R. 297</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250109">January 9, 2025</action-date><action-desc><sponsor name-id="M000317">Ms. Malliotakis</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and Workforce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit the availability of Federal funds to institutions of higher education that conduct painful biomedical research on dogs and cats.</official-title></form><legis-body id="H7F159BE879904D799816342D6F6FADA5" style="OLC"><section id="HB08C59930FAC41D4B216136DF78CF72D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Higher Education Loses Payments for Painful Experiments, Tests and Studies Act</short-title></quote> or the <quote><short-title>HELP PETS Act</short-title></quote>. </text></section><section id="HAE3C4EEE437344568DF94B983DF0302F"><enum>2.</enum><header>Prohibition on availability of Federal Funds to Institutions of Higher Education that conduct painful research using dogs and cats</header><subsection id="HF33C5FC7F6B94C6F9C674945CD72FB4F"><enum>(a)</enum><header>In general</header><text>Beginning on the date that is 180 days after the date of the enactment of this Act, no Federal funds may be made available to any institution of higher education that conducts or funds, in whole or in part, painful research on dogs or cats. </text></subsection><subsection id="HD13D6CACDA9448638CFE8BFA554EA87E"><enum>(b)</enum><header>Exceptions</header><text>Subsection (a) shall not apply to—</text><paragraph id="H8BDFF487CC9F4962974B28A585F76BE3"><enum>(1)</enum><text>clinical veterinary research; or</text></paragraph><paragraph id="HE3EAA3B7BCA940BB9734CD648E0CFA53"><enum>(2)</enum><text>any physical exam, training program, or study relating to service animals or military animals.</text></paragraph></subsection><subsection id="H25494A22136C426294D6B4D61B096E97"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H814C4DC8BD8C46A5B4A3A02D4F0E091C"><enum>(1)</enum><header>Clinical veterinary research</header><text>The term <term>clinical veterinary research</term> means research on a dog or cat with a naturally occurring disease or injury that is conducted—</text><subparagraph id="H8B1D84FDA8FB49EDA093D8977E0C6348"><enum>(A)</enum><text display-inline="yes-display-inline">for the benefit of the dog or cat; and</text></subparagraph><subparagraph id="HF1CB0AFAB1344C60BECA313C19A38607"><enum>(B)</enum><text>with the intention of studying the effect of a procedure, device, or treatment protocol.</text></subparagraph></paragraph><paragraph id="HABB1FE4FEE864A048EAE75FD7FCDB0E7"><enum>(2)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given the term in section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>).</text></paragraph><paragraph id="H6046C3CBF3294B69A8B36E39AF419D54"><enum>(3)</enum><header>Military animal</header><text>The term <term>military animal</term> has the meaning given the term in section 2583(i)(1) of title 10, United States Code.</text></paragraph><paragraph id="HCB1F8657738A4579B83A6468043D0A2B"><enum>(4)</enum><header>Painful research</header><text>The term <term>painful research</term> includes any research, biomedical training, experimentation, or biological testing classified in pain category D or E by the Department of Agriculture.</text></paragraph><paragraph id="H0B22FA955A2741C7BD17F22EB88653B1"><enum>(5)</enum><header>Service animal</header><text>The term <term>service animal</term> has the meaning given the term in section 37.3 of title 49, Code of Federal Regulations.</text></paragraph></subsection></section></legis-body></bill>
