R. 2970</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250417">April 17, 2025</action-date><action-desc><sponsor name-id="Y000067">Mr. Yakym</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 38, United States Code, to make certain improvements to the laws relating to advocacy for veterans who receive health care and other benefits furnished by the Department of Veterans Affairs, and for other purposes.</official-title></form><legis-body id="H07E2FC4B960A4EC5B6858FD20C4BD94A" style="OLC"><section id="H2D3B78938BAC4F258A0D8C9FAD910CDB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Veterans Advocate Act of 2025</short-title></quote>. </text></section><section id="HE5C87542EB7043D7A2712D88CDAE3713"><enum>2.</enum><header>Independent Office of the National Veterans’ Advocate in Department of Veterans Affairs</header><subsection id="H801810E95A994466A0B0155546BA53C9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 7309A of title 38, United States Code, is amended—</text><paragraph id="H044BFCE89C8542E6B593809B41BE15DE"><enum>(1)</enum><text>by striking the section heading and inserting the following new section heading:</text><quoted-block style="USC" id="H206C1C5628BD4097B0C8C507617EAA40" display-inline="no-display-inline"><section id="H74D58F3C24124C82B4A6B52B4C0FFD69"><enum>7309A.</enum><header>Office of the National Veterans’ Advocate </header></section><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H6A5113BC17E2448EA29E92012723CA89"><enum>(2)</enum><text>in subsection (a)—</text><subparagraph id="H676D7051566C4F3F8A6C89232409BE1B"><enum>(A)</enum><text>by striking <quote>within the Office of the Under Secretary for Health</quote>; </text></subparagraph><subparagraph id="HFACFFF93E37F41B9BBEECAF5E4B50181"><enum>(B)</enum><text>by striking <quote>an office</quote> and inserting <quote>an independent office</quote>; and</text></subparagraph><subparagraph id="HFAD8974B8D064A649BAD3A7E1F5F210E"><enum>(C)</enum><text>by striking <quote><quote>Office of Patient Advocacy</quote></quote> and inserting <quote><quote>Office of the National Veterans’ Advocate</quote></quote>;</text></subparagraph></paragraph><paragraph id="HFE4E55E218B64FA4982CCB91C4AB031A"><enum>(3)</enum><text>by striking <quote>patient advocate</quote> each place it appears and inserting <quote>veteran advocate</quote>; </text></paragraph><paragraph id="H9D15707223F3416C9C159C905260A0EB"><enum>(4)</enum><text>in subsection (b)—</text><subparagraph id="H6C01E23529E241DFBD28ABD5E9483FD8"><enum>(A)</enum><text>by striking paragraph (1) and inserting the following new paragraph (1):</text><quoted-block style="USC" id="HC25CB55439E94E4BAB8C4ADBB81C2B9A" display-inline="no-display-inline"><paragraph id="H4E11CAF4464E462FB578127B506E974D" indent="up1"><enum>(1)</enum><text display-inline="yes-display-inline">The Office of the National Veterans’ Advocate shall be under the supervision and direction of an official to be known as the “National Veterans’ Advocate”. The National Veterans’ Advocate shall report directly to the Secretary and shall be entitled to compensation at the same rate as the highest rate of basic pay established for the Senior Executive Service under section 5382 of title 5, United States Code.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H47C9D121030A4213872E531487D9499E"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="H100BF6C2A8554A8E8FC767F3B39880C3"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>Office of Patient Advocacy</quote> and inserting <quote>Office of the National Veterans’ Advocate</quote>;</text></clause><clause id="HB1706D4BAF8A4DC4BA9F804C9959191F"><enum>(ii)</enum><text>by striking <quote>by the Under Secretary for Health</quote> and inserting <quote>by the Secretary</quote>; and</text></clause><clause id="HD122F4C19FAB4F6FB64A955BFE341597"><enum>(iii)</enum><text>by striking <quote>shall report directly to the Under Secretary for Health</quote> and inserting <quote>shall be independent of the Secretary</quote>;</text></clause></subparagraph></paragraph><paragraph id="HCC06D2DAA6B54A16947880501749F813"><enum>(5)</enum><text>by striking <quote>Director</quote> each place it appears and inserting <quote>National Veterans’ Advocate</quote>; </text></paragraph><paragraph id="H6F0E5C134A6D4BA59B51880AE6B0BF89"><enum>(6)</enum><text>in subsection (c)—</text><subparagraph id="HBE1C48F884A74B28A76883E774072777"><enum>(A)</enum><text>by striking the subsection heading and inserting <quote>(c) <header-in-text level="subsection" style="USC">Functions</header-in-text>.