<section display-inline="no-display-inline" id="H83F93595B9134CCD8D387153C15128D9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Nuclear Family Priority Act</short-title></quote>.</text></section> <section id="H9C65B944266A4E148DAEE0FD464E551F"><enum>2.</enum><header>Immediate relative definition</header><text display-inline="no-display-inline">Section 201(b)(2)(A)(i) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151(b)(2)(A)(i)</external-xref>) is amended—</text> 
<paragraph id="H46ECEC8DB4A24E889BBA5D8276311F2C"><enum>(1)</enum><text>by striking <quote>children, spouses, and parents</quote> and inserting <quote>children and spouses</quote>; and</text></paragraph> <paragraph id="HC8A2A36D32E34C8DB9A9992C4BB54010"><enum>(2)</enum><text>by striking <quote>States, except that</quote> and all that follows through <quote>of age.</quote> and inserting <quote>States.</quote>.</text></paragraph></section> 
<section id="HA71753BFE2774B43A4DD07668D3C267E"><enum>3.</enum><header>Change in family-sponsored immigrant categories</header><text display-inline="no-display-inline">Section 203(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(a)</external-xref>) is amended to read as follows:</text> <quoted-block display-inline="no-display-inline" id="HC870504AE2554627A4499805EA2B23A9" style="traditional"> <subsection id="H6B2597C2B2374E6F87C898D7E4C25272"><enum>(a)</enum><header>Preference allocation for spouses and children of permanent resident aliens</header><text display-inline="yes-display-inline">Qualified immigrants who are the spouses or children of an alien lawfully admitted for permanent residence shall be allotted visas in a number not to exceed the worldwide level specified in section 201(c).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HDCA6FF381CAD4E969E1D9AF6E850A3F8"><enum>4.</enum><header>Change in worldwide level of family-sponsored immigrants</header><text display-inline="no-display-inline">Section 201(c) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151(c)</external-xref>) is amended—</text> <paragraph id="H320098C7F2164545AF0FE45964D7CCCA" indent="up1"><enum>(1)</enum><text display-inline="yes-display-inline">by amending paragraph (1) to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="H483BA02875D54A55AB7BF7AA584D204C" style="traditional"> 
<paragraph id="H252B8A90163447E2930A55B43872BFAC"><enum>(1)</enum><text display-inline="yes-display-inline">The worldwide level of family-sponsored immigrants under this subsection for a fiscal year is equal to—</text> <subparagraph id="H547BB1987736405387310EAD3361ABE3"><enum>(A)</enum><text>88,000; minus</text></subparagraph> 
<subparagraph id="H6C9FCAAE1FBC44618A54A78472C400DA"><enum>(B)</enum><text>the number computed under paragraph (2).</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> <paragraph id="H9F36FC1544F44CEE9C6881525CC45FA9"><enum>(2)</enum><text>by striking paragraphs (2), (3), and (5); and</text></paragraph> 
<paragraph id="HC860A2E7DF404062B0FA7F8422456E15"><enum>(3)</enum><text display-inline="yes-display-inline">by redesignating paragraph (4) as paragraph (2).</text></paragraph></section> <section id="H7CF1EB11582D4479A4529569195E4611"><enum>5.</enum><header>Conforming amendments</header> <subsection id="H289FA9C076A94597A1F3D79ADF60C358"><enum>(a)</enum><header>Numerical limitation to any single foreign state</header><text>Section 202 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1152">8 U.S.C. 1152</external-xref>) is amended—</text> 
<paragraph id="H6C6342BFD64C40298B62BC93DF9D2B69"><enum>(1)</enum><text>in subsection (a)(4)—</text> <subparagraph id="H9786E1C44CF5417CA7E50B0768983D5E"><enum>(A)</enum><text>by amending subparagraphs (A) and (B) to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="H736829290FE34DD5AB8A62A3B3B3CAE9" style="OLC"> 
<subparagraph id="H9BB64FD2221F4C618223E8F921345BB4"><enum>(A)</enum><header>75 percent of family-sponsored immigrants not subject to per country limitation</header><text>Of the visa numbers made available under section 203(a) in any fiscal year, 75 percent shall be issued without regard to the numerical limitation under paragraph (2).</text></subparagraph> <subparagraph id="HC1583D4FC7094B27A444134FFAC6845C"><enum>(B)</enum><header>Treatment of remaining 25 percent for countries subject to subsection <enum-in-header>(e)</enum-in-header></header> <clause id="H4D5CA3D2174842118493A0AC70D16F26"><enum>(i)</enum><header>In general</header><text>Of the visa numbers made available under section 203(a) in any fiscal year, the remaining 25 percent shall be available, in the case of a foreign state or dependent area that is subject to subsection (e) only to the extent that the total number of visas issued in accordance with subsection (A) to natives of the foreign state or dependent area is less than the subsection (e) ceiling (as defined in clause (ii)).</text></clause> 
