<section id="H04864EE72BC9467E9A35DF59622C7AA4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Student Athletes’ Economic Freedom Act of 2025</short-title></quote>.</text></section> <section id="H3D156002E33449D8A786891201A34B69"><enum>2.</enum><header>Employment standings</header><text display-inline="no-display-inline">Notwithstanding any other provision of Federal or State law, a student athlete (or former student athlete) may not be considered an employee of an institution, a conference, or an association under any Federal or State law or regulation based on participation of the student athlete (or former student athlete) in a varsity intercollegiate athletics program or a varsity intercollegiate athletics competition, or the existence of rules or requirements for being a member of any varsity sports team.</text></section>
<section id="H59289D74B4D248269C2E29855D994E9C"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="HD77DF19F29C04B6EA4C5BEF75668E37B"><enum>(1)</enum><header>Association</header><text>The term <term>association</term> means an organization that—</text>
<subparagraph id="H8649B962AC8C416AA2642FE32BC490A3"><enum>(A)</enum><text>has multiple conferences and institutions as members;</text></subparagraph> <subparagraph id="HBE65F64ADBCA4BD9900C2E8629EC3C33"><enum>(B)</enum><text>arranges championships for varsity intercollegiate athletics programs;</text></subparagraph>
<subparagraph id="HD4F6645813A548A0887E66ADFC5340D5"><enum>(C)</enum><text>sets rules for varsity intercollegiate athletics programs;</text></subparagraph> <subparagraph id="H2E27629BE913461AB077CD47BDD823E2"><enum>(D)</enum><text>sets rules for varsity intercollegiate athletics competitions; and</text></subparagraph>
<subparagraph id="H1B1CD3EF1A2E48AEAC3DEA5D1985FDDD"><enum>(E)</enum><text>is not a conference.</text></subparagraph></paragraph> <paragraph id="H75868E7698444145AB694E656A6CEC2D"><enum>(2)</enum><header>Conference</header><text>The term <term>conference</term> means an organization that—</text>
<subparagraph id="H9D7EF98DF6754C31AE5549880509DE92"><enum>(A)</enum><text>has multiple institutions as members;</text></subparagraph> <subparagraph id="H80DC0A9F2E764DB788763F16A83922B2"><enum>(B)</enum><text>sets rules for varsity intercollegiate athletics competitions;</text></subparagraph>
<subparagraph id="HC5F4D544C93E4BBBB10AA9501EA008C2"><enum>(C)</enum><text display-inline="yes-display-inline">arranges championships for varsity intercollegiate athletics programs; and</text></subparagraph> <subparagraph id="H993F9383F3024ED1BCD4ED311DB52A74"><enum>(D)</enum><text>is not an association.</text></subparagraph></paragraph>
<paragraph id="HBF138164049A48DE83333CAD9B547F9B"><enum>(3)</enum><header>Institution</header><text>The term <term>institution</term> means an institution of higher education (as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)) that sponsors a varsity intercollegiate athletics program in the United States.</text></paragraph> <paragraph id="H27B49C885E2B4197B857E1A087340F98"><enum>(4)</enum><header>Student athlete</header><text>The term <term>student athlete</term> means an individual who participates in a varsity intercollegiate athletics program.</text></paragraph>
<paragraph id="H41859A21A98A4FBD809AEF6151DFC2E6"><enum>(5)</enum><header>Varsity intercollegiate athletics competition</header><text>The term <term>varsity intercollegiate athletics competition</term> means a competition involving 2 or more varsity intercollegiate athletics programs sponsored by different institutions.</text></paragraph> <paragraph id="HD3409701F31A46098E1C51E783C41D23"><enum>(6)</enum><header>Varsity intercollegiate athletics program</header><text>The term <term>varsity intercollegiate athletics program</term> means a team or other program unit of an institution participating in a sport—</text>
<subparagraph id="HF2468EB5620A4E9DA989684BF7256958"><enum>(A)</enum><text>played at the intercollegiate level;</text></subparagraph> <subparagraph id="H0862EB2A08844A13AD1305C358CC8E75"><enum>(B)</enum><text>administered by an athletic department; and</text></subparagraph>
<subparagraph id="H2F7D78F1B288445390E4517520D262EF"><enum>(C)</enum><text>for which eligibility requirements for participation by student athletes are established by an association.</text></subparagraph></paragraph> <paragraph id="HA8DD4521BC3C4F2094D5D61C23365EC4"><enum>(7)</enum><header>Varsity sports team</header><text>The term <term>varsity sports team</term>—</text>
<subparagraph id="HE762F8E03C0D43C895691F58275C4FE4"><enum>(A)</enum><text>means a team of student athletes organized by a varsity intercollegiate athletics program to participate in a varsity intercollegiate athletics competition; and</text></subparagraph> <subparagraph id="H9349C04A70884BE0A0A992E7154A85EF"><enum>(B)</enum><text display-inline="yes-display-inline">does not include a team that is traditionally characterized as an intramural or club team.</text></subparagraph></paragraph></section>
