which was referred to the <committee-name committee-id="HED00">Committee on Education and Workforce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Health and Human Services to develop and nationally disseminate accurate, relevant, and accessible resources to promote understanding about sensitivities regarding adoption in the health care industry, and for other purposes.</official-title></form><legis-body id="H983368935A864FFABC6EDF030A885DF4" style="OLC"><section id="H51ADFE98C3094E5B8C9ABDED086721EC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hospital Adoption Education Act of 2025</short-title></quote>.</text></section><section id="H5499477A9C1347B285457A569795EBB5"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text><paragraph id="H6DCCA89FEE7B49269BA9EEA922EF7C80"><enum>(1)</enum><text>24 percent of Americans say that they have considered adopting a child.</text></paragraph><paragraph id="H0F561EC1B7FD40EE9F56258B87592411"><enum>(2)</enum><text>80 percent of women who consider adoption do so after their sixth month of pregnancy.</text></paragraph><paragraph id="HBF7C3A3203264147BDC887C766080451"><enum>(3)</enum><text>81 percent of birth parents report that easy access to objective information is important to them when making the decision to choose adoption. </text></paragraph><paragraph id="H138C2CBB7F2B48F98B39CF81EC8D2924"><enum>(4)</enum><text>93 percent of Americans consider hospitals and health care facilities to be trustworthy sources of information about adoption.</text></paragraph><paragraph id="H109449CF49A24396B8544AD6FB9F3B09"><enum>(5)</enum><text>98.2 percent of nurses have no professional development in the sensitivities around adoption. </text></paragraph><paragraph id="H8F07422FC57B4A0580499214FB4F2BE1"><enum>(6)</enum><text display-inline="yes-display-inline">Less than 1 percent of women with unintended pregnancies place their children through adoption.</text></paragraph></section><section id="HEFBAA66433B64807913939B18D3B15A4"><enum>3.</enum><header>Development and dissemination of adoption resources</header><subsection id="HBBAB1AEF4C6240A4901E48A9E17442BE"><enum>(a)</enum><header>In general</header><text>The Secretary of Health and Human Services—</text><paragraph id="H58CBBF7FC5DD4B42B65273F380B56FE6"><enum>(1)</enum><text>shall develop and nationally disseminate accurate, relevant, and accessible resources to promote understanding about—</text><subparagraph id="HEC6F06D3D6BC437F90BD532671755DC9"><enum>(A)</enum><text>the sensitivities regarding adoption in the health care industry; and</text></subparagraph><subparagraph id="H36CEDB3788244BD8B56B61F228E17BAA"><enum>(B)</enum><text>best practices when interacting with prospective birth mothers and adoptive families; and</text></subparagraph></paragraph><paragraph id="H5F095BB77C6F41ABB3BCD9BDC2696852"><enum>(2)</enum><text>in carrying out paragraph (1)—</text><subparagraph id="HC2F2DFF88DB04F0C95AB9FAC186C26B5"><enum>(A)</enum><text>shall include digital resources; and</text></subparagraph><subparagraph id="H5F8ED8AD07644D2185994C5DF832CFA0"><enum>(B)</enum><text>may include other types of resources, such as print resources.</text></subparagraph></paragraph></subsection><subsection id="H50A7818769FC49D49E99408C87A836DE"><enum>(b)</enum><header>Online adoption resources for health care workers</header><text>The Secretary shall maintain on the public website of the Administration for Children and Families a webpage on adoption resources for health care workers to improve the awareness and understanding of such workers regarding adoption.</text></subsection><subsection id="H0C2B6482E75B415AABBF692A09126BB4"><enum>(c)</enum><header>Development process</header><paragraph id="HDA7E7A3E53A8449DACBE86AABBFF85EE"><enum>(1)</enum><header>Committee</header><text>The Secretary shall develop the resources required by subsections (a) and (b) through a committee of adoption experts.</text></paragraph><paragraph id="H79C2259463CE41C6BB9D8114A694D9FB"><enum>(2)</enum><header>Membership</header><text>The membership of the committee referred to in paragraph (1) shall include—</text><subparagraph id="H04FCDCAA3E004CB481CBB1EE6DB07E5E"><enum>(A)</enum><text>representatives of organizations involved in adoption education;</text></subparagraph><subparagraph id="HF33B4705F91F42D9A1A1FE2DF6477DDA"><enum>(B)</enum><text>maternal health experts;</text></subparagraph><subparagraph id="H1D152B43F4744A9D8AE533B2F0E3245B"><enum>(C)</enum><text>child welfare experts;</text></subparagraph><subparagraph id="HF61772CFE1C648D098FE86144345779D"><enum>(D)</enum><text>licensed social workers;</text></subparagraph><subparagraph id="H9A2853A805504A6EA7425C913ABAB0A8"><enum>(E)</enum><text>hospital case managers; and</text></subparagraph><subparagraph id="H3917D1C5ACB74497BFF4F42697FA73FD"><enum>(F)</enum><text>adoption attorneys.