R. 2914</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250414">April 14, 2025</action-date><action-desc><sponsor name-id="M001194">Mr. Moolenaar</sponsor> (for himself and <cosponsor name-id="P000613">Mr. Panetta</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HFA00">Committee on Foreign Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide for the imposition of sanctions relating to the People’s Republic of China and support for Russian invasion of Ukraine, and for other purposes.</official-title></form><legis-body id="HDD47BF7D901B463CA05E17E5D53C5BD9" style="OLC"><section id="H5924E9213DF94F8BA9B7DEE923FE5A48" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>NO LIMITS Act of 2025</short-title></quote>.</text></section><section id="H20CE1860E3CF40DCAF893B0B23D2531E"><enum>2.</enum><header>Findings; sense of Congress</header><subsection id="H6D97EDBA38A34E5DA3AD19E6F110DDFD"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text><paragraph id="H93922EC1007D4A478C138AE5744D8CBC"><enum>(1)</enum><text>On September 30, 2022, the Office of Foreign Assets Control of the Department of the Treasury designated People’s Republic of China entity Sinno Electronics Co. Limited (Sinno) for providing material support to the defense industrial base of the Russian Federation.</text></paragraph><paragraph id="H7ECBE9D7D4844BAD97B53BEF39C6950A"><enum>(2)</enum><text display-inline="yes-display-inline">On January 26, 2023, the Office of Foreign Assets Control of the Department of the Treasury sanctioned People’s Republic of China entity Changsha Tianyi Space Science and Technology Research Institute Co. LTD (Spacety China) for providing material support to entities of the Russian Federation involved in combat operations in Ukraine.</text></paragraph><paragraph id="HF774385B19844F94B01EFA87ACBD2183"><enum>(3)</enum><text display-inline="yes-display-inline">There is clear and increasing evidence that People’s Republic of China entities continue to evade United States sanctions to provide material support to the defense and military industrial base of the Russian Federation.</text></paragraph><paragraph id="HC30C0C34DEE741DDA8B980CD4F5AF93C"><enum>(4)</enum><text display-inline="yes-display-inline">Under Executive Order 13959 (85 Fed. Reg. 73185; related to addressing the threat from securities investments that finance Communist Chinese military companies), the President found that the People’s Republic of China <quote>increases the size of the country’s military-industrial complex by compelling civilian Chinese companies to support its military and intelligence activities. Those companies, though remaining ostensibly private and civilian, directly support the PRC’s military, intelligence, and security apparatuses and aid in their development and modernization.</quote>.</text></paragraph><paragraph id="H4BBC37DB390746D897BC2D83A6DDD40D"><enum>(5)</enum><text display-inline="yes-display-inline">Evidence of industrial support for the Russian Federation by the People’s Republic of China, combined with inherent blurred lines between the civilian versus governmental defense apparatus in the People’s Republic of China, requires new authorities to protect the national security of the United States.</text></paragraph></subsection><subsection id="H2E2A46E890E04F33939D70415BE20551"><enum>(b)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that the Russian Federation’s continued invasion of Ukraine is directly enabled by the People’s Republic of China. It is therefore time for the President to— </text><paragraph id="HDEE08A6169664067BA7152C4FDDA376C"><enum>(1)</enum><text display-inline="yes-display-inline">more fully cut off financing avenues for People’s Republic of China entities providing materiel support to the defense and related materiel sector of the economy of the Russian Federation;</text></paragraph><paragraph id="H7100BE471EDE42FE947D45F008C6EF16"><enum>(2)</enum><text display-inline="yes-display-inline">more fully cut off financing avenues for People’s Republic of China entities involved in military modernization activities; </text></paragraph><paragraph id="H84808AE7A0CD42CB939B067C0B5C44D5"><enum>(3)</enum><text display-inline="yes-display-inline">impose country-wide export control restrictions on dual-use technology exported to the PRC over concerns of diversion to the Russian Federation; and</text></paragraph><paragraph id="H09D07F979C6E49BAAA7DE5F6C34AF230"><enum>(4)</enum><text display-inline="yes-display-inline">impose sanctions on PRC entities involved in the export of weapons and dual-use technology to the Russian Federation, including microelectronics, aerospace, automobiles, among others.</text></paragraph></subsection></section><section id="HC8D4F291FA0D441ABD246E4CDEF66632"><enum>3.