<section id="H8860EBBAC32546B39E1EA498E9D28CB4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Expediting Generator Interconnection Procedures Act of 2025</short-title></quote>.</text></section> <section commented="no" display-inline="no-display-inline" id="H4D19E6642BAC42189BCF92DFAA54EEB9"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
<paragraph id="H733DE9620C404D5F9A4DCBEC4ADCA02C"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Energy Regulatory Commission.</text></paragraph> <paragraph id="H5E4F4C42CD294B348BB3FE29E1A7CDA3"><enum>(2)</enum><header>Energy storage project</header><text display-inline="yes-display-inline">The term <term>energy storage project</term> means—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H09CA92FBFFDD4B7086C69290A742345B"><enum>(A)</enum><text display-inline="yes-display-inline">any equipment that receives, stores, and delivers energy using batteries, compressed air, pumped hydropower, hydrogen storage (including hydrolysis), thermal energy storage, regenerative fuel cells, flywheels, capacitors, superconducting magnets, or other technologies identified by the Commission; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H80F37E5984D54DF2A0A5E2750E4B1A23"><enum>(B)</enum><text>any project for the construction or modification of equipment described in subparagraph (A) as part of an effort to build-out transmission interconnection opportunities.</text></subparagraph></paragraph>
<paragraph id="HE405259DD9DD469785BB91CB24AF76DB"><enum>(3)</enum><header>Generation project</header><text display-inline="yes-display-inline">The term <term>generation project</term> means—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H8AD32E6919E84C108DF46250920CF1C6"><enum>(A)</enum><text display-inline="yes-display-inline">any facility—</text>
<clause id="H140E46DCCC3F4043BF4F3CACF6AB9C29"><enum>(i)</enum><text>that generates or injects electricity; and</text></clause> <clause id="H9CC1588002EE4D938516C6211328217F" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text>for which an interconnection request is subject to the jurisdiction of the Commission; and</text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H1B08D0F29DDA4707916B66B021584248"><enum>(B)</enum><text>any project for the construction or modification of a facility described in subparagraph (A).</text></subparagraph></paragraph> <paragraph id="HB67D3701A54741A4B405EBEA328139D4"><enum>(4)</enum><header>Interconnection customer</header><text>The term <term>interconnection customer</term> means a person or entity that has submitted an interconnection request.</text></paragraph>
<paragraph id="H20D73944752F4A7889146D0582A68A20"><enum>(5)</enum><header>Interconnection request</header><text>The term <term>interconnection request</term> means a request submitted to a public utility to interconnect a new generation project or energy storage project to the electric system of a public utility for the purposes of transmission of electric energy in interstate commerce or the sale of electric energy at wholesale.</text></paragraph> <paragraph id="HA4335EF93B484719BB0828E390DA9C4E"><enum>(6)</enum><header>Public utility</header><text>The term <term>public utility</term> has the meaning given the term in section 201(e) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824">16 U.S.C. 824(e)</external-xref>).</text></paragraph>
<paragraph id="HB5D3860C593A4A06BC87AA44F6F11960"><enum>(7)</enum><header>Transmission facility</header><text>The term <term>transmission facility</term> means a facility that is used for the transmission of electric energy in interstate commerce.</text></paragraph> <paragraph id="HDF404C633436417DBC32E05F020A047C"><enum>(8)</enum><header>Transmission provider</header><text>The term <term>transmission provider</term> means a public utility that owns, operates, or controls 1 or more transmission facilities.</text></paragraph>
<paragraph id="HC0F680740B464FECB336008AEC679C54"><enum>(9)</enum><header>Transmission system</header><text>The term <term>transmission system</term> means a network of transmission facilities used for the transmission of electric energy in interstate commerce.</text></paragraph></section> <section commented="no" display-inline="no-display-inline" id="H58AF075527A843B8ACA45A2E280E83DA"><enum>3.</enum><header>Rulemaking to expedite generator interconnection procedures</header> <subsection id="H1938149A3FAC4FDDBD33F7E804F623BE"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Commission shall initiate a rulemaking—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H1D5DDB3A1A8C4680BD7CF29E6DFF3CAE"><enum>(1)</enum><text display-inline="yes-display-inline">to address the inefficiencies and ineffectiveness of existing procedures for processing interconnection requests to ensure that new generation projects and energy storage projects can interconnect quickly, cost-effectively, and reliably; and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H7B747C21298A44CC95FF60141CE9138C"><enum>(2)</enum><text display-inline="yes-display-inline">to revise the pro forma Large Generator Interconnection Procedures and, as appropriate, the pro forma Large Generator Interconnection Agreement, promulgated pursuant to section 35.28(f) of title 18, Code of Federal Regulations (or successor regulations), to require transmission providers—</text>
<subparagraph id="H963BAE8046F046C8A5365C3D856669A3"><enum>(A)</enum><text>to develop and employ modeling assumptions for each resource type based on actual operating abilities and practices, for the purposes of studying an interconnection request;</text></subparagraph> <subparagraph id="HE869D80A10CA406494144F37606400B0"><enum>(B)</enum><text>to study interconnection requests in a manner consistent with the risk tolerance of the interconnection customer;</text></subparagraph>
<subparagraph id="H50BA832675524960A1FEA42E1FB5289C"><enum>(C)</enum><text>to select, as appropriate, 1 or more cost-effective solutions to address network reliability needs that may be identified while studying an interconnection request;</text></subparagraph> <subparagraph id="H9ED0407791094232A772240096AF8A45"><enum>(D)</enum><text display-inline="yes-display-inline">to provide sufficient information to interconnection customers for the interconnection customers to understand how a transmission provider has implemented the assumptions and solutions described in subparagraphs (A) and (C);</text></subparagraph>
<subparagraph id="HEBDF20ED68854B28971DB914BBE30B38"><enum>(E)</enum><text>to share and employ, as appropriate, queue management best practices, including with respect to the use of advanced computing technologies, automation, and standardized study criteria, in evaluating interconnection requests, in order to expedite study results; and</text></subparagraph> <subparagraph id="H4BBCC42B197E4604871C88F92EA35C5B"><enum>(F)</enum><text>to implement transparency and performance-enhancing measures to ensure timely and cost-conscious construction of necessary network upgrades once an interconnection agreement has been executed.</text></subparagraph></paragraph></subsection>
<subsection id="H9A66D5F94168424D9FA524E760606314"><enum>(b)</enum><header>Deadline for final rule</header><text>Not later than 18 months after the date of enactment of this Act, the Commission shall promulgate a final rule to complete the rulemaking initiated under subsection (a).</text></subsection> <subsection id="H34F49FAB45934E4399F31FBCAF193AFD"><enum>(c)</enum><header>Savings clause</header><text display-inline="yes-display-inline">Nothing in this section alters, or may be construed to alter, the allocation of costs of the transmission system pursuant to the ratemaking authority of the Commission under section 205 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824d">16 U.S.C. 824d</external-xref>).</text></subsection></section>
