<section id="H0604AAD416A24518B3D9ECB52F5E5B17" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Restoring Employment and Hiring Incentives for Removed Employees Act</short-title></quote> or the <quote><short-title>REHIRE Act</short-title></quote>.</text></section> 
<section id="H818BF7752BDA406089A5CE0643CCA64A"><enum>2.</enum><header>Hiring preference for certain career Federal employees involuntarily removed</header> 
<subsection id="HE1D869B63A6248F781E678A4C74C9C57"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Any Federal employee involuntarily removed from the civil service during the period beginning on January 1, 2025, and ending on January 1, 2027, shall—</text> <paragraph id="H1E65E5861DCC44E8AFE612DDAABC513E"><enum>(1)</enum><text>be deemed to be a preference eligible for purposes of appointments to positions in the competitive service; and</text></paragraph> 
<paragraph id="HC108B7AF58014C62AD082A2C842FF898"><enum>(2)</enum><text>shall be entitled to 5 additional points above their earned rating for purposes of section 3309 of title 5, United States Code.</text></paragraph></subsection> <subsection id="H6B01D86E68A44B73AD8FE7A6D01722AE"><enum>(b)</enum><header>Application</header><text>The authority under subsection (a) shall—</text> 
<paragraph id="H820B321259394899B7686F57030BE475"><enum>(1)</enum><text>not apply to—</text> <subparagraph id="HB8CFBA3527294BB098117BA6E09A0370"><enum>(A)</enum><text>any individual removed from a political position;</text></subparagraph> 
<subparagraph id="H98DA9908084C41978724798445AAA4AE"><enum>(B)</enum><text>any individual involuntarily separated on clearly documented charges of misconduct or delinquency; or</text></subparagraph> <subparagraph id="HF5B4CFC423AB44A1966B3C0E13CE472C"><enum>(C)</enum><text display-inline="yes-display-inline">any individual involuntarily separated and whose most recent performance review prior to such separation was unacceptable or less than fully successful, provided that such review is clearly documented; and</text></subparagraph></paragraph> 
<paragraph id="HC02AC2470120473E961C0ED373305392"><enum>(2)</enum><text display-inline="yes-display-inline">expire on the date that is 5 years after the date of the enactment of this section.</text></paragraph></subsection> <subsection id="H041C18E262844805AAE49845426633A8"><enum>(c)</enum><header>Definitions</header><text>In this section—</text> 
<paragraph id="H6C98A72F8B274C529A624794A507910A"><enum>(1)</enum><text>the term <quote>civil service</quote> has the meaning given that term in section 2101 of title 5, United States Code;</text></paragraph> <paragraph id="HF70AA15290AB4C8F9ACAED82D16E771C"><enum>(2)</enum><text display-inline="yes-display-inline">the term <quote>competitive service</quote> has the meaning given that term in section 2102 of such title;</text></paragraph> 
<paragraph id="H86953F9725C540FC81E365B9BD7C0E8D"><enum>(3)</enum><text>the term <quote>political position</quote> means—</text> <subparagraph id="H6775963D02814239A1B3AFEE94E15312"><enum>(A)</enum><text display-inline="yes-display-inline">a position described under sections 5312 through 5316 of such title (relating to the Executive Schedule);</text></subparagraph> 
<subparagraph id="HF38132377548428EBFC4A66C5FBC7527"><enum>(B)</enum><text display-inline="yes-display-inline">a noncareer appointee (as that term is defined in section 3132(a) of such title); or</text></subparagraph> <subparagraph id="HFD69689BE6704E7685D7F5B9411E0F7A"><enum>(C)</enum><text display-inline="yes-display-inline">a position in the executive branch of the Government of a confidential or policy-determining character under schedule C of subpart C of part 213 of title 5, Code of Federal Regulations; and</text></subparagraph></paragraph> 
<paragraph id="H4311F40970A14FA49ADA9FF3700ACBEA"><enum>(4)</enum><text>the term <quote>preference eligible</quote> has the meaning given that term in section 2108(3) of title 5, United States Code.</text></paragraph></subsection></section> </legis-body></bill>
