which was referred to the <committee-name committee-id="HSM00">Committee on Small Business</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish a position in the Small Business Administration to provide to small businesses assistance with establishing employee stock ownership plans, and for other purposes.</official-title></form><legis-body id="H8D88443D0AFC4487B518B854347DBAE5" style="OLC"><section id="HD26D832697774B14BAB61C3391E13F56" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>ESOP Funding for SBA Position Act of 2025</short-title></quote>.</text></section><section id="H3872405890744015B61E0D45B00498ED"><enum>2.</enum><header>Establishment of ESOP support position</header><subsection id="H69D027A508E74D9F99EE4E930F245B08"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">There is established in the Administration a position in the competitive service (as such term is defined in section 2102 of title 5, United States Code) which shall be appointed by the Administrator and responsible for providing small business concerns assistance with establishing employee stock ownership plans.</text></subsection><subsection id="H6BECFE12B5774C9681CAD1FB67085A38"><enum>(b)</enum><header>Responsibilities</header><text>The responsibilities of the position established under subsection (a) include—</text><paragraph id="HA4AF86B258B74F79B51E445748173808"><enum>(1)</enum><text>providing guidance to small business concerns on establishing employee stock ownership plans, including tax treatment of such plans, regulatory compliance, stock valuation, and opportunities to acquire funding to establish such a plan;</text></paragraph><paragraph id="H4B132B0F6B8F4AA8B1615B180472D976"><enum>(2)</enum><text>coordinating with relevant public and private entities to provide assistance and resources for establishing employee stock ownership plans that are tailored for small business concerns;</text></paragraph><paragraph id="H7C173CCFF0B64D2B92D278B9B46DE76D"><enum>(3)</enum><text>coordinating with the relevant personnel at the Department of Labor to assist small business concerns establishing employee stock ownership plans with compliance with all relevant regulatory requirements;</text></paragraph><paragraph id="H767CFAE1E7C841F79049C219EC7B6611"><enum>(4)</enum><text>advocating for appropriate guidance from relevant Federal agencies, including the Department of Labor, regarding regulations relating to establishing and maintaining employee stock ownership plans, including regulations regarding stock valuation and employee ownership; and</text></paragraph><paragraph id="H7A277E3FD07C408FAFEFD0B22FF102D3"><enum>(5)</enum><text>such other responsibilities as determined appropriate by the Administrator.</text></paragraph></subsection></section><section id="HA574B4D532474BA9A8C6A754698F2E28"><enum>3.</enum><header>Reporting</header><text display-inline="no-display-inline">Not later than one year after the date of the enactment of this Act, and annually thereafter, the Administrator shall submit to Congress a report on the activities of the position established under section 2(a), including the number of small business concerns that have received assistance from such position, the types of assistance and resources provided to small business concerns by such position, and any policy recommendations for improving the process for small business concerns to establish and maintain employee stock ownership plans.</text></section><section id="H7BBBD85F9C584B21B58FB4AA0F4378ED"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H29A08F0DFE2F4FD1A0B9F184997F58A8"><enum>(1)</enum><header>Administration</header><text>The term <term>Administration</term> means the Small Business Administration.</text></paragraph><paragraph id="H1FFAD8D3343742B5B2D12B76D5B93292"><enum>(2)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Administration.</text></paragraph><paragraph id="H4B48E35256634D4AA02091B17C49754F"><enum>(3)</enum><header>Employee stock ownership plan</header><text display-inline="yes-display-inline">The term <term>employee stock ownership plan</term> has the meaning given such term in <external-xref legal-doc="usc" parsable-cite="usc/26/4975">section 4975(e)(7)</external-xref> of the Internal Revenue Code of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/26/4975">26 U.S.C. 4975(e)(7)</external-xref>).</text></paragraph><paragraph id="H0FCDFFC14D4440AC886DB1438366C07E"><enum>(4)</enum><header>Small business concern</header><text>The term <term>small business concern</term> has the meaning given such term under section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>).</text></paragraph></section><section id="HB31D6A635D7440D89A580D5E78EB204D"><enum>5.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated such sums as are necessary to carry out this Act, except that, for the fiscal year in which this Act is enacted, there is authorized $500,000 to carry out this Act.</text></section></legis-body></bill>
