the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Save Our Seas 2.0 Act to improve the administration of the Marine Debris Foundation, to amend the Marine Debris Act to improve the administration of the Marine Debris Program of the National Oceanic and Atmospheric Administration, and for other purposes.</official-title></form><legis-body id="HE26DBA64459448029D30865F1E19EDE2" style="OLC"><section section-type="section-one" id="H7F20A184B0A24D1EA37A0979C905DC01"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Save Our Seas 2.0 Amendments Act</short-title></quote>.</text></section><section id="HB4BCAE8606DC4FBBA198EE8EEFBFBD5D"><enum>2.</enum><header>Modifications to the marine debris program of the national oceanic and atmospheric administration</header><subsection id="HD57B56D57B684568925EB8DC11EAFE37"><enum>(a)</enum><header>In general</header><text>The Marine Debris Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/449">Public Law 109–449</external-xref>) is amended—</text><paragraph id="HE134CA3C849E42969148981E549CEDFE"><enum>(1)</enum><text>by inserting before section 3 the following:</text><quoted-block style="OLC" id="H338E3604CB8F4623816677C2A4172438"><subtitle id="H86475EC534F44CBA9F63F8C1F885B370"><enum>A</enum><header>NOAA And Coast Guard Programs</header></subtitle><after-quoted-block>; and </after-quoted-block></quoted-block></paragraph><paragraph id="HF94DE8A986544D37BC1302609EC2EBCC"><enum>(2)</enum><text>by redesignating sections 3 through 6 as sections 101 through 104, respectively. </text></paragraph></subsection><subsection id="H2DE67C74F6B54B5BAE94CF1E64A41F54"><enum>(b)</enum><header>Grants, cooperative agreements, contracts, and other agreements</header><text>Section 101(d) of the Marine Debris Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1952">33 U.S.C. 1952(d)</external-xref>), as redesignated by this Act, is amended—</text><paragraph id="HA787D5249DB94E6288A5E322876BCFD3"><enum>(1)</enum><text>in the subsection heading by striking <quote><header-in-text level="subsection" style="OLC">AND CONTRACTS</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">CONTRACTS, AND OTHER AGREEMENTS</header-in-text></quote>;</text></paragraph><paragraph id="H3D430B1A0AD148DA8E007ED41F58B0FB"><enum>(2)</enum><text>in paragraph (1) by striking <quote>and contracts</quote> and inserting <quote>, contracts, and other agreements</quote>;</text></paragraph><paragraph id="HBFBE838B40F5439483458642C56577DD"><enum>(3)</enum><text>in paragraph (2)—</text><subparagraph id="HB0E48E5DFBEA417094995C8D5B2FAB70"><enum>(A)</enum><text>in subparagraph (B)—</text><clause id="H492106338B4B4ACC8BB960EAA143B504"><enum>(i)</enum><text>by striking <quote>part of the</quote> and inserting <quote>part of a</quote>; and</text></clause><clause id="H99CDDAF90B2F4D18B3A4BEAD9C0AE4A5"><enum>(ii)</enum><text>by inserting <quote>or (C)</quote> after <quote>subparagraph (A)</quote>; provided in subparagraph (B)</quote> after <quote>subparagraph (A)</quote>; and</text></subparagraph></paragraph><paragraph id="HABFD42584B354B2F81F7D83A75C44754"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H11471D02516042FC86C390A9D71948A1"><paragraph id="HB321CEA8A3B24F8387CFFD26F20C7588"><enum>(7)</enum><header>In-kind contributions</header><text>With respect to any project carried out pursuant to a contract or other agreement entered into under paragraph (1) that is not a cooperative agreement or an agreement to provide financial assistance in the form of a grant, the Under Secretary may contribute on an in-kind basis the portion of the costs of the project that the Under Secretary determines represents the amount of benefit the National Oceanic and Atmospheric Administration derives from the project.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="HAFA3486C34A841C184B2A15CE5DC7628"><enum>3.</enum><header>Modifications to the marine debris foundation</header><subsection id="H8B604591A4B64B82B9CD558E045EB13D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subtitle B of title I of the Save Our Seas 2.0 Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/224">Public Law 116–224</external-xref>) is transferred to appear after section 104 of the Marine Debris Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/449">Public Law 109–449</external-xref>), as redesignated by this Act.</text></subsection><subsection id="H3BB25D8514C6444FB235B9A587D7A00D"><enum>(b)</enum><header>Status of foundation</header><text>Section 111(a) of the Marine Debris Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/449">Public Law 109–449</external-xref>), as transferred by this Act, is amended, in the second sentence, by striking <quote>organization</quote> and inserting <quote>corporation</quote>.