<section id="H639CD84A6AC64CB3A59742171E698A37" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Trucker Bathroom Access Act</short-title></quote>.</text></section> <section id="HB4E9F6A8A0BE4410B035D11D7FF98780" section-type="subsequent-section"><enum>2.</enum><header>Restroom access for drivers</header> <subsection id="H58447243DE5145D8BDC7250CE3C62888"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/141">chapter 141</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text> <quoted-block style="USC" id="H0E493DD610864410B39998A5A2774BC7" display-inline="no-display-inline"> <section id="HBF419C57062A41559235AA11897264C1"><enum>14105.</enum><header>Restroom access for drivers</header> <subsection id="H172754D013EF493B876B3A6E9CED5D80"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A covered driver shall be granted access to any covered restroom facility at any covered establishment to which such employee delivers any goods or cargo or is waiting to be loaded to transport goods or cargo.</text></subsection> <subsection id="HC1C74BB56EB7475083E757ADF90411F3"><enum>(b)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to require a covered establishment to make any physical changes to a restroom to be in compliance with this section. </text></subsection> <subsection id="HE050470487524024A57C936E00850E18"><enum>(c)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="HB8CA1A1F8B8E41FB882EC52520C15DAB"><enum>(1)</enum><header>Covered driver</header><text display-inline="yes-display-inline">The term <quote>covered driver</quote> means any commercial motor vehicle operator with respect to whom the Secretary of Transportation has power to establish qualifications and maximum hours of service pursuant to the provisions of section 31502.</text></paragraph> <paragraph id="H2DF09703C7974F89A4C476707BF5D15D"><enum>(2)</enum><header>Covered restroom facility</header><text>The term <quote>covered restroom facility</quote> means a restroom located on the premises of a covered establishment that is intended for use by customers or employees of the establishment and that is—</text> <subparagraph id="H9B5AC66B3F214CA3B68CB71E314D02C3"><enum>(A)</enum><text>located in an area where providing access would not create an obvious health or safety risk to a covered driver; and</text></subparagraph> <subparagraph id="H39E2F8ABED7D45EEA0FA512CAD20C7F6"><enum>(B)</enum><text>located in an area where providing access would not pose an obvious security risk to the covered establishment.</text></subparagraph></paragraph> <paragraph id="H0EC7C38625094E899F2328AE9128D677"><enum>(3)</enum><header>Covered establishment</header><text>The term <quote>covered establishment</quote>—</text> <subparagraph id="HE3E185C0851B405FA78F46474EF97FB5"><enum>(A)</enum><text>means a place of business open to the general public for the sale of goods or services;</text></subparagraph> <subparagraph id="H4DF56F75779E4D15A7C3B4419947BF72"><enum>(B)</enum><text>a shipper, receiver, manufacturer, warehouse, distribution center, or any other business entity that is receiving or sending goods by commercial motor vehicle; and </text></subparagraph> <subparagraph id="H775E6CBF6F0A44A392478DFA690E1D51"><enum>(C)</enum><text>does not include any structure such as a filling station, service station, or restaurant of 800 square feet or less that has a restroom located within such structure that is only intended for use by employees. </text></subparagraph> </paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HCCFEB7C6EA8F4D95809574F4520FE636"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/141">chapter 141</external-xref> of title 49, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/49/14104">section 14104</external-xref> the following new item: </text> <quoted-block style="USC" id="HE9E48695FACB4E4BA298A77877F50ACB" display-inline="no-display-inline"> <toc regeneration="no-regeneration"> <toc-entry level="section">14105. Restroom access for drivers. </toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> <section id="HC239D500149444B0B4F0FEC3A819DFC7"><enum>3.</enum><header>Restroom access for drayage truck operators</header> <subsection id="H0DC0F87F214F48558717E291B04D282B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A terminal operator shall provide a sufficient number of covered restrooms for use by covered drayage truck operators in areas of the terminal that such operators typically have access to.</text></subsection> <subsection id="H887553164A6C418BA8DA8D0A8E05E386"><enum>(b)</enum><header>Requirements</header><text>To be in compliance with subsection (a), a terminal operator shall provide—</text> <paragraph id="H65C0C540AD984B95B475DF492E0E9A1C"><enum>(1)</enum><text>access to existing restrooms while covered drayage truck operators are on port property and when such access does not pose an obvious safety risk to such truck operators and other employees of the terminal operator in the area;</text></paragraph> <paragraph id="H8228C487B28B4B43BB8E7187D04857AB"><enum>(2)</enum><text>additional restrooms, if necessary, at locations where there is the most need; and</text></paragraph> <paragraph id="H49116635327045C3B1114D18D2530445"><enum>(3)</enum><text>a place for covered drayage truck operators to park vehicles while accessing such restrooms. </text></paragraph></subsection> <subsection id="HE0D561CB42A745339B63AB786B6C91EB"><enum>(c)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="HCA628A86FD5C4395A015DF42DD56F4D8"><enum>(1)</enum><header>Covered drayage truck operator</header><text display-inline="yes-display-inline">The term <quote>covered drayage truck operator</quote> means the driver of any in-use on-road vehicle with a gross vehicle weight rating of greater than 33,000 pounds operating on or transgressing through port or intermodal rail yard property for the purpose of loading, unloading, or transporting cargo, including containerized, bulk, or break-bulk goods.</text></paragraph> <paragraph id="H9FB5C3DE89E44678979B43994F2150B9"><enum>(2)</enum><header>Terminal operator</header><text>The term <quote>terminal operator</quote>—</text> <subparagraph id="H3796120AF6CE4BFFB237F1D5E3BDE054"><enum>(A)</enum><text>means the business entity operating a marine terminal for loading and unloading cargo to and from marine vessels; and</text></subparagraph> <subparagraph id="H9FA0C5CEC5D44290A29A429C1F377222"><enum>(B)</enum><text>includes the port authority if the port is directly operating the marine terminal in loading and unloading cargo to and from marine vessels.</text></subparagraph></paragraph> <paragraph id="H4A3219653B554C6C8558D6AEBE0A4DC2"><enum>(3)</enum><header>Covered restroom</header><text display-inline="yes-display-inline">The term <quote>covered restroom</quote> means a restroom or portable chemical toilet that is located in an area that does not pose an obvious health or safety risk to a covered drayage truck operator. </text></paragraph></subsection></section> </legis-body></bill>
