entity for the area, an entity described in paragraph (1) shall agree to ensure that the governing board of directors of the entity will meet the requirements of section 676B.</text></paragraph><paragraph id="H6CE8D7BE018A4220857C9B15EED95489"><enum>(3)</enum><header>Community</header><text>A service area referred to in this subsection or a portion thereof shall be treated as a community for purposes of this subtitle.</text></paragraph><paragraph id="H6933D2BF037D4C688EC47A35CECA8966"><enum>(4)</enum><header>Interim designation</header><text>If no entity that meets the requirements of subsection (a) is available for designation as a permanent eligible entity, the State may designate a private, nonprofit agency (or public agency if a private nonprofit is not available) on an interim basis for no more than one year while the State completes a selection process for a permanent eligible entity that meets the requirements of subsection (a). An agency designated on an interim basis shall be capable of providing programs, projects, and services designed to achieve the purposes described in section 672 and have demonstrated financial capacity to manage and account for Federal funds, and may be designated as a permanent eligible entity only if, by the time of permanent designation, it meets all the requirements of paragraphs (1) and (2).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HF63EEDEF88924746AD1B88859FE9830A"><enum>10.</enum><header>Tripartite boards</header><text display-inline="no-display-inline">Section 676B of the Community Services Block Grant Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9910">42 U.S.C. 9910</external-xref>) is amended—</text><paragraph id="HED4E266CF8B140009D181B95FD277FEB"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="HF35185841D0A40948674D782054EE23A"><enum>(A)</enum><text display-inline="yes-display-inline">by amending paragraph (1) to read as follows:</text><quoted-block id="HD9C14001B1534C2193F9269529AFFE28" style="OLC"><paragraph id="H27BB58DEC5E740FEA9876D40A025B6ED"><enum>(1)</enum><header>Board</header><text>In order for a private, nonprofit organization to be considered to be an eligible entity for purposes of 673(6), the entity shall be governed by a tripartite board of directors described in subparagraph (C) that fully participated in the development, planning, implementation, oversight, and evaluation of the programs, projects, and services carried out or provided through the subgrant made under section 675C(a) and all activities of the entity.</text></paragraph><after-quoted-block>,</after-quoted-block></quoted-block></subparagraph><subparagraph id="H6F2930CDE86446599FB3F14AFB62901C"><enum>(B)</enum><text>in paragraph (2)(A) by striking <quote>except</quote> and all that follows through <quote>requirement</quote>, and inserting <quote>(but if an elected official chooses not to serve, such official may designate a representative to serve as the voting board member); and</quote>, and</text></subparagraph><subparagraph id="HB1B0CCDF212A41E19FDC3B2521B9D418"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block id="H1994AC4D67F94841B9FFBD49ABAA961C" style="OLC"><paragraph id="HBB185C865C5D438E8DC33DD5B4827F44"><enum>(3)</enum><header>Compliance with tax-exempt and other requirements</header><text>The board of a private, nonprofit organization shall ensure that the board operates and conducts activities under the subgrant made under section 679(Ca) that complies with—</text><subparagraph id="HBE245A0A4A654E13832815044B45EB8D"><enum>(A)</enum><text>the requirements for maintaining tax-exempt status under <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(a)</external-xref> of the Internal Revenue Code of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/26/501">26 U.S.C. 501(a)</external-xref>) regarding the governance of charities under <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/26/501">26 U.S.C. 501(c)(3)</external-xref>); and</text></subparagraph><subparagraph id="H4F257C42C61A48429D32420340D26E15"><enum>(B)</enum><text>applicable requirements of State nonprofit law.</text></subparagraph></paragraph><after-quoted-block>, and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H857F63D7176044DE8596A1687A0C84F7"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="HCDE227E9CD8745EEB92F76B981D752EB"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="HF21C2499E6064631B60C991C131FC98A"><enum>(i)</enum><text>by redesignating subparagraphs (A), (B), and (C) as clauses (i), (ii), and (iii), respectively, and</text></clause><clause id="H44EB67D5F646407DA9A489646DC2733F"><enum>(ii)</enum><text>in paragraph (2) by adding <quote>References under this subtitle to the board of an eligible entity shall apply to such other mechanism.