which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Federal Agriculture Improvement and Reform Act of 1996 to assist farmers relying on the noninsured crop disaster assistance program by lowering the cost of purchasing coverage, reducing paperwork burdens, and increasing payouts under that program, and to incentivize farmers to transition gradually to a comprehensive insurance policy under the whole farm risk management insurance plan by offering progressive premium discounts on a commitment to purchase a whole farm plan of insurance.</official-title></form><legis-body id="H5101577F6D304EEBA028B58C7E56BD7C" style="OLC"><section section-type="section-one" id="HD21D6C688C0343978642E64EA72835ED"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Save Our Small Farms Act of 2025</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="H4FA23179C2E6417FB1279DFFA9C0A512"><enum>2.</enum><header display-inline="yes-display-inline">Administration and operation of noninsured crop assistance program</header><text display-inline="no-display-inline">Section 196 of the Federal Agriculture Improvement and Reform Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/7/7333">7 U.S.C. 7333</external-xref>) is amended—</text><paragraph id="H76945D6F51B9422483621819EDE9E5CE"><enum>(1)</enum><text>in subsection (a)(1)(C)—</text><subparagraph id="HDE6B5E102E664CD0B3BF3DF44875C1A3"><enum>(A)</enum><text>in the matter preceding clause (i), by inserting <quote>best facilitates</quote> after <quote>assistance program that</quote>;</text></subparagraph><subparagraph id="HA34F9A68DBD94BF6BAA2556B1A02F5E7"><enum>(B)</enum><text>in clause (i)—</text><clause id="H093C5F0A3B7546C682403E0DBCD17595"><enum>(i)</enum><text>by striking <quote>best facilitates the use of that</quote> and inserting <quote>the use of those</quote>; and</text></clause><clause id="H6AC78E381972411FA2A45E23F0F62B3D"><enum>(ii)</enum><text>by striking <quote>and</quote> at the end;</text></clause></subparagraph><subparagraph id="H8C6444C26ECA4833AE4A1B9D582AF506"><enum>(C)</enum><text>in clause (ii)—</text><clause id="HBC1E7F951992469FA88D10B77356D0F4"><enum>(i)</enum><text>by striking <quote>ensures the availability of that</quote> and inserting <quote>the public availability of those</quote>; and</text></clause><clause id="H9E1613CAE1D64384AC8C1D248DF9A8FD"><enum>(ii)</enum><text>by striking the period at the end and inserting a semicolon; and</text></clause></subparagraph><subparagraph id="HEED556D164A44E42A81A3BFB6AACFC5D"><enum>(D)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H6FE82C3F833A427DBAFAAD93620F13E8"><clause id="HC68A6441527D4D08BEF9CC87932AA8AF"><enum>(iii)</enum><text display-inline="yes-display-inline">the expansion of crops listed on the national crop table of the Agency with a local average market price;</text></clause><clause id="H1099275C030E45D7AE696D273555A156"><enum>(iv)</enum><text>the voluntary graduation of program participants to the whole farm risk management insurance plan developed under section 522(c)(7) of the Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1522">7 U.S.C. 1522(c)(7)</external-xref>); and</text></clause><clause id="H7105657ADFE44835A716F2652A38B62E"><enum>(v)</enum><text>the establishment of pilot projects for purposes of addressing emerging needs of producers and collecting data to support the development of policies or plans of insurance offered under the Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1501">7 U.S.C. 1501 et seq.</external-xref>).</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HC02D66AC644D409391409B7BCE3DABEB"><enum>(2)</enum><text>in subsection (b), by striking paragraph (4) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HE42361E6761A45279B4F892EE1D4E77B"><paragraph id="H4AEB187F28654BA1BA4111F5B08D55C4"><enum>(4)</enum><header>Streamlined application process</header><subparagraph commented="no" display-inline="no-display-inline" id="HB0A135CF4138488C9D46C0C23ED91390"><enum>(A)</enum><header display-inline="yes-display-inline">Definition of whole farm plan</header><text>In this paragraph, the term <term>whole farm plan</term> means the whole farm risk management insurance plan developed under section 522(c)(7) of the Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1522">7 U.S.C. 1522(c)(7)</external-xref>).