<section id="H473740C9A48841E4A5F39213BCD21B77" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Interstate Paid Leave Action Network Act of 2025</short-title></quote> or <quote><short-title>I–PLAN Act of 2025</short-title></quote>.</text></section> <section id="HE07CFE01FBBC4350A566C256F2382495"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="HB2A4840AD0FC4F26B9510B39604C3FC3" commented="no"><enum>(1)</enum><header>BLS</header><text display-inline="yes-display-inline">The term <term>BLS</term> means the Bureau of Labor Statistics.</text></paragraph> <paragraph id="H26B2DB5461074BE48A063A26453123E7"><enum>(2)</enum><header>Employer-provided paid family and medical leave plan</header><text display-inline="yes-display-inline">The terms <term>employer-provided paid family and medical leave plan</term> and <term>employer plan</term> mean a plan that—</text> 
<subparagraph id="H2B8F12F847794C588522187B1CE5E04A"><enum>(A)</enum><text display-inline="yes-display-inline">is provided by an employer to the employees of such employer (whether directly, under a contract with an insurer, or provided through a multiemployer plan);</text></subparagraph> <subparagraph id="H7C84A6D8618C48B7AFE28FFECE83A5AD"><enum>(B)</enum><text display-inline="yes-display-inline">is an option for an employer within the structure of a State paid family and medical leave program in such State; and</text></subparagraph> 
<subparagraph id="H2A4F0D00B906484B93E9AC3D42733E54"><enum>(C)</enum><text display-inline="yes-display-inline">meets or exceeds the requirements of the State paid family and medical leave program of the State in which such employee is employed.</text></subparagraph></paragraph> <paragraph id="H7004C8FE3AEB48039165C4BE0DAE6580"><enum>(3)</enum><header>I–PLAN</header><text display-inline="yes-display-inline">The term <term>I–PLAN</term> means the Interstate Paid Leave Action Network established in section 3(a).</text></paragraph> 
<paragraph id="HFA109D7F8F0C43E8B0E5E5D5AC58DB2F"><enum>(4)</enum><header>I–PLAN agreement</header><text display-inline="yes-display-inline">The term <term>I–PLAN Agreement</term> means the interstate agreement produced pursuant to section 3(b).</text></paragraph> <paragraph id="HFF777FF37E9647D28DDC0CB27D3E0A53"><enum>(5)</enum><header>National intermediary</header><text display-inline="yes-display-inline">The term <term>national intermediary</term> means a national nongovernmental workforce organization that has extensive experience partnering with the Department of Labor to operate interstate technological systems and the electronic transmission of information and data for State workforce agencies and employers.</text></paragraph> 
<paragraph id="H43A76E9D98BC435C93CAEACC770709DB"><enum>(6)</enum><header>Paid leave</header><text>The term <term>paid leave</term> means an increment of compensated leave that is provided, in the case of a State program, by such State or, in the case of an employer plan, by such employer for use during a period in which such individual is not working due to a qualifying reason.</text></paragraph> <paragraph id="HBF500E679B85498D9C88A1DFCC4C3506"><enum>(7)</enum><header>Qualifying reason</header><text display-inline="yes-display-inline">The term <term>qualifying reason</term> means, in relation to an individual, a reason described in subparagraphs (A) through (D) of section 102(a)(1) of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(a)(1)</external-xref>) (applied for purposes of this paragraph as if the individual involved were the employee referred to in such section).</text></paragraph> 
<paragraph id="H8C1E919F7BAE4B219C2C9F9576DAD80E"><enum>(8)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Labor.</text></paragraph> <paragraph id="H063FC2C9405E47EEB4F265101953D96F"><enum>(9)</enum><header>State focal</header><text display-inline="yes-display-inline">The term <term>State focal</term> means, with respect to a State, an individual—</text> 
<subparagraph id="H11FE2DE203664743B0B89B151DECA973"><enum>(A)</enum><text display-inline="yes-display-inline">designated by the State agency in charge of such State’s paid family and medical leave program to—</text> <clause id="HA68232FF193D4FBB8C65423094A3FAE6"><enum>(i)</enum><text>participate in the I–PLAN;</text></clause> 
<clause id="HC24585ABFBB44C30BF60775558971E86"><enum>(ii)</enum><text>lead such State’s efforts to adopt and implement the I–PLAN Agreement; and</text></clause> <clause id="H3A00B44FEF7D42D48639C7CED30B5568"><enum>(iii)</enum><text display-inline="yes-display-inline">communicate with key paid leave stakeholders across the State; and</text></clause></subparagraph> 
