<section id="H549410BCF1BD460C815C5D85947B6C5E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American Tank Car Modernization Act of 2025</short-title></quote>. </text> </section> <section id="HC107E0231E744B61B763F8B5F88CE8B0" commented="no"><enum>2.</enum><header>Grant programs for adoption of certain telematics systems</header> <subsection id="H5A0BF500700648A8AD86A5042EC4F474" commented="no"><enum>(a)</enum><header>Onboard freight railcar telematics systems and gateway device grant program</header><text>The Administrator of the Federal Railroad Administration shall establish a grant program to provide funds to freight railcar owners or operators to purchase and install—</text> 
<paragraph id="H6A5776613C9F4AA29E32A069C9EF9A88" commented="no"><enum>(1)</enum><text>onboard freight railcar telematics systems; or</text></paragraph> <paragraph id="HC10D46F882104ED5B7E44D5ED6160A6A" commented="no"><enum>(2)</enum><text>onboard freight railcar gateway devices.</text></paragraph></subsection> 
<subsection id="HE4D8F5557580400B95A7ECE247068DBD" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Eligible entities</header><text>Eligible entities for funding under the grant program under this section are freight railcar owners.</text></subsection> <subsection id="HB9E8522DCE2E4D0DA75390832AAD4249" commented="no"><enum>(c)</enum><header>Use of funds</header><text display-inline="yes-display-inline">Funds provided under this section may be used to purchase and install onboard freight railcar telematic systems or onboard freight railcar gateway devices that enable the recipient of a grant to obtain and enhance the data collected from such systems and devices resulting in the following:</text> 
<paragraph id="H30AFDDBCE1B5486FAF82206901721599" commented="no"><enum>(1)</enum><text>Near real-time visibility of freight railcar location and freight railcar asset health.</text></paragraph> <paragraph id="H6D5DC8AB61144D4EA39F03C49D905CA2" commented="no"><enum>(2)</enum><text>Increasing the visibility to the safety of the asset and commodity within the freight railcar asset.</text></paragraph> 
<paragraph id="HA228389E494A4D8BB63F67DAFD6E44B3" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">Increasing future capability of real-time visibility in the development of onboard freight railcar sensor technology that measures or monitors, for purposes of gathering information on maintenance requirements (and enables railcar owners, operators, and shippers to identify railcars that could become a hazard)—</text> <subparagraph id="H0ACB7C32A9B7497883C36AEF3485BCF6"><enum>(A)</enum><text>railcar impact;</text></subparagraph> 
<subparagraph id="HA7EF9D3036FD4847919EBC07044343F0"><enum>(B)</enum><text>wheel or wheel bearing temperature;</text></subparagraph> <subparagraph id="HE7B19100A32046448C0E13DE9E708FC3"><enum>(C)</enum><text>whether a hand brake is on or off;</text></subparagraph> 
<subparagraph id="HAEE6C96F0CD14646985101F66D3BC049"><enum>(D)</enum><text>whether a hatch is open or closed; and</text></subparagraph> <subparagraph id="HF36BA5319926473AADD7018F201D87CB"><enum>(E)</enum><text>internal railcar temperature.</text></subparagraph></paragraph> 
<paragraph id="HF870429640734612ADE37C353FDE758D" commented="no"><enum>(4)</enum><text>Increasing the efficiency of railcar utilization in the North American freight railcar fleet.</text></paragraph> <paragraph id="HB4CEC6448A2247E588A248750E1388DF" commented="no"><enum>(5)</enum><text>Reducing reliance on human and manual data capture, reducing the risk of errors due to data latency and timeliness related to freight railcar data and information.</text></paragraph> 
<paragraph id="H1D8CF66709364F24AB15C50910FC82CB" commented="no"><enum>(6)</enum><text>Offering development of alerts and triggers to capture and transmit freight railcar mechanical issues to the railroad operator for action.</text></paragraph> <paragraph id="H95CCCA4E3AAF420F972F9810B29B2622" commented="no"><enum>(7)</enum><text>Ability to communicate events real-time to a wide variety of stakeholders.</text></paragraph></subsection> 