</text></subparagraph><subparagraph id="H6B4435DED3E546979EE12FF397942F45"><enum>(B)</enum><header>Establishment</header><clause commented="no" display-inline="no-display-inline" id="H7645A3102F374F2F9CCCA3275FC8CF39"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall establish a streamlined process for the submission of records and acreage reports under paragraphs (2) and (3), respectively, for—</text><subclause id="H71498620BDCE4698A5EEC27F39EA3BEC"><enum>(I)</enum><text>diverse production systems, such as those typical of urban production systems;</text></subclause><subclause id="H93B72F671BC147FD87C6226903253D2A"><enum>(II)</enum><text>other small-scale production systems; and</text></subclause><subclause id="H66FAC94F4CD6470F8F91D11120B43063"><enum>(III)</enum><text>direct-to-consumer production systems.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="HB43544A43BDE40F789F033FAD9CB8235"><enum>(ii)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The streamlined process established under clause (i) shall include—</text><subclause id="H5D155F19011B49DEA4F5EBDB480BAA37"><enum>(I)</enum><text>reduced acreage report requirements; and</text></subclause><subclause id="H8D34EAAF00FC40D7B849525C26542A4C"><enum>(II)</enum><text>allowing the submission to the Secretary of 2 reports per year so as to accommodate later acreage reporting.</text></subclause></clause></subparagraph><subparagraph id="H3FD62EEDDD974A238618D8DA00E3943A"><enum>(C)</enum><header>Revenue-based option</header><clause id="H90777EDFD39944F0BA98ADC5C3D3259B"><enum>(i)</enum><header>Establishment</header><text display-inline="yes-display-inline">Notwithstanding paragraphs (2) and (3) or subsection (a)(1)(A), the Secretary shall establish a streamlined revenue-based coverage option that is available, on a voluntary basis, to any producer eligible for assistance under this section.</text></clause><clause id="H8438448804FE49A784860A5465C929DF"><enum>(ii)</enum><header>Submission of historical revenue</header><text display-inline="yes-display-inline">The Secretary shall accept the Internal Revenue Service Tax Form Schedule F, or successor forms, as sufficient for the establishment of historical adjusted revenue, subject to the condition that approved insurance providers may request additional verifiable records in cases where there is documented evidence, made clear to the applicant, that farm tax records are incomplete.</text></clause></subparagraph><subparagraph id="HACD7EEFC6C6B42E2BB6497879AF9D7D2"><enum>(D)</enum><header>On-ramp to whole farm plan</header><clause id="HAB6A8E252F844E40ABCCDD019D041074"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of a producer using diverse production systems described in subparagraph (B)(i) that may be eligible for the whole farm plan, the Secretary, acting through the Administrator of the Agency, shall establish a streamlined revenue-based option under the noninsured crop disaster assistance program under this section to assist the producer to transition, on a voluntary basis, from the noninsured crop disaster assistance program under this section to the whole farm plan. The Secretary may provide for such other options as may be necessary to assist producers with such a transition who are unable to purchase a whole farm plan. </text></clause><clause id="H0638E60C5102412EB561CDB4E5ADBB48"><enum>(ii)</enum><header>Requirements</header><text>The streamlined revenue-based option established under clause (i) shall offer a premium discount of—</text><subclause id="HB4F4708F6C75469493E5E05CD32A7833"><enum>(I)</enum><text display-inline="yes-display-inline">25 percent for the first crop year for which a producer—</text><item id="HB2F437F72EF747B5AD5628644BD35FB9"><enum>(aa)</enum><text>certifies that the producer will transition from the noninsured crop disaster assistance program