</enum><header>Imposition of sanctions relating to the People’s Republic of China and support for Russian invasion of Ukraine</header><subsection id="H33BFD53D297040969016BC8FD3FD9107"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">On and after the date that is 90 days after the date of the enactment of this Act, the President—</text><paragraph id="HDC4EA7810B9549139C7D3CEFC1E6F8AB" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">may impose the sanction described in subsection (c) with respect to a foreign person the President determines—</text><subparagraph id="H67C4E1ECB171452A82DEAEF7A9BB7E13" commented="no"><enum>(A)</enum><text>is located or headquartered within, or is organized under the laws of, the People’s Republic of China; and</text></subparagraph><subparagraph id="HFA64A2DCC8A94BCE9B60FA95625FFB93" commented="no"><enum>(B)</enum><text>operates in the technology sector of the economy of the Russian Federation, the defense and related materiel sector of such economy, or any other sector of such economy as may be determined by the Secretary of the Treasury or the Secretary of State, as the case may be; and</text></subparagraph></paragraph><paragraph id="HD17AED3925364210B7D3E67EC5027A6B"><enum>(2)</enum><text display-inline="yes-display-inline">may impose the sanction described in subsection (c) with respect to a foreign person the President determines that, in acting for or on behalf of, or for the benefit of, directly or indirectly, the armed forces or intelligence services of the People’s Republic of China, is responsible for or engages in—</text><subparagraph id="H5819C30A4DF842DE96DEDE349E3C2FA7"><enum>(A)</enum><text>malicious cyber-enabled activities; or</text></subparagraph><subparagraph id="HDEC53AE6C75146B6A8D9AFBE9B749A40" commented="no"><enum>(B)</enum><text>the production, or research and development, of dual-use technology or defense or related materials; or</text></subparagraph><subparagraph id="HC426D0D208874B3D822F3D49071ACE0F"><enum>(C)</enum><text display-inline="yes-display-inline">facilitating the evasion, circumvention, or direct violation of United States export controls or sanctions.</text></subparagraph></paragraph></subsection><subsection id="H97D40C5BAA864A43BF7679A74410FC74"><enum>(b)</enum><header>People’s Republic of China Military Companies Operating in Russian Federation</header><text>On and after the date that is 180 days after the date of the enactment of this Act, the President may impose the sanctions described in subsection (c) with respect to a foreign person that—</text><paragraph id="H4EC3071D30E64D6E8AC2EE59929A0DA2"><enum>(1)</enum><text>has business operations in the Russian Federation; and</text></paragraph><paragraph id="H4583880E106A4A0BB17C190CDA1405A4"><enum>(2)</enum><text>is a known Chinese military company.</text></paragraph></subsection><subsection id="HB711A43DB013460CBA397633FE91617D" commented="no"><enum>(c)</enum><header>Sanction described</header><paragraph id="H1FDDF9E6CF7D4D22BDDAB541C951DCD2" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The sanction described in this paragraph is the exercise all of the powers granted to the President under the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>) to the extent necessary to block and prohibit all transactions in property and interests in property of a foreign person if such property or interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</text></paragraph><paragraph id="HC3CA3DFB88EC48CC8ACF0CA734CA0B21" commented="no"><enum>(2)</enum><header>Implementation</header><text>The President may exercise the authorities provided to the President under sections 203 and 205 of the International Emergency Economic Powers Act (50 U.S.C. 1702 and 1704) to the extent necessary to carry out this section.</text></paragraph><paragraph id="H49578A89CC7C4A8C9141FA0A1CFF40FE" commented="no"><enum>(3)</enum><header>Penalties</header><text display-inline="yes-display-inline">The penalties provided for in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) shall apply to any person who violates, attempts to violate, conspires to violate, or causes a violation of any prohibition of this section, or an order or regulation prescribed under this section, to the same extent that such penalties apply to a person that commits an unlawful act described in subsection section 206(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705(a)</external-xref>).</text></paragraph><paragraph id="H3069494FFE8B46679D4B63CA1B5D827E" commented="no"><enum>(4)</enum><header>Exceptions</header><subparagraph id="H22C5C53075DA4A67B301A4E42135D495" commented="no"><enum>(A)</enum><header>Exception for intelligence and law enforcement actions</header><text>Sanctions under this section shall not apply with respect to—</text><clause id="HE7EC93430CFC4DD0A82CF4ACB72F4A31" commented="no"><enum>(i)</enum><text>any activity subject to the reporting requirements under title V of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3091">50 U.S.C. 3091 et seq.