which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To assist State and Tribal governments in assessing and remediating mold, and for other purposes.</official-title></form><legis-body id="HA77B2716EFF14CB98441F215F1D64B02" style="OLC"><section id="H8EB949C5AA6B429E925698580495B8AA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fix Moldy Housing Act</short-title></quote>.</text></section><section id="H9A6D9F16AB0045088AAC960934641A8F"><enum>2.</enum><header>Study on conditions in which mold assessment and remediation is warranted</header><subsection id="H461C12B7FDFE423D8437056D85842A39"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator of the Environmental Protection Agency shall enter into an arrangement with the National Academies of Sciences, Engineering, and Medicine to conduct a study on—</text><paragraph id="HE1E6FDFEFFB647819A2003590C8D604E"><enum>(1)</enum><text>the conditions in which indoor mold assessment and remediation is warranted; and</text></paragraph><paragraph id="HBD5DF9B5149F43869D1313A34181A0A6"><enum>(2)</enum><text display-inline="yes-display-inline">how to assess and remediate indoor mold properly and safely.</text></paragraph></subsection><subsection id="HB99BE6ECBAF84A04A6FF2A3156A17B00"><enum>(b)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act—</text><paragraph id="H717B583336274E96B1F8B604662AB811"><enum>(1)</enum><text>the study under subsection (a) shall be completed; and</text></paragraph><paragraph id="HD18FF516021E479586823445889B7B96"><enum>(2)</enum><text display-inline="yes-display-inline">the Administrator shall submit a report to the Congress on the results of such study.</text></paragraph></subsection></section><section id="H94083134400E4586A568EF7C55271E72"><enum>3.</enum><header>Standards for assessing and remediating mold</header><subsection id="H739AF053EBEF4FD584DBBABF49356E8D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, the Administrator, in conjunction with the heads of appropriate Federal agencies, shall issue nonbinding national standards that—</text><paragraph id="HD087966C36E640DBB9147A43AC1CED84"><enum>(1)</enum><text display-inline="yes-display-inline">identify levels of mold that should be assessed and remediated; and</text></paragraph><paragraph id="H13160945C2794A71ABB83341C7888985"><enum>(2)</enum><text>outline standards for—</text><subparagraph id="H908F6346F65046B0902D402FDB702E23"><enum>(A)</enum><text display-inline="yes-display-inline">properly and safely assessing mold; and</text></subparagraph><subparagraph id="HD459F7AAB8534438AED5005C0063A3D8"><enum>(B)</enum><text display-inline="yes-display-inline">properly and safely remediating mold.</text></subparagraph></paragraph></subsection><subsection id="HDEE9307128E04447A280F4D4CC43BB00"><enum>(b)</enum><header>Consideration</header><text display-inline="yes-display-inline">In issuing the standards under subsection (a), the Administrator shall take into consideration the results of the study conducted under section 2.</text></subsection></section><section id="HCFB607E1AE98432B9F002C6A82D9D38E"><enum>4.</enum><header>Program to assist State and Tribal governments with assessing and remediating mold</header><subsection id="H52FEB1C1465448B99BC8B58D4BA84B22"><enum>(a)</enum><header>Program</header><text display-inline="yes-display-inline">Taking into consideration the results of the study under section 2 and the national standards under section 3, the Administrator shall carry out a program to assist State and Tribal governments in carrying out programs and activities to assess and remediate mold.</text></subsection><subsection id="H9F49C6204A044CC5849618249C99A291"><enum>(b)</enum><header>Grants</header><paragraph id="HE45EF4A22CDB4A5E91F0FE12A6D21155"><enum>(1)</enum><header>Authorization</header><text display-inline="yes-display-inline">In carrying out the program under subsection (a), the Administrator shall award grants to State and Tribal governments to establish a licensing program for persons engaged in assessing and remediating mold.