</quote> at the end,</text></clause></subparagraph><subparagraph id="HED68091D2B064FA982307797281F09EE"><enum>(B)</enum><text>by redesignating paragraphs (1) and (2) as subparagraphs (A) and (B); respectively,</text></subparagraph><subparagraph id="H546D3F50808449999B422AF3ECDF4F9B"><enum>(C)</enum><text>by striking <quote><header-in-text level="subsection" style="OLC">public organizations.—</header-in-text></quote> and inserting,<quote><header-in-text level="section" style="OLC">board or other mechanism.—<enum-in-header>(1)</enum-in-header></header-in-text></quote>, and</text></subparagraph><subparagraph id="HD5DFB80F391D4DE784D8F3F083F721BA"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block id="H1C1AC12905FD4ADBB86FD84C4F79AEEC" style="OLC"><subparagraph id="H6B14DE6E83FB4F10877B1007113B3245"><enum>(2)</enum><header>Compliance with State requirements and policy</header><text>The board of a public entity shall ensure that the board operates in a manner that complies with State requirements for open meetings, financial transparency, and State open records policy.</text></subparagraph><after-quoted-block>, and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H5622D4838DFC45E593E8ABD692B9F1B4"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block id="H3A2D79FC9AEA47E9BF06AF2C54F46127" style="OLC"><subsection id="H84A3DE30AF474D54B03301ACD73BEA62"><enum>(c)</enum><header>Expertise</header><text>Each eligible entity shall ensure that the members of the board are provided resources, which may include contracted services with individuals and organizations with expertise in financial management, accounting, and law, to support the work of the board.</text></subsection><subsection id="H6631E34551BD4F6D91B33E45E811EEEF"><enum>(d)</enum><header>Board vacancies</header><text>To fulfill the requirements under this section, an eligible entity shall fill a board vacancy not later than 6 months after such vacancy arises. In the event that an eligible entity is unable to fill a board vacancy in the 6-month period, the entity shall certify to the State that it is making a good faith effort to fill the vacancy and shall receive one additional 6-month period to fill such vacancy.</text></subsection><subsection id="HA4A9AA6CDA0743F6BD4665AB70F5DCC7"><enum>(e)</enum><header>Operations and duties of the board</header><text>The duties of a board described in paragraph (1) or (2) of subsection (a) shall include—</text><paragraph id="HDEC43C2425E549F48D7735962F8A3718"><enum>(1)</enum><text>in the case of a board for a private, nonprofit organization that is an eligible entity, having legal and financial responsibility for administering and overseeing the eligible entity, including making proper use of Federal funds;</text></paragraph><paragraph id="H15F4144B2ADA40DCAB52516262EB4920"><enum>(2)</enum><text>establishing terms for officers and adopting a code of ethical conduct, including a conflict of interest policy for board members;</text></paragraph><paragraph id="HDD409292EFCF428481E676E155989B19"><enum>(3)</enum><text>participating in a comprehensive community needs assessment conducted at least once every three years, developing and adopting for the corresponding eligible entity an agency-wide strategic plan, and preparing the community action plan for the use of funds under this subtitle;</text></paragraph><paragraph id="H55C7BA487CC94978834C9450768B0AB8"><enum>(4)</enum><text>approving the eligible entity’s operating budget;</text></paragraph><paragraph id="HC6BF5325D5EB498F97829C911F9E7225"><enum>(5)</enum><text> reviewing all major policies such that—</text><subparagraph id="H131D9135514C4FE48663E045E75E2B31"><enum>(A)</enum><text>for private, nonprofit organizations that are eligible entities, a review includes conducting annual performance reviews of the eligible entity’s chief executive officer (or individual holding an equivalent position); and</text></subparagraph><subparagraph id="H2F0FF4EF1C0749319548E45A723D84EC"><enum>(B)</enum><text>for local public entities that are eligible entities, a review includes participating in annual performance reviews of the eligible entity’s chief executive officer (or individual holding an equivalent position);</text></subparagraph></paragraph><paragraph id="H2713C482BB9E41A69927023927035B7D"><enum>(6)</enum><text>performing oversight of the eligible entity to include—</text><subparagraph id="H46BA3F1081E444118D8D506855886554"><enum>(A)</enum><text>conducting assessments of the eligible entity’s progress in carrying out programmatic and financial provisions in the community action plan; and</text></subparagraph><subparagraph id="HE70B79C89087450AB859AF4575E8F02C"><enum>(B)</enum><text>in the case of any required corrective action, reviewing the eligible entity’s plans and progress in remedying identified deficiencies; and</text></subparagraph></paragraph><paragraph id="H77E10732F7F449448268D6A96E0C57C7"><enum>(7)</enum><text>concerning personnel policies and procedures—</text><subparagraph id="H5652D8093F1147A799F6FF1D4EA45517"><enum>(A)</enum><text>in the case of private, nonprofit organizations that are eligible entities, adopting personnel policies and procedures, including for hiring, annual evaluation, compensation, and termination, of the eligible entity’s chief executive officer (or individual holding a similar position); and</text></subparagraph><subparagraph id="H34F74CDFE560461D8364803BFA317908"><enum>(B)</enum><text>in the case of local public entities that are eligible entities, reviewing personnel policies and procedures, including for hiring, annual evaluation, compensation, and termination, of the eligible entity’s chief executive officer (or individual holding a similar position).