</text></subsection><subsection id="HCA1BEF3A81B94D93BB18B9A7E5051739"><enum>(c)</enum><header>Purposes</header><text display-inline="yes-display-inline">Section 111(b) of the Marine Debris Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/449">Public Law 109–449</external-xref>), as transferred and redesignated by this Act, is amended—</text><paragraph id="H77C82C5F2F0A4B389A1F06D0B5395DCC"><enum>(1)</enum><text>in paragraph (3) by inserting <quote>Indian Tribes,</quote> after <quote>Tribal governments,</quote>; and</text></paragraph><paragraph id="H7E0DB86CBA1E4040BF09E0BBD97E6BAF"><enum>(2)</enum><text>in paragraph (4) by striking <quote>title II</quote> and inserting <quote>subtitle C</quote>. </text></paragraph></subsection><subsection id="H83EA66CC73F446A38673E6916B1D4317"><enum>(d)</enum><header>Board of directors</header><paragraph id="H0879E68E3A46408888FCE8E5187D1B6B"><enum>(1)</enum><header>Appointment, vacancies, and removal</header><text>Section 112(b) of the Marine Debris Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/449">Public Law 109–449</external-xref>), as transferred by this Act, is amended—</text><subparagraph id="H2A4423C7E759490B8A4EE2B4C1B23F34"><enum>(A)</enum><text>by redesignating paragraphs (1) through (5) as paragraphs (2) through (6) respectively;</text></subparagraph><subparagraph id="H4002DF92F7124FE78EE69211B3BD3D84"><enum>(B)</enum><text>by inserting before paragraph (2), as redesignated, the following:</text><quoted-block style="OLC" id="HB33C1468128A435582EAAAC011D8310A"><paragraph id="HB42A1101190C4ACF8FE1C41D3550DF62"><enum>(1)</enum><header>Recommendations of board regarding appointments</header><text>For appointments made under paragraph (2), the Board shall submit to the Under Secretary recommendations on candidates for appointment.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H73E5B7CBA58C4DA5B513236EF0153025"><enum>(C)</enum><text>in paragraph (2), as redesignated, in the matter preceding subparagraph (A)—</text><clause under paragraph (2) shall be appointed for a term of 6 years.</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph><subparagraph id="H50D688DE06FF405682F14774B649C4FE"><enum>(E)</enum><text>in paragraph (4)(A), as redesignated, by inserting <quote>with the approval of the Secretary of Commerce</quote> after <quote>the Board</quote>; and </text></subparagraph><subparagraph id="H600B96782D1C4ECF96C6869F8EDD2F39"><enum>(F)</enum><text>in paragraph (6), as redesignated—</text><clause id="HA17941AE47134C1092C471872329BACE"><enum>(i)</enum><text>by inserting <quote>the Administrator of the United States Agency for International Development,</quote> after <quote>Service,</quote>; and</text></clause><clause id="HC0B606D3F2FA440581BD6CD303CA7C2E"><enum>(ii)</enum><text>by inserting <quote>and with the approval of the Secretary of Commerce</quote> after <quote>EPA Administrator</quote>.</text></clause></subparagraph></paragraph><paragraph id="HB2DA6D1C7D8B417AA6A1B8EF68F667F3"><enum>(2)</enum><header>General powers</header><text>Section 112(g) of the Marine Debris Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/449">Public Law 109–449</external-xref>), as transferred by this Act, is amended—</text><subparagraph id="HB3739C3DA2914AB1AA0A91B5097FE8FA"><enum>(A)</enum><text>in paragraph (1)(A) by striking <quote>officers and employees</quote> and inserting <quote>the initial officers and employees</quote>; and</text></subparagraph><subparagraph id="H1E50FD68BD3E4E648F1BA46FA2877E52"><enum>(B)</enum><text>in paragraph (2)(B)(i) by striking <quote>its chief operating officer</quote> and inserting <quote>the chief executive officer of the Foundation</quote>.</text></subparagraph></paragraph><paragraph id="HF316AB1268E14809B05052F34CF07438"><enum>(3)</enum><header>Chief executive officer</header><text>Section 112 of the Marine Debris Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/449">Public Law 109–449</external-xref>), as transferred by this Act, is amended by adding at the end the following:</text><quoted-block style="OLC" id="HF0D9F4EEF06048B7932293E29160C4DE"><subsection id="HF6F24597F4AC4D5FB27D1737496B6D02"><enum>(h)</enum><header>Chief executive officer</header><paragraph id="HFFD60FFEFE054A2089E00DB781786D21"><enum>(1)</enum><header>Appointment; removal; review</header><text>The Board shall appoint and review the performance of, and may remove, the chief executive officer of the Foundation.</text></paragraph><paragraph id="H997C59EC462A442A861CE907F07A20B3"><enum>(2)</enum><header>Powers</header><text>The chief executive officer of the Foundation may appoint, remove, and review the performance of any officer or employee of the Foundation.