display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Homebuyers Privacy Protection Act</short-title></quote>.</text></section><section id="H51ABBD8799FE48A29CDA922F35A483B3"><enum>2.</enum><header>Treatment of prescreening report requests</header><subsection id="HB2CC3DBA9968410C92092BE41350E1D5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 604(c) of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681b">15 U.S.C. 1681b(c)</external-xref>) is amended by adding at the end the following:</text><quoted-block id="HB7A1FFBBB2A14BDBA4C91E81FBEB80E4" style="OLC" changed="added" reported-display-style="italic" committee-id="HBA00"><paragraph id="H8E30B0D1CB734729BDD7922E029563A3"><enum>(4)</enum><header>Treatment of prescreening report requests</header><subparagraph id="H63A6D39623E94A93A36DECCC0EA4B4E4"><enum>(A)</enum><header>Definitions</header><text>In this paragraph:</text><clause id="H442BC28CA0724808B9FF3D45CE2A255A"><enum>(i)</enum><header>Credit union</header><text>The term <quote>credit union</quote> means a Federal credit union or a State credit union, as those terms are defined, respectively, in section 101 of the Federal Credit Union Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1752">12 U.S.C. 1752</external-xref>).</text></clause><clause id="H42B3A2CE961F4E93B12AB02F6E318903"><enum>(ii)</enum><header>Insured depository institution</header><text>The term <quote>insured depository institution</quote> has the meaning given the term in section 3 of the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1813">12 U.S.C. 1813(c)</external-xref>).</text></clause><clause id="H94E4EE35D1D741A9969333D78B3EEDCB"><enum>(iii)</enum><header>Residential mortgage loan</header><text>The term <quote>residential mortgage loan</quote> has the meaning given the term in section 1503 of the S.A.F.E. Mortgage Licensing Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/12/5102">12 U.S.C. 5102</external-xref>).</text></clause><clause id="HAF530C714A3340B091DFDED61D853504"><enum>(iv)</enum><header>Servicer</header><text>The term <quote>servicer</quote> has the meaning given the term in section 6(i) of the Real Estate Settlement Procedures Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/12/2605">12 U.S.C. 2605(i)</external-xref>).</text></clause></subparagraph><subparagraph id="H869FDF94178245EC8C8C1A64F2160BAF"><enum>(B)</enum><header>Limitation</header><text>If a person requests a consumer report from a consumer reporting agency in connection with a credit transaction involving a residential mortgage loan, that agency may not, based in whole or in part on that request, furnish a consumer report to another person under this subsection unless—</text><clause id="HDFFC8DEF7E72442CAAEC5FADA3DA82E7"><enum>(i)</enum><text>the transaction consists of a firm offer of credit or insurance; and</text></clause><clause id="HCC356173131F4D4E852D98614DEC6203"><enum>(ii)</enum><text>that other person—</text><subclause id="HFB863976FED747AA805D7466D45ABBDC"><enum>(I)</enum><text>has submitted documentation to that agency certifying that such other person has, pursuant to paragraph (1)(A), the authorization of the consumer to whom the consumer report relates; or</text></subclause><subclause id="H3BF12510C66A4AA0AEE3D2DB9BD7AED5"><enum>(II)</enum><item commented="no" display-inline="yes-display-inline" id="HC7A659A825E84CA395348AFA2650B35F"><enum>(aa)</enum><text>has originated a current residential mortgage loan of the consumer to whom the consumer report relates;</text></item><item id="HD01F4D47BE0D4AB89F5F8F993F906E28" indent="up1"><enum>(bb)</enum><text>is the servicer of a current residential mortgage loan of the consumer to whom the consumer report relates; or</text></item><item id="H980172E895264417B1865C90CD7AC1A6" indent="up1"><enum>(cc)</enum><subitem commented="no" display-inline="yes-display-inline" id="H3C9284AD59CA4DCB97D92973842E33F5"><enum>(AA)</enum><text>is an insured depository institution or credit union; and</text></subitem><subitem id="H150EE91DE9CE49C689141CBB5E58C436" indent="up1"><enum>(BB)</enum><text>holds a current account for the consumer to whom the consumer report relates.</text></subitem></item></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H8D869A4AAF19427D9D0E3DFA3B7C0CE2"><enum>3.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act, and the amendments made by this Act, shall take effect on the date that is 180 days after the date of enactment of this Act.</text></section><section id="H899BFE5D67B847AA832748656EF32CCD"><enum>4.</enum><header>GAO study</header><subsection id="H397E572E46424D5A9A8BA983CA0B401F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Comptroller General of the United States shall carry out a study on the value of trigger leads received by text message that includes input from State regulatory agencies, mortgage lenders, depository institutions (as defined in section 3 of the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1813">12 U.S.C. 1813</external-xref>)), consumer reporting agencies (as defined in section 603 of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681a">15 U.S.C. 1681a</external-xref>)), and consumers. </text></subsection><subsection id="HE8499843B79A4B1A932122D1D7229595" display-inline="no-display-inline"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than the end of the 12-month period beginning on the date of enactment of this Act, the Comptroller General shall submit to Congress a report containing any findings and determinations made in the study required by subsection (a).</text></subsection></section></legis-body><endorsement display="yes"><action-date date="20250620">June 20, 2025</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc></endorsement></bill>
