R. 274</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250109">January 9, 2025</action-date><action-desc><sponsor name-id="G000590">Mr. Green of Tennessee</sponsor> (for himself, <cosponsor name-id="B001302">Mr. Biggs of Arizona</cosponsor>, <cosponsor name-id="Z000018">Mr. Zinke</cosponsor>, <cosponsor name-id="H001077">Mr. Higgins of Louisiana</cosponsor>, <cosponsor name-id="O000175">Mr. Ogles</cosponsor>, <cosponsor name-id="C001129">Mr. Collins</cosponsor>, <cosponsor name-id="C001115">Mr. Cloud</cosponsor>, <cosponsor name-id="R000603">Mr. Rouzer</cosponsor>, <cosponsor name-id="O000086">Mr. Owens</cosponsor>, <cosponsor name-id="F000470">Mrs. Fischbach</cosponsor>, and <cosponsor name-id="B001317">Mr. Brecheen</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name>, and in addition to the Committees on <committee-name committee-id="HGO00">Oversight and Government Reform</committee-name>, and <committee-name committee-id="HRU00">Rules</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide for the sunset of rules upheld based on Chevron deference.</official-title></form><legis-body id="HFBA1AFD908F244209438B55176A09B5C" style="OLC"><section id="H07E9369796E24566952AED287C5C3552" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Sunset Chevron Act</short-title></quote>.</text></section><section id="HFB3CBA146880483E932E97F40DAEAE4D"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HDDD65FB8EE8F49409F493A2F8A28DCDA"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>Chevron deference</term> means the legal doctrine of judicial deference pursuant to Chevron U.S.A., Inc. v. Natural Resources Defense Council, Inc. (467 U.S. 837 (1984)). </text></paragraph><paragraph id="HE44FE754D14F454898348B0877738332"><enum>(2)</enum><text>The term <term>sunset date</term> means the date on which a rule will cease to have force or effect.</text></paragraph><paragraph id="HDCB1000F783344E3BBF3C9D0017EDA74"><enum>(3)</enum><text>The term <term>rule</term> has the meaning given such term in section 551 of title 5, United States Code. </text></paragraph></section><section id="HBDAEA844B57946B38845FBE9C1D76162"><enum>3.</enum><header>GAO Review of Rules Upheld by Chevron Deference</header><subsection id="H54DD21D6BC4648808F29692B6E01985F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Comptroller General of the United States shall compile and publish a list of each decision issued by a Federal court that—</text><paragraph id="H3B03D24279A74D79B4A53F6605794A59"><enum>(1)</enum><text>upheld a rule based on Chevron deference;</text></paragraph><paragraph id="H6E7A9143F54A45BC8DAF78BBE46CE524"><enum>(2)</enum><text>was not subsequently overturned; and</text></paragraph><paragraph id="H6DE5610A76624C2B846479EFA23BFC79"><enum>(3)</enum><text>pertains to a rule that is in effect on the date of enactment of this Act. </text></paragraph></subsection><subsection id="H303270EF56BC451D945F345508BD2394"><enum>(b)</enum><header>Organization of list</header><text>Such list shall—</text><paragraph id="H88ACB493AA4A48A4A1F1A70A650FFD1F"><enum>(1)</enum><text display-inline="yes-display-inline">be organized by the agency that made the rule, and for each such agency, the list shall be in reverse chronological order of the date on which the agency made the relevant rule; and</text></paragraph><paragraph id="HFE8C5BAA1798450AA2069BAF697F44F9"><enum>(2)</enum><text display-inline="yes-display-inline">provide a sunset date for each rule.</text></paragraph></subsection><subsection id="HBEBE432688DB4A98BC288101E6D2EAF9"><enum>(c)</enum><header>Sunset date calculation</header><text>The Comptroller General shall calculate the sunset date for each rule identified in the list compiled under subsection (a) as follows:</text><paragraph id="HE309F34B390842868A859E943A6486FC"><enum>(1)</enum><text display-inline="yes-display-inline">The sunset date for the most recent rule made by each agency and identified in the list under subsection (a) shall be on the date that is 30 days after the list under subsection (a) is published.</text></paragraph><paragraph id="H75C1CBD5343E4C5885D2736A154CA90F"><enum>(2)</enum><text>The sunset date for each prior rule made by such agency and identified in the list under subsection (a) shall be 30 days after the sunset date of the rule made by such agency and identified in such list that precedes such prior rule. </text></paragraph></subsection></section><section id="H690C76FC90A44B1F8887451A98A3E3A1" commented="no"><enum>4.</enum><header>Exception to the CRA to the 6-Legislative-Day Window for Certain Rules</header><text display-inline="no-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/8">Chapter 8</external-xref> of title 5, United States Code, shall apply to each rule identified under section 3, except that the 60-day period for filing a joint resolution under section 802(a) of that title shall not apply. </text></section></legis-body></bill>