<subsection id="H3D6E94AC4B8946858C2E6B5DDA4BD57B" commented="no"><enum>(d)</enum><header>Grant use prioritization</header><text display-inline="yes-display-inline">In selecting recipients of grants under this section, the Administrator shall prioritize installation of onboard freight railcar telematic systems or onboard freight railcar gateway devices in the following order of priority:</text> <paragraph id="H64BC6CE30AB1422794EF162A0F946926" commented="no"><enum>(1)</enum><text>Newly built freight railcars manufactured by a qualified manufacturer in a qualified facility.</text></paragraph> 
<paragraph id="H52F2DDE3DAFF4771AEBE11F7ED9B3470" commented="no"><enum>(2)</enum><text>Freight railcars entering a certification event in a qualified facility.</text></paragraph> <paragraph id="H412183D6CF6C4484B56DB8CFA4A293C4" commented="no"><enum>(3)</enum><text>Freight railcars entering a shopping event or maintenance event in a qualified facility.</text></paragraph></subsection> 
<subsection id="H18752462B19241FAAC53B956DCD2C35E" commented="no"><enum>(e)</enum><header>Freight railcar type prioritization</header><text display-inline="yes-display-inline">After establishing the priority requirements under subsection (c), the Administrator shall further ensure that the freight railcar types eligible to receive such an installation be considered in the following order of priority:</text> <paragraph id="HF85004F3C65944AE90DC40D817B7CF0A" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">Tank cars in <quote>TIH/PIH</quote> (toxic inhalation products) service.</text></paragraph> 
<paragraph id="H195A921A65344EEBA613EFB165D0FC75" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">Tank cars in Class I, II, and III flammable service.</text></paragraph> <paragraph id="HF821A6F2D1AB4F0CB1250B8467298898" commented="no"><enum>(3)</enum><text>Tank cars in hazardous materials service.</text></paragraph> 
<paragraph id="H13165296821F4E70B54C1370167ACF8D" commented="no"><enum>(4)</enum><text>Tank cars in specialized service.</text></paragraph> <paragraph id="H79BCCAE90CF74581A5746A4939401AD4" commented="no"><enum>(5)</enum><text>Other tank cars.</text></paragraph> 
<paragraph id="H266A86005B0F4B2B9A04960FCB74713E" commented="no"><enum>(6)</enum><text>All other freight railcars.</text></paragraph></subsection> <subsection id="H8F56E743920846C1B7014ADF06C045E7" commented="no"><enum>(f)</enum><header>Limitation</header><text>To be eligible for any expenditure of funds under this section, a freight railcar and any sensitive technology relating to such railcar shall comply with the requirements of section 20171 of title 49, United States Code. </text></subsection> 
<subsection id="H89EAA1DF824F46C381C8F945F6EECAA9" commented="no"><enum>(g)</enum><header>Report by Secretary of Transportation</header> 
<paragraph id="H3B565CBFBE5B431B89C7AABE1C634C73"><enum>(1)</enum><header>In general</header><text>Not later than 3 years after the date of enactment of this Act, the Secretary of Transportation shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report on the implementation and effects of the grant program established under this section.</text></paragraph> <paragraph id="HFA9C40A5D38045FFABB57F82441BE475"><enum>(2)</enum><header>Contents</header><text>The report required under paragraph (1) shall include, at a minimum, the following:</text> 
<subparagraph id="HA6A59AD3D4A14ED19D206223C5BC00C6"><enum>(A)</enum><text display-inline="yes-display-inline">The number of railcars equipped with telematics devices using funds provided under this section.</text></subparagraph> <subparagraph id="H9D696FDD7D78455195D4D98D01B9B46C"><enum>(B)</enum><text>The cost of equipping such railcars.</text></subparagraph> 