</text></subparagraph></paragraph></subsection></section><section id="H094D1CBB8D474B9FBE08B379D00045E0"><enum>4.</enum><header>Education and professional development for care providers regarding patient care for families pursuing adoption, including prospective birth mothers and potential adoptive families</header><subsection id="H990E38BDD904446BB50C31B9F0635F5B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, acting through the Administration for Children and Families, directly or through grants or contracts in accordance with subsection (b), shall—</text><paragraph id="H27E7C1445FDE497A80F765506B0AC835"><enum>(1)</enum><text display-inline="yes-display-inline">provide to care providers at hospitals and birthing centers education and professional development regarding patient care for families pursuing adoption, including prospective birth mothers and potential adoptive families; and</text></paragraph><paragraph id="H80987799285A4F18A13CD4856784FA05"><enum>(2)</enum><text display-inline="yes-display-inline">provide consultation services to hospitals and birthing centers employing care providers on standardized policies, guidelines, and procedures regarding such education and professional development for such care providers.</text></paragraph></subsection><subsection id="H061FE44FA4544A1B9E397333DE858AC6"><enum>(b)</enum><header>Grants or contracts</header><text display-inline="yes-display-inline">If the Secretary chooses to provide education, professional development, or consultation services under subsection (a) through the award of a grant or contract, the following provisions shall apply:</text><paragraph id="H47B4146F08A34CF18B4C41E53FC3FF01"><enum>(1)</enum><header>Eligibility</header><text display-inline="yes-display-inline">To be eligible for such an award, an entity—</text><subparagraph id="HFFA98DA68F4A473AA3B1B9143C49942D"><enum>(A)</enum><text>shall—</text><clause id="H5D3F5007BD2D4CC99450584C640D104F"><enum>(i)</enum><text>be a health care-based, nonprofit education organization that focuses on adoption;</text></clause><clause id="H5A4AA7D2666D44EFAD1D01194577BD67"><enum>(ii)</enum><text>partner with healthcare professionals, hospitals, birthing centers, and community organizations to implement patient-centered care models;</text></clause><clause id="H5B05D5159899421FA6C465E5D94AC89B"><enum>(iii)</enum><text>emphasize holistic parenting support in the perinatal setting; and</text></clause><clause id="HAE9DBC4C237E495283DDF8C33D509479"><enum>(iv)</enum><text>have demonstrated experience providing non-directive education to healthcare professionals supporting expectant parents considering adoption, parenting, and kinship care;</text></clause></subparagraph><subparagraph id="H7EF444503F864C58A8E815F14C3A309B"><enum>(B)</enum><text>shall not—</text><clause id="HA048AB03E4A34551BA6C09BC2BBE2D0F"><enum>(i)</enum><text>be or represent a child-placing agency;</text></clause><clause id="HA2A04621405C4B588E57F2C3C390C6E4"><enum>(ii)</enum><text>provide or refer for abortions; or</text></clause><clause id="H32304063A7784F08B923F10BAE18B63E"><enum>(iii)</enum><text>hold any other vested interest in a particular pregnancy outcome.</text></clause></subparagraph></paragraph><paragraph id="HE5B02CC8B64C4D71963C9EE9815E4A6B"><enum>(2)</enum><header>Application</header><text display-inline="yes-display-inline">To seek such an award, an eligible entity shall submit an application to the Secretary at such time, in such manner, and containing such information and assurances as the Secretary may require.</text></paragraph><paragraph id="H4DB3F673D87349AA91714592290B0AEC"><enum>(3)</enum><header>Period</header><text>The period of such an award shall not exceed 3 fiscal years.