R. 2643</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250403">April 3, 2025</action-date><action-desc><sponsor name-id="M001137">Mr. Meeks</sponsor> (for himself, <cosponsor name-id="M001157">Mr. McCaul</cosponsor>, and <cosponsor name-id="C001127">Mrs. Cherfilus-McCormick</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HFA00">Committee on Foreign Affairs</committee-name>, and in addition to the Committee on <committee-name committee-id="HJU00">the Judiciary</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Secretary of State to submit an annual report to Congress regarding the ties between criminal gangs and political and economic elites in Haiti and impose sanctions on political and economic elites involved in such criminal activities.</official-title></form><legis-body id="H8058F5A0F0C04B49A70649B1B4C0D383" style="OLC"><section id="HBF67A227CEEA42A68B96BD8363436479" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Haiti Criminal Collusion Transparency Act of 2025</short-title></quote>.</text></section><section id="H5AAE37428AFA4004AD05BA8FA0FF939D"><enum>2.</enum><header>Reporting requirements</header><subsection id="H02858B94F8A849A19661EF9393FC8F0B"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, and annually thereafter for the following 5 years, the Secretary of State, in coordination with other Federal agencies as appropriate, shall submit a report to the appropriate congressional committees regarding the ties between criminal gangs and political and economic elites in Haiti. The report shall—</text><paragraph id="H0C21018144EB4C4B9E4B48357AB740F3"><enum>(1)</enum><text>identify and list prominent criminal gangs in Haiti as well as the leaders thereof, and describe their criminal activities including coercive recruitment, and identify their primary geographic areas of operations;</text></paragraph><paragraph id="H08AC30875F9C49B295C012B8C3344492"><enum>(2)</enum><text>list Haitian political and economic elites who have direct links to criminal gangs and any organizations or entities controlled by these elites;</text></paragraph><paragraph id="H755BBD3B57F94A3DAA6301FD210C8312"><enum>(3)</enum><text>describe in detail the relationship between the individuals listed pursuant to paragraph (2) and the criminal gangs identified pursuant to paragraph (1);</text></paragraph><paragraph id="H0850EAD7A19345F2B73B81A3EF75DDE2"><enum>(4)</enum><text>describe in detail how Haitian political and economic elites use their relationships with criminal gangs to advance their political and economic interests and agenda;</text></paragraph><paragraph id="H4AAB2902B486427D9159DBA400892CDC"><enum>(5)</enum><text>include a list of each criminal organization assessed to be trafficking Haitians and other individuals to the United States border;</text></paragraph><paragraph id="H45C55EE680E0487E98D898F51D59A009"><enum>(6)</enum><text>include an assessment of ties between political and economic elites, criminal gangs in Haiti, and transnational criminal organizations;</text></paragraph><paragraph id="H6F378EBEF06B401182FF0FDA73398BE7"><enum>(7)</enum><text>include an assessment of how the nature and extent of collusion between political and economic elites and criminal gangs threatens the Haitian people and United States national interests and activities in the country; and</text></paragraph><paragraph id="H38569D0813BD4D32904A3C7709D947CF"><enum>(8)</enum><text>include an assessment of potential actions that the Government of the United States could take to address the findings made pursuant to paragraph (6).</text></paragraph></subsection><subsection id="H4A6B77F988654E11A5590B5E0BDCB2C2"><enum>(b)</enum><header>Form of report</header><text>The report required under subsection (a) shall be submitted in unclassified form, but may include a classified annex.</text></subsection></section><section id="HBDF3BE6959124ECCBD2C1A7120F4DA05"><enum>3.</enum><header>Sanctions</header><subsection id="HAF0E9929A3864D6C981DBB66DB8AF9D4"><enum>(a)</enum><header>In general</header><text>Not later than 90 days after the submission of the report to the appropriate committees, the President shall impose the sanctions described in subsection (b) with respect to each foreign person identified pursuant to sections 2(a)(1) and 2(a)(2).