<subparagraph id="HB36033E21E9C4CF8A289CA27E574CDBE"><enum>(B)</enum><text display-inline="yes-display-inline">who—</text> <clause id="HB8921D960CCF45A9ABFCAD46506F08E9"><enum>(i)</enum><text>is employed by such State’s paid family and medical leave program; and</text></clause> 
<clause id="H8131C4C086C7472F89625E4193898871"><enum>(ii)</enum><text>has knowledge, experience, and authority in paid leave matters.</text></clause></subparagraph></paragraph> <paragraph id="H4EE449DC8896493994E64745BE1846D9"><enum>(10)</enum><header>State paid family and medical leave program</header><text display-inline="yes-display-inline">The terms <term>State paid family and medical leave program</term> and <term>State program</term> mean a program under State law that provides, during any 24-month period, a total of not less than 6 weeks of paid leave to individuals—</text> 
<subparagraph id="H9ECDAD9D71614DE6B93874F8B757A8F8"><enum>(A)</enum><text>for each qualifying reason; and</text></subparagraph> <subparagraph id="H4665075736214D17B2DC3BF097F89594"><enum>(B)</enum><text>in aggregate.</text></subparagraph></paragraph></section> 
<section id="HE8AA329AF5A048F3BBDBCAEFD938D28E"><enum>3.</enum><header>Interstate Paid Leave Action Network</header> 
<subsection id="H26FA3029DE274C92B39382775AF48319"><enum>(a)</enum><header>In general</header> 
<paragraph id="H88FDE0ADCBAA4881B382C0C1321135E9"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established an Interstate Paid Leave Action Network the purpose of which is to provide support and incentives for the development and adoption of an interstate agreement in accordance with this Act to benefit employees, States, and employers by—</text> <subparagraph id="H232D3569890842FB9EA39224275B4BE4"><enum>(A)</enum><text>facilitating streamlined benefit delivery;</text></subparagraph> 
<subparagraph id="HFBB546A5BE30455588166EA8A116DC51"><enum>(B)</enum><text>reducing administrative burden; and</text></subparagraph> <subparagraph id="H6F29AEE01DF6495EBA293D915664EAE5"><enum>(C)</enum><text>coordinating and harmonizing State programs.</text></subparagraph></paragraph> 
<paragraph id="H40A821C19FBC4EA3B9AAA4C7BCD4D646"><enum>(2)</enum><header>Membership</header><text>The I–PLAN shall include a State focal from each State receiving a conforming grant under section 5(a).</text></paragraph> <paragraph id="H734EFEE63A7946CBADB3451FCEADB6B9"><enum>(3)</enum><header>Meetings</header><text display-inline="yes-display-inline">The I–PLAN shall meet not less than 3 times in each calendar year.</text></paragraph> 
<paragraph id="H2FB83F3BDA694F97822BD71836D779DA"><enum>(4)</enum><header>Processes</header> 
<subparagraph id="H9A7569A43ADB4D56946A9376229DA408"><enum>(A)</enum><header>Certification</header><text display-inline="yes-display-inline">States shall certify to the Secretary their participation in the I–PLAN.</text></subparagraph> <subparagraph id="H177CBF11EAC94B139260E85F7DB96C15"><enum>(B)</enum><header>Procedures</header><text display-inline="yes-display-inline">State focals may determine, in coordination with the Secretary, the process for the following:</text> 
<clause id="H02C66D113BC8443E86428B373B7A5231"><enum>(i)</enum><text>the order in which States approach the substance of each I–PLAN requirement;</text></clause> <clause id="HAC22FCC5B4A843F08C74D45440EC815F"><enum>(ii)</enum><text>the process by which States reach consensus on such substance and agree to the I–PLAN Agreement;</text></clause> 
<clause id="H848CAB9475F8409C9DB92DC625B40C0A"><enum>(iii)</enum><text>the process by which a State may leave the I–PLAN; and</text></clause> <clause id="H7B448C4F2B064D318BCA22C4296A35DF"><enum>(iv)</enum><text>other processes relevant to the success and administration of the I–PLAN as the Secretary determines.</text></clause></subparagraph></paragraph> 
<paragraph id="HAD1F35F3B1DC4857BE664E3445B10F57"><enum>(5)</enum><header>Roadmap</header><text display-inline="yes-display-inline">The I–PLAN shall develop, and annually update, a roadmap for developing and implementing the interstate agreement described in subsection (b) including metrics for success.</text></paragraph></subsection> <subsection id="H511578C2B700475D8C3C7A013E0247EA"><enum>(b)</enum><header>Duties</header><text display-inline="yes-display-inline">The duty of the I–PLAN shall be to produce an interstate agreement into which States offering a State paid family and medical leave program may enter and to periodically update such agreement as necessary to improve clarity and scope. Such agreement shall be publicly available and pursue each of the following requirements:</text> 
