<section id="H94701FEA15F34B13BE00D33A03B5E38A" section-type="section-one"><enum>1.</enum><header>Modification of certain provisions relating to AUKUS defense trade cooperation</header><text display-inline="no-display-inline">Section 38 of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2778">22 U.S.C. 2778</external-xref>) is amended—</text> <paragraph id="HB97A42D576EC48BCB9DABBA2288CFADC"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (j)(1)(C)(ii)—</text> 
<subparagraph id="HA0261D13C13748C8AD1C3277BA5441EC"><enum>(A)</enum><text>by striking subclauses (I), (II), and (III); and</text></subparagraph> <subparagraph id="HF58B555376BC4CE1A69AF51A98A30594"><enum>(B)</enum><text>redesignating subclauses (IV), (V), (VI), and (VII) as subclauses (I), (II), (III), and (IV), respectively; and</text></subparagraph></paragraph> 
<paragraph id="HC27EA495C50A4E95B9F619D0D633F6F1"><enum>(2)</enum><text>in subsection (l)(4)—</text> <subparagraph id="HBEDA8360B052417B82027E126A59B0DB"><enum>(A)</enum><text>in subparagraph (B), by striking <quote>subsection (j)(1)(C)(ii)</quote> and inserting <quote>any of subclauses (I) through (IV) of subsection (j)(1)(C)(ii)</quote>; and</text></subparagraph> 
<subparagraph id="HCAE317A32D794D37A395BA1C7225D9EC"><enum>(B)</enum><text>in subparagraph (C)(ii), by adding at the end before the period the following: <quote>and does not relate to the Missile Technology Control Regime</quote>.</text></subparagraph></paragraph></section> <section id="H807F35C7C8494A4D9817CC528A82FAA4"><enum>2.</enum><header>Statement of policy</header> <subsection id="HC7E8D06B9A4448679E845ACCC39454B1" display-inline="no-display-inline"><enum>(a)</enum><header>In general</header><text>It shall no longer be the policy of the United States to apply a <quote>presumption of denial</quote> to exports of materials considered Category 1 or 2 of the Missile Technology Control Regime to North Atlantic Treaty Organization (NATO) allies, major non-NATO allies, or the other countries of the <quote>Five Eyes</quote> intelligence alliance.</text></subsection> 
<subsection id="HAA1B66B0232C42909FE7649D3937A915"><enum>(b)</enum><header>Five eyes intelligence alliance defined</header><text>In this section, the term <quote><quote>Five Eyes</quote> intelligence alliance</quote> means Australia, Canada, New Zealand, the United Kingdom, and the United States.</text></subsection></section> </legis-body></bill>
