which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Veterans Affairs to restrict the access and use of veterans’ data by the US DOGE Service and special Government employees, and for other purposes.</official-title></form><legis-body id="HABCE3866AD6F49C6BD764DE4C0B36784" style="OLC"><section id="H13BFA1D4FCBF47D7A60194FEB16BA090" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>VA DATA Access Transparency and Accountability Act of 2025</short-title></quote> or the <quote>VA DATA Act of 2025</quote>.</text></section><section id="H2F3E327B34F94B238ABDDC319291F14E"><enum>2.</enum><header>Restrictions on access of DOGE Service to personal information about veterans</header><subsection id="H2B3A5D341BB843E8B0E9653528BB6884"><enum>(a)</enum><header>Restriction on access</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs may not provide to the Administrator of the United States DOGE Service (commonly referred to as the <quote>Department of Government Efficiency</quote> or <quote>DOGE</quote>) access to any veteran’s data in the possession of the Department of Veterans Affairs.</text></subsection><subsection id="H54A33D47DF444F4A9BE8ED54162DCCDA"><enum>(b)</enum><header>Restriction on use of information</header><text display-inline="yes-display-inline">No special Government employee may access or exfiltrate any veteran’s data in the possession of the Department of Veterans Affairs for the purpose of using such data—</text><paragraph id="H7A796DF02D2942B8B700AEA3027A3F9E"><enum>(1)</enum><text>for commercial gain; or</text></paragraph><paragraph id="H7E93EB6A4AF14C1BAF8D0A199E7414F0"><enum>(2)</enum><text>for any reason other than a governmental purpose authorized by the Secretary.</text></paragraph></subsection><subsection id="H929A0B446AA0465AB4E1162E9491A7DB"><enum>(c)</enum><header>Termination of access</header><text display-inline="yes-display-inline">If any special Government employee acquires access to any system of the Department of Veterans Affairs that contains any veteran’s data, the Secretary shall ensure that upon the termination of the period of service of the special Government employee, such employee—</text><paragraph id="HBB0F0F50396F48E9BD8B4A88431F5433"><enum>(1)</enum><text>returns all such data to the Department of Veterans Affairs; and</text></paragraph><paragraph id="H71AA2AC79FE64D93842C5C54EB74B2CA"><enum>(2)</enum><text>does not retain a copy of any such data.</text></paragraph></subsection><subsection id="H609C53B1C00B4C9EA7B7012CEBBD4209"><enum>(d)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HC99BF1DEB0614A738A487A51094793FD"><enum>(1)</enum><text>The term <quote>special Government employee</quote> has the meaning given such term in section 202(a) of title 18, United States Code.</text></paragraph><paragraph id="HB252370789F2441DB1CDA5D4FC89F79A"><enum>(2)</enum><text display-inline="yes-display-inline">The term <quote>veteran’s data</quote> mean data relating to an individual veteran, including personal health information, personal identifying information, and financial information.</text></paragraph><paragraph id="H538DDF01562B486E9E45BD10AA84384B"><enum>(3)</enum><text display-inline="yes-display-inline">The term <quote>personal health information</quote> means, with respect to a veteran, any information, whether oral or recorded in any form or medium, that is related to—</text><subparagraph id="HD92A1C0D7E5E4D09B52E09462B30BE10"><enum>(A)</enum><text>the health of the veteran, including past, present, or future health;</text></subparagraph><subparagraph id="HA5ADEB26823D46558D4623A6CEBFAD52"><enum>(B)</enum><text>the medical treatment of the veteran, including past, present or future such treatment; or </text></subparagraph><subparagraph id="HD3100318A3B44442911349295D24FDE5"><enum>(C)</enum><text>any payment made or charged to a veteran related to the health or medical treatment of the veteran, including any past, present or future such payment.</text></subparagraph></paragraph><paragraph id="H723A69D4B5224DAEBD770A98FB12873B"><enum>(4)</enum><text display-inline="yes-display-inline">The term <quote>personal identifying information</quote> means, with respect to a veteran, any information, whether oral or recorded in any form or medium, that can be used to uncover the identity of the veteran, including—</text><subparagraph id="HD8C780EDD3DA4E1AA2D9AC2F761C4258"><enum>(A)</enum><text>the name, signature, or initials of the veteran;</text></subparagraph><subparagraph id="HA2130FFB2E9C4A039A8AE8B8417AB615"><enum>(B)</enum><text>the social security number of the veteran;</text></subparagraph><subparagraph id="HC102A34EF5ED4FD99B9523804B43377C"><enum>(C)</enum><text>the drivers license number or passport number of the veteran;</text></subparagraph><subparagraph id="HF82DE8DFC4F44EBAB931DE050208DE4D"><enum>(D)</enum><text>the home or mailing address of the veteran;</text></subparagraph><subparagraph id="H6612FEC29AD84821B35E9075BED2AA1A"><enum>(E)</enum><text>the date of birth of the veteran;</text></subparagraph><subparagraph id="HEE5BE9F367E445CFBFF399A5DD799F0A"><enum>(F)</enum><text>any medical record of the veteran; </text></subparagraph><subparagraph id="H29944F53B5F74937A594B2C3EB4E20A4"><enum>(G)</enum><text>any financial account or credit card number of the veteran; and</text></subparagraph><subparagraph id="H8827AE6034D64E52918829C790AC4F1C"><enum>(H)</enum><text>any biometric records.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
