<subsection id="H1C4CEF1A2E5347B9B1B6D61279104941" commented="no"><enum>(a)</enum><header>Short title</header><text>This Act may be cited as the <quote><short-title>Small Modular Reactor Commercialization Act of 2025</short-title></quote>.</text></subsection> <subsection id="HA1A0A2E71E0D4B0EBF20E047D51121CD" commented="no"><enum>(b)</enum><header>Table of contents</header><text>The table of contents for this Act is as follows:</text>

<section id="HF20FB44F369B4BC5A6AF36E78D978287" commented="no"><enum>2.</enum><header>Treatment of modular reactors with increased efficiency</header><text display-inline="no-display-inline">Paragraph (5)(B) of section 170 b. of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210(b)(5)(B)</external-xref>) is amended by striking <quote>300,000 electrical kilowatts, with a combined rated capacity of not more than 1,300,000 electrical kilowatts</quote> and inserting <quote>500,000 electrical kilowatts, with a combined rated capacity of not more than 1,500,000 electrical kilowatts</quote>.</text></section> <section id="HFAEF7DF0619046448B07BE848E7AEBA8" commented="no"><enum>3.</enum><header>Defined small modular reactor output range</header><text display-inline="no-display-inline">Section 40321(a)(5)(A) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18751">42 U.S.C. 18751(a)(5)(A)</external-xref>) is amended by striking <quote>300</quote> and inserting <quote>500</quote>.</text></section> 
<section id="HD4E05F2B11054F4781C557C2D657C730" commented="no"><enum>4.</enum><header>Published guidance on small modular reactors</header><text display-inline="no-display-inline">The Nuclear Regulatory Commission and Secretary of Energy shall revise Nuclear Regulatory Commission and Department of Energy guidance relating to maximum electrical output of small modular reactors and microreactors to align such guidance with the definitions of small modular reactor and microreactor in section 7 of this Act.</text> </section> <section id="H6488A739A43A4D0599C79BB5E3410A45" commented="no"><enum>5.</enum><header>Financial assistance eligibility for efficient small modular reactor development, demonstration, and deployment</header> <subsection id="H06892F0AF8B946D98BC315B9D2DB7A99"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Secretary of Energy, in providing any funding assistance to support the development, demonstration, or deployment of grid-scale small modular reactors, shall not exclude from award eligibility projects or reactor technologies on the basis that a single reactor unit output exceeds any electrical megawatt threshold between 50 and 500 electrical megawatts.</text></subsection> 
<subsection id="HA8970B9F540C4BD19D09F48DA0D057C8"><enum>(b)</enum><header>Treatment of existing programs</header><text display-inline="yes-display-inline">Nothing in this section shall be construed as limiting the authority of the Secretary of Energy to make awards within the explicit scope of Department of Energy solicitations issued prior to the date of enactment of this Act. </text> </subsection></section> <section id="H46DC7FCB65AC4D1FB762CB195DC0ED29" commented="no"><enum>6.</enum><header>Small modular reactor commercialization and industrialization competitiveness working group</header> <subsection id="H16F2AAB35AD5428D91C4DA0AF083A60E" commented="no"><enum>(a)</enum><header>In general</header><text>The Secretary of Energy shall establish a working group to be known as the <quote>Small Modular Reactor Commercialization and Industrialization Competitiveness Working Group</quote> (in this section referred to as the <quote>Working Group</quote>).</text></subsection> 
<subsection id="H1F5B1DD167814632816836F53EE57C4E" commented="no"><enum>(b)</enum><header>Duties</header><text>The duties of the Working Group shall include the following:</text> <paragraph id="H767501EDE7AB443084BB449C5EE60FE1"><enum>(1)</enum><text>To identify small modular reactor technologies the design for which an application has been submitted or received approval from the Nuclear Regulatory Commission, or a foreign nuclear regulator with a signed memorandum of cooperation with the Nuclear Regulatory Commission.</text></paragraph> 
<paragraph id="H1E5001924AA647E180A99AFB82887FC0" commented="no"><enum>(2)</enum><text>To assess, and recommend initiatives to improve, the ability of the United States to—</text> <subparagraph id="H9DD40F70760A4239A8133FBA8A077C81"><enum>(A)</enum><text>serve as the preeminent geography to commercialize small modular reactor technologies after initial or first-of-a-kind deployment; and</text></subparagraph> 
