which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 49, United States Code, to require Amtrak to make traditional dining and an alternative, more affordable food and beverage service available to passengers on overnight routes of Amtrak, and for other purposes.</official-title></form><legis-body id="H3902E92F01AD4E7BBC92AF1DD32DEE40" style="OLC"><section id="H1225C49D3CFD4882A35291183E97DBC2" commented="no" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Train Establishment of Appetizing Table Service Act</short-title></quote> or the <quote><short-title>Train EATS Act</short-title></quote>.</text></section><section id="H387A28F25CDF4DA6894C3917EEF2CCD5"><enum>2.</enum><header>Food and beverage service requirements on overnight routes of Amtrak</header><subsection id="HE95F7ED22CF34FC587C4EA1CC5C7B648"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/243">Chapter 243</external-xref> of title 49, United States Code, is amended by adding at the end the following new section:</text><quoted-block style="USC" display-inline="no-display-inline" id="H7C21BB4F2E334EA39061EABF75953DA8"><section id="HDB0EB88D26FF4594A83BA91F7B867C7C"><enum>24324.</enum><header>Food and beverage service requirements on overnight routes of Amtrak.</header><subsection id="H5EC2E5B14C6E46DE81FD424C7B64AE98"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">On each covered route, Amtrak shall make available—</text><paragraph id="H402041203716400DB3A89F4B0DD67710"><enum>(1)</enum><text display-inline="yes-display-inline">to the extend practicable, in accordance with subsection (b), traditional dining; and</text></paragraph><paragraph id="H25B63ED23D244A4BB1CB4A0AA432C075"><enum>(2)</enum><text display-inline="yes-display-inline">to all passengers an alternative food and beverage service that is more affordable than traditional dining.</text></paragraph></subsection><subsection id="HB1B731109EB940D6A61F9D647315B40A"><enum>(b)</enum><header>Priority of traditional dining capacity</header><text display-inline="yes-display-inline">On each covered route on which traditional dining is available, Amtrak shall offer any traditional dining capacity not otherwise used by passengers in First Class or Business Class to passengers traveling in Coach Class (or other base fare class ticket) for a fee on a first-come, first-serve basis.</text></subsection><subsection id="H96CD3D26EB65497D805B95A2D44386CD"><enum>(c)</enum><header>Traditional dining meal options</header><text>Amtrak shall ensure that traditional dining on a covered route includes—</text><paragraph id="H61A19E1F122043B9B55CB81B2CC4193F"><enum>(1)</enum><text>a healthy meal option; and</text></paragraph><paragraph id="HD6DF37FCA7E1441CA4BD02C6082E1979"><enum>(2)</enum><text>upon pre-order from a passenger to whom traditional dining is offered, meals that satisfy the dietary restrictions of the passenger.</text></paragraph></subsection><subsection id="H98FA8DEF68344C22AA49CEFECD736EEB"><enum>(d)</enum><header>Regulations</header><text>The Secretary of Transportation shall issue such regulations as are necessary to carry out this section.</text></subsection><subsection id="H5CF761E8F0784097A93108BF748FC96C"><enum>(e)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H95592F0DEE2E4DBF820F3323BFA6429A"><enum>(1)</enum><header>Covered route</header><text display-inline="yes-display-inline">The term <term>covered route</term> means a rail passenger transportation route operated by Amtrak that is scheduled to depart and arrive on different dates.</text></paragraph><paragraph id="HF85C80C95DCA45C889EDD66620C04BA1"><enum>(2)</enum><header>Healthy meal option</header><text display-inline="yes-display-inline">The term <term>healthy meal option</term> means a meal the nutritional contents of which are consistent with the Dietary Guidelines for Americans established under section 301 of the National Nutrition Monitoring and Related Research Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/5341">7 U.S.C. 5341</external-xref>).</text></paragraph><paragraph id="HF18AB25E911C4F15A2569E712C02215C"><enum>(3)</enum><header>Traditional dining</header><text>With respect to rail passenger transportation, the term <term>traditional dining</term> means a food and beverage service—</text><subparagraph id="H38E9B72A765E4E49B3FF95B05865C51E"><enum>(A)</enum><text display-inline="yes-display-inline">for which a passenger is seated at a table in a car designated solely for such food and beverage service to order and eat a meal; and</text></subparagraph><subparagraph id="H8E587C08871643F38E8BAB68C02009DB"><enum>(B)</enum><text>that is serviced by wait staff.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HE048BE20E12E40828334ED7B87B3844E"><enum>(b)</enum><header>Clerical amendments</header><text display-inline="yes-display-inline">The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/243">chapter 243</external-xref> of title 49, United States Code, is amended by adding at the end the following new item:</text><quoted-block style="USC" display-inline="no-display-inline" id="H7A87E12A6F724C7E8355A0C0B684A784"><toc regeneration="no-regeneration"><toc-entry level="section">24324.