—</quote>;</text></subparagraph><subparagraph id="H98547AC9D29F4771BA3BF5F0A4EC2F40"><enum>(B)</enum><text>in paragraph (1)—</text><clause id="H27C4ED82A10B4E0C8B13F2A2E4CB2C8C"><enum>(i)</enum><text>by striking <quote>function</quote> and inserting <quote>functions</quote>;</text></clause><clause id="HB57C84F9621149F184A0A5DFD2226DEA"><enum>(ii)</enum><text>by striking <quote>is</quote> and inserting <quote>are</quote>; and</text></clause><clause id="H976111997C0D44AF927533C2370E1B26"><enum>(iii)</enum><text>by inserting before the period at the end the following: <quote>and to monitor Department processes and make recommendations to Congress on how to improve the Department’s efficiency and care for veterans</quote>;</text></clause></subparagraph><subparagraph id="HD67CFD475A414F7EA8ED51BD1E042480"><enum>(C)</enum><text>in paragraph (2)—</text><clause id="H79D5511B8C844B01B948AB61558D800F"><enum>(i)</enum><text>in subparagraph (B), by striking <quote>and</quote> after the semicolon;</text></clause><clause id="H09F358C2620645D792305A1694E02A95"><enum>(ii)</enum><text>in subparagraph (C), by striking the period and inserting a semicolon; and</text></clause><clause id="HA3C30F45CD0847EBBE5B4DE93FD4519F"><enum>(iii)</enum><text>by adding at the end the following new subparagraphs:</text><quoted-block style="USC" id="H04792B1196AB492CBF268CAD03EFFCA6" display-inline="no-display-inline"><subparagraph id="HFFF28C9EC8B845D18F316AE6F5142019" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">identify areas in which veterans have problems in dealings with the Department;</text></subparagraph><subparagraph id="HAD02A8A0AD88435BB456298ED449213B" indent="up1"><enum>(E)</enum><text>to the extent possible, propose changes in the administrative practices of the Department to mitigate problems identified under subparagraph (D); and</text></subparagraph><subparagraph id="H36D2D98D184C417C8E8670C8497F404D" indent="up1"><enum>(F)</enum><text>identify potential legislative changes which may be appropriate to mitigate such problems.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HD27D78F756034D74B110B0617B88AD46"><enum>(D)</enum><text>in paragraph (3)—</text><clause id="HBB2571F53D464CCB9DB8AF7C7C37E4CC"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>and</quote> after the semicolon;</text></clause><clause id="H33A41C52985744C4884DB221AD38DB53"><enum>(ii)</enum><text>by redesignating subparagraph (B) as subparagraph (C);</text></clause><clause id="HCF3833F4A12747839297BABE9B69B5F7"><enum>(iii)</enum><text>by inserting after subparagraph (A) the following new subparagraph (B):</text><quoted-block style="USC" id="HB011E9C25BF044859B16B1166161AF94" display-inline="no-display-inline"><subparagraph id="HC0943C91535F4EB0B937B6C12855F5D4" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">fill out forms to relating to casework problem that facilitate the rapid assignment of a local veteran advocate caseworker who can directly interface with the veteran if needed; and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="HE9E5DFD4DEE841A9B09D52B140333686"><enum>(iv)</enum><text>in subparagraph (C), as redesignated by clause (ii), by inserting <quote>or forms</quote> after <quote>complaint</quote> both times it appears; </text></clause></subparagraph><subparagraph id="H861413418A72430F8B939D78F3FF09DA"><enum>(E)</enum><text>by adding at the end the following new paragraphs:</text><quoted-block style="USC" id="H77EA2E5DE0E14BD2AC5645C50AF4F041" display-inline="no-display-inline"><paragraph id="HC1EC198B478746A0B247926FE3CCFE19" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">The Office shall have the authority to manage casework issues across the Department.