which was referred to the <committee-name committee-id="HFA00">Committee on Foreign Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit the Executive branch from engaging in any reorganization of the Department of State without congressional consultation and approval.</official-title></form><legis-body id="H5C9455806B1D4DB1A67C4B3ADF43D944" style="OLC"><section id="H64A96EEF0D9846D3BBDE5FC8FC962E85" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Defending American Diplomacy Act</short-title></quote>.</text></section><section id="HAFC040A8FD944160B98850B780CB50B2"><enum>2.</enum><header>Prohibition on implementation absent specific statutory authorization</header><subsection id="H0C74BCC30D1544C0B5F5A965AA2BA126"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">No reorganization of the Department of State may be implemented or otherwise take effect unless both of the following conditions are met:</text><paragraph id="HE78D30024E844C99B6A3FBCFFCEE3C11"><enum>(1)</enum><text>There is enacted specific statutory authorization to carry out such reorganization.</text></paragraph><paragraph id="H2C348A6195D040A3AED0A0F28F32739A"><enum>(2)</enum><text>The Secretary of State has submitted to the appropriate congressional committees a detailed plan, pursuant to section 3, with respect to the reorganization.</text></paragraph></subsection><subsection id="H15D77C607EBA42AB9B81E4DCB087AA75"><enum>(b)</enum><header>Consequence for noncompliance</header><text>On and after the date on which the Comptroller General certifies to the Chair and Ranking Member of each of the appropriate congressional committees that the Secretary of State has implemented a reorganization in a manner that is not in compliance with the prohibition under subsection (a)—</text><paragraph id="H0F1036AE8CDF4731A23916004E72DC47"><enum>(1)</enum><text>no Federal funds may be made available to facilitate any activity of the Department of Government Efficiency; and</text></paragraph><paragraph id="HD093BE903B134CDA8E87D9486FD2D8D6"><enum>(2)</enum><text>none of the funds appropriated or otherwise made available to the Department of State may be obligated or expended for official travel by any politically appointed official of the Department.</text></paragraph></subsection></section><section id="H7318B6B0B4B748FDB3EC53EEDD63080A"><enum>3.</enum><header>Requirement for submission of detailed plans</header><text display-inline="no-display-inline">Upon determining that any reorganization of the Department of State or any component of such Department is necessary, the Secretary of State shall submit to the appropriate congressional committees a detailed plan for such reorganization that shall include, at a minimum, the following elements:</text><paragraph id="H57B1FFA4269B47C5B9B95F3C86FCEA3A"><enum>(1)</enum><text display-inline="yes-display-inline">A clear description of the proposed organizational changes and a justification for such changes, including a description of the manner and extent to which current roles, responsibilities, and personnel of the Department or relevant component of the Department will be affected.</text></paragraph><paragraph id="H329C39723A524E59A763536613697C93"><enum>(2)</enum><text display-inline="yes-display-inline">A clear description of what, if any, new responsibilities the Department or affected component will absorb and a detailed plan of how the Department or affected component will develop or acquire the competencies and expertise to carry out these new responsibilities.</text></paragraph><paragraph id="H72187121B09F4579A6923AFEF85CF336"><enum>(3)</enum><text display-inline="yes-display-inline">An analysis of the potential impacts on the ability to advance United States foreign policy interests, including impacts to each of the following:</text><subparagraph id="HB0F5C5586353404BB8FB95AF79697915"><enum>(A)</enum><text>Diplomatic footprint and operations abroad.</text></subparagraph><subparagraph id="H86600193C057424A9F2D6FF93E0501A2"><enum>(B)</enum><text>Consular services and visa processing times, including as a result of any closures of consulates and diplomatic posts abroad.</text></subparagraph><subparagraph id="HA97E710114C7472EBF2A090171E34B39"><enum>(C)</enum><text>The ability to carry out existing multilateral and bilateral diplomatic commitments.</text></subparagraph><subparagraph id="HB343C15DB7F844EFBDFF90FFC49C9BE7"><enum>(D)</enum><text>Bilateral and multilateral military cooperation and security assistance.</text></subparagraph><subparagraph id="HEA0EF54986984DAAB9872242C9273F95"><enum>(E)</enum><text>United States intelligence gathering capabilities and United States intelligence posture abroad.</text></subparagraph><subparagraph id="H261D319364E5464AAFFAA9965EAE56CD"><enum>(F)</enum><text>Interagency coordination with international partners.</text></subparagraph><subparagraph id="H9C8C09884E34438D9127212FCCC8DAB8"><enum>(G)</enum><text display-inline="yes-display-inline">Advancing United States development objectives abroad and facilitating the delivery of lifesaving humanitarian assistance.</text></subparagraph></paragraph><paragraph id="H6531868929FF4173AE3EC87BE30451D4"><enum>(4)</enum><text>An explanation of how the proposed changes will improve the Department of State’s ability to carry out its overall strategic objectives in comparison to the previous organizational structure.</text></paragraph><paragraph id="HD7E761302F834120B059A6EA97D1949C"><enum>(5)</enum><text>An assessment of the potential risks or unintended consequences that may result from the proposed changes, including—</text><subparagraph id="H3D3AC0D654D343D7B2D365C09AA44728"><enum>(A)</enum><text display-inline="yes-display-inline">how United States competitors might capitalize on any downsizing of diplomatic functions to advance their own military, intelligence, soft power, economic, or political interests; and</text></subparagraph><subparagraph id="H0B76C4CACB9940BD9EC79C7E9E56B244"><enum>(B)</enum><text>which diplomatic relationships and United States interests would be especially vulnerable to the impacts of the desired reorganization.</text></subparagraph></paragraph><paragraph id="H188000467F7549C780EA7F88F6FB7222"><enum>(6)</enum><text display-inline="yes-display-inline">A detailed implementation plan and timeline for making the proposed changes, including mechanisms to mitigate any adverse effects on the Department or affected component’s functions and personnel that would provide a more stable transition.</text></paragraph><paragraph id="H86338556DD8C49418481C8A1753CBA79"><enum>(7)</enum><text display-inline="yes-display-inline">A detailed analysis of the impact on the workforce and personnel of the affected components as well as the broader Department and a transition plan for the termination or reassignment and retraining of employees, including plans for the compensation of any terminated employees.</text></paragraph><paragraph id="H302379C70CB047F4B70A2AC1C51ACC50"><enum>(8)</enum><text display-inline="yes-display-inline">A certification that no Federal laws or regulations will be violated for the purposes of executing the reorganization, including specifically that no affected employee’s rights or protections will be violated.</text></paragraph></section><section id="HFB396190688542E5A4EB544BED1CF69B"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H39489E8CCAB64AFAB150B0461988576F"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <quote>appropriate congressional committees</quote> means the Committee on Foreign Affairs and Committee on Appropriations of the House of Representatives and the Committee on Foreign Relations and the Committee on Appropriations of the Senate. </text></paragraph><paragraph id="HA32CFC6E861E4A54AA0DF30F720AB2D5"><enum>(2)</enum><header>Reorganization</header><text display-inline="yes-display-inline">The term <term>reorganization</term> means any action which, pursuant to section 7063 of division F of <external-xref legal-doc="public-law" parsable-cite="pl/118/47">Public Law 118–47</external-xref>, would require prior consultation and notification.</text></paragraph></section></legis-body></bill>
