<section id="H916247FB3D1944AE9E893B4563AAF649" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>PFAS–Free Procurement Act of 2025</short-title></quote>.</text></section> 
<section id="H17B1E24B272447E8A700DCAC719DE304"><enum>2.</enum><header>Prohibition on procurement of certain items containing PFOS or PFOA</header> 
<subsection id="H555A8830C18A480A8AA8340B847D049B"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">The head of an executive agency may not renew or enter into a contract for the procurement of a covered item that contains PFOS or PFOA.</text></subsection> <subsection id="H16162175DF61437198119702C8CAD471"><enum>(b)</enum><header>Priority procurement of products not containing pfas</header><text>The head of an executive agency shall prioritize the procurement of covered items, where available and practicable, that do not contain PFAS.</text></subsection> 
<subsection id="H0D1A3BD79A974B519F3BF7B81E01667B"><enum>(c)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H83BED607E585448BB7154FB22F42DCB4"><enum>(1)</enum><header>Executive agency</header><text>The term <term>executive agency</term> has the meaning given the term in section 133 of title 41, United States Code.</text></paragraph> 
<paragraph id="H6D0DDDA5C2314A5CBFE5E7EBCF7ADAB4"><enum>(2)</enum><header>Covered item</header><text>The term <term>covered item</term> means—</text> <subparagraph id="HDB47D030F43B45078F5D605DA0DD1FA2" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">nonstick cookware and a cooking utensil; and</text></subparagraph> 
<subparagraph id="HAAA73F72552949F58DD238781B37AC8E" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">furniture, carpet, and any rug treated with stain-resistant coating.</text></subparagraph></paragraph> <paragraph id="H4A7F5D1E34FF43928CDC0B00DCF1CA4F"><enum>(3)</enum><header>PFAS</header><text display-inline="yes-display-inline">The term <term>PFAS</term> means harmful perfluoroalkyl or polyfluoroalkyl substances.</text></paragraph> 
<paragraph id="H3B076F2EB4B9461B905AF66EA30882FB"><enum>(4)</enum><header>PFOA</header><text display-inline="yes-display-inline">The term <term>PFOA</term> means perfluorooctanoic acid.</text></paragraph> <paragraph id="H82748AC2666246848A4E22CF73E254D0"><enum>(5)</enum><header>PFOS</header><text display-inline="yes-display-inline">The term <term>PFOS</term> means perfluorooctane sulfonate.</text></paragraph></subsection> 
<subsection id="HA78BB28322114047B9F3D500984CDF11"><enum>(d)</enum><header>Applicability</header><text display-inline="yes-display-inline">This section shall take effect 6 months after the date of the enactment of this Act and shall apply with respect to any contract entered into on and after such effective date.</text></subsection></section> </legis-body></bill>