</text></paragraph><paragraph id="H00D66725D87E4F65B89FC3C406F4F0E1"><enum>(2)</enum><header>Permissible use</header><text>A grant awarded under paragraph (1) may be used to pay the costs of operating a licensing program described in paragraph (1), including administrative costs.</text></paragraph><paragraph id="H6BC308BB3C3F44B1872404628945CE7B"><enum>(3)</enum><header>Preference</header><text display-inline="yes-display-inline">In awarding grants under paragraph (1), the Administrator shall give preference to State and Tribal governments that include geographic areas that are highly susceptible to indoor mold contamination based on—</text><subparagraph id="H1F81FAD64C47423880DA1EB5754F84B4"><enum>(A)</enum><text display-inline="yes-display-inline">the national standards established under section 3;</text></subparagraph><subparagraph id="HA927E96C87C7407EA904EC31753F2AEA"><enum>(B)</enum><text>outdoor environmental conditions, such as humidity; or</text></subparagraph><subparagraph id="H097EAF7CD4CB41AFA6F4ADC53BCD9D90"><enum>(C)</enum><text>other factors identified by the Administrator.</text></subparagraph></paragraph></subsection><subsection id="HB7DB203147D448E5A90266543DCB7265"><enum>(c)</enum><header>Technical assistance</header><text display-inline="yes-display-inline">In carrying out the program under subsection (a), the Administrator shall provide technical assistance to State and Tribal programs to assess and remediate mold.</text></subsection><subsection id="HBD818C1C1FD14579BA7F51648A6D83C5"><enum>(d)</enum><header>Training program</header><text display-inline="yes-display-inline">In carrying out the program under subsection (a), the Administrator shall administer training seminars on assessing and remediating mold.</text></subsection><subsection id="HCEA0BB3FF7FB40BDA2FBAE5C44E1B33F"><enum>(e)</enum><header>Authorization of appropriations</header><text>To carry out this section, there is authorized to be appropriated $50,000,000 for each of fiscal years 2026 through 2030.</text></subsection></section><section id="HE2CFA4787C824C51A48248696DCAB68B"><enum>5.</enum><header>Grants for assessment and remediation of mold in public buildings and severely impacted homes</header><subsection id="HC5BD6C7E20204973B8724458B2DB2FB4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator shall award grants to State and Tribal governments to cover the costs associated with assessing and remediating mold in—</text><paragraph id="H02906B516D354ADCAA42579C35CF0814"><enum>(1)</enum><text display-inline="yes-display-inline">buildings owned or leased by such governments, including schools and housing; and</text></paragraph><paragraph id="H6506A97C54204CA8B38AE6DA71B77435"><enum>(2)</enum><text display-inline="yes-display-inline">private residential properties, including single family and multifamily properties.</text></paragraph></subsection><subsection id="H79043BBA44F04E67A4ECBB3EFAB659A0"><enum>(b)</enum><header>Additional permissible uses of funds</header><text display-inline="yes-display-inline">In addition to uses allowed under subsection (a), a grant awarded under this section may also be used to cover the costs of temporary housing for periods not in excess of 6 months, including moving costs, for individuals who—</text><paragraph id="H96BE42971BD847CF891AB6CF6C8F587D"><enum>(1)</enum><text>are severely impacted by mold in their residences;</text></paragraph><paragraph id="HCFBDC0E32A4E4655A4B842925D535D05"><enum>(2)</enum><text display-inline="yes-display-inline">are without insurance coverage for mold; and</text></paragraph><paragraph id="HA650AE7BD35E4C7789024F1F7C901E63"><enum>(3)</enum><text display-inline="yes-display-inline">do not have sufficient financial resources to obtain alternative housing, as determined on a case-by-case basis by the State or Tribal government.</text></paragraph></subsection><subsection id="H838E22C8DECE422195FF0D5667BEA0EF"><enum>(c)</enum><header>Licensing program</header><text display-inline="yes-display-inline">As a condition on receipt of a grant awarded under this section, a State or Tribal government shall agree to implement a licensing program for persons in the relevant jurisdiction engaged in assessing and remediating mold.