which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Public Health Service Act to allow certain public health data modernization grants to be used to track hospital bed capacity, and for other purposes.</official-title></form><legis-body id="H769EA55E0E02409EA92325E677A72AB2" style="OLC"><section id="H74143E86007B4D8583AD82215548B554" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Addressing Boarding and Crowding in the Emergency Department</short-title> Act of 2025</quote> or the <quote>ABC-ED Act of 2025</quote>.</text></section><section id="H4C88E9FDFD4646088C196330CB541782"><enum>2.</enum><header>Allowing public health data modernization grants to be used to track hospital bed capacity</header><text display-inline="no-display-inline">Section 2823(a)(1) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300hh-33">42 U.S.C. 300hh–33(a)(1)</external-xref>) is amended—</text><paragraph id="HC63D4064767D48CF92A4FE2A78E98F44"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="HC4C3C47C36604C828DC17D456C13D7B3"><enum>(2)</enum><text>in subparagraph (B)(viii), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H9BA8C981024849BE91FE54B08A78423D"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H1E6BE70A7D224DEEB48A8CFF3E08381B" display-inline="no-display-inline"><subparagraph id="H6EA416976C544E9EBA891F85D6B7F9D3"><enum>(C)</enum><text display-inline="yes-display-inline">award grants or cooperative agreements to appropriate entities for the expansion and modernization of public health data systems by—</text><clause id="HB0FA82CC10A2480C8E02331E47773A0D"><enum>(i)</enum><text>developing State- or region-wide, real-time (or near real-time), accurate, and scalable systems for tracking—</text><subclause id="H3C8C0584DB4A49DF892F7255D4FE94A5"><enum>(I)</enum><text>hospital bed capacity; and</text></subclause><subclause id="HD8D8B286D3C5404DA7E36467503935D5"><enum>(II)</enum><text>how such capacity affects emergency department boarding rates, wait times for treatment in emergency departments, and the amount of time emergency medical services personnel are waiting in emergency departments to offload patients; and</text></subclause></clause><clause id="HF59835C93EFA4D6092ED0C83B4CE5E91"><enum>(ii)</enum><text>establishing or maintaining a public-facing dashboard of the information tracked pursuant to systems described in clause (i), with such information redacted in accordance with applicable privacy laws.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HE9C6DD33B0CB42898B743BF9299C56B5"><enum>3.</enum><header>Center for Medicare and Medicaid Innovation pilot program</header><text display-inline="no-display-inline">Section 1115A(b)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1315a">42 U.S.C. 1315a(b)(2)</external-xref>) is amended—</text><paragraph id="HFE19B1879E9B4BF5A8D721E357E15B49" commented="no"><enum>(1)</enum><text>in subparagraph (A), in the third sentence, by inserting <quote>, and shall include the models described in clauses (xxviii) and (xxix) of such subparagraph</quote> before the period at the end; and</text></paragraph><paragraph id="H80C379A14D2C4BE390CD58159D2A6D32"><enum>(2)</enum><text>in subparagraph (B), by adding at the end the following new clauses:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HE4038E0DEBA548B98D001ABC2A600CAD"><clause id="H26D792EC0D684A6CB10A97317A99FDE8"><enum>(xxviii)</enum><text display-inline="yes-display-inline">Promoting research-based ways to facilitate improved emergency care for applicable individuals who are older adults, including through—</text><subclause id="H0A958AB350934BA4BC3A552763E4074C"><enum>(I)</enum><text display-inline="yes-display-inline">sufficient, flexible, and interdisciplinary staffing and education of staff at emergency departments;</text></subclause><subclause id="H44828C896C304CB8BC4B6A05A2D6B2ED"><enum>(II)</enum><text>changes to the physical infrastructure of emergency departments;</text></subclause><subclause id="H558DAB83E129454D84C3835076FE71B6"><enum>(III)</enum><text display-inline="yes-display-inline">introducing geriatric-focused policies, protocols, and quality improvement metrics; and</text></subclause><subclause id="HC3397A4F8319409D9E04B2167AFDB2FC"><enum>(IV)</enum><text display-inline="yes-display-inline">improving coordination between emergency departments and post-acute care facilities (including senior care facilities such as skilled nursing facilities, assisted living facilities, and independent living facilities) with respect to such individuals, which may include the mutual, bidirectional exchange of medical information and improvements to the transfer process.