<paragraph id="H4640072A90314095AC83E5075745D7C8" commented="no"><enum>(1)</enum><header>Policy standard</header><text display-inline="yes-display-inline">Create a single policy standard with respect to all participating States to facilitate easier compliance with and understanding of paid leave programs across States, including definitions for the following:</text> <subparagraph id="H9867F4844B3641608438D0E748ABE0A8" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">Benefit day, week, and year.</text></subparagraph> 
<subparagraph id="H88A483912F3D41789D57735D275281AA" commented="no"><enum>(B)</enum><text>Base period.</text></subparagraph> <subparagraph id="H228CC3DB23B141BCA4DC3ED17EFA57F4" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">Intermittent and reduced schedule leave.</text></subparagraph> 
<subparagraph id="HF24E4450622446F686BC7C10713490BC" commented="no"><enum>(D)</enum><text>Place of performance.</text></subparagraph> <subparagraph id="HB7693E717E894447908C462A00E7BF26" commented="no"><enum>(E)</enum><text display-inline="yes-display-inline">Family members.</text></subparagraph> 
<subparagraph id="H0A5A7496ADE54105A0BABB258230951F" commented="no"><enum>(F)</enum><text display-inline="yes-display-inline">Employee eligibility.</text></subparagraph> <subparagraph id="H8B4225D66AAB4ADFBA0267A061BD619A" commented="no"><enum>(G)</enum><text display-inline="yes-display-inline">Employee coverage.</text></subparagraph> 
<subparagraph id="H9BB12570E85E4F018CE265D118EB314E" commented="no"><enum>(H)</enum><text display-inline="yes-display-inline">Waiting period.</text></subparagraph> <subparagraph id="H01B82BA4F6C345008D3739749B89F694"><enum>(I)</enum><text>Covered wage.</text></subparagraph></paragraph> 
<paragraph id="HED0111AE2CF04CE9882D0393957926FF"><enum>(2)</enum><header>Administrative standard</header><text display-inline="yes-display-inline">Create a single administrative standard with respect to all participating States to facilitate easier compliance with and understanding of paid leave programs across States, including—</text> <subparagraph id="H22575BE2B2C844A0951E2B348B5DEB8F"><enum>(A)</enum><text display-inline="yes-display-inline">the process by which employers respond to requests from States to verify and provide employee information for eligibility determinations, including wages and work history;</text></subparagraph> 
<subparagraph id="H36557160B3DB4F95B9281F88E13DA68F"><enum>(B)</enum><text display-inline="yes-display-inline">the process by which employers provide periodic and permanent notice of the availability of paid leave under a State program or employer plan to employees;</text></subparagraph> <subparagraph id="H4C6063055CDF4D74B1B83A50FBB8870C"><enum>(C)</enum><text display-inline="yes-display-inline">employees’ responsibility to provide notices of leave to their employers;</text></subparagraph> 
<subparagraph id="H1C21F258FA034ACBA2FB396F4F8A517B"><enum>(D)</enum><text display-inline="yes-display-inline">timing of and process for collecting payroll contributions;</text></subparagraph> <subparagraph id="H8A0354E587B8491A8CDD48D70D445782"><enum>(E)</enum><text display-inline="yes-display-inline">coordinating with other types of paid time off and leaves of absence;</text></subparagraph> 
<subparagraph id="H9F75B87549754110B477157C7B26A244"><enum>(F)</enum><text display-inline="yes-display-inline">continuing other benefits;</text></subparagraph> <subparagraph id="HA44691B2B42442CDB318253B4145EC01"><enum>(G)</enum><text display-inline="yes-display-inline">accessing employee leave information;</text></subparagraph> 
<subparagraph id="HD2C18C6F4A4644F68D765E927F2CC4FF"><enum>(H)</enum><text display-inline="yes-display-inline">protecting personal information;</text></subparagraph> <subparagraph id="HC546947D68A145DB8C72B4A4EDF00C38"><enum>(I)</enum><text display-inline="yes-display-inline">creating and updating written leave materials such as handbooks;</text></subparagraph> 