<subparagraph id="HCBFD3FEAF0B844478CF99DC80628E456"><enum>(C)</enum><text>The number of safety incidents involving such railcars reported to the Federal Railroad Administration.</text></subparagraph> <subparagraph id="H09A0EF4FC4454750A8238C34218598D1"><enum>(D)</enum><text>Anecdotal experience of grant recipients relating to the deployment of telematics devices.</text></subparagraph> 
<subparagraph id="HD76CD4B891EB4168821F3677109F0B11"><enum>(E)</enum><text>Any legislative recommendations relating to the grant program established under paragraph (1).</text></subparagraph></paragraph> <paragraph id="H055F7AE911314C788BC85A681BF295C0"><enum>(3)</enum><header>Public availability</header><text display-inline="yes-display-inline">The report required under paragraph (1) shall be made publicly available to the maximum extent practicable without compromising confidentiality or security.</text></paragraph> 
<paragraph id="H923EA8D22F184D729D5305C9C8EB2650"><enum>(4)</enum><header>Consultation</header><text display-inline="yes-display-inline">In preparing the report required under paragraph (1), the Secretary shall consult with Federal agencies and stakeholders, as appropriate, to gather technical, operational, and safety-related data.</text></paragraph></subsection> <subsection id="HBD6B9BE8590B4864B91A2A21FC50061A" commented="no"><enum>(h)</enum><header>Definitions</header><text>In this section, the following definitions apply:</text> 
<paragraph id="H7B22E787E4A34277AD44BC1DCAB228A9" commented="no"><enum>(1)</enum><header>Onboard freight railcar telematics system; onboard freight railcar gateway device</header><text display-inline="yes-display-inline">The terms <term>onboard freight railcar telematics system</term> and <term>onboard freight railcar gateway device</term> mean the telematics or gateway device physically installed on a freight railcar that is owned by a railcar owner that collects and transmits data about the railcar asset.</text></paragraph> <paragraph id="H10B32C0C7661474F89349308A1BC2BF1" commented="no"><enum>(2)</enum><header>Telematics</header><text>The term <term>telematics</term> means a technology that—</text> 
<subparagraph id="H2699A5BA6456460CBE4F71EB432F0075" commented="no"><enum>(A)</enum><text>relies on telecommunications, informatics, and computer and data processing;</text></subparagraph> <subparagraph id="H1A2D9F09F61C4176AE1546CE1E0D2120" commented="no"><enum>(B)</enum><text>generates data and informatics from gateway devices fixed to railcars and provides for the exchange of information over a distance using battery or solar powered wireless connections; and</text></subparagraph> 
<subparagraph id="H50BC234C52EA49C999DB509C4317FE3D" commented="no"><enum>(C)</enum><text>includes the method upon which freight railcars are monitored by using GPS technology through a gateway device using on-board diagnostics to plot a railcar’s movements and, if applicable, gather railcar equipment health and condition data from other onboard railcar sensors when applied.</text></subparagraph></paragraph> <paragraph id="H5B4DCD3526DC4044B1C75B332EF22AD6" commented="no"><enum>(3)</enum><header>Gateway device</header><text>The term <term>gateway device</term> means a network hardware or software node used in freight railcar telecommunications that—</text> 
<subparagraph id="H478B4644C4414219986230DEEA4B14B7"><enum>(A)</enum><text>connects two networks with different transmission protocols together;</text></subparagraph> <subparagraph id="H0AAB1DF0A1754DF38B5AC29049A7A93C"><enum>(B)</enum><text>serves as an entry and exit point for a network as all data collected from the railcar must pass through or communicate with the gateway prior to being routed;</text></subparagraph> 
