Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Assistant Secretary of Commerce for Communications and Information to establish a competitive grant program to assist local governments in providing efficient review and approval of zoning and permitting applications that facilitate the deployment of broadband infrastructure, and for other purposes.</official-title></form><legis-body id="H006D0A6E94DB4CE894CE339FE96DDCF4" style="OLC"><section id="HC15EA85EC5C54CFA8DA9191512BD1BC7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Broadband Incentives for Communities Act</short-title></quote>.</text></section><section id="H15E06FCB37B74BF994144972ECC1571A"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="H21AD8871EEA445E5B5BA7091C41F3076"><enum>(1)</enum><text display-inline="yes-display-inline">Congress provided at least $42,500,000,000 through the Infrastructure Investment and Jobs Act (<external-xref legal-doc="public-law" parsable-cite="pl/117/58">Public Law 117–58</external-xref>) for Federal agencies to carry out broadband-support activities, including through competitive grants and other forms of financial assistance, to expand broadband connections to underserved rural communities and underserved low-income communities.</text></paragraph><paragraph id="HFE65C324E2564EF3A499D7658956E8DE"><enum>(2)</enum><text>Local governments play a significant role in the deployment of broadband infrastructure through their zoning and permitting processes.</text></paragraph><paragraph id="H50216B1F68F544E580B41163F0157BD1"><enum>(3)</enum><text display-inline="yes-display-inline">Local governments will need additional assistance to manage the expected accelerated pace of zoning and permitting applications that facilitate the deployment of broadband infrastructure in their communities.</text></paragraph><paragraph id="H112F402F27744F6BA930E5065D4AEECF"><enum>(4)</enum><text display-inline="yes-display-inline">The Federal Government has a critical role to play in encouraging the deployment of broadband infrastructure by local governments.</text></paragraph><paragraph id="HC0D10B0E8D014CE7B5A3DFCE1773ADDA" commented="no"><enum>(5)</enum><text display-inline="yes-display-inline">The establishment of a competitive grant program to provide resources to, and incentives for, local governments to fulfill their role in expanding broadband access for all is a vital component of a successful broadband deployment policy.</text></paragraph></section><section id="H8DF6B3DCA9CA4A05B8017AD7133083CB"><enum>3.</enum><header>Broadband Incentives for Communities Grant Program</header><subsection id="HEF31ADF4A06C42FA972D07D8DAAF9BFD"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Assistant Secretary shall establish a program to make grants on a competitive basis to covered entities to assist such entities in providing efficient review and approval of covered applications.</text></subsection><subsection id="H240D947F0E7540ABAB509C1C831F35A0"><enum>(b)</enum><header>Eligibility</header><text display-inline="yes-display-inline">The Assistant Secretary may only make a grant under this section to a covered entity that does the following:</text><paragraph id="HE050F41DFC834F57A4F0EC45261BD823"><enum>(1)</enum><text>The covered entity submits to the Assistant Secretary an application at such time, in such form, and accompanied by such information and assurances as the Assistant Secretary may require.</text></paragraph><paragraph id="H5142083E9DC747EEB660A6A727F2AE2C"><enum>(2)</enum><text>The covered entity demonstrates readiness for the deployment of broadband infrastructure (including fifth-generation wireless communications infrastructure) in the jurisdiction of the covered entity, including through the following:</text><subparagraph id="H5C45B50142734C42B0194FA3DAB5BE1D"><enum>(A)</enum><text display-inline="yes-display-inline">Adoption and implementation of efficient processes, which comply with applicable Federal standards and regulations, for reviewing covered applications that facilitate wireless and fiber deployment, including those applications relating to projects that make efficient use of existing infrastructure.</text></subparagraph><subparagraph id="H2D52B971BF264677B98CC345B574D0A7"><enum>(B)</enum><text display-inline="yes-display-inline">Adoption and implementation of written policies, ordinances, or guidance that allows the use of expedited processes, such as micro-trenching, for the deployment of broadband infrastructure.