which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of State to revoke the visas of students who have engaged in antisemitic activities, and for other purposes.</official-title></form><legis-body id="HCB36C5A3E8A64F4589F0D94800E37400" style="OLC"><section id="H71E8992D1AC34F4EB62F1236B5234475" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Visas for Anti-Semitic Students Act</short-title></quote>. </text></section><section id="H1DF5BF3E9E124257BD4DBA64DE05FDB8"><enum>2.</enum><header>Visa revocation or denial for students engaging in antisemitic activities</header><subsection id="H49879FD8FF054077AC4E7EF1C746C126"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of State shall revoke or deny a visa under subparagraph (F) or (M) of section 101(a)(15) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)</external-xref>) to any alien who, on or after the date of enactment of this Act—</text><paragraph id="HB4605685AD6D40499D117B913318743D"><enum>(1)</enum><text>engages in prohibited antisemitic conduct; and</text></paragraph><paragraph id="H9EBBDCF65C1544769EAEDB1179BD6F90"><enum>(2)</enum><text>is determined by the Secretary of State, pursuant to section 237(a)(4)(C)(i) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227(a)(4)(C)(i)</external-xref>), to pose potentially serious adverse foreign policy consequences for the United States through such conduct.</text></paragraph></subsection><subsection id="H5A81093D465B47B6AD032060483C81F8"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section: </text><paragraph id="H3F556FA4BCEF47A7BC32B45AE3090805"><enum>(1)</enum><header>Antisemitism</header><text>The term <term>antisemitism</term> means the definition adopted on May 26, 2016, by the International Holocaust Remembrance Alliance, of which the United States is a member, as adopted by the Department of State, including the <quote>contemporary examples of antisemitism</quote> identified therein.</text></paragraph><paragraph id="H06541D747C6B48498D6FA1B4EEA453D2"><enum>(2)</enum><header>Prohibited antisemitic conduct</header><text>The term <term>prohibited antisemitic conduct</term> means—</text><subparagraph id="H18BF56D6B2A04D5393A0B3865B4BFF2B"><enum>(A)</enum><text display-inline="yes-display-inline">engaging in a physical act of violence, vandalism, or harassment targeting a Jewish individual, their property, a community institution, or religious facility, with intent to intimidate or harm based on based on the Jewish identity or affiliation of the individual or property targeted; or</text></subparagraph><subparagraph id="H0424E013A0F743CB8762CC38E13B2C03"><enum>(B)</enum><text> providing material support (including funding, organizing, or inciting) to a person knowing that the person intended to use such support to engage in an act described in subparagraph (A). </text></subparagraph></paragraph></subsection></section><section id="H755619D0CB37471080A58E4824617EB7"><enum>3.</enum><header>Terms of nonimmigrant status for students</header><text display-inline="no-display-inline">Section 214 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" id="HF330DB04C8754FBFBB805E14EC7751FE" display-inline="no-display-inline"><subsection id="H5334FF38427D4136877DE96C86004C2D"><enum>(s)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H992CB376B72B4BD79B7CE7C7BC5BBD97"><enum>(1)</enum><text display-inline="yes-display-inline">An alien may not be granted or maintain nonimmigrant status under subparagraph (F) or (M) of section 101(a)(15) if the alien engages in prohibited antisemitic conduct and the Secretary of State determines, pursuant to section 237(a)(4)(C)(i), that such conduct would have potentially serious adverse foreign policy consequences for the United States.</text></paragraph><paragraph id="H8CA8186774CF4734BBCB637DBCA1D618" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">If the Secretary of State determines that an alien who has been granted nonimmigrant status under subparagraph (F) or (M) of section 101(a)(15) has engaged in prohibited antisemitic conduct, and that, as described in section 237(a)(4)(C)(i), such alien or such alien’s conduct poses potentially serious adverse foreign policy consequences for the United States, the Secretary shall revoke the alien’s visa.</text></paragraph><paragraph id="H0FF24E060C6947E6BE377663DF36C494" indent="up1"><enum>(3)</enum><text>In this subsection:</text><subparagraph id="HAC014F7030794E9585ACB27531066FB3"><enum>(A)</enum><text>The term <term>antisemitism</term> means the definition adopted on May 26, 2016, by the International Holocaust Remembrance Alliance, of which the United States is a member, as adopted by the Department of State, including the <quote>contemporary examples of antisemitism</quote> identified therein.</text></subparagraph><subparagraph id="HADAC7587434E4761A440EE5DD724505E"><enum>(B)</enum><text>The term <term>prohibited antisemitic conduct</term> means— </text><clause id="HDB26EF4536E242B789C57068A3562D69" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">engaging in a physical act of violence, vandalism, or harassment targeting a Jewish individual, their property, a community institution, or religious facility, with intent to intimidate or harm based on based on the Jewish identity or affiliation of the individual or property targeted; or</text></clause><clause id="H46EC53976F5C4D1BB1CD0D7C48FB21C5"><enum>(ii)</enum><text> providing material support (including funding, organizing, or inciting) to a person knowing that the person intended to use such support to engage in an act described in clause (i). </text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