<subparagraph id="H0A9A8383CDC8410CA2EEEA76FAAFF835"><enum>(C)</enum><text>are distinct from routers or switches in that they communicate using more than one protocol to connect multiple networks; and</text></subparagraph> <subparagraph id="H9D50309BDEC84A569B7135A902403E17"><enum>(D)</enum><text>may be any device on a freight railcar that is embedded with electronics, software, sensors, or other connectivity, that enables the device to connect to, collect data from, or exchange data with another device, including—</text> 
<clause id="HE26D92CBC47A4AC7BA7537127F5BB907" commented="no"><enum>(i)</enum><text>railcar onboard telematics;</text></clause> <clause id="H8482F675E79541E791BDD5A80581D3E6" commented="no"><enum>(ii)</enum><text>global positioning system satellite and cellular location tracking systems;</text></clause> 
<clause id="H3E1CC66F9BA34CA5B252951E5A72557F" commented="no"><enum>(iii)</enum><text>railcar event status sensors;</text></clause> <clause id="H2C4179FB038E49D69A2F61020FB4B40A" commented="no"><enum>(iv)</enum><text>railcar predictive component condition and performance monitoring sensors; and</text></clause> 
<clause id="HFA22EF3CB9234231B53B0008FAADD443" commented="no"><enum>(v)</enum><text>similar technologies embedded into freight railcar components and sub-assemblies.</text></clause></subparagraph></paragraph> <paragraph id="HA51EEFA33075435B87B963975A14291A" commented="no"><enum>(4)</enum><header>Railroad freight car</header><text>The term <term>railroad freight car</term> means a car designed to carry freight or railroad personnel by rail, including—</text> 
<subparagraph id="H39CA4281B49048E9B8729ECC59A48820" commented="no"><enum>(A)</enum><text>a box railcar;</text></subparagraph> <subparagraph id="H30F16B0CCC7344C2A181118113D01250" commented="no"><enum>(B)</enum><text>a refrigerator railcar;</text></subparagraph> 
<subparagraph id="HD24F68E34A07459EB344BE06AEDD9091" commented="no"><enum>(C)</enum><text>a ventilator railcar;</text></subparagraph> <subparagraph id="HF0A6AA0BAE9F4A92B6524FAB5F1E6D18" commented="no"><enum>(D)</enum><text>an intermodal well railcar;</text></subparagraph> 
<subparagraph id="HAF27BFB74D3148E589DF85B28F4E842B" commented="no"><enum>(E)</enum><text>a gondola railcar;</text></subparagraph> <subparagraph id="H91B77F7EC4F84CBCB9CB4D88D75F3161" commented="no"><enum>(F)</enum><text>a hopper railcar;</text></subparagraph> 
<subparagraph id="HC51F57406E4A47CE8423CA0696CD49DB" commented="no"><enum>(G)</enum><text>an auto rack railcar;</text></subparagraph> <subparagraph id="H89043A7F72184FDABF64C52D832FFFAA" commented="no"><enum>(H)</enum><text>a flat railcar;</text></subparagraph> 
<subparagraph id="HB42259DF0BFC4C41B996921EE5CB9F18" commented="no"><enum>(I)</enum><text>a special railcar;</text></subparagraph> <subparagraph id="HDAD3F936E5B7468DACFFC7D05B39A8BE" commented="no"><enum>(J)</enum><text>a caboose railcar;</text></subparagraph> 
<subparagraph id="HA41B05F2E8064D50AE18B0D72D00BDE1" commented="no"><enum>(K)</enum><text>a tank railcar; and</text></subparagraph> <subparagraph id="H251825644E8C4776B01D5EC724B75D6B" commented="no"><enum>(L)</enum><text>a yard railcar.</text></subparagraph></paragraph> 
<paragraph id="H5ACE905A075C4B28B23008ADB480BB22" commented="no"><enum>(5)</enum><header>Qualified facility</header><text>The term <term>qualified facility</term> means a facility that is not owned or under the control of a state-owned enterprise.</text></paragraph> <paragraph id="HD59F749EDF0444D689AEFD5259899EF7" commented="no"><enum>(6)</enum><header>Qualified manufacturer</header><text>The term <term>qualified manufacturer</term> means a railroad freight car manufacturer that is not owned or under the control of a state-owned enterprise.</text></paragraph> 
