<section id="H0678968A418A4BD197BBC4D4FC386576" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Improving Reporting to Prevent Hate Act of 2025</short-title></quote>. </text></section> <section id="H3BCCB363B0B344A2A72163108E4A35E1"><enum>2.</enum><header>Requirement to credibly report hate crimes</header><text display-inline="no-display-inline">Section 505 of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10156">34 U.S.C. 10156</external-xref>) is amended by adding at the end the following: </text>

<subsection id="HFE5FD93081314B439F79BCC5CB948EC5"><enum>(j)</enum><header>Evaluation for reporting on hate crimes</header><text>Beginning not later than three years after the date of the enactment of this Act and from the data acquired by the Attorney General in accordance with the Hate Crimes Statistics Act (<external-xref legal-doc="usc" parsable-cite="usc/34/41305">34 U.S.C. 41305</external-xref>), the Attorney General shall establish a method of evaluating and use such method to evaluate whether a covered jurisdiction has credibly reporting hate crimes, including whether, for each year, a covered jurisdiction—</text> <paragraph id="HF7509421ABC84E0CAF4D5BDA5CEFC01A"><enum>(1)</enum><text>has not reported hate crime data to the Federal Bureau of Investigation; or</text></paragraph>
<paragraph id="H57E13D5DAFD743CB9FA0E3C7CB702742"><enum>(2)</enum><text display-inline="yes-display-inline">has reported zero hate crime incidents to the Federal Bureau of Investigation. </text></paragraph></subsection> <subsection id="H300E3FA81F8E4820980747D6B5EE5A61"><enum>(k)</enum><header>Eligibility</header> <paragraph id="H3AACA574EFEA4F12B495E5F07168B2D6"><enum>(1)</enum><header>In general</header><text>A covered jurisdiction that is found not to have credibly reported hate crimes following an evaluation pursuant to subsection (j) shall not be eligible for an allocation under this section.</text></paragraph>
<paragraph id="HE6333F6A915C4E0FBBE8185CFB038C76"><enum>(2)</enum><header>Exception</header><text>A covered jurisdiction that is found not to have credibly reported hate crimes following an evaluation pursuant to subsection (j) shall not be subject to a penalty under paragraph (1) if the Attorney General certifies that the covered jurisdiction has conducted significant community public education and awareness initiatives on hate crimes.</text></paragraph></subsection> <subsection id="HC1DD18B2CB254378BB079974F3B32E67"><enum>(l)</enum><header>Annual report</header><text display-inline="yes-display-inline">Each year the Attorney General shall publish on the internet website of the Department of Justice a report on the covered jurisdictions certified under subsection (k)(2).</text></subsection>
<subsection id="H87E3B1DDF68C4C4180F6AD08DDFC47D9"><enum>(m)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H0F344217E4CC4D1DAB5762BD99C46EF4"><enum>(1)</enum><header>Covered jurisdiction</header><text display-inline="yes-display-inline">The term <quote>covered jurisdiction</quote> means a unit of local government that has a requested a grant under this subpart and has a population of over 100,000 people.</text></paragraph>
<paragraph id="HDE76C71F3E0E436D9133821869FF0ED8"><enum>(2)</enum><header>Hate crime</header><text>The term <term>hate crime</term> means—</text> <subparagraph id="H68D130C65D2B48F8855116E4F5EBA4A1"><enum>(A)</enum><text display-inline="yes-display-inline">an act described in section 1(b)(1) of the Hate Crime Statistics Act ((34 U.S.C. 41305(1)(b)(1)); and </text></subparagraph>
<subparagraph id="H3907706250174D869012DDF6453972AF"><enum>(B)</enum><text>an act in violation of sections 241, 245, 247, or 249 of title 18, United States Code. </text></subparagraph></paragraph> <paragraph id="H85D18413D3DD416AB90B0FEE2BAF1234"><enum>(3)</enum><header>Significant community public education and awareness initiatives on hate crimes</header><text display-inline="yes-display-inline">The term <quote>significant community public education and awareness initiatives on hate crimes</quote> means that a covered jurisdiction—</text>
<subparagraph id="HC7DC228FC7464CC79405A6F4EA43DA44"><enum>(A)</enum><text>has—</text> <clause id="HA6B628E1433542128E6F49CD78F87226"><enum>(i)</enum><text>made substantial progress towards comprehensive reporting hate crimes; </text></clause>
<clause id="H563005EDDC3D4690884686CD22F215A7"><enum>(ii)</enum><text>adopted a policy on identifying, investigating, and reporting hate crimes; and </text></clause> <clause id="HFEEC2324AC044439883C066AF558B3CF"><enum>(iii)</enum><text display-inline="yes-display-inline">developed a standardized system of collecting, analyzing, and reporting hate crimes to the National Incident-Based Reporting System of the Federal Bureau of Investigation; or </text></clause></subparagraph>
<subparagraph id="H373F74D2DBC24422B14CB661F9A94DDD"><enum>(B)</enum><text>may—</text> <clause id="HD6A523D2FA084EFBBFA15303CE3F5AF8"><enum>(i)</enum><text>establish a unit or liaison specialized in identifying, investigating, and reporting hate crimes and engaging in community relations functions related to preventing hate crimes; or</text></clause>
<clause id="HF3A2718B6DD342D582E85B63CD7E8A64"><enum>(ii)</enum><text>conduct an ongoing and regular public meetings or educational forums on the impact of hate crimes, services available to victims of hate crimes, and any relevant Federal, State, or local laws related to hate crimes.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> </legis-body></bill>