</text></paragraph><paragraph id="H55A3773D9C304555AC97E9F1D58912A2"><enum>(4)</enum><header>Reports</header><text>As a condition on receipt of such an award, an eligible entity shall agree to submit to the Secretary each fiscal year a report on the activities carried out through the award. Each such report shall include such information as the Secretary determines is necessary to provide an accurate description of such activities.</text></paragraph><paragraph id="H10A8902001AF4C17AEFC9AC390338AE0"><enum>(5)</enum><header>Supplement not supplant</header><text>Activities carried out using funds made available through such an award shall supplement, and not supplant, activities carried out using other funds made available from the Federal Government or other sources.</text></paragraph></subsection><subsection id="HCBEE9BE8D5D64BB69F89EF0CE3213B41"><enum>(c)</enum><header>Technical assistance; coordination</header><text>The Secretary shall—</text><paragraph id="HA1812D7D3A7649BF97030938D9E69EBB"><enum>(1)</enum><text>provide technical assistance to eligible entities regarding activities carried out through an award under this section; and</text></paragraph><paragraph id="H1BD62E9A4085479DACA05B38C9204E21"><enum>(2)</enum><text>as appropriate, coordinate the provision of education, professional development, and consultation services under subsection (a) with other adoption-related research, professional development, services, and assistance activities carried out by the Department of Health and Human Services.</text></paragraph></subsection><subsection id="H7BBF29DCAC4E44DBB488996FF6CFDB22"><enum>(d)</enum><header>Evaluation</header><paragraph id="HBD13423FB7C94F08B199EB62FF1DB98C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall evaluate the implementation and effectiveness of the activities carried out (directly or through grants or contracts) under this section, including by calculating—</text><subparagraph id="HB5D6D535ED6A4E6FA861BDAC0709855E"><enum>(A)</enum><text>the number of hospitals and birthing centers that implement adoption-sensitive programming and education and professional development as a result of the activities under this section; and</text></subparagraph><subparagraph id="HBFC7CB675C7048C392EA15C638A7DCB9"><enum>(B)</enum><text>the number of care providers who receive adoption education or professional development as a result of the activities under this section.</text></subparagraph></paragraph><paragraph id="HDAB95382B0324177903197FC47E03C6C"><enum>(2)</enum><header>Report to Congress</header><text>Not later than 3 years after the date of enactment of this Act, the Secretary shall complete the evaluation under paragraph (1) and submit to the Congress a report that contains the results of such evaluation, including the calculations under subparagraphs (A) and (B) of paragraph (1).</text></paragraph></subsection></section><section id="H461B0BB1CD7E495292C5E63ABE75D430"><enum>5.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H23C2F1E2B5CD40CC940CA69A881F35A0"><enum>(1)</enum><text>The term <term>birth mother</term> means a woman who places her baby with the adoptive parents and terminates parental rights.</text></paragraph><paragraph id="HA65E357C8F614B1AB386107B64BA45E3"><enum>(2)</enum><text>The term <term>care provider</term> includes any health care personnel (including bedside staff) and ancillary staff who have contact in a hospital or birthing center with expectant mothers, birth mothers, and potential adoptive families.</text></paragraph><paragraph id="HD23E0633E1CD445BB7774FAD199DE185"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>child-placing agency</term> means a business or service conducted, maintained, or operated by a person engaged in finding homes for newborn infants by placing, or arranging for the placement of, such newborn infants for adoption or foster care.</text></paragraph><paragraph id="H1DD764EC0A364D298A0DF30A72D923E6"><enum>(4)</enum><text>The term <term>potential adoptive family</term> means one or more individuals who are actively seeking to adopt a child.</text></paragraph><paragraph id="H8D7260A65D4B4844AD956D8E67CCAB2D"><enum>(5)</enum><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of Health and Human Services.</text></paragraph></section><section id="H5F81108C58CB437F9449359762BC0886"><enum>6.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">To carry out this Act, there is authorized to be appropriated to the Secretary of Health and Human Services $5,000,000 for the period of fiscal years 2026 through 2029.</text></section></legis-body></bill>