</external-xref>); or</text></clause><clause id="H3DFE907BD7A8407085191C76B8B5BD66" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">any authorized intelligence or law enforcement activities of the United States.</text></clause></subparagraph><subparagraph id="HD6607BDDF47540D09D79FE143C67B647" commented="no"><enum>(B)</enum><header>Exception relating to importation of goods</header><clause id="HCD308929156F4061B33E562728BF8EDF" commented="no"><enum>(i)</enum><header>In general</header><text>The authorities and requirements to impose sanctions authorized under this section shall not include the authority or requirement to impose sanctions on the importation of goods.</text></clause><clause id="H97E1090E7C804F65A6E09A07A193315F" commented="no"><enum>(ii)</enum><header>Good defined</header><text>In this subparagraph, the term <term>good</term> means any article, natural or manmade substance, material, supply or manufactured product, including inspection and test equipment, and excluding technical data.</text></clause></subparagraph></paragraph></subsection><subsection id="H74C8C3B336A3478183858ACA16720718"><enum>(d)</enum><header>Waivers</header><text display-inline="yes-display-inline">The President may waive the application of sanctions under this section with respect to a foreign person for renewable periods of not more than 90 days each if the President determines and reports to Congress that such a waiver is vital to the national interests of the United States.</text></subsection><subsection id="H2DBCF595727B40AE9629D5A5D6F94B6F"><enum>(e)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H2829FFD44FCA4F09844621EB90BEB029"><enum>(1)</enum><header>Business operations</header><text display-inline="yes-display-inline">The term <term>business operations</term> means any participation by any person in a commercial enterprise or venture, or participation in any association, institution, organization, or entity, whether of a commercial nature or otherwise. This includes the production, distribution, exportation, sale of goods, or provision of services, regardless of whether a pecuniary benefit or other assets are derived from such participation.</text></paragraph><paragraph id="H182596D1B9AE48D299DB5F5E72FC324A"><enum>(2)</enum><header>Foreign person</header><text display-inline="yes-display-inline">The term <term>foreign person</term> means any person that is not a United States person.</text></paragraph><paragraph id="HAB35011B6CE6441D93566CC952B49F50"><enum>(3)</enum><header>Knowingly</header><text display-inline="yes-display-inline">The term <term>knowingly</term>, with respect to conduct, a circumstance, or a result, means that a person has actual knowledge, or should have known, of the conduct, the circumstance, or the result (as the case may be).</text></paragraph><paragraph id="H4C4468AC1ED34BA38926F0A8AE1808CE" commented="no"><enum>(4)</enum><header>Person</header><text display-inline="yes-display-inline">The term <term>person</term> means an individual or entity.</text></paragraph><paragraph id="HBF17BED8BAC6491A80EFE83D3B93A1D3" commented="no"><enum>(5)</enum><header>United States person</header><text display-inline="yes-display-inline">The term <term>United States person</term> means any United States citizen, permanent resident alien, an entity organized under the laws of the United States or any jurisdiction within the United States (including a foreign branch of such an entity), or any person in the United States.</text></paragraph><paragraph id="H2859F5F16B4842AA8DC5FB86550F1666"><enum>(6)</enum><header>Known Chinese military company</header><text>The term <term>known Chinese military company</term> means any of the following persons:</text><subparagraph id="HDB8EDCFBEC424B718934BDA92B3F373F"><enum>(A)</enum><text>Aviation Industry Corporation of China Ltd (AVIC).</text></subparagraph><subparagraph id="HC5205C63A4E040D18DD86B8B34709F9E"><enum>(B)</enum><text>360 Security Technology Inc. (Qihoo 360).</text></subparagraph><subparagraph id="H4260AB727F0E4EFD9666BF0672A87DFF"><enum>(C)</enum><text>Advanced Micro-Fabrication Equipment Inc. or</text></paragraph><paragraph id="H910E60F77423497891E24BFBBA9C34C2"><enum>(2)</enum><text>any successor regulations.</text></paragraph></section><section id="H090B1AAA87D142D8926C702DBDA08C44"><enum>7.</enum><header>Regulations</header><text display-inline="no-display-inline">Not later than 90 days after the date of the enactment of this Act, the Secretary of Commerce, the Secretary of Defense, and the Secretary of State, shall issue such regulations as may be necessary to carry out this Act and the amendments made by this Act.</text></section></legis-body></bill>