<paragraph id="H6E30A9A65600478B9A0B356C633A6DE9" commented="no"><enum>(7)</enum><header>Certification event</header><text>The term <term>certification event</term> means a railroad freight car that is required by current regulations to be recertified in a maintenance facility or qualified facility.</text></paragraph> <paragraph id="H12131EE9A9F14C1AAC3828FA670CC7CF" commented="no"><enum>(8)</enum><header>Shopping event</header><text>The term <term>shopping event</term> means a railroad freight car that is undergoing regular or routine maintenance by a railcar maintenance facility or qualified facility.</text></paragraph> 
<paragraph id="H5EFD8A93BFAE460FB2FC382DF891A87F" commented="no"><enum>(9)</enum><header>State-owned enterprise</header><text>The term <term>state-owned enterprise</term> means—</text> <subparagraph id="H26CE14E109AE46C4A0254CEF424D6DCD" commented="no"><enum>(A)</enum><text>an entity that is owned by, or under the control of, a national, provincial, or local government of a country of concern, or an agency of such government; or</text></subparagraph> 
<subparagraph id="H0BEFF718F9004C6B96F6943F34B5B093" commented="no"><enum>(B)</enum><text>an individual acting under the direction or influence of a government or agency described in subparagraph (A).</text></subparagraph></paragraph> <paragraph id="H009D1083A5C84DCCA049C6534AB46C19" commented="no"><enum>(10)</enum><header>Country of concern</header><text>The term <term>country of concern</term> means a country that—</text> 
<subparagraph id="H12153051640A4E35A6553C702D0C1A7B" commented="no"><enum>(A)</enum><text>is identified by the Department of Commerce as a nonmarket economy country (as defined in section 771(18) of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1677">19 U.S.C. 1677(18)</external-xref>)) as of the date of enactment of the Passenger Rail Expansion and Rail Safety Act of 2021;</text></subparagraph> <subparagraph id="H08CAD0B07F3646399076ACA6F232D4D1" commented="no"><enum>(B)</enum><text>was identified by the United States Trade Representative in the most recent report required by section 182 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2242">19 U.S.C. 2242</external-xref>) as a foreign country included on the priority watch list (as defined in subsection (g)(3) of such section); and</text></subparagraph> 
<subparagraph id="H2A7FC25A2D014569B112EF7ADC10D2AC" commented="no"><enum>(C)</enum><text>is subject to monitoring by the Trade Representative under section 306 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2416">19 U.S.C. 2416</external-xref>).</text></subparagraph></paragraph></subsection> <subsection id="H91218C17027A42AFBBDDF43D05489896" commented="no"><enum>(i)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $100,000,000 for each of fiscal years 2026 through 2029, to remain available until expended.</text></subsection> </section> 
<section id="HFA0620172EA14223AC3C0DCADA72B68C" commented="no"><enum>3.</enum><header>Enhancing freight railcar onboard telematics and sensor development pilot program</header> 
<subsection id="H130F15E3918D48C6ACF7492D1933C1CE" commented="no"><enum>(a)</enum><header>Establishment</header><text>The Administrator of the Federal Railroad Administration shall establish a pilot program to—</text> <paragraph id="H3DBD7B84C7F14444AF6106DA8893EA46"><enum>(1)</enum><text>assist freight railcar owners and freight railcar manufacturers in the development of freight railcar onboard sensor technologies to add visibility to the safety of the freight railcar asset and commodity within the freight railcar asset;</text></paragraph> 
<paragraph id="HC90AA43F251C4073B268E807505E358F"><enum>(2)</enum><text>encourage development of freight railcar onboard sensors that communicate to the freight railcar onboard gateway devices to offer future capabilities of real-time visibility of—</text> <subparagraph id="H07E684475F0B496BB1B9BE0AABB8BA3A"><enum>(A)</enum><text>wheel and wheel bearing temperature;</text></subparagraph> 
