R. 2490</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250331">March 31, 2025</action-date><action-desc><sponsor name-id="B001309">Mr. Burchett</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name>, and in addition to the Committee on <committee-name committee-id="HED00">Education and Workforce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend section 505 of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 to prohibit the provision of assistance under title IV of the Higher Education Act of 1965 to States that offer in-State tuition rates to aliens who are not lawfully present in the United States, and for other purposes.</official-title></form><legis-body id="H7F91E6C5FD78406498C662DA63D19A9E" style="OLC"><section id="HD4A826BDB43E407C861C5061C52F03FC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No In-State Tuition for Illegal Immigrants Act</short-title></quote>. </text></section><section id="H8DC121D6AB544B58ADB4CD4E3AE3145C"><enum>2.</enum><header>Restricting in-State tuition rates for aliens not lawfully present</header><text display-inline="no-display-inline">Section 505 of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1623">8 U.S.C. 1623</external-xref>) is amended—</text><paragraph id="HBC25C663421F45B4B0635A1E20854F55"><enum>(1)</enum><text>in subsection (b), by striking <quote>This section</quote> and inserting <quote>Subsection (a)</quote>; and</text></paragraph><paragraph id="H559362D6755843E8AE7A50F9C8EF59F9"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H122247E922A54E209E16F6FCDAD2AD63" display-inline="no-display-inline"><subsection id="HFB16461085B84B88958CDEEEE3E2F610"><enum>(c)</enum><header>Prohibition on Federal financial assistance under HEA title IV</header><paragraph id="H22065A99C8834139908AD426F0A2370D"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A State may not receive any Federal financial assistance under title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070">20 U.S.C. 1070 et seq.</external-xref>) for the fiscal year following any fiscal year in which the Secretary of Education determines that the State is an ineligible State under paragraph (2).</text></paragraph><paragraph id="HF77C4FE429D1421496B83C5BC0C6B08F"><enum>(2)</enum><header>Ineligibility</header><text display-inline="yes-display-inline">A State is an ineligible State for purposes of this subsection if the State charges an alien who is not lawfully present in the United States tuition for attendance at a public institution of higher education in the State at a rate that is equal to or less than the rate charged for residents of the State who are citizens of the United States.</text></paragraph><paragraph id="HC83FA0AA157C46C3AF5F1E98A4B42862"><enum>(3)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="HD76E2113590F4D9BB8E647FFE58E3A99"><enum>(A)</enum><text display-inline="yes-display-inline">The term <quote>Federal financial assistance</quote> has the meaning given such term in section 7501(a)(5) of title 31, United States Code.</text></subparagraph><subparagraph id="H4A1DBC6AF2F5452B8EF98CFF94278081"><enum>(B)</enum><text>The term <quote>institution of higher education</quote> has the meaning given such term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>).</text></subparagraph><subparagraph id="H8334D4A794DD459C8CA97FF5F92F3C6A"><enum>(C)</enum><text>The term <quote>State</quote> has the meaning given such term in section 103 of the Higher Education Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/20/1003">20 U.S.C. 1003</external-xref>).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