</text></subparagraph><subparagraph id="H27ACA6BCEDCC4E4B9BB70D31499A46C1" commented="no"><enum>(C)</enum><text>With respect to fees for the processing of covered applications—</text><clause id="H957CE05871C545EE90C4629922158369" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">in the case of a covered application described in subparagraph (A), adoption and implementation of fees that are limited to the actual, objectively reasonable costs incurred by the covered entity to process the application and (if applicable) provide access to the right-of-way to which the application relates; and</text></clause><clause id="HBF6146C87EF54A01AB3DB66D431E6EAD" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of any other covered application, adoption and implementation of uniform and objectively reasonable fees, which shall be published in advance of the date on which such fees begin to apply to any such application.</text></clause></subparagraph></paragraph></subsection><subsection id="H87CC58D5D0D74EEBBFD41576B7725823"><enum>(c)</enum><header>Use of funds</header><text>A covered entity that receives a grant under this section shall use the grant for one or more of the following:</text><paragraph id="HDA0F26166A13478B95571B077414CDD0"><enum>(1)</enum><text display-inline="yes-display-inline">Capacity-building for the covered entity to facilitate the processing of covered applications, including employee training and hiring.</text></paragraph><paragraph id="H2384332E1F874F50B084534F4D1A9203"><enum>(2)</enum><text>The purchase of technology, software, and equipment to facilitate the processing of covered applications, including in a remote work environment.</text></paragraph></subsection></section><section id="HFDF4D61B72BD41B9843802ABE4386A0B"><enum>4.</enum><header>Local Broadband Advisory Council</header><subsection id="H2908C4FE09B44003A842D6BAFB319A81"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Assistant Secretary shall establish an advisory council, to be known as the <quote>Local Broadband Advisory Council</quote>, to develop solutions to the challenges shared by local jurisdictions, covered entities, and infrastructure providers in facilitating wireless and broadband deployment, including in unserved and underserved communities.</text></subsection><subsection id="H529190CCBD4E4B68835D8EFB6137F7A7"><enum>(b)</enum><header>Membership</header><text>The Council shall be composed of broadband deployment stakeholders appointed by the Assistant Secretary, including representatives from the broadband industry, infrastructure providers, local governments, and covered entities.</text></subsection><subsection id="HF1E652CBC90A483B80C8D6E7C88BE7EB"><enum>(c)</enum><header>Report</header><text>Not later than 1 year after the Council is established under subsection (a), the Council shall submit to the Assistant Secretary and Congress a report on the solutions developed under such subsection.</text></subsection></section><section id="HE427048F5BFD47AD9F8C47EDA53D1788"><enum>5.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated to the Assistant Secretary such sums as may necessary to carry out this Act.</text></section><section id="H33E859F838924784AE5D6931AFF40A41"><enum>6.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HE1A32DB849F34A0EA7B4E562D851AA23"><enum>(1)</enum><header>Assistant Secretary</header><text>The term <term>Assistant Secretary</term> means the Assistant Secretary of Commerce for Communications and Information.</text></paragraph><paragraph id="H1C890187533B4F5A85BACABFC6AE58F5"><enum>(2)</enum><header>Broadband infrastructure</header><text display-inline="yes-display-inline">The term <term>broadband infrastructure</term> means facilities or equipment utilized for the provision of broadband internet access service (as defined in section 8.1(b) of title 47, Code of Federal Regulations).</text></paragraph><paragraph id="H3EB73A7AC3E842AFA54327CFEDFE7FA2"><enum>(3)</enum><header>Council</header><text>The term <term>Council</term> means the Local Broadband Advisory Council established under section 4.</text></paragraph><paragraph id="H18EE246EE3BF49259DC378E2E601B714"><enum>(4)</enum><header>Covered application</header><text>The term <term>covered application</term> means a zoning or permitting application that facilitates the deployment of broadband infrastructure. </text></paragraph><paragraph id="H893D0F7E22EF4D459FEC80DA064AFA88"><enum>(5)</enum><header>Covered entity</header><text display-inline="yes-display-inline">The term <term>covered entity</term> means—</text><subparagraph id="HF47268819D434D9A8C18EE7A0B39AF35"><enum>(A)</enum><text>a political subdivision of a State; or</text></subparagraph><subparagraph id="HD4EE2DC0451A48D5BD8108B3A8F45C40" commented="no"><enum>(B)</enum><text>an Indian Tribe (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)).</text></subparagraph></paragraph><paragraph id="H582231FF72C948B8B26D16544DD87497" commented="no"><enum>(6)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means each State of the United States, the District of Columbia, and each commonwealth, territory, or possession of the United States.</text></paragraph></section></legis-body></bill>