<subparagraph id="HA6F4D39E174F463E98A6DD76113D998A"><enum>(B)</enum><text>whether a hand brake is on or off;</text></subparagraph> <subparagraph id="HEE984244A54E49EB98B52D7CC5DCBD54"><enum>(C)</enum><text>whether a hatch is open or closed; and</text></subparagraph> 
<subparagraph id="HB5842FCE74414BD5876C788B941285BF"><enum>(D)</enum><text>internal railcar temperature; and</text></subparagraph></paragraph> <paragraph id="H9F89E21E43FB42F798B8E9C3F17F459C"><enum>(3)</enum><text>carry out any of the activities described in paragraph (1) and (2) for purposes of informing railcar owners or operators on maintenance requirements, and enable operators, shippers, and railcar owners to possibly identify railcars that could become a hazard.</text></paragraph></subsection> 
<subsection id="H661D55FD7DE74B11917D4329ADA2F482" commented="no"><enum>(b)</enum><header>Eligible entities</header><text>Eligible entities for funding under the pilot program under this section are freight railcar owners.</text></subsection> <subsection id="HAECB6F2E0D774E4EA22D3135CE92CA05" commented="no"><enum>(c)</enum><header>Limitation</header><text>To be eligible for any expenditure of funds under this section, a freight railcar and any sensitive technology relating to such railcar shall comply with the requirements of section 20171 of title 49, United States Code. </text></subsection> 
<subsection id="H4CFC326D8E6045E0A13578C6805842CB" commented="no"><enum>(d)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Administrator shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report on—</text> <paragraph id="HEDF3F8751D4A4DC7A77D7620A942F131"><enum>(1)</enum><text>the activities carried out with funds provided under this section; and</text></paragraph> 
<paragraph id="H6ADEDBFA284F44A4B416E349472090B2"><enum>(2)</enum><text>the effectiveness of developed freight railcar onboard sensors by outlining the types and numbers of sensors that have become industry accepted and are in use on freight railcars.</text></paragraph></subsection> <subsection id="HAA5E8807AFDE4151B4CF7AF2875A8C43" commented="no"><enum>(e)</enum><header>Definitions</header> <paragraph id="H24789CB704A0483DA083C1FE1E3971C9" commented="no"><enum>(1)</enum><header>Freight railcar onboard sensor</header><text>The term <term>freight railcar onboard sensor</term> means the onboard sensor that communicates or signals the freight railcar onboard telematics device or gateway device physically installed on a freight railcar that is purchased and installed by, and owned by the railcar owner that collects and transmits data about the railcar asset to the railcar owner, data system, or data collection point.</text></paragraph> 
<paragraph id="H25D5691C536E45D1938E1B261BD9874D" commented="no"><enum>(2)</enum><header>Railroad freight car</header><text>The term <term>railroad freight car</term> means a car designed to carry freight or railroad personnel by rail, including—</text> <subparagraph id="HA4351D49D93E4EB4935CD2B72569830E" commented="no"><enum>(A)</enum><text>a box railcar;</text></subparagraph> 
<subparagraph id="HFB4B3FE1E36B4408B90BADB7358DF01C" commented="no"><enum>(B)</enum><text>a refrigerator railcar;</text></subparagraph> <subparagraph id="H031636E0C60C4E9EBE6A4AAE874AD39A" commented="no"><enum>(C)</enum><text>a ventilator railcar;</text></subparagraph> 
<subparagraph id="HEFB8407AD77044C2B8B9BCBD421D068B" commented="no"><enum>(D)</enum><text>an intermodal well railcar;</text></subparagraph> <subparagraph id="H203F1DCAACA94256ADFA4418A181A72C" commented="no"><enum>(E)</enum><text>a gondola railcar;</text></subparagraph> 
<subparagraph id="HE1DBB16CD3E4467580281E11086CED0F" commented="no"><enum>(F)</enum><text>a hopper railcar;</text></subparagraph> <subparagraph id="H8E9A454C9BF14E2989882C198B344D3C" commented="no"><enum>(G)</enum><text>an auto rack railcar;</text></subparagraph> 
<subparagraph id="HC240E1F3F13E407294AB03E24BAD5E2D" commented="no"><enum>(H)</enum><text>a flat railcar;</text></subparagraph> <subparagraph id="H154C6AE0A76942AF8453E04D50C8926C" commented="no"><enum>(I)</enum><text>a special railcar;</text></subparagraph> 
