Martek Purple Heart Restoration Act</short-title></quote>. </text></section><section id="HB49DE4A79F104FCD91659AFD3E4C4CE7"><enum>2.</enum><header>Awarding of Purple Heart to Certain Veterans Who Experienced a Traumatic Brain Injury</header><text display-inline="no-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/57">Chapter 57</external-xref> of title 10, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/10/1129a">section 1129a</external-xref> the following new section:</text><quoted-block style="USC" id="HF83D6766B2D74B2DB5927B1196DC9385" display-inline="no-display-inline"><section id="HAF07A59CCADC4755A38A8E7C094F946B"><enum>1129b.</enum><header>Purple Heart: certain veterans who experienced a traumatic brain injury</header><subsection id="H4968740CF59F4D92A190CBEC653F85B8"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline">For purposes of the award of the Purple Heart, the Secretary concerned shall treat a veteran described in subsection (b) in the same manner as a member of the Armed Forces who is killed or wounded in action as the result of an act of an enemy of the United States.</text></subsection><subsection id="H7A81AC7FAA8D442AA00F4217DD6A3A40" display-inline="no-display-inline"><enum>(b)</enum><header>Veteran Described</header><text display-inline="yes-display-inline">A veteran described in this subsection is a veteran—</text><paragraph id="H3B9E474E32C34D5DB4E37343EE250B00"><enum>(1)</enum><text>who experienced a traumatic brain injury while a member of the Armed Forces that is attributable to an act of an enemy of the United States that occurred on or after December 7, 1941; and</text></paragraph><paragraph id="H1F7AB578187C4F35A3010650923BE8DE" display-inline="no-display-inline"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H3A1DAFA126444853AFC8662A6D8C6825"><enum>(A)</enum><text>who has a service-connected disability attributable to such traumatic brain injury, as determined by the Secretary of Veterans Affairs; or</text></subparagraph><subparagraph id="H46367A48BCA84D91A4F257F98B376BAA" indent="up1"><enum>(B)</enum><text>with respect to whom there is a military record that demonstrates the occurrence of such traumatic brain injury.</text></subparagraph></paragraph></subsection><subsection id="HFF0BED56F76F4E27A9F7299800A4ED35"><enum>(c)</enum><header>Award Process</header><text display-inline="yes-display-inline">Each Secretary concerned shall—</text><paragraph id="HD089BF74F0B94BD8A07BEBFBE9C7E193"><enum>(1)</enum><text>establish a process for persons to submit applications for the awarding of the Purple Heart under this section; and</text></paragraph><paragraph id="H93EA044204D74D5D8A19C99512C1FA36"><enum>(2)</enum><text>award the Purple Heart to each person who submits an application that demonstrates the person is a veteran described in subsection (b), without regard to the date on which the veteran experienced the traumatic brain injury that is described in the application.</text></paragraph></subsection><subsection id="H88C071523F1149EDBCE82449D0F143BD"><enum>(d)</enum><header>Definitions</header><text>In this section, the terms <quote>service-connected</quote> and <quote>veteran</quote> have the meaning given the terms in section 101 of title 38.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
