which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name>, and in addition to the Committee on <committee-name committee-id="HRU00">Rules</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To limit the authority of the President to modify duty rates for national security reasons and to limit the authority of the United States Trade Representative to impose certain duties or import restrictions, and for other purposes.</official-title></form><legis-body id="HE47B711AEC7B430D860DD68DEB37FB19" style="OLC"><section id="HD25802EA61C1446587F37AD8BB752151" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reclaiming Congressional Trade Authority Act of 2025</short-title></quote>.</text></section><section id="HD0B620DE2F3A4D9BAE810E1102B786D8"><enum>2.</enum><header>Limitation on authority of President to modify duty rates for national security reasons</header><subsection id="H2AE623F0673C4A35B3BEFCA205321325"><enum>(a)</enum><header>Authority To modify duty rates for national security reasons</header><text>Notwithstanding any other provision of law and except as provided in subsection (c), the President may proclaim a new or additional national security duty on an article imported into the United States only if—</text><paragraph id="HF8E869D1364D4B8EA01E05CF266D655B"><enum>(1)</enum><text>the President, not later than 30 calendar days after making the national security determination that is the basis for the new or additional duty, submits to the International Trade Commission the duty proposal, including—</text><subparagraph id="HFE1AD39C35FF4189A015711D16D6FCB9"><enum>(A)</enum><text>a description of each article for which the President recommends a new or additional duty;</text></subparagraph><subparagraph id="H2633D641927B43ECA2AB53005EF94B77"><enum>(B)</enum><text>the proposed new or additional duty rate; and</text></subparagraph><subparagraph id="H829D737491FC4F9C8377F0CBE99B0CB8"><enum>(C)</enum><text>the proposed duration of that rate;</text></subparagraph></paragraph><paragraph id="HC1303FBDEDDB4A41BDBD84C05F97633A"><enum>(2)</enum><text>the President, not later than 15 calendar days after submitting the duty proposal under paragraph (1), submits to Congress a request for authorization to modify duty rates in accordance with that duty proposal, including—</text><subparagraph id="HD24833AA6A8D487BA49F241EFC0885AC"><enum>(A)</enum><text>a report by the Secretary of Defense explaining why the proposal is in the interest of national security; and</text></subparagraph><subparagraph id="HCA86D5C2042C484882EC35D4215D20B8"><enum>(B)</enum><text>a report by the International Trade Commission assessing the likely impact of the proposal on the economy of the United States as a whole and specific industry sectors;</text></subparagraph></paragraph><paragraph id="H0A6059C3AF98402F892628300ACB7A4F"><enum>(3)</enum><text>the President consults with the Committee on Finance and the Committee on Armed Services of the Senate and the Committee on Ways and Means and the Committee on Armed Services of the House of Representatives regarding the duty proposal under paragraph (1), including—</text><subparagraph id="H6A4500AA839A41919B5B43C60D32F1D0"><enum>(A)</enum><text>the short-term and long-term goals of the proposal;</text></subparagraph><subparagraph id="HE4D1B7F72DCF436897B97CB04E8EE075"><enum>(B)</enum><text>an action plan to achieve those goals; and</text></subparagraph><subparagraph id="H80F7F3ED594C4065BC3B18967B771D96"><enum>(C)</enum><text>plans to consult with officials of countries impacted by the proposal to resolve any issues relating to the proposal; and</text></subparagraph></paragraph><paragraph id="H785C24D3483144F9B68D2EBDDC35FD82"><enum>(4)</enum><text>a joint resolution of approval under subsection (b) is enacted.</text></paragraph></subsection><subsection id="H3E1475B774654336AA4B611C995FDD22"><enum>(b)</enum><header>Joint resolution of approval</header><paragraph id="H26E8F66397814190BFF256EC4F7FD890"><enum>(1)</enum><header>Joint resolution of approval defined</header><text>In this subsection, the term <term>joint resolution of approval</term> means a joint resolution the sole matter after the resolving clause of which is as follows: <quote>That Congress authorizes the President to proclaim duty rates as set forth in the request of the President on ___________</quote>, with the blank space being filled with the date of the request submitted under subsection (a)(2).