<subparagraph id="H95AA951A96234471B0A74FE1F17A09CE" commented="no"><enum>(J)</enum><text>a caboose railcar;</text></subparagraph> <subparagraph id="H7A5E79B30837455996305903EAB1033A" commented="no"><enum>(K)</enum><text>a tank railcar; and</text></subparagraph> 
<subparagraph id="H4FB27B60E8524AC68FA999726957C34D" commented="no"><enum>(L)</enum><text>a yard railcar.</text></subparagraph></paragraph> <paragraph id="HE131936264F44C19832D70F5DCF9CFB0" commented="no"><enum>(3)</enum><header>Telematics</header><text>The term <term>telematics</term> means a technology that—</text> 
<subparagraph id="HF6473299471A4A9A9C918B707A21BE0C" commented="no"><enum>(A)</enum><text>relies on telecommunications, informatics, and computer and data processing;</text></subparagraph> <subparagraph id="HFF4F164CB7E1402E9B682C8BF1428781" commented="no"><enum>(B)</enum><text>generates data and informatics from gateway devices fixed to railcars and provide for the exchange of information over a distance using battery or solar powered wireless connections; and</text></subparagraph> 
<subparagraph id="H5B0FB539A9D14C7BB04234945AEB9FD4" commented="no"><enum>(C)</enum><text>includes the method upon which freight railcars are monitored by using GPS technology through a gateway device using on-board diagnostics to plot a railcar’s movements and, if applicable, gather railcar equipment health and condition data from other onboard railcar sensors when applied.</text></subparagraph></paragraph> <paragraph id="H839B75AEA6A743DDB507EFE34BAA8A1A" commented="no"><enum>(4)</enum><header>Gateway device</header><text>The term <term>gateway device</term> means a network hardware or software node used in freight railcar telecommunications that—</text> 
<subparagraph id="HC57E287FBD4940E3A167C204FC04A26F"><enum>(A)</enum><text>connects two networks with different transmission protocols together;</text></subparagraph> <subparagraph id="H8B9FFCE36C6B4201B56AE9E5BA65DA67"><enum>(B)</enum><text>serve as an entry and exit point for a network as all data collected from the railcar must pass through or communicate with the gateway prior to being routed;</text></subparagraph> 
<subparagraph id="H2AE1651317EC47DC9E2238803C100B45"><enum>(C)</enum><text>are distinct from routers or switches in that they communicate using more than one protocol to connect multiple networks; and</text></subparagraph> <subparagraph id="H6BE56D70E1BE4E8F9B91FD72C9609849"><enum>(D)</enum><text>may be any device on a freight railcar that is embedded with electronics, software, sensors, or other connectivity, that enables the device to connect to, collect data from, or exchange data with another device, including—</text> 
<clause id="H88EC80C8C3754DD4B0ACE166DF88B15C" commented="no"><enum>(i)</enum><text>railcar onboard telematics;</text></clause> <clause id="H0CFD43CA064E4D1BAFD863BDA29A5AF7" commented="no"><enum>(ii)</enum><text>global positioning system satellite and cellular location tracking systems;</text></clause> 
<clause id="HEC6C975CA7294899AD67707B5758D8DE" commented="no"><enum>(iii)</enum><text>railcar event status sensors;</text></clause> <clause id="H072C51C3B62B47AFABC916FC94227B5A" commented="no"><enum>(iv)</enum><text>railcar predictive component condition and performance monitoring sensors; and</text></clause> 
<clause id="HFEB13772763A490AB2CEBFFFA09E4592" commented="no"><enum>(v)</enum><text>similar sensitive technologies embedded into freight railcar components and sub-assemblies.</text></clause></subparagraph></paragraph></subsection> <subsection id="H6CEB16F0791F4C4EB6E21E67D660664D" commented="no"><enum>(f)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $10,000,000 for each of fiscal years 2026 through 2029, to remain available until expended.</text></subsection></section>
