R. 3017</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250424">April 24, 2025</action-date><action-desc><sponsor name-id="S000929">Mrs. Spartz</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Assistant Secretary for Planning and Evaluation of the Department of Health and Human Services to conduct an annual study on health care competition and consolidation at the State level.</official-title></form><legis-body id="HDDB6F8AA4EDA4CE384BEC6BF253A2236" style="OLC"><section id="H9CF060606950421AB6C0D9B830A7C449" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Measuring State Healthcare Freedom Act</short-title></quote>.</text></section><section id="HF1B628F59E5F42CF9F967E9ACF1313C8" section-type="subsequent-section"><enum>2.</enum><header>Annual study on health care competition and consolidation at State level</header><subsection id="H87564EB4AFAE499B875AB0655B4FF070"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Over each of the 10 years following the date of enactment of this Act, the Assistant Secretary for Planning and Evaluation of the Department of Health and Human Services (in this section referred to as the <quote>Assistant Secretary</quote>) shall conduct a study on health care competition and consolidation at the State level.</text></subsection><subsection id="HC7663E2BFA544348A183BB6CB0D390B1"><enum>(b)</enum><header>Consultation</header><text display-inline="yes-display-inline">In conducting the study under this section, the Assistant Secretary shall consult with the Chair of the Federal Trade Commission and the Assistant Attorney General in charge of the Antitrust Division of the Department of Justice.</text></subsection><subsection id="H717AA89CB9DC49CD9309080FB0337D94"><enum>(c)</enum><header>Obtaining data</header><text display-inline="yes-display-inline">The Assistant Secretary may secure from the Federal Trade Commission information necessary to enable the Assistant Secretary to carry out subsection (d)(2). Upon request of the Assistant Secretary, the Chair of the Federal Trade Commission shall furnish that information to the Assistant Secretary. </text></subsection><subsection id="HB02BEE5C9DE44B0CAE9B56D6A9A265D4"><enum>(d)</enum><header>Metrics</header><text>The study under this section shall include data collection on each of the following:</text><paragraph id="HDAC2838EB4FE4DC68F8150C397A5EAFD"><enum>(1)</enum><text>Licensing requirements for doctors, nurses, and other health care practitioners, including requirements with respect to—</text><subparagraph id="H5DF5BB0C47F64C959E0E10CC7050DD1C"><enum>(A)</enum><text>initial licensure;</text></subparagraph><subparagraph id="HF2CB2838BF3D4224B86C9B20AF4EBD56"><enum>(B)</enum><text>ongoing maintenance of licensure;</text></subparagraph><subparagraph id="H4E9CC1050D2649B39C01D1028B482494"><enum>(C)</enum><text>specific training and postgraduate and continuing medical education; </text></subparagraph><subparagraph id="H47AED384E6944D219357F9474AD366A6"><enum>(D)</enum><text>residency supervisory requirements; and</text></subparagraph><subparagraph id="HFF6A5597C459407A9BB9C37DBB5AC3F4"><enum>(E)</enum><text>board certification.</text></subparagraph></paragraph><paragraph id="H9FF3B9A4F86D4D48A295C932A4A31A1E"><enum>(2)</enum><text display-inline="yes-display-inline">Mergers and acquisitions (both vertical and horizontal), involving—</text><subparagraph id="H85A9C1E899C9440AA27BEFDFA6B6A93D"><enum>(A)</enum><text>hospitals;</text></subparagraph><subparagraph id="H6D26A3C7387644C4BA7FDE24B1FF1A15"><enum>(B)</enum><text>ambulatory or outpatient practices;</text></subparagraph><subparagraph id="HEEEBA268A8364FD489C0828699335AB3"><enum>(C)</enum><text>ambulatory surgical centers;</text></subparagraph><subparagraph id="H94A53DFAA245461EA7229368585D8C6D"><enum>(D)</enum><text>health insurance providers; </text></subparagraph><subparagraph id="H88AFD365DAEA447DB8B0FCFD39BC67FE"><enum>(E)</enum><text>habilitative service providers (such as providers of physical therapy or occupational therapy); and</text></subparagraph><subparagraph id="H371C9B406285409B8E84F946FE40836A"><enum>(F)</enum><text>telehealth.