</text></subparagraph></paragraph></subsection><subsection id="H47472CE55710416EBD0F8179FF0BCAA2"><enum>(f)</enum><header>Conflict of interest</header><text>In establishing the conflict of interest policy described in subsection (e)(2), a board shall ensure that such policy—</text><paragraph id="H46871F4FBC7C4828A0228B72EF6252D5"><enum>(1)</enum><text>requires a board member to recuse themself from any discussion, deliberations, and votes relating to any contract or transaction from which the following would receive a direct financial benefit from the eligible entity:</text><subparagraph id="HA4B315C95E0B49279FA7815B69FBAD2E"><enum>(A)</enum><text>such board member;</text></subparagraph><subparagraph id="H6D369422BD224B86A718AB6A15BD17B7"><enum>(B)</enum><text>the immediate family member of such board member; or</text></subparagraph><subparagraph id="HBDDB65A024EC4616AC8C4A716F45BFCE"><enum>(C)</enum><text>an organization or a business from which such board member, or an immediate family of such board member, receives a direct financial benefit;</text></subparagraph></paragraph><paragraph id="H74557CF7E6504F408B951857D160CE1F"><enum>(2)</enum><text>prohibits a board member from receiving compensation for serving on the board from the eligible entity other than for reasonable expenses, except that a board member’s receipt of an economic benefit from the eligible entity because such member is eligible to receive benefits and services under this subtitle shall not be considered to be compensation for purposes of this subsection; and</text></paragraph><paragraph id="H781F1519610548D8810720CCDC3F674A"><enum>(3)</enum><text>ensures all activities funded under this subtitle are conducted free of personal or family favoritism.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H87FC81A26ADC40C48BA4FD9AB1890FFA"><enum>11.</enum><header>Office of community services</header><text display-inline="no-display-inline">Section 678(b) of the Community Services Block Grant Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9912">42 U.S.C. 9912(b)</external-xref>) is amended by inserting <quote>, acting through the Director,</quote> after <quote>The Secretary</quote>.</text></section><section id="HB6C71258EC984BDC99EA33381AC8FC6D"><enum>12.</enum><header>Training, technical assistance, and other activities</header><text display-inline="no-display-inline">Section 678A(c) of the Community Services Block Grant Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9913">42 U.S.C. 9913(c)</external-xref>) is amended to read as follows:</text><quoted-block id="HB5BD3AAE2E0F49FBB6261E4159CB58A0" style="OLC"><subsection id="H490485A3AB074D259379CB34F1F8D7D9"><enum>(c)</enum><header>Distribution requirement</header><paragraph id="H488B32AD0A2F4762B7B37F0F9D13651A"><enum>(1)</enum><header>In general</header><text>The amounts reserved under section 674(b)(2)(A) for activities to be carried out under this subsection shall be distributed directly to eligible entities and other community services network organizations for—</text><subparagraph id="HB15DC75B98E1410687F98890E4A7AB26"><enum>(A)</enum><text>professional development for key community services network organization personnel;</text></subparagraph><subparagraph id="HB8F64D64E4404E4BB1E0C867B655299A"><enum>(B)</enum><text>activities to improve community services network organization program quality, financial management, compliance, and governance practices (including practices related to performance management information systems);</text></subparagraph><subparagraph id="H0F3C950409224948BA53A9A3811F681D"><enum>(C)</enum><text>activities that train community services network organizations in building and using evidence of effectiveness in achieving the purposes of this subtitle; and</text></subparagraph><subparagraph id="HA5FF23D653C2472EADA545ABF0578443"><enum>(D)</enum><text>activities to ensure responsiveness to identified local needs.</text></subparagraph></paragraph><paragraph id="H8ABB89C74BF344C49E9B5DE4FDD6F52D"><enum>(2)</enum><header>Eligible entities or organizations</header><text>Eligible entities and other community services network organizations described in this subsection shall include such entities and organizations (and their partners, including institutions of higher education), with demonstrated expertise in providing training to individuals and organizations on methods of effectively addressing the needs of low-income and working families and communities.