R. 2871</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250410">April 10, 2025</action-date><action-desc><sponsor name-id="M001222">Mr. Miller of Ohio</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Internal Revenue Code of 1986 to restrict the advanced manufacturing production credit with respect to components produced by, or in connection with, foreign entities of concern.</official-title></form><legis-body id="HAF6AA979F37D4C66A4433B4D0AC830B5" style="OLC"><section id="H8E870E7868E447139896B892C2229A17" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safeguarding U.S. Supply Chains Act</short-title></quote>. </text></section><section id="HCB4376EA2EDF4A7DB4D29DCC6614B98B"><enum>2.</enum><header>Restriction on advanced manufacturing production credit with respect to foreign entities of concern</header><subsection id="H50066D652BF54344B16A0301D3191BEA"><enum>(a)</enum><header>Credit not allowed for components produced by foreign entities of concern</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/45X">Section 45X(d)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="HA001CE50B30F4B899CF4D05987B8A9C1" display-inline="no-display-inline"><paragraph id="H152B5393F1E64C77AAAE6F587F26AED8"><enum>(5)</enum><header>Credit not allowed for components produced by foreign entities of concern</header><text display-inline="yes-display-inline">No credit shall be allowed under this section with respect to any eligible component which is produced by a foreign entity of concern (as defined in section 9901(8) of the William M. Mac Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/4651">15 U.S.C. 4651(8)</external-xref>)).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H844016D03FD24D60A2DCBBA18EFAAB67"><enum>(b)</enum><header>Additional restrictions with respect to qualifying battery components</header><text>Section 45X(c)(5) of such Code is amended by adding at the end the following new subparagraph:</text><quoted-block style="OLC" id="H6CE39ADCDA8941DB9821E534C2E08768" display-inline="no-display-inline"><subparagraph id="HCD13E688710D432E8B9522A320A1056A"><enum>(C)</enum><header>Prohibition on certain involvement of foreign entities of concern</header><text display-inline="yes-display-inline">The term <quote>qualifying battery component</quote> shall not include any battery component produced using technology designed, developed, manufactured, licensed, or supplied by a foreign entity of concern (as defined in section 9901(8) of the William M. Mac Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/4651">15 U.S.C. 4651(8)</external-xref>)).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H00757F41406247D2AEBABCCA7C9C37BF"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to components produced and sold after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