</text></subsection><subsection id="H3A0C0567FDEB4B24AEF662626D0EE25F"><enum>(b)</enum><header>Sanctions described</header><text>The sanctions described in this subsection are the following:</text><paragraph id="HA9E24C9019644A06A17245DEB6FB1362"><enum>(1)</enum><header>Property blocking</header><text>Notwithstanding the requirements of section 202 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref>), the President may exercise of all powers granted to the President by that Act to the extent necessary to block and prohibit all transactions in all property and interests in property of the foreign person if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</text></paragraph><paragraph id="H56807834BD814F5EB594A1A6CF8EB29C"><enum>(2)</enum><header>Visas, admission, or parole</header><subparagraph id="HC77CD5051A954471AC0FF1399E5FE3B7"><enum>(A)</enum><header>In general</header><text>An alien who the Secretary of State or the Secretary of Homeland Security (or a designee of one of such Secretaries) knows, or has reason to believe, is described in subsection (a) is—</text><clause id="HF9C54B0DFDE4400F9EB1C872E6CB4860"><enum>(i)</enum><text>inadmissible to the United States;</text></clause><clause id="H71C65B14CD4944ADB7A127F38A09C50C"><enum>(ii)</enum><text>ineligible for a visa or other documentation to enter the United States; and</text></clause><clause id="H45326DC864CD40EDB3B7ABA84DC29528"><enum>(iii)</enum><text>otherwise ineligible to be admitted or paroled into the United States or to receive any other benefit under the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>).</text></clause></subparagraph><subparagraph id="H0D0282A283584981801888A317740376"><enum>(B)</enum><header>Current visas revoked</header><clause id="HA7022A9DD5CA4F14A26ADC364C1A2FDC"><enum>(i)</enum><header>In general</header><text>The issuing consular officer, the Secretary of State, or the Secretary of Homeland Security (or a designee of one of such Secretaries) shall, in accordance with section 221(i) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1201">8 U.S.C. 1201(i)</external-xref>), revoke any visa or other entry documentation issued to an alien described in subsection (a) regardless of when the visa or other entry documentation is issued.</text></clause><clause id="H39BA5DB5DFCC4679A8D304F676E74D65"><enum>(ii)</enum><header>Effect of revocation</header><text>A revocation under clause (i) shall take effect immediately and shall automatically cancel any other valid visa or entry documentation that is in the alien’s possession.</text></clause></subparagraph></paragraph></subsection><subsection id="H5FE5352807E241EDA66059CC35E9C552"><enum>(c)</enum><header>Exceptions</header><paragraph id="HA3139338F1F34FFBA4A8031023E9CFF7"><enum>(1)</enum><header>Exception to comply with international obligations</header><text>Sanctions under this section shall not apply with respect to the admission of an alien if admitting or paroling the alien into the United States is necessary to permit the United States to comply with the Agreement regarding the Headquarters of the United Nations, signed at Lake Success June 26, 1947, and entered into force November 21, 1947, between the United Nations and the United States, or other applicable international obligations.</text></paragraph><paragraph id="H7A2C0AD409644D93AF4AF42A3E30D815"><enum>(2)</enum><header>Exception relating to the provision of humanitarian assistance</header><text>Sanctions under this section may not be imposed with respect to transactions or the facilitation of transactions for—</text><subparagraph id="H039480D20D494396A225346DAB38B92B"><enum>(A)</enum><text>the sale of agricultural commodities, food, medicine, or medical devices to Haiti;</text></subparagraph><subparagraph id="H03A6587C0441401789EBDFE657F2D767"><enum>(B)</enum><text>the provision of humanitarian assistance to the people of Haiti;</text></subparagraph><subparagraph id="H98EA2E89695546328F98A666DB726401"><enum>(C)</enum><text>financial transactions relating to humanitarian assistance or for humanitarian purposes in Haiti; or</text></subparagraph><subparagraph id="HE1C35D780DD34B3A95CFF4EAD5CF4DDC"><enum>(D)</enum><text>transporting goods or services that are necessary to carry out operations relating to humanitarian assistance or humanitarian purposes in Haiti.</text></subparagraph></paragraph></subsection><subsection id="H28392E47DB534C57A13B6B69A0D61B52"><enum>(d)</enum><header>Implementation; penalties</header><paragraph id="H425BA75AF6BA4D5BB47991F7E7CAB569"><enum>(1)</enum><header>Implementation</header><text>The President may exercise all authorities provided to the President under sections 203 and 205 of the International Emergency Economic Powers Act (50 U.S.C. 1702 and 1704) to carry out this subtitle.