under this section to the whole farm plan not later than 3 years after the date of the certification; and</text></item><item id="HF6F0693EC6D74600BED50B4A37FCCA70"><enum>(bb)</enum><text>provides revenue history with respect to that crop year;</text></item></subclause><subclause id="HF28046469D7F4A14908838CBFDA25DA1"><enum>(II)</enum><text display-inline="yes-display-inline">50 percent for the crop year following the crop year described in subclause (I) if the producer—</text><item id="H372143BB4B404991ABFBFABDDD0817FF"><enum>(aa)</enum><text display-inline="yes-display-inline">certifies that the producer will transition from the noninsured crop disaster assistance program under this section to the whole farm plan not later than 2 years after the date of the certification; and</text></item><item id="HEEE35BA65BEB49D48E2B0CBD324E4D0A"><enum>(bb)</enum><text>provides revenue history with respect to that crop year; and</text></item></subclause><subclause id="HAEBC9F7DB8FD438EB45CDE89E6691DDF"><enum>(III)</enum><text display-inline="yes-display-inline">50 percent for the crop year following the crop year described in subclause (II) if the producer—</text><item id="H8E186DB9B8D346FCBECE64E03A00D5F0"><enum>(aa)</enum><text display-inline="yes-display-inline">purchases insurance under the whole farm plan not later than 1 year after the date of the certification; and</text></item><item id="HC74A7146617241CFAAB761E74F94E95D"><enum>(bb)</enum><text>provides revenue history with respect to that crop year.</text></item></subclause></clause><clause id="HD2908A43C4F24A7384FB83DFC44202FA"><enum>(iii)</enum><header>Tax Form Schedule F</header><text>The Secretary shall accept the Internal Revenue Service Tax Form Schedule F (or a successor form) with respect to a producer for purposes of establishing revenue history under clause (ii).</text></clause><clause id="H67EA3AB0CBC648249B97AAD9E398BD11"><enum>(iv)</enum><header>Revenue history sharing</header><text>The Secretary shall submit to the Federal Crop Insurance Corporation the revenue history submitted to the Secretary pursuant to clause (ii).</text></clause></subparagraph><subparagraph id="H1493BAFC705A4AE6901385C2BB15CA49"><enum>(E)</enum><header>Rulemaking</header><text>Not later than 90 days after the date of the enactment of the <short-title>Save Our Small Farms Act of 2025</short-title>, the Secretary shall issue regulations to ensure that premium discounts under this paragraph are only available to producers who transition to a whole farm plan, as described in subparagraph (D)(i).</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HB411C606B60A4039A356858B74A08974"><enum>(3)</enum><text>in subsection (c), by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H01529A709F4B4934B33D9EFBD58CFA05"><paragraph id="HFDE1B1C694C046BABE7FED3DA89A16B1"><enum>(5)</enum><header>Notice of certain losses</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law (including regulations), a producer of a hand-harvested or rapidly deteriorating crop may submit to the Secretary notification of a loss of that crop 120 hours or more after the loss in order to be eligible for assistance under this section.</text></paragraph><paragraph id="HA6B80CDB3FD84A2FB29E288B26C101EF"><enum>(6)</enum><header>Appraisal of loss</header><subparagraph id="HDE7CE33065024932A77D90DB428D5BA0"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In any case in which an appraisal of crop acreage is requested by a producer or determined to be necessary by the Secretary for a year in which a notice of loss is filed under this subsection, particularly in any case in which a loss adjuster is not available within 72 hours of the notice, the Secretary shall permit the following alternatives to an in-person appraisal by a loss adjuster:</text><clause id="HB92DF615A9BD4923B0DC7747E5509F1C"><enum>(i)</enum><text>Remote appraisal, including time-stamped photographs, drone footage, and other technology applications.</text></clause><clause id="H3E847322B90546C98BA7B8D6EF81A945"><enum>(ii)</enum><text>Appraisal by field office staff of the Agency with requisite training, in conjunction with a remote appraisal under clause (i).