</text></subclause></clause><clause id="H32A241EDA5604F9389EE6F9C977DC42D" commented="no"><enum>(xxix)</enum><text display-inline="yes-display-inline">Promoting research-based ways to facilitate improved emergency care for applicable individuals experiencing acute psychiatric crisis, including by—</text><subclause id="H5A380190482543B2BBF53012B72A3165" commented="no"><enum>(I)</enum><text>implementing dedicated units at emergency departments to provide emergency care to such individuals; and</text></subclause><subclause id="H5A5D8B03B54B4EA280E1430AC8A1A393" commented="no"><enum>(II)</enum><text>improving transfers between emergency departments and post-acute care facilities for such individuals, which may include expedited placement at such facilities.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H7DDFD0EA86A2468D802AC5C94D771978"><enum>4.</enum><header>Study on best practices for public health data systems for tracking hospital capacity</header><subsection id="HF7CE32DA2F044048B704B94DCC38A82D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Comptroller General of the United States shall conduct a study—</text><paragraph id="H484513FC5751404798CB23BC95258E8F"><enum>(1)</enum><text display-inline="yes-display-inline">to determine best practices for the development and maintenance of public health data systems for tracking hospital capacity (including such systems supported pursuant to section 2823(a)(1) of the Public Health Service Act, as amended by section 2) to ensure that such tracking—</text><subparagraph id="HEDC8BEF1342C41349E211C6BE82AD5E7"><enum>(A)</enum><text>is State- or region-wide, real-time (or near real-time), accurate, and scalable;</text></subparagraph><subparagraph id="H6FDCEF801AD14373ABD1C190246E19CE"><enum>(B)</enum><text display-inline="yes-display-inline">includes tracking of hospital capacity with respect to emergency departments, adult and pediatric intensive care units, inpatient psychiatric services, skilled nursing facilities, and other appropriate types of facilities and services; and </text></subparagraph><subparagraph id="HFD21C8007C8544868F3FFC655969FAB5"><enum>(C)</enum><text display-inline="yes-display-inline">is seamlessly and directly integrated with relevant hospital electronic medical records systems; and</text></subparagraph></paragraph><paragraph id="HC74E64FB227E4418BEBB5DA6729EB2D8"><enum>(2)</enum><text display-inline="yes-display-inline">to assess how implementation of such public health data systems for tracking hospital capacity affects—</text><subparagraph id="H362B44440341424B96508563CA3DEBD8"><enum>(A)</enum><text display-inline="yes-display-inline">emergency department boarding rates as determined using quality measures and other metrics that are established and utilized by the Centers for Medicare and Medicaid Services and others accreditation entities;</text></subparagraph><subparagraph id="H725A60FB99EB4695B2E760578E22C62E"><enum>(B)</enum><text>wait times for treatment and discharge in emergency departments; and</text></subparagraph><subparagraph id="H29DA773A456F4E7A93B7F15BAA356005"><enum>(C)</enum><text>the amount of time emergency medical services personnel are waiting in emergency departments to offload patients.</text></subparagraph></paragraph></subsection><subsection id="H81F60F25F0BE436A9409B8DCC6580F5E"><enum>(b)</enum><header>Report to Congress</header><text>Not later than 1 year after the date of enactment of this Act, the Comptroller General shall—</text><paragraph id="HDB00E3DC9D8D45939322170657190E3B"><enum>(1)</enum><text>complete the study under subsection (a); and</text></paragraph><paragraph id="H6C9642F8AF654054BFFEC8EAC3F40452"><enum>(2)</enum><text>submit to the Congress a report on the results of such study.</text></paragraph></subsection></section></legis-body></bill>