<subparagraph id="HEE259BAD7B464EB7B9587C1773AAC8F2"><enum>(B)</enum><text>secure and attract long-term manufacturing industrial base investment in small modular reactor fabrication.</text></subparagraph></paragraph> <paragraph id="HB302D057DDCF44F7B3C91D79AA3C3A49" commented="no"><enum>(3)</enum><text>To recommend policy changes that would improve the ability of the United States to host the manufacturing of small modular reactor technologies identified in paragraph (1) that are undergoing first-of-a-kind deployment outside of the United States.</text></paragraph> 
<paragraph id="H79901D82D7734D9A85D6004A10B121C8" commented="no"><enum>(4)</enum><text>To assess, and recommend initiatives to improve, workforce readiness in the United States to enable small modular reactor commercialization at scale.</text></paragraph> <paragraph id="H000B28ED85E8420ABF94211891EDB01D" commented="no"><enum>(5)</enum><text display-inline="yes-display-inline">To identify strategic research objectives supporting industrialization and small modular reactor fabrication cost-reduction following first-of-a-kind reactor deployment. </text></paragraph></subsection> 
<subsection id="HB4A8D391A0824BA49EF254890A968D30" commented="no"><enum>(c)</enum><header>Chairperson</header><text>The Secretary of Energy, or a designee of the Secretary, shall serve as the Chairperson of the Working Group.</text></subsection> <subsection id="HE6A79363BE4C4052935ECBF8280D593F" commented="no"><enum>(d)</enum><header>Membership</header> <paragraph id="H986CB2220BEE422BB986B42DF822501D"><enum>(1)</enum><header>Mandatory members</header><text>The Working Group shall be composed of, at a minimum, representatives from—</text> 
<subparagraph id="H05DE0B894B7246C1B4D8ECE48D93759E"><enum>(A)</enum><text display-inline="yes-display-inline">the Department of Energy (including, as the Secretary of Energy determines appropriate, offices in such Department, such as the Office of Nuclear Energy and any National Laboratory); </text></subparagraph> <subparagraph id="HECE9190D4BE4478EA3E87FB2BA108367"><enum>(B)</enum><text>the Department of Defense;</text></subparagraph> 
<subparagraph id="HFC71674933C84FBEB71B7ABC3957BE0D"><enum>(C)</enum><text>the Department of State;</text></subparagraph> <subparagraph id="H328163AC90D242B18E816E8A863FBAE4"><enum>(D)</enum><text>the Department of Commerce;</text></subparagraph> 
<subparagraph id="H813AB8EBEA5242799E3AD86E9C2777CD"><enum>(E)</enum><text>the Department of the Interior; </text></subparagraph> <subparagraph id="H04FFEAAEC7FA417D9E6C79E028A4CD07"><enum>(F)</enum><text>the Department of the Treasury; and</text> </subparagraph> 
<subparagraph id="H827DE530A08E4F339D2949FC606C48CC"><enum>(G)</enum><text display-inline="yes-display-inline">the Nuclear Regulatory Commission. </text></subparagraph></paragraph> <paragraph id="HFE860450F06F4CB4BD5494BC8BE51A86"><enum>(2)</enum><header>Additional members</header><text>The Secretary of Energy may add members to the Working Group, as the Secretary determines appropriate. </text> </paragraph> </subsection> 
<subsection id="H0D4C38AFF05B48C2B39D5AD07E794E49" commented="no"><enum>(e)</enum><header>Annual report</header><text display-inline="yes-display-inline">Not later than December 1 of each year through 2030, the Secretary of Energy shall submit a report to the Committees on Science, Space, and Technology and Energy and Commerce of the House of Representatives and the Committee on Energy and Natural Resources of the Senate on the findings and recommendations of the Working Group.</text></subsection></section> <section id="H5C9F18F7D32D40DA89DD1561FB21E75F" commented="no"><enum>7.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="HD94854F6670F4CD2B7077DF959C16034" commented="no"><enum>(1)</enum><header>Advanced nuclear reactor</header><text>The term <term>advanced nuclear reactor</term> has the meaning given such term in section 951(b)(1) of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16271">42 U.S.C. 16271(b)(1)</external-xref>).</text></paragraph> <paragraph id="HB60355685844416EB2A9DB0FFF4D04D4" commented="no"><enum>(2)</enum><header>Microreactor</header><text>The term <term>microreactor</term> means an advanced nuclear reactor with a rated capacity of less than 50 electrical megawatts.</text></paragraph> 
<paragraph id="H9739B6CC18E8489090D6DC83D3E78491" commented="no"><enum>(3)</enum><header>Small modular reactor</header><text>The term <term>small modular reactor</term> means an advanced nuclear reactor—</text> <subparagraph id="H172F7879643A4858A7CFBB739F607B3E" commented="no"><enum>(A)</enum><text>with a rated capacity of less than 500 electrical megawatts; and</text></subparagraph> 
<subparagraph id="HD7C85285B295488D8B2D13B93264335C" commented="no"><enum>(B)</enum><text>that can be constructed and operated in combination with similar reactors at a single site.</text></subparagraph></paragraph></section> </legis-body></bill>