</text></clause></subparagraph><subparagraph id="H62DD233A86464881BCA8D9E68C9B59F7"><enum>(B)</enum><header>Training</header><text display-inline="yes-display-inline">The Secretary shall require field office staff to attend noninsured crop disaster assistance appraisal training for purposes of subparagraph (A)(ii).</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HE7D4D0788F394C93B9ADE384C0FD20C2"><enum>(4)</enum><text>in subsection (e)(3), by striking <quote>65 percent</quote> and inserting <quote>100 percent</quote>;</text></paragraph><paragraph id="H435266EFAC1A4D8BA733E40DE7C24A9B"><enum>(5)</enum><text>in subsection (i)(2)—</text><subparagraph id="H6870C42AA1964D579C8B8062A44387C6"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H2C8274D2C3794191ADE8E476D6FC112A"><enum>(B)</enum><text>in subparagraph (B), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H5C3E9C6BD95B4EB39C2BB961FAE00379"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HA3D4FF1AFADB4310A7197CD457C8E4D9"><subparagraph id="H1C919A24304847A79D237B20291A5D76"><enum>(C)</enum><text display-inline="yes-display-inline">notwithstanding subparagraphs (A) and (B), in the case of a limited resource, beginning, or socially disadvantaged farmer, as determined by the Secretary, a veteran farmer or rancher (as defined in section 2501(a) of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/2279">7 U.S.C. 2279(a)</external-xref>)), or a producer participating in the streamlined revenue-based option pursuant to subsection (b)(4)(C), $600,000.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H2B2401DB26CC4389928D9D7A28B05494"><enum>(6)</enum><text>in subsection (k)(2)—</text><subparagraph id="H6693D51F31CA44598BC8BA6DE5890B70"><enum>(A)</enum><text>by striking <quote>defined by the Secretary, or a veteran</quote> and inserting <quote>determined by the Secretary, a veteran</quote>; and</text></subparagraph><subparagraph id="HECC6EDE83BCB4C33AF5AE68C06D10E34"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting <quote>, or a producer participating in the streamlined revenue-based option pursuant to subsection (b)(4)(C)</quote> before the period at the end;</text></subparagraph></paragraph><paragraph id="HBC26D8929F1E4EFDB85CEB4C584F2B59"><enum>(7)</enum><text>in subsection (l), by striking paragraph (3) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H0350761D04E141C695E7FE53F1FE7F5A"><paragraph id="H552C8DF3A34B402EA6F737A5D56BC5E2"><enum>(3)</enum><header>Premium discount</header><text display-inline="yes-display-inline">The coverage made available under this subsection shall be available to limited resource, beginning, or socially disadvantaged farmers, as determined by the Secretary, veteran farmers or ranchers (as defined in section 2501(a) of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/2279">7 U.S.C. 2279(a)</external-xref>)), and producers participating in the streamlined revenue-based option pursuant to subsection (b)(4)(C), in exchange for a premium that is 25 percent of the premium determined under paragraph (2).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H802E32731AE54B2FA7E8CAC732EFBA7D"><enum>(8)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HFCBA7C79DB4E420FA2D51A18497B42CD"><subsection id="HA0AAC1630A434BF6B82C815979D00A56"><enum>(m)</enum><header>Delivery</header><text display-inline="yes-display-inline">The Secretary shall collaborate with outreach and technical assistance providers, extension offices, and State departments of agriculture to advertise the noninsured crop disaster assistance program under this section, particularly to limited resource, beginning, or socially disadvantaged farmers, as determined by the Secretary, veteran farmers or ranchers (as defined in section 2501(a) of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/2279">7 U.S.C. 2279(a)</external-xref>)), and producers eligible to participate in the streamlined revenue-based option pursuant to subsection (b)(4)(C).