<subparagraph id="H75BD5539817745239F015AA2FA5C36A6"><enum>(J)</enum><text display-inline="yes-display-inline">maintaining records and documentation; and</text></subparagraph> <subparagraph id="HFCCFA1757FE14F1A9AC31BFA526A2037"><enum>(K)</enum><text>if a State program permits employers to elect to provide employer plans, facilitating such election, including by creating a single equivalency standard with respect to all participating States to determine whether the maximum monetary value of an employer plan for the average weekly wage of workers in the State for total covered establishments in all industries (based on the most recent calendar year for which data are available from the Quarterly Census of Employment and Wages program of the BLS) is greater than or equal to the maximum monetary value of a State program (or that of multiple States), taking into account programmatic elements such as—</text> 
<clause id="H07C9DC89A05E439FB41F8DD9E8BB787C"><enum>(i)</enum><text>how benefit duration, wage replacement, absence of a weekly benefit cap, absence of a waiting week, and other factors interact in a quantitative manner; and</text></clause> <clause id="HB0E22473B81A45109CEB16AF66AAF4E2"><enum>(ii)</enum><text>how an individual taking paid family and medical leave for a qualifying reason affects the ability of such individual to take paid family and medical leave for another qualifying reason.</text></clause></subparagraph></paragraph> 
<paragraph id="HC3B22EB891CA4DCF9D5D3C225682683F"><enum>(3)</enum><header>Coordination of benefits across State programs</header><text display-inline="yes-display-inline">Create a single process for State programs to process claims for an individual who has work history across multiple participating States so that a single State program may provide benefits to such individual on the basis of all such work history.</text></paragraph></subsection></section> <section id="HC99BDE58A75840FE8A3C743D8F31A2FF"><enum>4.</enum><header>National intermediary to support the Interstate Paid Leave Action Network</header> <subsection id="H05D45373687548A1916204378F514DFD"> <enum>(a)</enum> <header>Authority To make grants</header> <text display-inline="yes-display-inline">Subject to the availability of appropriations under section 6(a), the Secretary, acting through the Employment and Training Administration, shall award a grant to one national intermediary to facilitate the activities of the I–PLAN.</text>
      </subsection> 
<subsection id="HD9C6E11E403D44B4A7EED8491EF91C2E"><enum>(b)</enum><header>Use of funds</header><text display-inline="yes-display-inline">A national intermediary awarded a grant under subsection (a) shall use funds for the costs related to each of the following:</text> <paragraph id="HDE33003D0FAE4F018BF55DF5198366A3"><enum>(1)</enum><header>Meetings</header><text display-inline="yes-display-inline">Meeting activities, including—</text> 
<subparagraph id="HD8309E6E14984057A44FB8E417CCC4E0"><enum>(A)</enum><text display-inline="yes-display-inline">convening the State focals as described in section 3(a)(3), including reasonable travel, transportation, and other expenses of State focals and staff of the national intermediary (and any necessary accompanying State personnel);</text></subparagraph> <subparagraph id="H5DA9D197B341430C828ABDC615822904"><enum>(B)</enum><text display-inline="yes-display-inline">making publicly available information on the agendas and outcomes of such meetings; and</text></subparagraph> 
<subparagraph id="H249E2F91FCB345AF947B3245728AB04D"><enum>(C)</enum> 
<clause id="H83C67A9C027A4087AA32C547A51D374F" display-inline="yes-display-inline"><enum>(i)</enum><text>not later than 12 months after the date of enactment of this Act, making publicly available the roadmap described under section 3(a)(5); and</text></clause> <clause id="H2468464FD7EE43B297AEBEF453BA00DC" indent="up1"><enum>(ii)</enum><text>making any updates to such roadmap publicly available.</text></clause></subparagraph></paragraph> 
<paragraph id="HF6E879F6A616465A8991FEDFF3E39D25"><enum>(2)</enum><header>Annual report</header><text display-inline="yes-display-inline">Producing and making publicly available on an annual basis a report that compares State programs, including information on—</text> <subparagraph id="H788E172F97DA482F8331FDAD4909F6E9"><enum>(A)</enum><text>benefit eligibility;</text></subparagraph> 
<subparagraph id="H501CB9A525B1461F9E4E3ED9D69687A6"><enum>(B)</enum><text display-inline="yes-display-inline">the maximum number of weeks an eligible employee is allowed to receive benefits—</text> <clause id="HC00C1C4A125A466F9CFAE8732A769F23"><enum>(i)</enum><text>for each qualifying reason; and</text></clause> 