</text></paragraph><paragraph id="HD8C56CA86907427EA3849F2DDD16A495" indent="up1"><enum>(5)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H2488DFF8C2D14766A06FAE32FB14D384"><enum>(A)</enum><text>Not later than March 30 and September 30 of each year, the National Veterans’ Advocate shall submit to the Committees on Veterans’ Affairs of the Senate and House of Representatives a report on the operations of the Office of the National Veterans’ Advocate. Each such report shall include—</text><clause id="HEA0052A742BD41208BD486913513B21F" indent="up1"><enum>(i)</enum><text>a description of the activities of the Office carried out pursuant so subsection (c)(2)(D) through (F); and</text></clause><clause id="HC1463E52E29D471B95D8749CCBFA9265" indent="up1"><enum>(ii)</enum><text>independent legislative recommendations for the improvement of health outcomes for veterans, the quality of health care and benefits provided by the Department, and the cost efficiency of the Department.</text></clause></subparagraph><subparagraph id="H80B07E8090104B95A8C7F898B9F0B283" indent="up1"><enum>(B)</enum><text>Recommendations included in a report under this paragraph may not be reviewed by the Secretary or by any other official of the Department prior to submission.</text></subparagraph><subparagraph id="H997F18BC9E164B7992764309EBECEE39" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">Each report under this paragraph shall be transmitted to the Secretary and made publicly available on the website the National Veterans’ Advocate.</text></subparagraph></paragraph><paragraph id="HF130D5DCC6B441C793EA490406896513" indent="up1"><enum>(6)</enum><text>The Office shall have a designated publicly accessible website that includes access to the information technology system required under paragraph (3).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HBB6EDD3EFA234708A3AD8E8CABA151B8"><enum>(7)</enum><text>in subsection (d)—</text><subparagraph id="H909B8CFC7B444FAD8203C2AA02DAE11E"><enum>(A)</enum><text>in the subsection heading, by striking <quote><header-in-text level="subsection" style="USC">Patient advocacy</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="USC">Veteran advocacy</header-in-text></quote>; and</text></subparagraph><subparagraph id="HEAC45B6F7CED49A3BF151EEAF50A6EB3"><enum>(B)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="USC" id="HB70B4D4B9AD8429F89840480885A624C" display-inline="no-display-inline"><paragraph id="H9757FDC1FE344D5E841F334884C86C58"><enum>(15)</enum><text display-inline="yes-display-inline">In coordination with the recommendation team, to identify problems experienced within the Department in the course of providing hospital care, medical services, and nursing home care and burial and interment benefits to veterans and to develop recommendations to address such problems.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H23CC099B23844CA1956D820D406CAA59"><enum>(8)</enum><text>in subsection (e)—</text><subparagraph id="HFEBC6164EA8D493B9EE7536C84E39184"><enum>(A)</enum><text>by striking <quote>shall ensure that such training is consistent throughout the Department.</quote> and inserting <quote>shall—</quote>;</text></subparagraph><subparagraph id="H96B7F025A7AD40799888A381B36F6257"><enum>(B)</enum><text>by adding at the end the following new subparagraphs:</text><quoted-block style="USC" id="HDA07ECC2AC454B74A937DBE1F664F749" display-inline="no-display-inline"><subparagraph id="H09CDEE91E8F3480E8A246F163CDDEEE7"><enum>(A)</enum><text display-inline="yes-display-inline">develop the curriculum for such training in coordination with the Under Secretary for Benefits, the Under Secretary for Health, the Director of each of the Veterans Integrated Service Networks, and veterans service organizations;</text></subparagraph><subparagraph id="HBDA690D5A5694A5991F4D2317BE90A0F"><enum>(B)</enum><text>ensure that each veteran advocate is required to receive such training on an annual basis;</text></subparagraph><subparagraph id="HDFF8BB89E9164BBC9C82E9B49F83B20D"><enum>(C)</enum><text>ensure that such training includes up-to-date information on Department policy, crisis management, health care, and such other matters as the Secretary determines appropriate; and</text></subparagraph><subparagraph id="HCCF8FD4134F14A5688F0C1B6E08CA499"><enum>(D)</enum><text>ensure that such training is consistent throughout the Department.