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H2F9018337E4343ECBFEF1F9C5C45E1AA"><enum>(e)</enum><header>Powers of foundation</header><text>Section 113(c)(1) of the Marine Debris Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/449">Public Law 109–449</external-xref>), as transferred by this Act, is amended in the matter preceding subparagraph (A)—</text><paragraph id="HAE8957686389423BAAEA1C2C0665C0BA"><enum>(1)</enum><text>by inserting <quote>nonprofit</quote> before <quote>corporation</quote>; and</text></paragraph><paragraph id="HB166C7AE58B84A479037D7930EEBCCEB"><enum>(2)</enum><text>by striking <quote>acting as a trustee</quote> and inserting <quote>formed</quote>.</text></paragraph></subsection><subsection id="HF74F17B5A73D48CBA1639253A0BAB810"><enum>(f)</enum><header>Principal office</header><text>Section 113 of the Marine Debris Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/449">Public Law 109–449</external-xref>), as transferred by this Act, is amended by adding at the end the following:</text><quoted-block style="OLC" id="H4C9001D8A78841D99674A1BCB60B6F0C"><subsection id="HDE674E351A3243C2BB1319B240A5140F"><enum>(g)</enum><header>Principal office</header><text>The Board shall locate the principal office of the Foundation in the National Capital Region, as such term is defined in section 2674(f)(2) of title 10, United States Code, or a coastal shoreline community.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HB929D93EBBA1498598434B9A4C6E610C"><enum>(g)</enum><header>Best practices; rule of construction</header><text>Section 113 of the Marine Debris Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/449">Public Law 109–449</external-xref>), as transferred by this Act and amended by subsection (e), is further amended by adding at the end the following:</text><quoted-block style="OLC" id="HC342D7485189466DA0A0EC1163420B05"><subsection id="H1F6C634F42D44EF586878D9B71D2A295"><enum>(h)</enum><header>Best practices</header><paragraph id="H916AD1D96432428296CCDE1A0E2CE1F6"><enum>(1)</enum><header>In general</header><text>The Foundation shall develop and implement best practices for conducting outreach to Indian Tribes and Tribal Governments.</text></paragraph><paragraph id="HA950A7FB41DE4C6294582C8B945FB0EB"><enum>(2)</enum><header>Requirements</header><text>The best practices developed under paragraph (1) shall—</text><subparagraph id="H23F3092595AB452D9EF29AFA4FB190DA"><enum>(A)</enum><text>include a process to support technical assistance and capacity building to improve outcomes; and</text></subparagraph><subparagraph id="H68CFA7F9F8F448B58BC37B39B3AC09A9"><enum>(B)</enum><text>promote an awareness of programs and grants available under this Act.</text></subparagraph></paragraph></subsection><subsection commented="no" id="H1330C9E1E6B543F1B8E0DC297685AF4E"><enum>(i)</enum><header>Rule of construction</header><text>Nothing in this Act may be construed—</text><paragraph commented="no" id="H5C21C889C5574252AE4F1CE0C0DE47BC"><enum>(1)</enum><text>to satisfy any requirement for government-to-government consultation with Tribal Governments; or</text></paragraph><paragraph commented="no" id="H07D8F44D87EB4CB2812875F456EBA656"><enum>(2)</enum><text>to affect or modify any treaty or other right of any Tribal Government.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H6C230F8F1A9245B3A237248E668EA90D"><enum>(h)</enum><header>Authorization of appropriations</header><text>Section 118(a) of the Marine Debris Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/449">Public Law 109–449</external-xref>), as transferred by this Act, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="H1D331D9CD90044108AD8AB25A568A3E1"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by inserting <quote>and $2,000,000 for fiscal year 2025</quote> after <quote>through 2024</quote>; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB631B10DEE9E488EA16C0732C32E5076"><enum>(2)</enum><text>in paragraph (2), by striking <quote>and State and local government agencies</quote> and inserting <quote>, State and local government agencies, regional organizations, Indian Tribes, Tribal organizations, and foreign governments</quote>.</text></paragraph></subsection><subsection id="H9A8F5DB0C82648419FE92322392DE216"><enum>(i)</enum><header>Reauthorization</header><text display-inline="yes-display-inline">Section 9(a) of the Marine Debris Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/449">Public Law 109–449</external-xref>) is amended by striking <quote>for</quote> the first place it appears and all that follows through <quote>carrying out</quote> and inserting <quote>for each of fiscal years 2018 through 2029 for carrying out</quote>.</text></subsection></section><section id="HCCEFC28A2EAB420B91AE0C54A98AC81F"><enum>4.