</text></paragraph><paragraph id="H8E1E47272E7E4D9FA99FC92B86E1F7CD"><enum>(2)</enum><header>Introduction</header><text>A joint resolution of approval may be introduced in either House of Congress by any Member during the 15-legislative day period beginning on the date on which the President submits to Congress the material set forth in subsection (a)(2).</text></paragraph><paragraph id="HD4B3853837AD4283A8C807C6C8891017"><enum>(3)</enum><header>Expedited procedures</header><text>The provisions of subsections (b) through (f) of section 152 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2192">19 U.S.C. 2192</external-xref>) apply to a joint resolution of approval to the same extent that such subsections apply to joint resolutions under such section 152.</text></paragraph><paragraph id="H22EB33CE7A7040A6BA3BF632B63104DF"><enum>(4)</enum><header>Rules of House of Representatives and Senate</header><text>This subsection is enacted by Congress—</text><subparagraph id="H0800CB05DE3D4A1D8FFA901B0D7EFB8F"><enum>(A)</enum><text>as an exercise of the rulemaking power of the Senate and the House of Representatives, respectively, and as such is deemed a part of the rules of each House, respectively, but applicable only with respect to the procedure to be followed in that House in the case of a joint resolution of approval, and supersedes other rules only to the extent that it is inconsistent with such rules; and</text></subparagraph><subparagraph id="H3B77C7841F644F8CBD15AF219DA737C5"><enum>(B)</enum><text>with full recognition of the constitutional right of either House to change the rules (so far as relating to the procedure of that House) at any time, in the same manner, and to the same extent as in the case of any other rule of that House.</text></subparagraph></paragraph></subsection><subsection id="H546AC216CCBB4019973B23672D35F016"><enum>(c)</enum><header>Exception for urgent action</header><text>Notwithstanding the requirements of subsection (a), the President may proclaim a new or additional national security duty for one period of 120 calendar days if the President determines that urgent action is necessary—</text><paragraph id="H59505E98D1C94FD0AC9700ADD8D3C79C"><enum>(1)</enum><text>to address a national emergency;</text></paragraph><paragraph id="H2B906298E93C414396A43FF970642EDB"><enum>(2)</enum><text>for the prevention or mitigation of, or to respond to, loss of life or property;</text></paragraph><paragraph id="HD462CC3C4D1440BAAF5F79DCBA694293"><enum>(3)</enum><text>to address an imminent threat to health or safety;</text></paragraph><paragraph id="H91ABEC5DDFF64183AF7486BB8AEF16FD"><enum>(4)</enum><text>for the enforcement of criminal laws; or</text></paragraph><paragraph id="HA203B78C85C543959F239461438F6998"><enum>(5)</enum><text>for national security.</text></paragraph></subsection><subsection id="H1E50B500454F4AACB0D32760F2D0234D"><enum>(d)</enum><header>National security duty defined</header><text>In this section, the term <term>national security duty</term> means the following:</text><paragraph id="H0DE76D2229074716A4B887BD7930436C"><enum>(1)</enum><text>A duty proclaimed pursuant to—</text><subparagraph id="H60A2E104213046E3821BF9018290E4DF"><enum>(A)</enum><text>section 232 of the Trade Expansion Act of 1962 (<external-xref legal-doc="usc" parsable-cite="usc/19/1862">19 U.S.C. 1862</external-xref>);</text></subparagraph><subparagraph id="HBB94981B611642599B326ECCC40AC5E2"><enum>(B)</enum><text>the Trading with the Enemy Act (<external-xref legal-doc="usc" parsable-cite="usc/50/4301">50 U.S.C. 4301 et seq.</external-xref>); or</text></subparagraph><subparagraph id="HC5DE11102FFE4EDEB6EA3EF737D2D5E5"><enum>(C)</enum><text>the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4C7A275B9CF7452993AB1BE3DCFFDF8C"><enum>(2)</enum><text>A duty proclaimed pursuant to any other provision of law if in reports or other public statements regarding the duty the President or another cabinet-level official identifies national security as a significant reason for proclaiming the duty.</text></paragraph></subsection></section><section id="H3D32CD2C6C7A45F78B4C70B5C4489479"><enum>3.