R. 280</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250109">January 9, 2025</action-date><action-desc><sponsor name-id="H001096">Ms. Hageman</sponsor> (for herself, <cosponsor name-id="M001204">Mr. Meuser</cosponsor>, and <cosponsor name-id="M001205">Mrs. Miller of West Virginia</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Secretary of the Interior to take certain actions with respect to certain qualified coal applications, and for other purposes.</official-title></form><legis-body id="HF34AE36867ED43A68B77906F6D376935" style="OLC"><section id="H62E2E131372442FC8550098B0A8FD380" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Combating Obstruction Against Leasing Act of 2025</short-title></quote> or the <quote><short-title>COAL Act of 2025</short-title></quote>.</text></section><section id="H95521C0E86544C31961EAFF6CC0C437B" section-type="subsequent-section"><enum>2.</enum><header>Leasing for certain qualified coal applications</header><subsection id="H552D9A81CC8B48B48C0A897A80E0A398"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H93110267FC8648F9ABA57D008692062E"><enum>(1)</enum><header>Coal lease</header><text display-inline="yes-display-inline">The term <term>coal lease</term> means a lease entered into by the United States as lessor, through the Bureau of Land Management, and the applicant on Bureau of Land Management Form 3400–012.</text></paragraph><paragraph id="H81ABF50BE786473DBC7C74491A62959E"><enum>(2)</enum><header>Qualified application</header><text display-inline="yes-display-inline">The term <term>qualified application</term> means any application pending under the lease by application program administered by the Bureau of Land Management pursuant to the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/181">30 U.S.C. 181 et seq.</external-xref>) and subpart 3425 of title 43, Code of Federal Regulations (as in effect on the date of the enactment of this Act), for which the environmental review process under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) has commenced.</text></paragraph></subsection><subsection id="H29ABBF338E4240D4BC70F4C09C5D7FFC"><enum>(b)</enum><header>Mandatory leasing and other required approvals</header><text display-inline="yes-display-inline">As soon as practicable after the date of the enactment of this Act, the Secretary shall promptly—</text><paragraph id="H1FB2C2614E79492E8ABFC9BC26336F53"><enum>(1)</enum><text>with respect to each qualified application—</text><subparagraph id="HD36F31BE0E0A41DEA8C53AD177B3C451"><enum>(A)</enum><text display-inline="yes-display-inline">if not previously published for public comment, publish a draft environmental assessment, as required under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) and any applicable implementing regulations;</text></subparagraph><subparagraph id="H352F39115FED4B7BB34BD741AD6BCE1E"><enum>(B)</enum><text display-inline="yes-display-inline">finalize the fair market value of the coal tract for which a lease by application is pending;</text></subparagraph><subparagraph id="H2C76479764DA49ECAB0D2B9559BBDA63"><enum>(C)</enum><text display-inline="yes-display-inline">take all intermediate actions necessary to grant the qualified application; and</text></subparagraph><subparagraph id="H7F16F387EDAA42489B25CFCBB89EFDED"><enum>(D)</enum><text display-inline="yes-display-inline">grant the qualified application; and</text></subparagraph></paragraph><paragraph id="H5AE00400861843F08D7A603943B36895"><enum>(2)</enum><text display-inline="yes-display-inline">with respect to previously awarded coal leases, grant any additional approvals of the Department of the Interior or any bureau, agency, or division of the Department of the Interior required for mining activities to commence.</text></paragraph></subsection></section><section id="H2CDCB15E7AFA4B0C9AF94C4ECF6D5FA8"><enum>3.</enum><header>Future coal leasing</header><text display-inline="no-display-inline">Notwithstanding any judicial decision to the contrary or a departmental review of the Federal coal leasing program, Secretarial Order 3338, issued by the Secretary of the Interior on January 15, 2016, shall have no force or effect.</text></section></legis-body></bill>