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H22661B7C9B17427A9B1A21A87BEAE51A"><enum>13.</enum><header>Fiscal controls, audits, and withholding</header><text display-inline="no-display-inline">Section 678D of the Community Services Block Grant Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9916">42 U.S.C. 9916</external-xref>) is amended—</text><paragraph id="H57532FC253B946CF90CA678BCDC489C5"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H3750CBFB773D452E8844B2DA7CD1460C"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="H74B6D5FD435048B083C4E4915A81C8B0"><enum>(i)</enum><text>in paragraph (A) by inserting <quote>and, notwithstanding the applicability of subparagraph (B), issue payment to subrecipients on an advance basis.</quote> before the semicolon at the end, and</text></clause><clause id="H290070713D534C1CBD3E4F3ECEC94857"><enum>(ii)</enum><text>by amending subparagraph (B) to read as follows:</text><quoted-block id="H2E629FF9CB1D4F73A3EC0BDF8419C8B3" style="OLC"><subparagraph id="H8A9C3D6ED82A479F8C2DEEC448E874B4"><enum>(B)</enum><header>Single audit requirements</header><clause id="H82A676E2E1EF48C4BA2FE5F18DA45E1F"><enum>(i)</enum><header>In general</header><text>Audits shall be conducted under this paragraph in the manner and to the extent provided in <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/75">chapter 75</external-xref> of title 31, United States Code (commonly known as the <quote>Single Audit Act Amendments of 1984</quote>), except in the event a serious financial deficiency is identified.</text></clause><clause id="HBC3D8B5A47A34BDFBE9DE8DBB2718F1C"><enum>(ii)</enum><header>Serious financial deficiency</header><text>In the event that such a deficiency is identified, the Secretary shall order an audit conducted as described in subparagraph (1), or an audit of each of the accounts involved, in accordance with subparagraph (2).</text></clause></subparagraph><after-quoted-block>, and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H19853C3D689846D08683A351AEB7B051"><enum>(B)</enum><text>by amending paragraph (3) to read as follows:</text><quoted-block id="HFD1F7FDAB3144C7CA10824F173055CEC" style="OLC"><paragraph id="H420B27CD54EA41DA9F4CE762C969AD26"><enum>(3)</enum><header>Repayments</header><text>If the Secretary, after review of the audit, finds that a State has not expended an amount of funds in accordance with this subtitle, the Secretary is authorized to withhold funds from the State under this subtitle until the State remedies the improperly expended funds for the original purpose for which the grant funds were intended.</text></paragraph><after-quoted-block>, and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H80B72A51F88C47D99CA6D4360D332846"><enum>(2)</enum><text>in subsection (b)(3) by inserting <quote>or a complaint of a serious deficiency concerning any State</quote> after <quote>any fiscal year</quote>.</text></paragraph></section><section id="H9A000146159242EEA06C57FBC7DF9072"><enum>14.</enum><header>Accountability and reporting requirements</header><text display-inline="no-display-inline">Section 678E(b) of the Community Services Block Grant Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9917">42 U.S.C. 9917</external-xref>) is amended—</text><paragraph id="HB482DADCA7C34B36AFD8EF3125369244"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (3) by striking <quote>Labor and Human Resources</quote> and inserting <quote>Health, Education, Labor, and Pensions</quote>, and</text></paragraph><paragraph id="H02A7C5BBD7814590A006D04B4D52A33B"><enum>(2)</enum><text>by striking paragraph (4).</text></paragraph></section><section id="HCAF134CAF1144CA7B2E17271AD7FF683"><enum>15.</enum><header>Limitations on use of funds</header><text display-inline="no-display-inline">Section 678F(a)(1) of the Community Services Block Grant Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9918">42 U.S.C. 9918(a)(1)</external-xref>) is amended by striking <quote>amounts reserved under section 674(b)(3)</quote> and inserting <quote>amounts appropriated under section 674(c)</quote>.</text></section><section id="H7B6EA3157B444B9FAFC39895D871F04F"><enum>16.</enum><header>Discretionary authority of the Secretary</header><text display-inline="no-display-inline">Section 680 of the Community Services Block Grant Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9921">42 U.S.C. 9921</external-xref>) is amended—</text><paragraph id="H84B86C8E0B6B4DF9AAE4A2BD5922F307"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="HA70B473837174A8A8C2256E0B22C5E65"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="H9A02A47B19A54D449105F70A39EEAD84"><enum>(i)</enum><text>by striking <quote>funds reserved under section 674(b)(3)</quote> and inserting <quote>amounts made available to carry out this section</quote>, and</text></clause><clause
