<official-title display="yes">To require the Administrator of the Small Business Administration to require an applicant for certain loans of the Administration to provide certain citizenship status documentation, and for other purposes.</official-title>

<section id="HB5FE3F28D1AD44239416FEA11A1860FC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American Entrepreneurs First Act of 2025</short-title></quote>.</text></section> <section id="H960A9885AB9E4076B0F318C554147BBA"><enum>2.</enum><header>Requirements for citizenship status documentation for certain loan programs of the Small Business Administration</header> <subsection id="H152395192F284BA6B5608C9A9CE4B223"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator of the Small Business Administration shall ensure that any application for a loan submitted under section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>) or title V of the Small Business Investment Act of 1958 (<external-xref legal-doc="usc" parsable-cite="usc/15/695">15 U.S.C. 695 et seq.</external-xref>) includes the following information:</text>
<paragraph id="H0F750E66C983492CAC08DA38476ABC30"><enum>(1)</enum><text display-inline="yes-display-inline">The date of birth for each individual applicant for such loan or for each individual owner of an applicant concern.</text></paragraph> <paragraph id="HD7CF0BA6EB874A4DAA65DEB7CD7CEFFE"><enum>(2)</enum><text display-inline="yes-display-inline">Certification that—</text>
<subparagraph id="HF603A098AA3C41B3A7459570E227407D"><enum>(A)</enum><text display-inline="yes-display-inline">an individual applicant for such loan is a citizen of the United States, a national of the United States, or a lawful permanent resident of the United States; or</text></subparagraph> <subparagraph id="H9F1C0B806D704F2B85D4697F6C4D4EF8"><enum>(B)</enum><text>an applicant concern for such loan or a guarantor for such loan is 100 percent beneficially owned by individuals who are either citizens of the United States, nationals of the United States, or lawful permanent residents of the United States.</text></subparagraph></paragraph>
<paragraph id="HAC8008A8F7DB43F3A3701663471C98C5"><enum>(3)</enum><text display-inline="yes-display-inline">Certification that no direct or indirect owner of an applicant concern for such loan is an ineligible person.</text></paragraph> <paragraph id="H6BA47985BA3D48DB9E84B5B1F2B59409"><enum>(4)</enum><text display-inline="yes-display-inline">Documentation of the alien registration number of any lawful permanent resident who is—</text>
<subparagraph id="H9F723661708449838EA83EF8EA7665DC"><enum>(A)</enum><text display-inline="yes-display-inline">an individual applicant for such loan; or</text></subparagraph> <subparagraph id="HB79976F94FEC47E1913AF0A5B245A2E6"><enum>(B)</enum><text>an owner of an applicant concern.</text></subparagraph></paragraph></subsection>
<subsection id="H84916436790A48E09E9B0DD722BB15C8"><enum>(b)</enum><header>Prohibition</header><text display-inline="yes-display-inline">An applicant for a loan under section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>) or title V of the Small Business Investment Act of 1958 (<external-xref legal-doc="usc" parsable-cite="usc/15/695">15 U.S.C. 695 et seq.</external-xref>) is ineligible for such loan if—</text> <paragraph id="H2C686E51430B4EFFA9ADA60F1ABCBAB1"><enum>(1)</enum><text>the applicant submits the application for such loan after the date of the enactment of this Act and such application does not contain the information required under subsection (a);</text></paragraph>
<paragraph id="H5A4D7E41969F48C991EBE7E4F9B75B25"><enum>(2)</enum><text>in the case such applicant is an applicant concern, any direct or indirect owner of such applicant concern is an ineligible person; or</text></paragraph> <paragraph id="H3D14B54097DD44898EAC41D0B8B17DE2"><enum>(3)</enum><text>in the case such applicant is an individual applicant, such applicant is an ineligible person.</text></paragraph></subsection>
<subsection id="H6FCC35C0F40247DA869EDB913B657B17"><enum>(c)</enum><header>Ineligible person defined</header><text display-inline="yes-display-inline">In this Act, the term <term>ineligible person</term> means—</text> <paragraph id="HCFF8DDF9585E45A6888B5D61147149B2"><enum>(1)</enum><text display-inline="yes-display-inline">an asylee;</text></paragraph>
<paragraph id="H84085E13FEE64E099FF1E99E27EE0866"><enum>(2)</enum><text>a refugee;</text></paragraph> <paragraph id="HBE2724902B7345538C08CFEF48CD87F8"><enum>(3)</enum><text>an individual issued a visa to remain in the United States;</text></paragraph>
<paragraph id="H6E356197FEEB4013ACF42B921BBE3D34"><enum>(4)</enum><text display-inline="yes-display-inline">an alien classified as a nonimmigrant under any subparagraph of section 101(a)(15) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)</external-xref>);</text></paragraph> <paragraph id="H978B08F21EAF4F7488D348DF857BD159"><enum>(5)</enum><text display-inline="yes-display-inline">an alien to whom deferred action has been granted pursuant to the Deferred Action for Childhood Arrivals policy announced by the Secretary of Homeland Security on June 15, 2012; or</text></paragraph>
<paragraph id="H36F0ACA9324043E3BC03B1D9949BFA80"><enum>(6)</enum><text display-inline="yes-display-inline">an alien present in the United States without lawful status under the immigration laws (as such term is defined in section 101(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)</external-xref>)).</text></paragraph></subsection></section> </legis-body><attestation><attestation-group><attestation-date date="20250606" chamber="House">Passed the House of Representatives June 6, 2025.</attestation-date><attestor display="no">Kevin F.
