<section section-type="section-one" id="H6A10EFAB497348449AD2A15FA20D550B"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Election Administration from Interference Act of 2025</short-title></quote>.</text></section> <section id="H182FF214D65349B5AD5D1A7BDA8BC9D2"><enum>2.</enum><header>Enhancement of protections for election records, papers, and equipment</header> <subsection id="H212D044CF9FB48329EFE3D9A6FC56A50"><enum>(a)</enum><header>Preservation of records, paper, and equipment</header><text display-inline="yes-display-inline">Section 301 of the Civil Rights Act of 1960 (<external-xref legal-doc="usc" parsable-cite="usc/52/20701">52 U.S.C. 20701</external-xref>) is amended—</text> 
<paragraph id="H3474C20020C64A56BD98A59E64A73F66"><enum>(1)</enum><text>by striking <quote>Every officer</quote> and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H5412DF6EC1AA44C5A71CBDE7CB780D34"> <subsection id="H6FB6607C02CC4F1FB378959D8F524B36"><enum>(a)</enum><header>In general</header><text>Every officer</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H59BCD6C15DD14EB9812BCF5126AD73D4"><enum>(2)</enum><text>by striking <quote>records and papers</quote> and inserting <quote>records (including electronic records), papers, and election equipment</quote> each place the term appears; </text></paragraph> <paragraph id="H6F3D1A1ACD6B48269BEC5EFAF037EE30"><enum>(3)</enum><text>by striking <quote>record or paper</quote> and inserting <quote>record (including electronic record), paper, or election equipment</quote>;</text></paragraph> 
<paragraph id="H06689AEC7DB142DEAADDA88321DB5F13"><enum>(4)</enum><text>by inserting <quote>(but only under the direct administrative supervision of an election officer). Notwithstanding any other provision of this section, the paper record of a voter’s cast ballot shall remain the official record of the cast ballot for purposes of this title</quote> after <quote>upon such custodian</quote>; </text></paragraph> <paragraph id="H967E4F6B39084AC99191AFB4871E5977"><enum>(5)</enum><text>by inserting <quote>, or acts in reckless disregard of,</quote> after <quote>fails to comply with</quote>; and</text></paragraph> 
<paragraph id="H001DD2576952488FAFEB177D94EF57EC"><enum>(6)</enum><text>by inserting after subsection (a) the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H2C6D9FDEC9044CDB8E3110AEA6711601"> <subsection id="HD0BF0187A5AA46C9AE7617CB2E54BF45"><enum>(b)</enum><header>Election equipment</header><text>The requirement in subsection (a) to preserve election equipment shall not be construed to prevent the reuse of such equipment in any election that takes place within twenty-two months of a Federal election described in subsection (a), provided that all electronic records, files, and data from such equipment related to such Federal election are retained and preserved.</text></subsection> 
<subsection id="H0D4D4C10FB5344F68CA55CCB3F5218AA"><enum>(c)</enum><header>Guidance</header><text>Not later than 1 year after the date of the enactment of this subsection, the Director of the Cybersecurity and Infrastructure Security Agency of the Department of Homeland Security, in consultation with the Election Assistance Commission and the Attorney General, shall issue guidance regarding compliance with subsections (a) and (b), including minimum standards and best practices for retaining and preserving records (including electronic records), papers, and election equipment in compliance with subsections (a) and (b). Such guidance shall also include protocols for enabling the observation of the preservation, security, and transfer of records (including electronic records), papers, and election equipment described in subsection (a) by the Attorney General and by a representative of each party, as defined by the Attorney General.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H93B458A1947A4DE9960356392B46F4A9"><enum>(b)</enum><header>Penalty</header><text>Section 302 of the Civil Rights Act of 1960 (<external-xref legal-doc="usc" parsable-cite="usc/52/20702">52 U.S.C. 20702</external-xref>) is amended—</text> 