<clause id="HCBA08E3EE3CE4503BFC7A75DC3EFE4A5"><enum>(ii)</enum><text>in aggregate;</text></clause></subparagraph> <subparagraph id="H5870F298A3294707866FD6D380652A0E"><enum>(C)</enum><text display-inline="yes-display-inline">wage replacement rate and how that may vary based on prior earnings;</text></subparagraph> 
<subparagraph id="HA5C29D42E68C4A2785C312E2D56C9CA1"><enum>(D)</enum><text display-inline="yes-display-inline">maximum weekly benefit amount;</text></subparagraph> <subparagraph id="H7AF19CAA4943468CA6C0C9474B669A8F"><enum>(E)</enum><text display-inline="yes-display-inline">how such programs are financed by employees and employers, including the payroll tax rate and amount of wages subject to tax;</text></subparagraph> 
<subparagraph id="HCB0D87F03F994A838CF0D163459C2741" commented="no"><enum>(F)</enum><text display-inline="yes-display-inline">whether and how such programs allow employers to provide employer plans, taking into consideration elements such as—</text> <clause id="HB7DDDDCEFC254767B0C3A990A795356E" commented="no"><enum>(i)</enum><text>benefit payment timeliness; and</text></clause> 
<clause id="H253EC188EA074EC58DD5D18748795668" commented="no"><enum>(ii)</enum><text>employer and employee administrative complexity;</text></clause></subparagraph> <subparagraph id="H49D435C968F54025B818AD7EE9A6A689"><enum>(G)</enum><text display-inline="yes-display-inline">whether and how such programs coordinate with other types of paid-time off and leaves of absence;</text></subparagraph> 
<subparagraph id="H24856DC72B3E4BB1974848FDB411795D"><enum>(H)</enum><text display-inline="yes-display-inline">the reasons, including qualifying reasons, under which an individual is eligible to take paid family and medical leave; and</text></subparagraph> <subparagraph id="H6B6DAAA8DA3C4D4D982E2806AB12757D"><enum>(I)</enum><text display-inline="yes-display-inline">other activities essential for the success, effectiveness, and sustainability of the I–PLAN.</text></subparagraph></paragraph> 
<paragraph id="H68D4479C1C3A4860B4D48A417D0E46EF"><enum>(3)</enum><header>Outreach and coordination</header><text display-inline="yes-display-inline">Engagement, consulting, and gathering relevant information in coordination with I–PLAN States from a wide range of external stakeholders, including—</text> <subparagraph id="HA57C0D5C64464B5BB8997DFE30799676"><enum>(A)</enum><text display-inline="yes-display-inline">State legislatures;</text></subparagraph> 
<subparagraph id="H0F472BB52343495E977D087EBD8DA41F"><enum>(B)</enum><text>Governors;</text></subparagraph> <subparagraph id="H15309BC314FB4F01B278831F9AED9A42"><enum>(C)</enum><text display-inline="yes-display-inline">employees;</text></subparagraph> 
<subparagraph id="HCDF2FB54A9634034A69787C144CEE8A9"><enum>(D)</enum><text display-inline="yes-display-inline">representatives of employers, including—</text> <clause id="HD6C54DA587364842B4015CFE34580A5A"><enum>(i)</enum><text>employers with employees in multiple States; and</text></clause> 
<clause id="H91790E10B6BC4E39B7C2DCEB19AF0066"><enum>(ii)</enum><text display-inline="yes-display-inline">employers with fewer than 50 employees;</text></clause></subparagraph> <subparagraph id="HBECA9B9B803E441A930531A08C00BAC6"><enum>(E)</enum><text display-inline="yes-display-inline">self-employed individuals;</text></subparagraph> 
<subparagraph id="H71AC7F971BEF4EDCB5F45602AE6BB957"><enum>(F)</enum><text display-inline="yes-display-inline">policy experts and other organizations with expertise on paid leave and unemployment compensation programs; and</text></subparagraph> <subparagraph id="H577904A8ACB743DC8D5B2EEB6C58FE46"><enum>(G)</enum><text>Tribal governments.</text></subparagraph></paragraph> 
<paragraph id="H34148387EDD6475F9DB44063BC7DBC52"><enum>(4)</enum><header>Standardized and interoperable technology system for wages</header><text display-inline="yes-display-inline">Providing a standardized technology-based system to facilitate States’ ability to carry out the I–PLAN Agreement, allowing States to process interstate claims and strengthen program integrity, that—</text> <subparagraph id="HAAA95B7F6B3947C28B78A68288462F00"><enum>(A)</enum><text display-inline="yes-display-inline">adopts or leverages modular technology that—</text> 