</enum><header>Transfers</header><subsection id="HA3FFFD6D06F747A391CF0288F3E4F1EB"><enum>(a)</enum><header>Save our seas 2.0 act</header><text>Subtitle C of title I of the Save Our Seas 2.0 Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/224">Public Law 116–224</external-xref>) is transferred to appear after section 119 of the Marine Debris Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/449">Public Law 109–449</external-xref>) as transferred and redesignated by this Act.</text></subsection><subsection id="H7B88636CB1D84083B5D9ABEF7AEE78FB"><enum>(b)</enum><header>Marine debris act</header><text>The Marine Debris Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/449">Public Law 109–449</external-xref>) is amended—</text><paragraph id="H1B09F8E5049F45DBAA1F0E3A356DF1DD"><enum>(1)</enum><text>by transferring sections 7, 8, 9 (as amended), and 10 to appear after section 127, as transferred by this Act, and redesignated as sections 131, 132, 133, and 134, respectively; and</text></paragraph><paragraph id="HE882F1E9E46D43F5A85BDF6DE7183D43"><enum>(2)</enum><text>by inserting before section 131, as so transferred and redesignated, the following:</text><quoted-block style="OLC" id="HDEDF1119666B4F94A7AE948BAEC19E2E"><subtitle id="HC2A9205300AA4CD7956AF6A12D9FD09A"><enum>D</enum><header>Administration</header></subtitle><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="H910B8096AC804C5089DC2075E1DA2A74"><enum>5.</enum><header>Definitions</header><subsection id="H596710602E5C4A26B386280105AE0994"><enum>(a)</enum><header>In general</header><text>Section 131 of the Marine Debris Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/449">Public Law 109–449</external-xref>), as transferred and redesignated by this Act, is amended—</text><paragraph id="H266E047A35A54631A7DDAEF8F335D9BB"><enum>(1)</enum><text>by striking paragraph (1);</text></paragraph><paragraph id="HBCACBD239D5E4DDDAFA08294A5A7E751"><enum>(2)</enum><text>by redesignating paragraphs (2), (3), (4), (5), (6), and (7) as paragraphs (5), (6), (7), (11), (12), and (13), respectively;</text></paragraph><paragraph id="H59818DDDC7A64B7B956EC3EFB5E06E9C"><enum>(3)</enum><text>by inserting before paragraph (5), as so redesignated, the following:</text><quoted-block style="OLC" given such term in section 2 of the Save Our Seas 2.0 Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/224">Public Law 116–224</external-xref>).</text></paragraph><paragraph id="H915092122CF24A719DB5257562A13D15"><enum>(2)</enum><header>Coastal shoreline community</header><text>The term <quote>coastal shoreline community</quote> means a city or county directly adjacent to the open ocean, major estuaries, or the Great Lakes.</text></paragraph><paragraph id="H7ADB9A4C40E54366ABFE53FE6B5A1967"><enum>(3)</enum><header>EPA administrator</header><text>The term <quote>EPA Administrator</quote> has the meaning given such term in section 2 of the Save Our Seas 2.0 Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/224">Public Law 116–224</external-xref>).</text></paragraph><paragraph id="H248514F9DAA441D394763426CC2F742C"><enum>(4)</enum><header>Indian Tribe</header><text>The term <quote>Indian Tribe</quote> has the meaning given that term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HAB7182504A0B46489AEB00C7B2188495"><enum>(4)</enum><text>by inserting before paragraph (11), as so redesignated, the following:</text><quoted-block style="OLC" id="H04030598163B4DD79B04623D466EB4C8"><paragraph id="H7B8CAD020FB14769914B5708E70E54F8"><enum>(9)</enum><header>Nonprofit organization</header><text>The term <quote>nonprofit organization</quote> has the meaning given such term in section 2 of the Save Our Seas 2.0 Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/224">Public Law 116–224</external-xref>).</text></paragraph><paragraph id="H1435BC8CC30D4D0C98C74E4D8DE7102E"><enum>(10)</enum><header>Post-consumer materials management</header><text>The term <quote>post-consumer materials management</quote> has the meaning given such term in section 2 of the Save Our Seas 2.0 Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/224">Public Law 116–224</external-xref>).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H05D08B9FB8FB429C954993F2CF5DE73F"><enum>(5)</enum><text>by inserting after paragraph (13), as so redesignated, the following:</text><quoted-block style="OLC" id="HA7273E0ED6B940AFB0A3E8A67C6340E2"><paragraph commented="no" id="HD6B52740C8BC4176BE879C72A743C7BD"><enum>(14)</enum><header>Tribal Government</header><text display-inline="yes-display-inline">The term <quote>Tribal Government</quote> means the recognized governing body of any Indian or Alaska Native Tribe, band, nation, pueblo, village, community, component band, or component reservation, individually identified (including parenthetically) in the list published most recently as of the date of the enactment of the Save Our Seas 2.0 Amendments Act pursuant to section 104 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref