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section section-type="subsequent-section" id="H031A78140F3342458F490A41C37078CF" display-inline="no-display-inline"><enum>3.</enum><header>Whole farm revenue protection</header><text display-inline="no-display-inline">Section 522(c) of the Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1522">7 U.S.C. 1522(c)</external-xref>) is amended—</text><paragraph id="H9E2FF7D89CF14349A951FD6F3D226BF5"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="HD7AA359A567C485B9043BF6A4882F8A6"><enum>(A)</enum><text>in subparagraph (B), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="HCFD89CA1BDC6449C8694D99C5870B4D8"><enum>(B)</enum><text>in subparagraph (C), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H945BA8B5CF524895A5147690F342A3F6"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H8A33DFD052174617A5F86CEACFFB98C3"><subparagraph id="HBE63E6EB96E44F6EB94396A898636153"><enum>(D)</enum><text>increase participation by producers—</text><clause id="HF2DE22D240294ED4A1FC0B06B77778EC"><enum>(i)</enum><text>marketing direct-to-consumers;</text></clause><clause id="HB7E5386A12FC446CA02D816ACBA03796"><enum>(ii)</enum><text>marketing through intermediated sales in local and regional markets; </text></clause><clause id="HC5BD1C626A94450B9E72FA61445B2CCC"><enum>(iii)</enum><text>using farm identity-preserved marketing; or</text></clause><clause id="H17E9475084AC4C13865F048990D1529C"><enum>(iv)</enum><text display-inline="yes-display-inline">undertaking producer education on how to use direct market prices.</text></clause></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H307CEC66B5EF48FAA8F23EA41D52DC21"><enum>(2)</enum><text>in paragraph (7)—</text><subparagraph id="H6C104BB0BD0F4DE580E663BA2DC5613F"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>, with a liability limitation of $1,500,000,</quote>;</text></subparagraph><subparagraph id="HB158CD0E692A4166AA739C681F2D6C3E"><enum>(B)</enum><text>in subparagraph (B), by inserting <quote>or in combination with</quote> after <quote>in lieu of</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H325D6E0F7DFC4D82B1471F38435D6AF8"><enum>(C)</enum><text display-inline="yes-display-inline">in subparagraph (C)—</text><clause id="HA0A2584C348D4BFFB239706C22D0B8F8"><enum>(i)</enum><text>in the matter preceding clause (i), by striking <quote>may</quote> and inserting <quote>shall</quote>;</text></clause><clause id="H93B6409ADFA4419C97F9D6D14E7B8818"><enum>(ii)</enum><text>in clause (i), by striking <quote>or</quote> at the end;</text></clause><clause id="HDC3D7A443D9841758D6DB46A2210B7B3"><enum>(iii)</enum><text>by redesignating clause (ii) as clause (iii); and</text></clause><clause id="H244616D55F2A4F8CA96D20292AF359F8"><enum>(iv)</enum><text>by inserting after clause (i) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H457131D8076A4402B2BF9A7DB2D79569"><clause id="HD5A32A6F35284825922212AF29CB6877"><enum>(ii)</enum><text display-inline="yes-display-inline">utilize a resource-conserving crop rotation (as defined in section 1240L(d)(1) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-24">16 U.S.C. 3839aa–24(d)(1)</external-xref>)); and</text></subclause><subclause id="H70F4EFA4D9644CA0B81F4475E4101EBD" commented="no"><enum>(II)</enum><text>submit to the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate a report that includes a summary of the most recent review conducted under subclause (I) and any expected changes to the policy for the following reinsurance year.</text></subclause></clause><clause id="H2B5DCD81030B4E818EC3C79BB168C4EF" commented="no"><enum>(iv)</enum><header>Public report</header><text>Not later than 18 months after the date of the enactment of the <short-title>Save Our Small Farms Act of 2025</short-title>, the Board shall make publicly available a report describing the decisions made by the Board with respect to each factor described in clause (ii).