</text></paragraph><paragraph id="H71B809A6C61244439AAA2702E9C4682A" commented="no"><enum>(2)</enum><header>Penalties</header><text display-inline="yes-display-inline">The penalties provided for in of section 206(b) and (c) of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) shall apply to a person that violates, attempts to violate, conspires to violate, or causes a violation of regulations promulgated to carry out this section to the same extent that such penalties apply to a person that commits an unlawful act described in section 206(a) of that Act.</text></paragraph></subsection><subsection id="H0E132B65CCBB407F98A10EA93CB0EB20"><enum>(e)</enum><header>Waiver</header><text display-inline="yes-display-inline">The President may waive the application of sanctions or restrictions imposed with respect to a foreign person under this section if the President certifies to the appropriate congressional committees that the waiver is important to the national interests of the United States.</text></subsection></section><section id="H82C08F5F74234E7289128E843C4FA106"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HF4C39F76AAAF4DB6A76AFD98D98107B5"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph id="H35E46D3CA5A24535A763EB9B859AAFE4"><enum>(A)</enum><text>the Committee on Foreign Affairs of the House of Representatives;</text></subparagraph><subparagraph id="H45BFFC8997E6445C8EA705373212E90B"><enum>(B)</enum><text>the Committee on Foreign Relations of the Senate;</text></subparagraph><subparagraph id="HDF5033B60F354FC5A4F7212ACC064D16"><enum>(C)</enum><text>the Committee on Financial Services of the House of Representatives;</text></subparagraph><subparagraph id="H1CDA86B55C5C4BE398268F0F88556D1F"><enum>(D)</enum><text>the Committee on Banking, Housing, and Urban Affairs of the Senate;</text></subparagraph><subparagraph id="H728B3D5C7194496CBCC9857D94C69D93"><enum>(E)</enum><text>the House Permanent Select Committee on Intelligence;</text></subparagraph><subparagraph id="H94E98243710C4D8C9D408D655D7C3E3B"><enum>(F)</enum><text display-inline="yes-display-inline">the Senate Select Committee on Intelligence;</text></subparagraph><subparagraph id="HF24E075D2F4B4ABFAB9D48F71EAA5BA6"><enum>(G)</enum><text>the Committee on Appropriations of the House of Representatives; and</text></subparagraph><subparagraph id="H10A7534C75D04F228C40FFC60F9EC7DF"><enum>(H)</enum><text>the Committee on Appropriations of the Senate.</text></subparagraph></paragraph><paragraph id="H75D9DB5DB8F14AD3B501F2F07D3DD02D"><enum>(1)</enum><header>Foreign person</header><text>The term <term>foreign person</term> means an individual or entity that is not a United States person.</text></paragraph><paragraph id="HCE5DEF31DC6C432F9EF1C23BE39105D2"><enum>(2)</enum><header>United States person</header><text>The term <term>United States person</term> means—</text><subparagraph id="H959D1E7A80DB4DF184D22AA1A89652A3"><enum>(A)</enum><text>a United States citizen;</text></subparagraph><subparagraph id="H22A51938A32B47C3815B7548E7848FD2"><enum>(B)</enum><text>a permanent resident alien of the United States; or</text></subparagraph><subparagraph id="HD57F4B17CEFF4F87B5B9DF15D506C98A"><enum>(C)</enum><text>an entity organized under the laws of the United States or of any jurisdiction within the United States, including a foreign branch of such an entity.</text></subparagraph></paragraph><paragraph id="H130C8500B5EC493AA16B2521FD770CEF"><enum>(3)</enum><header>Economic elites</header><text>The term <term>economic elites</term> means board members, officers, and executives of groups, committees, corporations, or other entities that exert substantial influence or control over Haiti’s economy, infrastructure, or particular industries.</text></paragraph><paragraph id="H60816F0828884D8CA09475CDE8729941"><enum>(4)</enum><header>Political elites</header><text>The term <term>political elites</term> means current and former government officials and their high-level staff, political party leaders, and political committee leaders.</text></paragraph></section><section id="HFD2D1F6671E247F68AE3130941D82795"><enum>5.</enum><header>Sunset</header><text display-inline="no-display-inline">The authorities provided by this Act shall cease to have effect on the date that is 5 years after the date of the enactment of this Act.</text></section></legis-body></bill>
