which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Government Reform</committee-name>, and in addition to the Committee on <committee-name committee-id="HJU00">the Judiciary</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Office of National Drug Control Prevention Act of 1998 to include new requirements for assessments and reports, and for other purposes.</official-title></form><legis-body id="HB66FBF67E0A640DCB6B5ED8303C770CB" style="OLC"><section section-type="section-one" id="H8EB09719A2BC40F8A172A27C304105F8"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fight Fentanyl Act</short-title></quote>.</text></section><section id="H0F3A7C5C7C4745029DE13AC581228447"><enum>2.</enum><header>Office of National Drug Control Policy</header><text display-inline="no-display-inline">The Office of National Drug Control Policy Reauthorization Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/21/1701">21 U.S.C. 1701 et seq.</external-xref>) is amended—</text><paragraph id="HC7CCCAF6B1BB4B948600D4B105B90745"><enum>(1)</enum><text>in section 706(g)(3) (<external-xref legal-doc="usc" parsable-cite="usc/21/1705">21 U.S.C. 1705(g)(3)</external-xref>)—</text><subparagraph id="HBCDE492D3D33442BAB37411504E12032"><enum>(A)</enum><text>in subparagraph (C), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="HEA58C3D19054465BBF02DFA78D167B61"><enum>(B)</enum><text>in subparagraph (D), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H3E85C58577E14FDC88641C5B842A75EB"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H40D249E12EEB42D98BEC0786E45C3E1E"><subparagraph id="H40B902873A314950852A79EE679B7A7D"><enum>(E)</enum><text>a report describing the use of HIDTA funds to investigate organizations and individuals trafficking in fentanyl or fentanyl-related substances, including any resulting prosecution, in the prior calendar year, including—</text><clause id="H214D77AB4BE84B2DBF6A652632CD6748"><enum>(i)</enum><text>the amounts of fentanyl or fentanyl-related substances seized by a HIDTA-funded initiative in the area during the previous year; and</text></clause><clause id="H4569C5D9FA894FC9A2CA22B2746F7CB8"><enum>(ii)</enum><text>law enforcement and predictive data from regional HIDTA threat assessments showing patterns and trends in substance abuse, trafficking, and transportation of fentanyl and fentanyl-related substances.</text></clause></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H660F0B6318D440FE9AD961B2C7068E3B"><enum>(2)</enum><text>in section 707 (<external-xref legal-doc="usc" parsable-cite="usc/21/1706">21 U.S.C. 1706</external-xref>)—</text><subparagraph commented="no" display-inline="no-display-inline" id="H9435A530177346EB8A65038A7CD1D07F"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (l)(2)—</text><clause id="H23F92E3470094987A84BD26ABBA803DC"><enum>(i)</enum><text>in subparagraph (F), by striking <quote>and</quote> at the end;</text></clause><clause id="HE5D2739358E74FADA03238B379DA8643"><enum>(ii)</enum><text>in subparagraph (G), by striking the period at the end and inserting <quote>; and</quote>; and</text></clause><clause id="HCD94A69A3B814834BC64B82F166E2CD9"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF833D03AB4D840759C06F99EE2F5B384"><subparagraph id="H53329E52BD0D4BC2B0A54D71F5ED57E8"><enum>(H)</enum><text>any limitations of the ability of a high intensity drug trafficking area to meet the purpose or goals of the area and recommendations to address any such limitations, including through resource allocation, partnerships, or a change in authority or law.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HE1D67F5FF4CC4B8188AD6E5F0D89C628"><enum>(B)</enum><text>in subsection (p)—</text><clause id="H5B53E27B995D4684AF1CF82D15763B13"><enum>(i)</enum><text>in paragraph (5), by striking <quote>and</quote> at the end;</text></clause><clause id="H0D299E0E543D4E818F636FCC2E6A4FF2"><enum>(ii)</enum><text>in paragraph (6), by striking the period at the end and inserting <quote>; and</quote>; and</text></clause><clause id="H4DEC3C88C18347E3ADBF18FC5A0795C2"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HD4AE75CB1B204ED8897345F1F03233D4"><paragraph id="H6E5061C6EA9A4B0D9DD9978799FD7E01"><enum>(7)</enum><text>$333,000,000 for each of fiscal years 2025 through 2030.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HF66C271769E94FBA9923BE4A7295056E"><enum>(C)</enum><text>in subsection (s)—</text><clause commented="no" display-inline="no-display-inline" id="H3AC2AC0461AC4DE5A2F2910F59CD7C63"><enum>(i)</enum><text>in the matter preceding paragraph (1), by striking <quote>$10,000,000</quote> and inserting <quote>$14,224,000</quote>;</text></clause><clause commented="no" display-inline="no-display-inline" id="H4B775868521E49719F731BB6857F4EA6"><enum>(ii)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking <quote>and</quote> at the end;</text></clause><clause commented="no" display-inline="no-display-inline" id="H4C873AA58B724E0FB86AAA7E9789FF40"><enum>(iii)</enum><text>in paragraph (3), by striking the period at the end and inserting a semicolon; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HAE5DBE38FFFE433C9DA86235007B95FF"><enum>(iv)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HB4F7D690E54E4EFAA633B181B31CF953"><paragraph id="H5838E69392F848928FB8676ACF2C4CA6"><enum>(4)</enum><text>providing assistance to Federal, State, local, and Tribal law enforcement agencies in investigations and activities related to the interdiction of fentanyl and other substances; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD9F6AFC6A91F4E29830584B4287DC334"><enum>(5)</enum><text>any additional purpose the Director determines is appropriate to enhance fentanyl prevention, seizure, and interdiction activities.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB8012C52C7F1491BADB68B00F8D2FD62"><enum>(D)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H2CB5088D81304D209B6CC2B92F197B35"><subsection id="H57CE272122844479BA850F6A23921B53"><enum>(t)</enum><header>Additional prosecutorial resources</header><paragraph id="H28908640AC984FB4AC1A3D4726ACC53A"><enum>(1)</enum><header>In general</header><text>The Attorney General shall make available sufficient investigative and prosecution resources as may be practicable for the purposes described in this section, including temporary reassignment under subsection (b)(2) for fiscal years 2024 through 2030, during which such an assistant United States attorney shall prioritize the investigation and prosecution of organizations and individuals trafficking in fentanyl and fentanyl-related substances. Such temporary reassignment may be extended by the Attorney General for such time as may be necessary to conclude any ongoing investigation or prosecution in which the assistant United States attorney is engaged.</text></paragraph><paragraph id="H985472A95499402E8CDF693F9741F3BD"><enum>(2)</enum><header>Process for temporary reassignment</header><text>Not later than 180 days after the date of enactment of this subsection, the Attorney General shall establish a process under which the Director, in consultation with the Executive Boards of each designated high intensity drug trafficking area, may request an assistant United States attorney to be so temporarily reassigned in accordance with this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section></legis-body></bill>
