R. 2694</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250407">April 7, 2025</action-date><action-desc><sponsor name-id="O000019">Mr. Obernolte</sponsor> (for himself, <cosponsor name-id="C000059">Mr. Calvert</cosponsor>, <cosponsor name-id="K000401">Mr. Kiley of California</cosponsor>, <cosponsor name-id="F000480">Mr. Fong</cosponsor>, <cosponsor name-id="V000129">Mr. Valadao</cosponsor>, <cosponsor name-id="I000056">Mr. Issa</cosponsor>, and <cosponsor name-id="M001177">Mr. McClintock</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HHA00">Committee on House Administration</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Help America Vote Act of 2002 to establish deadlines for States to count the ballots cast in elections for Federal office and to certify the results of elections for Federal office, and for other purposes.</official-title></form><legis-body id="H3729B67DDCA443DEA6E4E514C944C198" style="OLC"><section id="HA226E205FDE3472396801572E879B337" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Election Results Accountability Act</short-title></quote>.</text></section><section id="H2A74F4EB843944149D76EF60CE1CAC02"><enum>2.</enum><header>Establishment of deadlines for counting ballots and certifying results of Federal elections</header><subsection id="H482C800F908A4355A2925BCA65E2E0E8"><enum>(a)</enum><header>Deadlines</header><text display-inline="yes-display-inline">Title III of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/20181">52 U.S.C. 20181 et seq.</external-xref>), as amended by section 2(a) of the COCOA Act of 2024, is amended—</text><paragraph id="H36AD72C7177F414F953D501569BC4D97"><enum>(1)</enum><text>by redesignating sections 305 and 306 as sections 306 and 307; and</text></paragraph><paragraph id="H53D3F54F705A4842B73B0757308870FE"><enum>(2)</enum><text>by inserting after section 304 the following new section:</text><quoted-block style="OLC" id="H2AE83BD1B853491CAE9AD344E9816FC5" display-inline="no-display-inline"><section id="H1671A309FF0C4129A0ECB5C73B6418D3"><enum>305.</enum><header>Deadlines for counting ballots and certifying results</header><subsection id="H7A2D01CF5B3F4AD4B9963470AA6258AF"><enum>(a)</enum><header>Deadlines</header><paragraph id="HC9A6CFE1627545B4B1E3C37A8F652925"><enum>(1)</enum><header>Counting ballots</header><text display-inline="yes-display-inline">Not later than 72 hours after the closing of the polls for an election for Federal office held in a State, the State shall count not less than 90 percent of the ballots cast in the election and make the result of the count publicly available.</text></paragraph><paragraph id="H4E3B56BDE01B4A3183B48FB07E41DC97"><enum>(2)</enum><header>Certifying results</header><text display-inline="yes-display-inline">Not later than 2 weeks after the closing of the polls for an election for Federal office held in a State, the State shall—</text><subparagraph id="HDDCEEF27ECB1461CB23BA07972C0DF92"><enum>(A)</enum><text>complete the counting of all of the ballots cast in the election; and</text></subparagraph><subparagraph id="HEBBB57026DF14164B4F832AD904BFF16"><enum>(B)</enum><text>officially certify the result of the election and make the result publicly available.</text></subparagraph></paragraph></subsection><subsection id="HC8D4EC7C10E14FD197FFBBC11496253C"><enum>(b)</enum><header>Exceptions</header><text display-inline="yes-display-inline">A State shall not be considered to be out of compliance with the requirements of subsection (a) if the Commission and the Attorney General certify that the State’s failure to meet such requirements is due to any of the following:</text><paragraph id="H9F117D91C3B3418ABE53710CCD5B8267"><enum>(1)</enum><text display-inline="yes-display-inline">A bona fide emergency, including—</text><subparagraph id="HE09337EA4D17411EA237CF861B271C0B"><enum>(A)</enum><text display-inline="yes-display-inline">a major disaster (as defined in section 102 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5122">42 U.S.C. 5122</external-xref>));</text></subparagraph><subparagraph id="H4F568D2CA2584A22B37AA214504C6EFF"><enum>(B)</enum><text>a significant public health emergency, such as a pandemic or widespread outbreak; or</text></subparagraph><subparagraph id="HD50557B504944D789063934C2303C2E9"><enum>(C)</enum><text display-inline="yes-display-inline">a cyberattack, data breach, or other significant security threat to the election infrastructure.</text></subparagraph></paragraph><paragraph id="H70581EB02FAF472AA8053873FF1CDCCF"><enum>(2)</enum><text display-inline="yes-display-inline">Technical difficulties, including—</text><subparagraph id="H84EB0315A72749CA88CD9F1961553D77"><enum>(A)</enum><text display-inline="yes-display-inline">malfunctioning election equipment or software; or</text></subparagraph><subparagraph id="HCBBBE7CDEBB847659FC9B859818E719B"><enum>(B)</enum><text>errors in the tabulation of ballots or the transmission of results that could not have been reasonably anticipated or mitigated in advance.</text></subparagraph></paragraph><paragraph id="H76244677BF3141F2B47A76DDFF71FDCC"><enum>(3)</enum><text display-inline="yes-display-inline">The implementation of new election procedures or reforms and the State certifies that it is in the process of complying with all such requirements, except that this paragraph applies only with respect to the first election held after the implementation of the new procedures or reforms.</text></paragraph><paragraph id="HBA1279B7660C43628560C8DBCFEB2D6B"><enum>(4)</enum><text display-inline="yes-display-inline">The conducting of a recount of the results of the election.</text></paragraph></subsection><subsection id="H0CAAA3C9AC6C400FA820E008525B033A"><enum>(c)</enum><header>Withholding of election administration funds for failure To comply with deadlines</header><text display-inline="yes-display-inline">If the Commission and the Attorney General each certify that a State is not in compliance with the requirements of subsection (a) with respect to an election, the State may not receive any funds from the Commission to support the administration of subsequent elections unless—</text><paragraph id="H4D0CD0090C1243B2881ADA726F80B8E5"><enum>(1)</enum><text>the State submits to the Commission and the Attorney General a plan to ensure that the State will comply with such requirements with respect to such subsequent elections; and</text></paragraph><paragraph id="H2D40D511FDF74043B38B28959C324935"><enum>(2)</enum><text>the Commission and the Attorney General each certify that the State has taken actions to comply with such plan.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HCD75997066AE42319279EB10E83736AE"><enum>(b)</enum><header>Conforming amendment relating to existing enforcement provisions</header><text>Section 401 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/21111">52 U.S.C. 21111</external-xref>), as amended by section 2(b) of the COCOA Act of 2024, is amended by striking <quote>and 304</quote> and inserting <quote>304, and 305</quote>.</text></subsection><subsection id="H8645C1C40F3B4D798278E7EF1BD44B8A"><enum>(c)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of contents of such Act, as amended by section 2(c) of the COCOA Act of 2024, is amended—</text><paragraph id="H08003E9840D246A285DB02B2B7376BA6"><enum>(1)</enum><text>by redesignating the items relating to sections 305 and 306 as relating to section 306 and 307; and</text></paragraph><paragraph id="HF0D4F465BFC449B1A87D9586B994C6FE"><enum>(2)</enum><text>by inserting after the item relating to section 304 the following:</text><quoted-block style="OLC" id="H383247CC51D34C799B98A65248971D2A" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 305. Deadlines for counting ballots and certifying results.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H47065540C07B4EFD86C500B3A15AD7A0"><enum>(d)</enum><header>Effective date</header><text>This Act and the amendments made by this Act shall apply with respect to elections held after the expiration of the 90-day period which begins on the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