</enum><header>Conditions on use of authority by United States Trade Representative to impose duties or other import restrictions</header><subsection id="H5CDC8C0286C5435895D711241217124A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 301(c) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2411">19 U.S.C. 2411(c)</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HF25A71702A124B3290BAA7705BD1A3E7" style="OLC"><paragraph id="HCF372AA0EA424CC8A93E4BBB8A67C6C6"><enum>(7)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H799F9EA593D946078D1D96A8C9A2AB19"><enum>(A)</enum><text>The Trade Representative may take action pursuant to paragraph (1)(B) only if—</text><clause id="H0E0D78C9DCB64F90875DA258B127F86A" indent="up1"><enum>(i)</enum><text>the Trade Representative submits to the International Trade Commission a proposal for duties or other import restrictions under that paragraph, including—</text><subclause id="H8289CB44A55542A19BE7C0C027E55A58"><enum>(I)</enum><text>a description of each article covered by that proposal;</text></subclause><subclause id="H9A2F77707D5C48C58FE1E81EC86061E2"><enum>(II)</enum><text>the proposed new or additional duty rate; and</text></subclause><subclause id="H385ADAE91DE045CCBC2E5256DDEE9FE6"><enum>(III)</enum><text>the proposed duration of that rate;</text></subclause></clause><clause id="H3A93A5A547554F308958DEBBF87E0095" indent="up1"><enum>(ii)</enum><text>the Trade Representative submits to Congress a notification of intent to impose duties or import restrictions under that paragraph, including—</text><subclause id="H4BA4E63BA42F48899E19B40CBEC0D0FA"><enum>(I)</enum><text>the proposal submitted under clause (i); and</text></subclause><subclause id="H413C516817C54281B2AE26A09CA9E5B5"><enum>(II)</enum><text>a report by the International Trade Commission assessing the likely impact of the proposal on the economy of the United States as a whole and specific industry sectors;</text></subclause></clause><clause id="H5AF69D8CF3A34477AE8C22B858B34A3C" indent="up1"><enum>(iii)</enum><text>after submitting the notification under clause (ii), the Trade Representative consults with the Committee on Finance of the Senate and the Committee on Ways and Means of the House of Representatives and, if the proposal affects agricultural products, the Committee on Agriculture, Nutrition, and Forestry of the Senate and the Committee on Agriculture of the House of Representatives;</text></clause><clause id="H0D8AEF74150E4276AEC17C29584680D0" indent="up1"><enum>(iv)</enum><text>a period of 60 calendar days, beginning on the date on which the Trade Representative has completed consultations under clause (iii), has passed; and</text></clause><clause id="H1D5DD23F394C4A48A6FA90690C534384" indent="up1"><enum>(v)</enum><text>no disapproval resolution under subparagraph (B) is passed during the period described in clause (iv).</text></clause></subparagraph><subparagraph id="H43EE310A63824C1FBCD2C800C4953708" indent="up1"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="H5F445A45D6C84F6EA8877A0321BFE823"><enum>(i)</enum><text>In this subparagraph, the term <term>disapproval resolution</term> means a joint resolution the sole matter after the resolving clause of which is as follows: <quote>That implementation of the proposal by the Trade Representative to impose duties or other import restrictions submitted to Congress on ________________ is not in the interest of the United States.</quote>, with the blank space being filled with the date on which the Trade Representative submitted to Congress the material described in subsection (A)(ii).</text></clause><clause commented="no" display-inline="no-display-inline" id="HCF2FE0950EDF4703B719A249E265F20E" indent="up1"><enum>(ii)</enum><text>Paragraph (2) of section 106(b) of the Bipartisan Congressional Trade Priorities and Accountability Act of 2015 (<external-xref legal-doc="usc" parsable-cite="usc/19/4205">19 U.S.C. 4205(b)</external-xref>) applies to a disapproval resolution under this subparagraph to the same extent that such paragraph applies to a procedural disapproval resolution under such section 106(b).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HCFB2E55322094A078489099C354F810F"><enum>(b)</enum><header>Conforming amendment</header><text>Paragraph (1)(B) of such section is amended by inserting <quote>subject to paragraph (7),</quote> before <quote>impose duties</quote>.</text></subsection></section></legis-body></bill>