<clause id="HD0C25AEFD9644E9A97D1E135E969B8AA"><enum>(i)</enum><text display-inline="yes-display-inline">ensures privacy, security, and prompt data availability;</text></clause> <clause id="H4DE3D43F28AC48C8AC4D7E63CE238D61"><enum>(ii)</enum><text display-inline="yes-display-inline">enhances and streamlines the claimant, employer, and participating State experience; and</text></clause> 
<clause id="H7F7C0BD857B448C1AE88294B65DC2A15">
                            <enum>(iii)</enum>
 <text display-inline="yes-display-inline">is interoperable with other relevant State systems; and</text>
                        </clause></subparagraph> 
<subparagraph id="H4303470D7239406E8F0BE343976241FB"><enum>(B)</enum><text display-inline="yes-display-inline">permits States to report on, to the extent reasonable and technologically feasible, and disaggregated by qualifying reason, on trends such as—</text> <clause id="H84DFE3AA9A0343579A888265515F8F41"><enum>(i)</enum><text>the number of initial and continued benefit claims;</text></clause> 
<clause id="H0EAFBB266F95424999BFEF6FB6B933D0"><enum>(ii)</enum><text>average duration of benefits;</text></clause> <clause id="HC804882DCB2845529558F9131863B532"><enum>(iii)</enum><text>average weekly benefit amount;</text></clause> 
<clause id="H948E8AAF42F24270B6675CC2D0A3F95A"><enum>(iv)</enum><text>average time between filing a claim and receiving an initial benefit payment; and</text></clause> <clause id="H3199E1568E4545328CEB911E2714099A"><enum>(v)</enum><text>the accuracy of benefit payment amounts.</text></clause></subparagraph></paragraph> 
<paragraph id="HA06611307B6348EE922A32FD6EEE9CD2"><enum>(5)</enum><header>Additional uses</header><text display-inline="yes-display-inline">Additional activities, including—</text> <subparagraph id="HC10F01EDEAD04424A6459787CB559685"><enum>(A)</enum><text display-inline="yes-display-inline">hiring and compensating staff;</text></subparagraph> 
<subparagraph id="H4477C78D32DB4983BB9AB7995E78CEB4"><enum>(B)</enum><text>formulating guidance, recommendations, and best practices for States;</text></subparagraph> <subparagraph id="H3478C55639B44C61BBAF4DF70B4EEA5C"><enum>(C)</enum><text display-inline="yes-display-inline">providing training on program administration;</text></subparagraph> 
<subparagraph id="HC197AF0AAF8D4759AD873A734FD2BDA0"><enum>(D)</enum><text>providing technical assistance to States; and</text></subparagraph> <subparagraph id="H3F45DA410AE64375BBAC89619802EAAB"><enum>(E)</enum><text display-inline="yes-display-inline">creating or leveraging technology essential for the success and effectiveness of the I–PLAN.</text></subparagraph></paragraph></subsection> 
<subsection id="H275F05FE15A948D9B917592A7BE95186" commented="no"><enum>(c)</enum><header>Duration of award</header> 
<paragraph id="HCFAE1DC3A6E348B6A98887CEB7852035" display-inline="no-display-inline"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), the period during which payments are made to an entity from an award of a grant under subsection (a) shall be 5 years.</text></paragraph> <paragraph id="HD330182535CF49AAB5AB5129A2E43A6B" commented="no"><enum>(2)</enum><header>Compliance</header><text display-inline="yes-display-inline">The Secretary shall annually evaluate whether the national intermediary is complying with the requirements of this Act and, if the Secretary determines that the national intermediary is not so complying, shall withhold any payment or part of the payment to the national intermediary under this section for the following fiscal year unless and until the Secretary determines the national intermediary has remedied such compliance issue.</text></paragraph></subsection> 
<subsection id="H4EDC4DC8EA444402B3459C58BCF77565"><enum>(d)</enum><header>National intermediary oversight</header><text display-inline="yes-display-inline">The Secretary shall—</text> <paragraph id="HF9F6D66D0B824641A8C2F869DD487C87"><enum>(1)</enum><text display-inline="yes-display-inline">monitor the national intermediary to ensure compliance with the requirements of this Act;</text></paragraph> 
<paragraph id="H877DAD360B6B48658E161813EE816C85"><enum>(2)</enum><text display-inline="yes-display-inline">provide technical assistance to assist the national intermediary with such compliance; and</text></paragraph> <paragraph id="HAD7B764E170A4E8E9D6962EA28CE0E19"><enum>(3)</enum><text display-inline="yes-display-inline">require regular reports on the performance of the national intermediary, including on the roadmap under section 3(a)(5), the use of funds under section 4(b), and other methods of evaluation.</text></paragraph></subsection></section> 
