<section id="H13C0501144BB42519E2A975C07411D0D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting American Families and Servicemembers from Anthrax Act</short-title></quote>.</text></section> <section id="HBF8C9FF305D44E0F9345FAAA5F0039E1"><enum>2.</enum><header>Developing a modernized strategy for ensuring the defense of the United States from the anthrax threat</header> <subsection id="H0DDD91B4213B429C9279EEE4369C73C2"><enum>(a)</enum><header>Modernized strategy</header> <paragraph id="H431CE547F5744340B53D7C5C0CED9BDB"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the covered Secretaries shall develop a modernized 10-year strategy for ensuring sustained stockpiling of anthrax countermeasures, including the replenishment, consistent with requirement levels, of such anthrax countermeasures stockpiled—</text> 
<subparagraph id="HC8808A49339144C8A7CC1E28B59AFAB8" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">in the Strategic National Stockpile under section 319F–2(a) of the Public Health Service Act (42 U.S.C. 247d–6b(a)); or</text></subparagraph> <subparagraph id="H5052566E03864190BFADA0CFFFB78CD1"><enum>(B)</enum><text>by the Secretary of Defense, including such anthrax countermeasures stockpiled in protection and treatment of civilians, servicemembers, and dependents on military installations.</text> </subparagraph></paragraph> 
<paragraph id="H01E30AF5A8B84A1BBF0A536DF1BDFACE"><enum>(2)</enum><header>Cooperation and sustainability</header><text>The strategy described in paragraph (1) shall ensure innovative cooperation with, and sustainability of, manufacturers of anthrax countermeasures.</text></paragraph> </subsection> <subsection id="HB41F395B8A0041CA88BEC6C02427EF7E"><enum>(b)</enum><header>Reporting</header> <paragraph id="H8CAC725E00EA429DABA6AA047B8508D6"><enum>(1)</enum><header>Initial report</header><text>Not later than 180 days after the date of enactment of this Act, the covered Secretaries shall submit to the appropriate congressional committees a report on—</text> 
<subparagraph id="HAB0786CD9AC24750A19878A751DE8B0E"><enum>(A)</enum><text>the threat, to the people and military installations of the United States, of weaponized anthrax from foreign countries, foreign terrorist organizations (as designated by the Secretary of State in accordance with section 219(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189(a)</external-xref>)), and other threat streams;</text></subparagraph> <subparagraph id="H64339D0A361C47129C157EEA9ED45C12"><enum>(B)</enum><text>programs and activities of the Federal Government (other than programs and activities under the Public Health Emergency Medical Countermeasure Enterprise, such as multi-year budgets, research and development investments, and countermeasure procurements) that address the modernized strategy under subsection (a)(1), including such programs and activities that address multidrug-resistant strains; and</text></subparagraph> 
<subparagraph id="H9D0A6A671DEF46B29F1C5063B7E5153E"><enum>(C)</enum><text>initiatives of the Federal Government to ensure adequate availability of anthrax countermeasures for treatment of military dependents on United States military installations in foreign countries.</text></subparagraph></paragraph> <paragraph id="H557EA3AD5CB643F291551922110D1347"><enum>(2)</enum><header>Inclusion of modernized strategy</header><text display-inline="yes-display-inline">The report under paragraph (1) shall include the modernized strategy under subsection (a)(1).</text></paragraph> 
<paragraph id="HFEE79D4BF39345569830613CCE094500"><enum>(3)</enum><header>Annual updates</header><text>Following the submission of the report under paragraph (1), the covered Secretaries shall, on an annual basis, submit to the appropriate congressional committees an update to such report.</text></paragraph> <paragraph id="H2CE78AD2E6CC4672BE2653F13189CB37"><enum>(4)</enum><header>Form</header><text>The report under paragraph (1) and the updates under paragraph (3) shall be submitted in classified form but may include an unclassified annex.</text></paragraph></subsection> 
<subsection id="HABD90D19543F481583053F3A69EF1565"><enum>(c)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H4B2970711CA44C9F9C63B02E9BE274A1"><enum>(1)</enum><header>Anthrax countermeasure</header><text display-inline="yes-display-inline">The term <term>anthrax countermeasure</term>—</text> 
<subparagraph id="H13BB0F4CF4C54371829BB8DDE83B4105"><enum>(A)</enum><text>means a drug, device, or biological product intended to counter the effects of anthrax that is approved, cleared, classified, licensed, or otherwise authorized by the Food and Drug Administration; and</text></subparagraph> <subparagraph id="H31DDFEA10DC7490182764D17F6FD8E93"><enum>(B)</enum><text>includes an antitoxin and a prophylactic.</text> </subparagraph></paragraph> 
<paragraph id="HB051E7B3312A40728C6F177FBA2866E5"><enum>(2)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text> <subparagraph id="H259F08941CC543FCB5AF256199957553"><enum>(A)</enum><text>the Committee on Appropriations of the House of Representatives;</text></subparagraph> 
<subparagraph id="H0269CD0696BE4BC695D24899E4D5D189"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Appropriations of the Senate;</text></subparagraph> <subparagraph id="H9CEE6B1D05C64A8793A62D7BD358E74A"><enum>(C)</enum><text>the Committee on Armed Services of the House of Representatives;</text></subparagraph> 
<subparagraph id="H03304A09E76543E4958B057E1373A73B"><enum>(D)</enum><text>the Committee on Armed Services of the Senate;</text></subparagraph> <subparagraph id="H7A9D97E7920F4222A2A062CC677B195E"><enum>(E)</enum><text>the Committee on Energy and Commerce of the House of Representatives; and</text></subparagraph> 
<subparagraph id="H762DB0AFE604449FA27827389B14BCCE"><enum>(F)</enum><text>the Committee on Health, Education, Labor, and Pensions of the Senate.</text></subparagraph></paragraph> <paragraph id="H073D7852AA904D639D3DCD2DC6604AF6"><enum>(3)</enum><header>Covered Secretaries</header><text display-inline="yes-display-inline">The term <term>covered Secretaries</term> means the Secretary of Health and Human Services, acting through the Assistant Secretary for Preparedness and Response, and the Secretary of Defense, acting through the Assistant Secretary of Defense for Nuclear, Chemical, and Biological Defense Programs, acting jointly, in consultation with the members of the Public Health Emergency Medical Countermeasures Enterprise established under section 2811–1 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300hh-10a">42 U.S.C. 300hh–10a</external-xref>).</text> </paragraph></subsection></section>