<paragraph id="HF6B5215C1C7F4928BDF19672F0A5E362"><enum>(1)</enum><text>by inserting <quote>, or whose reckless disregard of section 301 results in the theft, destruction, concealment, mutilation, or alteration of,</quote> after <quote>or alters</quote>; and</text></paragraph> <paragraph id="H3E2033A6E28B466E94A51916D33B1CA5"><enum>(2)</enum><text>by striking <quote>record or paper</quote> and inserting <quote>record (including electronic record), paper, or election equipment</quote>.</text></paragraph></subsection> 
<subsection id="H8E0D913B0C3B426FB89D2B997784B91E"><enum>(c)</enum><header>Inspection, reproduction, and copying</header><text>Section 303 of the Civil Rights Act of 1960 (<external-xref legal-doc="usc" parsable-cite="usc/52/20703">52 U.S.C. 20703</external-xref>) is amended by striking <quote>record or paper</quote> and inserting “record (including electronic record), paper, or election equipment” each place the term appears.</text></subsection> <subsection id="H72B9B947A1484E9480429FA07DB363A4"><enum>(d)</enum><header>Nondisclosure</header><text>Section 304 of the Civil Rights Act of 1960 (<external-xref legal-doc="usc" parsable-cite="usc/52/20704">52 U.S.C. 20704</external-xref>) is amended by striking <quote>record or paper</quote> and inserting “record (including electronic record), paper, or election equipment”.</text></subsection> 
<subsection id="HDB397330846F4E24B314CCA095484A09" commented="no"><enum>(e)</enum><header>Jurisdiction To compel production</header><text>Section 305 of the Civil Rights Act of 1960 (<external-xref legal-doc="usc" parsable-cite="usc/52/20705">52 U.S.C. 20705</external-xref>) is amended by striking <quote>record or paper</quote> and inserting “record (including electronic record), paper, or election equipment” each place the term appears.</text></subsection></section> <section id="H6CA9E7E2DDD34705B6B7AE1EBC9EBE0E"><enum>3.</enum><header>Judicial review for election records</header><text display-inline="no-display-inline">Title III of the Civil Rights Act of 1960 (<external-xref legal-doc="usc" parsable-cite="usc/52/20701">52 U.S.C. 20701 et seq.</external-xref>), is amended—</text> 
<paragraph id="H6241CAE0AB964DA5B1EB8ABC477BAB1C"><enum>(1)</enum><text>by redesignating section 306 as section 307; and</text></paragraph> <paragraph id="H307507BDD5814414B7D4E8C192143C74"><enum>(2)</enum><text>by inserting after section 305 the following:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="H5DFBF6824CE14C5BAA015F516E824DEB"> 
<section id="H2C4FBC0CE1884F5A874006722F0B286F"><enum>306.</enum><header>Judicial review to ensure compliance</header> 
<subsection id="H6B5F0E5D7E2748B98E1181E330A471E3"><enum>(a)</enum><header>Right of action</header><text>The Attorney General, a representative of the Attorney General, or a candidate in a Federal election described in section 301 may bring an action in the district court of the United States for the judicial district in which a record (including electronic record), paper, or election equipment is located, or in the United States District Court for the District of Columbia, to compel compliance with the requirements of section 301.</text></subsection> <subsection id="HAD2F789F50CC41F7AACFACF9E88FB937"><enum>(b)</enum><header>Duty To expedite</header><text>It shall be the duty of the court to advance on the docket, and to expedite to the greatest possible extent the disposition of, the action and appeal under this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HF552B04B52F94710A5D709F4B1057B90"><enum>4.</enum><header>Criminal penalties for intimidation of tabulation, canvass, or certification efforts</header><text display-inline="no-display-inline">Section 12(1) of the National Voter Registration Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/52/20511">52 U.S.C. 20511(1)</external-xref>) is amended—</text> <paragraph id="H2C6C8554F06E4FD0B30229F5753EE0E5"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking <quote>or</quote> at the end; and</text></paragraph> 
<paragraph id="HAADBD07C3F72408F85731E4860DC0096"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following: </text> <quoted-block style="OLC" display-inline="no-display-inline" id="H34BF9ED7D7404DF3AA3451BD53A4E488"> <subparagraph id="H25C864B544AE485E8F3E00B7743B853E"><enum>(D)</enum><text display-inline="yes-display-inline">processing or scanning ballots, or tabulating, canvassing, or certifying voting results; or</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