<section id="H8BF4FFE6E0F04912BCC1EC169BDCA1D0"><enum>5.</enum><header>Grants to eligible States</header> 
<subsection id="HC62959536BE84E598BF46BA341BE3F6A"><enum>(a)</enum><header>Conforming grants</header> 
<paragraph id="H6EF41AC4FA1C42B38D251FF68B42FB43"><enum>(1)</enum><header>In general</header> 
<subparagraph id="HE0CE3491ACD741EAB657BD3996E0A484"><enum>(A)</enum><header>Authority to make grants</header><text display-inline="yes-display-inline">Subject to the availability of appropriations under section 6(b), the Secretary, acting through the Employment and Training Administration, shall, on an annual basis, make a conforming grant to each eligible State.</text></subparagraph> <subparagraph id="H1F64760A4233413AA06F1070774B769B"><enum>(B)</enum><header>Amount of grant</header> <clause id="H9394AE1FF8E94A0CA8F5CBEBCCB4A1FA"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">A grant to an eligible State under this subsection shall be—</text> 
<subclause id="H6298742B7BBE4873AFAAEDDBA4888B3E"><enum>(I)</enum><text>not less than $1,500,000 and not more than $8,000,000; and</text></subclause> <subclause id="H140EB5AE5E2E4D5B89DB48199C5A90E3"><enum>(II)</enum><text display-inline="yes-display-inline">subject to subclause (I), awarded on the basis of the relative annual level of employment (as published by the Current Employment Statistics program of the BLS) of the eligible State, compared to the annual level of employment in all eligible States.</text></subclause></clause> 
<clause id="HA24807603C2241B8BF4CC05762803BE1"><enum>(ii)</enum><header>Adjustment</header><text display-inline="yes-display-inline">The amounts specified in clause (i) shall be ratably increased or decreased to the extent that funds available under section 6(b) exceed or are less than (respectively) the amount required to provide the amounts specified in clause (i).</text></clause></subparagraph></paragraph> <paragraph id="H030BA05883A74945B461D0FFEE089CDC"><enum>(2)</enum><header>Eligible States</header> <subparagraph id="H657C9B2DBFF7478E92FA84FE57046FAE"><enum>(A)</enum><header>In general</header><text>To be eligible to receive a grant under paragraph (1), a State shall—</text> 
<clause id="H1934C931F464497890ADEA420918E60C"><enum>(i)</enum><text display-inline="yes-display-inline">have a State focal; and</text></clause> <clause id="HD92D80B133FF4563BFB73DAE5382B72B"><enum>(ii)</enum><text display-inline="yes-display-inline">participate in the I–PLAN in good faith.</text></clause></subparagraph> 
<subparagraph id="HF05D78DC07A541A988E8B60FE9D58D8F"><enum>(B)</enum><header>Good faith requirement</header> 
<clause id="H22BCDF3AD188403F8FD55444ACF6E684"><enum>(i)</enum><header>Withholding</header><text>If the Secretary, in consultation with the national intermediary awarded the grant under section 4(a), determines that a State is not participating in the I–PLAN in good faith, the Secretary—</text> <subclause id="H1C6177FD5D68485D93455165F26D8CBD"><enum>(I)</enum><text display-inline="yes-display-inline">shall provide warning and feedback to States in a prompt manner; and</text></subclause> 
<subclause id="HD57261DC7DD545D3A5CEA4693FCAD006"><enum>(II)</enum><text display-inline="yes-display-inline">if, six months after the date on which the Secretary provides such warning and feedback, the Secretary determines such State continues not to participate in the I–PLAN in good faith, the Secretary may elect to withhold a portion or the total amount of a grant under paragraph (1) to such State.</text></subclause></clause> <clause id="H1B076B63A0014E0E8E7874F98399C067"><enum>(ii)</enum><header>Restoration</header><text display-inline="yes-display-inline">If the Secretary elects to withhold an amount from a State under clause (i)(II), the Secretary may later elect to provide the amount so withheld to such State if the Secretary later determines that such State is participating in good faith.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="HD96A86B5C94A45B4BCAF6DE34353162A" commented="no"><enum>(b)</enum><header>Implementation grants</header> 
<paragraph id="H1B2F1032F479491097E9E5446A1971A7"><enum>(1)</enum><header>In general</header> 
<subparagraph id="HC3364625D9714BFBAE2EAFCD1F0D48DD"><enum>(A)</enum><header>Authority to make grants</header><text display-inline="yes-display-inline">Subject to the availability of appropriations under section 6(c), the Secretary, acting through the Employment and Training Administration, shall, on an annual basis, make an implementation grant to each eligible State.</text></subparagraph> <subparagraph id="H372441398002465083B0AFAEA3E5023E"><enum>(B)</enum><header>Amount of grant</header> <clause id="H1D92B67C4F9F4EEF8D4F1F5C7CE01861"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">A grant to an eligible State under this subsection shall be—</text> 