</text></subsection><subsection id="H3D27017CEDC6478B9BD59098B0D832BC"><enum>(d)</enum><header>Not for use for high-Income households</header><text display-inline="yes-display-inline">As a condition on receipt of a grant awarded under this section, a State or Tribal government shall agree to refrain from using the grant to assess or remediate mold in housing occupied by households that are, as determined by the Administrator, high-income.</text></subsection><subsection id="H93F3EC6E4C3248CE8AA94B765BDB0BDD"><enum>(e)</enum><header>Prioritization</header><text>In awarding grants under this section, the Administrator shall give priority to—</text><paragraph id="H7CC37F27DACB46ED9AA35B25EF90CE1D"><enum>(1)</enum><text>applicants proposing to use a grant under this section to assess and remediate mold in—</text><subparagraph id="HC7093462A0454E589F5D5A1046C5D65D"><enum>(A)</enum><text display-inline="yes-display-inline">housing occupied by households that are, as determined by the Administrator, low-income; or</text></subparagraph><subparagraph id="H4D23074509ED468FBFDFDC6DE5FB7007"><enum>(B)</enum><text>buildings serving communities that are, as determined by the Administrator, low-income; and</text></subparagraph></paragraph><paragraph id="HC8151A894D06408A9D6BEA9253D2D00A"><enum>(2)</enum><text display-inline="yes-display-inline">State and Tribal governments that include geographic areas that are highly susceptible to indoor mold contamination based on—</text><subparagraph id="H41878E3182664CDA992BC4FF614A11D4"><enum>(A)</enum><text display-inline="yes-display-inline">the national standards established under section 3;</text></subparagraph><subparagraph id="HD72D2498AFE94CF297F473B0E48BA631"><enum>(B)</enum><text>outdoor environmental conditions, such as humidity; or</text></subparagraph><subparagraph id="HAB333E5F762D423F8CAA4AD8B3BBF09E"><enum>(C)</enum><text>other factors identified by the Administrator.</text></subparagraph></paragraph></subsection><subsection id="H647ED9B5402A494FB8D608DBE1BD78FA"><enum>(f)</enum><header>Federal share</header><text display-inline="yes-display-inline">The Federal share of the cost of activities implemented with a grant under this section in any fiscal year shall not exceed 60 percent of the costs incurred by the State or Tribal government receiving the grant in implementing such activities.</text></subsection><subsection id="H2BFD87F560C444D8B8F615966412691E"><enum>(g)</enum><header>Allocation</header><text display-inline="yes-display-inline">Of the funds made available to carry out this section each fiscal year—</text><paragraph id="H1DE9374ADE39407AA1DEBD90C7EAF729"><enum>(1)</enum><text>at least 20 percent shall be used pursuant to subsection (a) to cover costs associated with assessing and remediating mold in buildings owned or leased by governments; and</text></paragraph><paragraph id="H0583DD0C199E4B9D90CC636CC4D84D63"><enum>(2)</enum><text>at least 20 percent shall be used pursuant to subsection (a) to cover costs associated with assessing and remediating mold in private residential properties.</text></paragraph></subsection><subsection id="HCC98A2BA729E4C619468DF8DCCEB3902"><enum>(h)</enum><header>Authorization of appropriations</header><text>To carry out this section, there is authorized to be appropriated $50,000,000 for each of fiscal years 2026 through 2030.</text></subsection></section><section id="H9CD31F89CA5B44F69DA11C8D26795BF1"><enum>6.</enum><header>Definitions</header><text display-inline="no-display-inline"> In this Act:</text><paragraph id="H2F50F5949688440FA152C154FD051CA3"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph><paragraph id="H4BE71785987E4DEFB1A0BB6B8C11DE6D"><enum>(2)</enum><header>Mold</header><text display-inline="yes-display-inline">The term <term>mold</term> means a fungal growth that forms and spreads on various kinds of damp or decaying organic matter.</text></paragraph><paragraph id="H4832D74E170F4DA5918AA6D456500517"><enum>(3)</enum><header>State</header><text>The term <term>State</term> includes, in addition to the several States, the District of Columbia and any territory of the United States. </text></paragraph></section></legis-body></bill>