<clause id="H8DB209EB5DF54381BCE0869CD2166E89"><enum>(ii)</enum><header>Subsection <enum-in-header>(e)</enum-in-header> ceiling defined</header><text>In clause (i), the term <term>subsection (e) ceiling</term> means, for a foreign state or dependent area, 77 percent of the maximum number of visas that may be made available under section 203(a) to immigrants who are natives of the state or area consistent with subsection (e).</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> <subparagraph id="H4A904DC8DC064301B7BE94C5AD9E92FA"><enum>(B)</enum><text>by striking subparagraphs (C) and (D); and</text></subparagraph></paragraph> 
<paragraph id="H014DD9448EA947CD9F287243FC954D42"><enum>(2)</enum><text>in subsection (e)—</text> <subparagraph id="HDF01C0BFBA1445DEA5A7BBB3D71D1D84"><enum>(A)</enum><text>in paragraph (1), by adding <quote>and</quote> at the end;</text></subparagraph> 
<subparagraph id="H27974675B2EB4E2EAF2766BF46A31393"><enum>(B)</enum><text>by striking paragraph (2) and redesignating paragraph (3) as paragraph (2); and</text></subparagraph> <subparagraph id="H9E4B732B12854BEC9C087EF68C4D23D4"><enum>(C)</enum><text>in the final sentence, by striking <quote>respectively,</quote> and all that follows through the period at the end and inserting <quote>respectively.</quote>.</text></subparagraph></paragraph></subsection> 
<subsection id="H44E5DB21B8DF4AE7BE2006F4593D0F5A"><enum>(b)</enum><header>Rules for determining whether certain aliens are children</header><text>Section 203(h) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(h)</external-xref>) is amended by striking <quote>(a)(2)(A)</quote> each place such term appears and inserting <quote>(a)</quote>.</text></subsection> <subsection id="H0A9F8EE603C444E9AC78B42796265FA5"><enum>(c)</enum><header>Procedure for granting immigrant status</header><text>Section 204 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154</external-xref>) is amended—</text> 
<paragraph id="HFE73E3C26A6B41E49C695798D025A9A9"><enum>(1)</enum><text>in subsection (a)(1)—</text> <subparagraph id="H3B99AC316348437E9769BA04FB411187"><enum>(A)</enum><text>in subparagraph (A)(i), by striking <quote>to classification by reason of a relationship described in paragraph (1), (3), or (4) of section 203(a) or</quote>;</text></subparagraph> 
<subparagraph id="HD274604F35B04C7E891073026E0BA8C9"><enum>(B)</enum><text>in subparagraph (B), by striking <quote>203(a)(2)(A)</quote> and <quote>203(a)(2)</quote> each place such terms appear and inserting <quote>203(a)</quote>; and</text></subparagraph> <subparagraph id="H7079E3405EBC49259740A1E1DCCD2770"><enum>(C)</enum><text display-inline="yes-display-inline">in subparagraph (D)(i)(I), by striking <quote>a petitioner for preference status under paragraph (1), (2), or (3)</quote> and all that follows through the period at the end and inserting <quote>an individual under 21 years of age for purposes of adjudicating such petition and for purposes of admission as an immediate relative under section 201(b)(2)(A)(i) or a family-sponsored immigrant under section 203(a), as appropriate, notwithstanding the actual age of the individual.</quote>;</text></subparagraph></paragraph> 
<paragraph id="H90E5E46E99F24EE281BA31DCD0F1D6A2"><enum>(2)</enum><text>in subsection (f)(1), by striking <quote>201(b), 203(a)(1), or 203(a)(3), as appropriate.</quote> and inserting <quote>201(b).</quote>; and</text></paragraph> <paragraph id="HE654DAEA0DE34AA0840915A713D6C5E8"><enum>(3)</enum><text>by striking subsection (k).</text></paragraph></subsection> 
<subsection id="H93548BFF7DF347A18BC0FE7430187F05"><enum>(d)</enum><header>Waivers of inadmissibility</header><text>Section 212(d)(11) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(d)(11)</external-xref>) is amended by striking <quote>(other than paragraph (4) thereof)</quote>.</text></subsection> <subsection id="HA9E1A418459A45B0A15AD15B9F88E5AD"><enum>(e)</enum><header>Conditional permanent resident status for certain alien spouses and sons and daughters</header><text display-inline="yes-display-inline">Section 216(h)(1)(C) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1186a">8 U.S.C. 1186a(h)(1)(C)</external-xref>) is amended by striking <quote>203(a)(2)</quote> and inserting <quote>203(a)</quote>.</text></subsection> 