<subclause id="HF741B8638FAD4C8481B07FB41971E5F9"><enum>(I)</enum><text>not less than $1,500,000 and not more than $8,000,000; and</text></subclause> <subclause id="H1400010240A24BA6B1FDC7753E183E01"><enum>(II)</enum><text display-inline="yes-display-inline">subject to subclause (I), awarded on the basis of the relative annual level of employment (as published by Current Employment Statistics program of the BLS) of the eligible State, compared to the annual level of employment in all eligible States.</text></subclause></clause> 
<clause id="HBCC56DA227A14F519F91A7EC78D2B88A"><enum>(ii)</enum><header>Adjustment</header><text display-inline="yes-display-inline">The amounts specified in clause (i) shall be ratably increased or decreased to the extent that funds available under section 6(c) exceed or are less than (respectively) the amount required to provide the amounts specified in clause (i).</text></clause></subparagraph></paragraph> <paragraph id="H40D25B569ECD4CB88E670F20C8864863" commented="no"><enum>(2)</enum><header>Eligibility</header> <subparagraph id="H4CCFA3DB73164ED1AA7BF02BDFEFA90C" commented="no"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), to be eligible to receive a grant under paragraph (1), a State shall—</text> 
<clause id="H4A42E9C1664A41D6AA8B34FEDEE6AB87" commented="no"><enum>(i)</enum><text>meet the requirements of subsection (a)(2)(A); and</text></clause> <clause id="H2DBABCDE2FDE4CDC8FA764ABE3082285" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">have entered into the I–PLAN Agreement.</text></clause></subparagraph> 
<subparagraph id="HD55C7EAEB4E34D4C87D778824E253075" commented="no"><enum>(B)</enum><header>Limitation</header><text>A State described in subparagraph (A) shall be ineligible to receive a grant for any fiscal year beginning after the date that is 4 years after the date on which such State enters into the I–PLAN Agreement in which such State does not meet the requirements of such Agreement.</text></subparagraph></paragraph></subsection> <subsection id="H8623C3DD9C054904B4B6F2FC0C9AADE6"><enum>(c)</enum><header>Use of funds</header><text>A State may use grants received under this section—</text> 
<paragraph id="H38665F26E48E4E3B978594FCFEEF7165"><enum>(1)</enum><text>to help pay administrative costs, including costs related to—</text> <subparagraph id="H596E1DC2CC36426A82E23794F8669F4B"><enum>(A)</enum><text display-inline="yes-display-inline">customer service;</text></subparagraph> 
<subparagraph id="H385B4CF25B0C4D17B6F8B7B0334346C7"><enum>(B)</enum><text>staffing and training;</text></subparagraph> <subparagraph id="HBA284056C4F34866AF42E94FA18B5EB0"><enum>(C)</enum><text>technology;</text></subparagraph> 
<subparagraph id="HBA486141FBF74B2BB0F5DDB10EBC736E"><enum>(D)</enum><text>data sharing;</text></subparagraph> <subparagraph id="H56C77B26EAF9473F8585248672FB9077"><enum>(E)</enum><text>identity validation; and</text></subparagraph> 
<subparagraph id="HFE80A6F024644F8FB6060A8D61A8C8E2"><enum>(F)</enum><text display-inline="yes-display-inline">program awareness; and</text></subparagraph></paragraph> <paragraph id="H0DF6D99000C14DB283FE225F351BC591"><enum>(2)</enum><text display-inline="yes-display-inline">to help small businesses, as defined by the State, afford employer payroll contributions or access other forms of technical and operational assistance related to State paid family and medical leave.</text></paragraph></subsection></section> 
<section id="HA031738CEFB44510965B1807E59861A9"><enum>6.</enum><header>Authorization of appropriations</header> 
<subsection id="HB34EBFD0FE0B4209BF53559F8B2A595B"><enum>(a)</enum><header>National intermediary grant</header><text display-inline="yes-display-inline">There are authorized to be appropriated not more than $10,000,000 for the purposes of section 4 for each of fiscal years 2026 through 2028.</text></subsection> <subsection id="H1C96E752B4154CCBB866CFE6CA6A3BBA"><enum>(b)</enum><header>Conforming grants</header><text display-inline="yes-display-inline">There are authorized to be appropriated not more than $40,000,000 for the purposes of section 5(a) for each of fiscal years 2026 through 2028.</text></subsection>