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H5067B87B82EC4BBFB46DE987E571965D"><enum>(9)</enum><text>by redesignating subsection (f) as subsection (l); and</text></paragraph><paragraph id="H12BC44CEFCBE4103A55DC5A41C801E11"><enum>(10)</enum><text>by inserting after subsection (e) the following new subsections:</text><quoted-block style="USC" id="H0E6F532A2F7E4017BED9CCC9BC7AC795" display-inline="no-display-inline"><subsection id="HE30C60649B18416ABEB2F8AAFB7ACB80"><enum>(f)</enum><header>Deputy National Veterans’ Advocates</header><paragraph commented="no" display-inline="yes-display-inline" id="HB77E14B1BDC3430588710E00FB5FCC72"><enum>(1)</enum><text display-inline="yes-display-inline">There is in each Veterans Integrated Service Network (hereinafter referred to as a <quote>VISN</quote>) a Deputy National Veterans’ Advocate who shall have responsibility for managing the employees of the Office with primary responsibility for casework.</text></paragraph><paragraph id="HD86AB464612641FA99FB8969FC713C40" indent="up1"><enum>(2)</enum><text>The Deputy National Veterans’ Advocate for a VISN shall ensure that for the geographic area served by that VISN, the Department employs at least one veteran advocate for every 12,000 veterans who reside in such area and are enrolled in the patient enrollment system under section 1705 of this title. </text></paragraph></subsection><subsection id="H2A16A92E82114240973A2404AFBEB0D6"><enum>(g)</enum><header>Office employees</header><text>The Office of the National Veterans’ Advocate shall have employees in the Washington, D.C., office in the Department. Such employees shall carry out the responsibilities under subsection (c)(2)(D) through (F), coordinate with Deputy National Veterans’ Advocates and veteran advocates, and carry out such other responsibilities as the National Veterans’ Advocate determines appropriate.</text></subsection><subsection id="H7DF68B001F7544989F60ABBAE73208D6"><enum>(h)</enum><header>Casework request portal</header><text display-inline="yes-display-inline">The National Veterans’ Advocate shall establish, on the website of the National Veterans’ Advocate, a casework request portal that veterans can use to request assistance with casework.</text></subsection><subsection id="HEEC30CCE83EA46DD888104FFBA3FBE0B"><enum>(i)</enum><header>Outreach</header><text>The Secretary shall conduct outreach to veterans receiving benefits under the laws administrated by the Secretary to provide information to such veterans about the Office and the assistance available to veterans through the Office.</text></subsection><subsection id="HB3EA51DC819541F09EE7AD36B9DE4643"><enum>(j)</enum><header>Coordination To improve policies</header><text display-inline="yes-display-inline">The Secretary, the National Veterans’ Advocate, the Under Secretary for Health, and the Under Secretary for Benefits shall—</text><paragraph id="H108B8CD367B2475B92D67D31C01EB301"><enum>(1)</enum><text>work closely together on a continual basis to improve the policies of the Department without the necessity for congressional action; and</text></paragraph><paragraph id="HA65F2D3B77724DCA84565A02D2B244A1"><enum>(2)</enum><text>communicate frequently to ensure such improvement.</text></paragraph></subsection><subsection id="HA01FF0ECAA7B4A27AD4C12C880A1BE1A"><enum>(k)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this section $25,000,000 for each of fiscal years 2026 through 2030.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HF68EAC0AD05F4A8FB2EC268F33049FBC"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of chapter 73 of such title is amended by striking the item relating to section 7309A and inserting the following new item:</text><quoted-block style="USC" id="H2C97EFE6CABA4A468FE4D6B7AB36F3AA" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">7309A.