</text></subparagraph></paragraph><paragraph id="H423F6513121340A2BC57E17C312F9C99" commented="no"><enum>(3)</enum><text>The number of—</text><subparagraph id="H04687E4370E1476DBDBA9F3717D0E277" commented="no"><enum>(A)</enum><text>State laws establishing a legal mechanism by which a State approves mergers between or among two or more hospitals (commonly referred to as <quote>certificates of public advantage</quote>); and</text></subparagraph><subparagraph id="H4467C13CFE414DF9BD5F3130DACE702E" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">State laws establishing a legal mechanism for regulating the growth of construction of new health care facilities (commonly referred to as <quote>certificates of need</quote>). </text></subparagraph></paragraph><paragraph id="H500415E9C817419D92EDE048FC52F314"><enum>(4)</enum><text>The availability of alternative forms of health insurance coverage, including—</text><subparagraph id="H654AC780B9004316BC1DD1A198379A3A"><enum>(A)</enum><text>short-term limited duration insurance (as defined for purposes of section 2791(b)(5) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-91">42 U.S.C. 300gg–91(b)(5)</external-xref>)); and</text></subparagraph><subparagraph id="HB64550305020413694BF41670D377043"><enum>(B)</enum><text>association health plans (including plans offered through the American Farm Bureau Federation).</text></subparagraph></paragraph><paragraph id="H7740F9FE7AA24D28936885197E737AD9"><enum>(5)</enum><text display-inline="yes-display-inline">The number of each of the following in operation at the start and the end of each year covered by the 10-year study period:</text><subparagraph id="HC9AFEDFB3729400A9892C1942A3ED67C"><enum>(A)</enum><text>Hospitals.</text></subparagraph><subparagraph id="H89D9A6AB2E384FCEB92073F8465A4D51"><enum>(B)</enum><text>Medical practices.</text></subparagraph><subparagraph id="HC9D3A87183AA422199ECEBD3F245D76D"><enum>(C)</enum><text>Ambulatory or outpatient practices.</text></subparagraph><subparagraph id="HD80CCE01C3894AA895110259359A37DB"><enum>(D)</enum><text>Ambulatory surgical centers.</text></subparagraph><subparagraph id="H798A90D4E297433C926750C8934D6B35"><enum>(E)</enum><text>Health insurance providers.</text></subparagraph><subparagraph id="H8870A2E4B07E433CA43C1A1F23D7C915"><enum>(F)</enum><text display-inline="yes-display-inline">Habilitative service providers.</text></subparagraph></paragraph><paragraph id="H2652CB754FEB40DD9567F0A6E78EE215"><enum>(6)</enum><text display-inline="yes-display-inline">The Herfindahl-Hirschman Index, within geographic areas defined by the Assistant Secretary in consultation with the Bureau of Competition of the Federal Trade Commission, for the following health care services:</text><subparagraph id="H8FA7E61DA88B4D7A8DFCDC43ABDE3BA5"><enum>(A)</enum><text>General acute care hospital services.</text></subparagraph><subparagraph id="HDBFE92E7D4314D11A3AA8E5C705DA287"><enum>(B)</enum><text>Ambulatory or outpatient medical services, disaggregated by medical specialty.</text></subparagraph><subparagraph id="H4A191EB572BB4E32B93E37F04B050E0C"><enum>(C)</enum><text>Habilitative services.</text></subparagraph></paragraph></subsection><subsection id="H4F2F7974B5814820819B0F8F7CD6900A"><enum>(e)</enum><header>Annual reports</header><paragraph id="H62F056946F134E03A2511671BE037CE6"><enum>(1)</enum><header>In general</header><text>Not later than the end of each of the 10 years referred to in subsection (a), the Assistant Secretary shall submit to the Committee on Energy and Commerce and the Committee on Ways and Means of the House of Representatives and the Committee on Finance and the Committee on Health, Education, Labor, and Pensions of the Senate a report on the status and results of the study under this section.</text></paragraph><paragraph id="HF9FBB9C247F046D99A0AFBE39DA4DE1B"><enum>(2)</enum><header>Publication; publicly accessible datasets</header><text display-inline="yes-display-inline">Not later than the end of each of the 10 years referred to in subsection (a), the Assistant Secretary shall—</text><subparagraph id="H36741F83F1914A1299F1C7E11E73D80A"><enum>(A)</enum><text display-inline="yes-display-inline">publish on the website of the Office of the Assistant Secretary the report submitted under paragraph (1) for the respective year; and</text></subparagraph><subparagraph id="H3C14A44EF759463496F6FAF0B1BB6C71"><enum>(B)</enum><text> make the data collected through the study under this section available to the public on such website in a manner that is publicly accessible and interactive.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