<subsection id="H01C1A8D64E704F09995B689F6A920549"><enum>(f)</enum><header>Classes of deportable aliens</header><text display-inline="yes-display-inline">Section 237(a)(1)(E)(ii) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227(a)(1)(E)(ii)</external-xref>) is amended by striking <quote>203(a)(2)</quote> and inserting <quote>203(a)</quote>.</text></subsection></section> <section id="HA7ED64A166D54CA19D77112FAEF8D2DA"><enum>6.</enum><header>Nonimmigrant status for alien parent of adult United States citizens</header> <subsection id="HB7891C2728A9441BBB3762BFE476AC64"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 101(a)(15) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)</external-xref>) is amended—</text> 
<paragraph id="H917769C24BC8481B861F94D745F87669"><enum>(1)</enum><text>in subparagraph (U), by striking <quote>or</quote> at the end;</text></paragraph> <paragraph id="HDA46F6280FD746B6B5E3DA51853977FE"><enum>(2)</enum><text>in subparagraph (V), by striking the period at the end and inserting <quote>or</quote>; and</text></paragraph> 
<paragraph id="H1D1129CE6585427BBDA07BE2E2266F46"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H0A7E412EB3EE41BC8313A12DAA0829EC" style="OLC"> <subparagraph id="H897AFD6795684CC79B56F634D62EF219" indent="up1"><enum>(W)</enum><text display-inline="yes-display-inline">Subject to section 214(s), an alien who is a parent of a citizen of the United States, if the citizen is at least 21 years of age.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H70D30BC0BF6743E9A1D8AFC1E344F5E9"><enum>(b)</enum><header>Conditions on admission</header><text display-inline="yes-display-inline">Section 214 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184</external-xref>) is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="HA7A797A15BB341958D2CF54E512E0F38" style="traditional"> <subsection id="HD5A8137CC24D4C88BC0FCFA832B58B2C"><enum>(s)</enum> <paragraph commented="no" display-inline="yes-display-inline" id="HAF80879A6BB94D5098F402240D3CAACE"><enum>(1)</enum><text>The initial period of authorized admission for a nonimmigrant described in section 101(a)(15)(W) shall be 5 years. Such period may be extended by the Secretary of Homeland Security so long as the United States citizen son or daughter of the nonimmigrant is residing in the United States.</text></paragraph> 
<paragraph id="HEB74CB157D154E2C94F66C07BA9FCDC2" indent="up1"><enum>(2)</enum><text>A nonimmigrant described in section 101(a)(15)(W) is not authorized to be employed in the United States and is not eligible, notwithstanding any other provision of law, for any Federal, State, or local public benefit. In the case of such a nonimmigrant, the United States citizen son or daughter shall be responsible for the support of the nonimmigrant, regardless of the resources of the nonimmigrant.</text></paragraph> <paragraph id="H49968A28063C41A986FB82039053A2D3" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">An alien is ineligible to receive a visa and ineligible to be admitted into the United States as a nonimmigrant described in section 101(a)(15)(W) unless the alien provides satisfactory proof that the United States citizen son or daughter has arranged for the provision to the alien, at no cost to the alien, of health insurance coverage applicable during the period of the alien’s presence in the United States.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H73962EBB54DD4238B021DD246BBDACF2"><enum>7.</enum><header>Effective date; applicability</header><text display-inline="no-display-inline">The amendments made by this Act shall take effect on the first day of the second fiscal year that begins after the date of the enactment of this Act, except that the following shall be considered invalid:</text> <paragraph id="HDDB46026631C4FD2AD11414D7F986AA4"><enum>(1)</enum><text display-inline="yes-display-inline">Any petition under section 204 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154</external-xref>) seeking classification of an alien under a family-sponsored immigrant category eliminated by the amendments made by this Act that is filed after the date of the introduction of this Act in the House of Representatives.</text></paragraph> 
<paragraph id="HC546259819084064A119BF3344921E0D"><enum>(2)</enum><text>Any application for an immigrant visa based on a petition described in paragraph (1).</text></paragraph></section> </legis-body></bill>
