<section section-type="section-one" id="H164F48A93106436EA78C4A28F79EDDC4"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Medicare Audiology Access Improvement Act of 2025</short-title></quote>.</text></section> <section id="H6A823847B13948BE83FD5414FC76A3CB" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header>Coverage of audiology services under the Medicare program</header> <subsection id="H100F7787CDD2476F95AC9D5CA016BE77"><enum>(a)</enum><header>In general</header><text>Section 1861(s)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(s)(2)</external-xref>) is amended—</text> 
<paragraph id="HF6157A5F8BF04EC09BBD58EA92044D4A"><enum>(1)</enum><text>in subparagraph (JJ), by striking the semicolon at the end and inserting <quote>; and</quote>; and</text></paragraph> <paragraph id="H77CD27D9487F492DA8F484AF0321DC2B"><enum>(2)</enum><text>by adding at the end the following new subparagraph:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="HC1E47D6864E34D35ABBFF5078DC1F8E7"> 
<subclause id="H95B83BFAEC9E46A493BE532775B4D6D0" indent="up3"><enum>(KK)</enum><text>audiology services (as defined in subsection (ll)(3));</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H4ECDD90CA0F84AE1A00E79060E0BEDD9"><enum>(b)</enum><header>Improved access to audiology services</header><text>Paragraph (3) of section 1861(ll) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(ll)</external-xref>) is amended to read as follows:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="HEC6ECA0CFF84419585073AA5B9F4F810"> 
<paragraph id="H02BE33C7C05744AD8392796A5DE43471" indent="up1"><enum>(3)</enum><text>The term <term>audiology services</term> means such hearing and balance assessment services furnished on or before December 31, 2026, and beginning January 1, 2027, such diagnostic or treatment services furnished by a qualified audiologist which the qualified audiologist is legally authorized to perform under State law (or the regulatory mechanism provided by State law), as would otherwise be covered if furnished by a physician or as incident to a physician’s service. A qualified audiologist shall be permitted to furnish such audiology services without regard to any requirement that the individual receiving such audiology services is under the care of (or referred by) a physician or other health care practitioner or that such services are furnished under the supervision of a physician or other health care practitioner.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H2BCF2DFC310940799A67A23A48F9595F" commented="no"><enum>(c)</enum><header>Payment amount and coinsurance</header><text>Section 1833(a)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(a)(1)</external-xref>) is amended—</text> 
<paragraph id="H3D74CF8983EC4B0E9ADE6E66AA6B33AE" commented="no"><enum>(1)</enum><text>by striking <quote>and</quote> before (HH); and</text></paragraph> <paragraph id="H1E3E9CFEC6574538AD911C1C63B0D630" commented="no"><enum>(2)</enum><text>by inserting the following before the semicolon: <quote>and (II) with respect to audiology services furnished under section 1861(s)(2)(KK), the amounts paid shall be 80 percent of the lesser of the actual charge for the services or the fee schedule amount provided under section 1848</quote>.</text></paragraph></subsection> 
<subsection id="H6B8BB1CEC7D64DCE9762ECBAE3C3DF59" commented="no"><enum>(d)</enum><header>Payment on assignment-Related basis</header><text>Section 1842(b)(18)(C) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395u">42 U.S.C. 1395u(b)(18)(C)</external-xref>) is amended by adding at the end the following new clause:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H6BF94CC395BC4F2AB57D2B418B745C41"> <clause id="H2057D032FD9D4AF1ACA82DA4838533D4" commented="no"><enum>(ix)</enum><text>A qualified audiologist (as defined in section 1861(ll)(4)(B)).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H3BBAAB1F0A50458C9C98D3112BA38DCB" commented="no"><enum>(e)</enum><header>Inclusion of qualified audiologists as RHC and FQHC practitioners</header><text display-inline="yes-display-inline">Section 1861(aa)(1)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(aa)(1)(B)</external-xref>) is amended by inserting <quote>by a qualified audiologist (as defined in subsection (ll)(4)(B)),</quote> after <quote>(as defined in subsection (hh)(1)),</quote>.</text></subsection> <subsection id="H9010BB77BB4B4FBF94D8061DC82BBD2C"><enum>(f)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in the amendments made by this section shall be construed to expand the scope of audiologist services or services for which payment may be made to other providers under title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395 et seq.</external-xref>) beyond those services for which such payment may be made as of December 31, 2026.</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H7FEBC421CF9E45B791918D41C1758F29"><enum>(g)</enum><header>Effective date</header><text>The amendments made by this section shall apply to items and services furnished on or after January 1, 2027.</text></subsection></section> </legis-body></bill>
