R. 2616</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250403">April 3, 2025</action-date><action-desc><sponsor name-id="W000798">Mr. Walberg</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and Workforce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require public elementary and middle schools that receive funds under the Elementary and Secondary Education Act of 1965 to obtain parental consent before changing a minor’s gender markers, pronouns, or preferred name on any school form or sex-based accommodations, including locker rooms or bathrooms.</official-title></form><legis-body id="H2751DD68D59A46D286B67588FDD35101" style="OLC"><section section-type="section-one" id="H94352C9048DD4FA48655A00F23CE58BD"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Parental Rights Over The Education and Care of Their Kids Act </short-title></quote> or the <quote><short-title>PROTECT Kids Act</short-title></quote>.</text></section><section id="HE02E65E586DE418EA702A6456B47D864"><enum>2.</enum><header>Requirement related to gender markers, pronouns, and preferred names on school forms</header><subsection id="H59E610378AF346929DFADC0B46279E62"><enum>(a)</enum><header>Requirement</header><text display-inline="yes-display-inline">As a condition of receiving funds under the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6301">20 U.S.C. 6301 et seq.</external-xref>), a public school that receives funds under such Act shall be required to obtain parental consent before changing a covered student’s—</text><paragraph id="H2590C7E54480450BB0EAF2CD93222EBD"><enum>(1)</enum><text display-inline="yes-display-inline">gender markers, pronouns, or preferred name on any school form; or</text></paragraph><paragraph id="H1A0902CB3D9448729C2354184CB1F255"><enum>(2)</enum><text>sex-based accommodations, including locker rooms or bathrooms.</text></paragraph></subsection><subsection id="H8CE8BD9005B343A3A6CB311BF84E5F88"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H4E9AF85138554BE5842768585B04AAF3"><enum>(1)</enum><header>Covered student</header><text>The term <quote>covered student</quote> means a minor who is—</text><subparagraph id="H6AE0DD1C2D694C92B6187E094316B05D"><enum>(A)</enum><text>an elementary school student; or</text></subparagraph><subparagraph id="HB0A20993995C4A11BC2468E35FC278B8"><enum>(B)</enum><text>a student in any of the middle grades.</text></subparagraph></paragraph><paragraph id="H6C62F1267E204E798DEF08558DC0BAAB"><enum>(2)</enum><header>ESEA terms</header><text>The terms <quote>elementary school</quote>, <quote>middle grades</quote>, and <quote>parent</quote> have the meanings given such terms in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph></subsection></section></legis-body></bill>
