R. 2706</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250408">April 8, 2025</action-date><action-desc><sponsor name-id="D000626">Mr. Davidson</sponsor> (for himself, <cosponsor name-id="B001302">Mr. Biggs of Arizona</cosponsor>, <cosponsor name-id="B001325">Mrs. Biggs of South Carolina</cosponsor>, and <cosponsor name-id="S000522">Mr. Smith of New Jersey</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HFA00">Committee on Foreign Affairs</committee-name>, and in addition to the Committee on <committee-name committee-id="HRU00">Rules</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To modify the requirements of section 104(f) of the Foreign Assistance Act of 1961.</official-title></form><legis-body id="HDDA1FA7FBE744D75B5F3FE5B89B1BBAE" style="OLC"><section id="H544A08C4738A4DF6A37091662AA30558" section-type="section-one"><enum>1. </enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Aid Accountability Act of 2025</short-title></quote>. </text></section><section id="HF546A1E78B784509B0CCB88D6780472B"><enum>2.</enum><header>Modification to requirements of section 104(f) of the Foreign Assistance Act of 1961</header><text display-inline="no-display-inline">Section 104(f) of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2151b">22 U.S.C. 2151b(f)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H56F9F2AD65824F90B7883E4FD5104491" display-inline="no-display-inline"><paragraph id="H9B79935566A044E3BDF594D3DC6C2475" indent="up1"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HA2C35B56FB67454C998340D63E8D630A"><enum>(A)</enum><text display-inline="yes-display-inline">An individual who is a Federal employee and knowingly violates any of the requirements of this subsection—</text><clause id="HFB96AF9DA55649F7A4DCAB854C05E682" indent="up1"><enum>(i)</enum><text>shall be terminated from Federal employment and may not be receive any Federal employment in the future; and</text></clause><clause id="H0B7616938B8A4B6C8B50F8202D39984A" indent="up1"><enum>(ii)</enum><text>shall be fiscally liable for an amount equal to the amount of funds illegally allocated to the activity that was in violation of such requirements in order to provide restitution to the Federal government.</text></clause></subparagraph><subparagraph id="H934D36F74F01484D8601297CA9C17244" indent="up1"><enum>(B)</enum><text>A grantee, sub-grantee, contractor or other recipient of Federal funds who violates any of the requirements of this subsection may not receive any Federal funds in the future.</text></subparagraph><subparagraph id="HFE8CCCA7819047599C4350D04508930A" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">The Secretary of State—</text><clause id="H7593CCC29DC646E89F75A743A6599A76"><enum>(i)</enum><text>shall make final determinations of violations of the requirements of this subsection and the penalties imposed under subparagraphs (A) and (B), and such final determinations shall not be subject to review or reversal except by a Federal court of competent jurisdiction; and</text></clause><clause id="H1E30FD39298A4381B719E25B2678E750"><enum>(ii)</enum><text>shall submit to Congress a report not later than 60 days after making a determination of a violation of the requirements of this subsection, which shall include—</text><subclause id="H63E2DC777E9E4054A79FB9D4F4A38C26"><enum>(I)</enum><text>a description of the nature of the violation;</text></subclause><subclause id="HDD7E49D3214B481DA85B7780AB35CB3E"><enum>(II)</enum><text>who carried out or was involved in the violation; and</text></subclause><subclause id="H2BC85240FD114640B1084E7F148E8E77"><enum>(III)</enum><text>what will be done to ensure the violation is not repeated.</text></subclause></clause></subparagraph><subparagraph id="H959864F6AAAE46248A5CC1E8FE47D05B" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">Any final determination of the Secretary of State under subparagraph (C)(i) shall be subject to the procedures under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/8">chapter 8</external-xref> of title 5, United States Code (commonly known as the <quote>Congressional Review Act</quote>).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
