<section id="HEE734AB76CC841A0843D0C36511371C3" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Health Savings and Affordability for Fertility Act</short-title></quote> or the <quote>HSA for Fertility Act</quote>.</text></section> <section id="H3D051A529E4F49C6BA47335CD2B965C5"><enum>2.</enum><header>Fertility treatments treated as medical expenses for purposes of health savings account</header> <subsection id="H8261BE322287460AA9239D6919ACF1FF"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/223">Section 223(d)(2)</external-xref> of the Internal Revenue Code of 1986 is amended—</text> 
<paragraph id="HFCA07D07BF3C4312B6451C3A9F758766"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A), by inserting <quote>and fertility treatments</quote> after <quote>products</quote>, and</text></paragraph> <paragraph id="H1762C3E2293B4CE19EB267F4620CD92D"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following new subparagraph:</text> 
<quoted-block style="OLC" id="H0B9894EEF71841B9AA6EFB058136E7CB" display-inline="no-display-inline"> 
<subparagraph id="HEDAA9269FD6C44BA94BED3294F5B48BE"><enum>(E)</enum><header>Fertility Treatment</header><text display-inline="yes-display-inline">For the purposes of this paragraph, the term <quote>fertility treatment</quote> includes the following:</text> <clause id="H2123C1BBED0149F98499D1F553B3F1CF"><enum>(i)</enum><text display-inline="yes-display-inline">Preservation (including long-term storage) of human oocytes, sperm, or embryos for later reproductive use.</text></clause> 
<clause id="HC77E89AFD6DF4E99869B9200BDA9D77D"><enum>(ii)</enum><text display-inline="yes-display-inline">Artificial insemination, including intravaginal insemination, intracervical insemination, and intrauterine insemination.</text></clause> <clause id="H1DB43BF0AAC346AA8F725911B804766C"><enum>(iii)</enum><text display-inline="yes-display-inline">Assisted reproductive technology, including in vitro fertilization and other treatments or procedures in which reproductive genetic material, such as oocytes, sperm, fertilized eggs, and embryos, are handled, when clinically appropriate.</text></clause> 
<clause id="H23B15D611AC44943A002E28303115C6E"><enum>(iv)</enum><text display-inline="yes-display-inline">Medications prescribed as indicated for fertility.</text></clause> <clause id="H1B1FC6BD220B4EFBA4926CA7C9191800"><enum>(v)</enum><text display-inline="yes-display-inline">Gamete donation, including reimbursement for an individual who agrees to provide such material to an eligible individual under a gamete donor agreement as well as medical expenses associated with procuring such material from the donor.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HD6D6000B274644439F5E3056A34CC7D9"><enum>(b)</enum><header>Effective Date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply to amounts paid or incurred after the date of the enactment of this Act.</text></subsection> <subsection id="H8F72974808DD4F01A8B3994D530F68E6"><enum>(c)</enum><header>No inference</header><text>Nothing contained in this section, or the amendments made thereby, shall be construed to—</text> 
<paragraph id="H84F560A18F3049DAAEFA610EEB7862DF"><enum>(1)</enum><text>create any inference with respect to any amounts paid on or before such date, or</text></paragraph> <paragraph id="HD575E54AF1CF4CB492FF47BCEBB74C23"><enum>(2)</enum><text>limit the continued treatment after such date of any fertility-related expense not described in subsection (d)(2)(E) of <external-xref legal-doc="usc" parsable-cite="usc/26/223">section 223</external-xref> of the Internal Revenue Code of 1986 (as added by this Act) as a medical expense for purposes of such section.</text></paragraph></subsection></section>
