<official-title display="yes">To amend the National Marine Sanctuaries Act to prohibit requiring an authorization for the installation, continued presence, operation, maintenance, repair, or recovery of undersea fiber optic cables in a national marine sanctuary if such activities have previously been authorized by a Federal or State agency.<pagebreak/></official-title>

<section id="H2FB45E7D49D24BA69BC346A2BCC34319" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Undersea Cable Protection Act of 2025</short-title></quote>.</text></section> <section id="H8BEA30EA18AF4AE991D284DADBF25F53" section-type="subsequent-section"><enum>2.</enum><header>Prohibition on prohibiting, or requiring permits or other authorizations for, undersea fiber optic cables authorized by a Federal or State agency</header><text display-inline="no-display-inline">The National Marine Sanctuaries Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1431">16 U.S.C. 1431 et seq.</external-xref>) is amended by inserting after section 310 the following: </text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="HB92A006CD6BC4B329192639C256CD805"> 
<section id="H70240A50B2DE4A6B84D9C8F44F0B0028"><enum>310A.</enum><header>Prohibition on prohibiting, or requiring permits or other authorizations for, undersea fiber optic cables authorized by a Federal or State agency</header> 
<subsection id="HB71A3C4716C948B3A0A0C1295797BD71" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this Act, the Secretary may not prohibit, or require any permit, including any special use permit, or other authorization for, the installation, continued presence, operation, maintenance, repair, or recovery of undersea fiber optic cables in a national marine sanctuary if a license, lease, or permit has been issued by a Federal or State agency, and is in effect, authorizing such installation, continued presence, operation, maintenance, repair, or recovery. </text></subsection> <subsection id="HCFDBC5D7792942B1BF2968F14059F745" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Interagency cooperation</header><text display-inline="yes-display-inline">Nothing in this section shall be construed as altering existing requirements regarding interagency cooperation under section 304(d) in any Federal agency action described in that section and involving the installation, continued presence, operation, maintenance, repair, or recovery of undersea fiber optic cables in a national marine sanctuary.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H53411A71D8234347BBFF60EABBB5AEC7"><enum>3.</enum><header>Removing restrictions on activities covered by sanctuary special use permits</header><text display-inline="no-display-inline">Section 310(c) of National Marine Sanctuaries Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1441">16 U.S.C. 1441(c)</external-xref>) is amended—</text> <paragraph id="H3C24E3F039A845F5ABB68AF4E4A7BBDD"><enum>(1)</enum><text>in paragraph (1), by adding <quote>and</quote> at the end;</text></paragraph> 
<paragraph id="HEC69E3DF8D974B62AC152B570841E937"><enum>(2)</enum><text>by striking paragraphs (2) and (3); and</text></paragraph> <paragraph id="HA63F49B00B444FEA9F0C8B62E7B6D377"><enum>(3)</enum><text>by redesignating paragraph (4) as paragraph (2).</text></paragraph></section> 
</legis-body><official-title-amendment>Amend the title so as to read: <quote>A bill to amend the National Marine Sanctuaries Act to prohibit the Secretary of Commerce from prohibiting, or requiring any permit or other authorization for, the installation, continued presence, operation, maintenance, repair, or recovery of undersea fiber optic cables in a national marine sanctuary if such activities have been authorized by a Federal or State agency.</quote>.</official-title-amendment>