</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H6C0855BA17A54890B9C6D22EA8C105E7"><enum>(F)</enum><text>by redesignating subparagraph (F) as subparagraph (G); and</text></subparagraph><subparagraph id="HDFAA1D6B4E13489A94B4D7EA92662B0A" commented="no"><enum>(G)</enum><text>by inserting after subparagraph (E) the following:</text><quoted-block style="OLC" id="H1C935B5154554AACB250B602EE02A992" display-inline="no-display-inline"><subparagraph id="H486C8E803D884F6DA644A576A34C3337" commented="no"><enum>(F)</enum><header>Modifications to improve effectiveness for specialty crops and diversified farms</header><clause id="HD36AF50688D64B0FB89A1943D20C7465" commented="no"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 18 months after the date of the enactment of the <short-title>Save Our Small Farms Act of 2025</short-title>, the Corporation shall implement the following modifications to the plan developed under subparagraph (A):</text><subclause id="HC21687386BE04EFC86370A1534257061" commented="no"><enum>(I)</enum><text>Establish that appropriate income reported on Internal Revenue Service Tax Form Schedule F (or a successor form), shall be sufficient for the establishment of historical adjusted revenue, subject to the condition that approved insurance providers may request additional verifiable records in cases where there is documented evidence, made clear to the applicant, that farm tax records are incomplete.</text></subclause><subclause id="H51CE8388D374410388FCA6EC004749B3" commented="no"><enum>(II)</enum><text>Presume that declines in total market price are due to unavoidable natural causes, unless the Corporation demonstrates the extent to which the decline in lower market price is the direct result of an uninsured manmade event.</text></subclause><subclause id="HC85250AD8342468D988CD49128A31484" commented="no"><enum>(III)</enum><text>Require that any adjustment of the revenue guarantee by an approved insurance provider, after the approved insurance provider accepts a revised farm operation report from the insured, is contingent on approval from the Risk Management Agency, and allow the insured an opportunity to appeal any denial by the Risk Management Agency of that revenue guarantee adjustment to the National Appeals Division.</text></subclause><subclause id="H5138194EFD5144E09D2283A5CE79549D" commented="no"><enum>(IV)</enum><text>With respect to whole farm revenue protection policies, raise the limit on growth expansion for all producers to the lower of—</text><item id="H683CBCD6E2C1444BA0BDB4FF1E75D3A7" commented="no"><enum>(aa)</enum><text>100 percent of historic revenue; and</text></item><item id="H3D309BFAA6574C038A7661A8D90304B3" commented="no"><enum>(bb)</enum><text>$500,000.</text></item></subclause><subclause id="HD99C1D2C94F94D3C82155E29FA4C9701" commented="no"><enum>(V)</enum><text>In the case of a rejection of an application from a producer for a whole farm insurance plan, the approved insurance provider involved shall notify the producer of such rejection, and include in such notification a written rationale with sufficient detail for the producer to understand any deficiencies in the application and how to cure those deficiencies.</text></subclause><subclause id="H3852C8814C714CE59D4C42DDA5C224BF"><enum>(VI)</enum><text display-inline="yes-display-inline">Expand the maximum commodity count eligible for the diversification-based premium discount under subparagraph (C) to apply to 10 commodities produced. The Secretary may raise that maximum commodity count eligible for the diversification-based premium discount to include more than 10 commodities if determined necessary.</text></subclause><subclause id="H91C6187087DF45068A7699B068D0749E" commented="no"><enum>(VII)</enum><text>Moderate the impact of disaster years, as determined by the Secretary, on historic revenue by—</text><item id="HD935009087EE43A4B2C1F2A81EF515EA" commented="no"><enum>(aa)</enum><text>counting indemnities as historic revenue for loss years, including payments made under the noninsured crop disaster assistance program established by section 196 of the Federal Agriculture Improvement and Reform Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/7/7333">7 U.S.C. 7333</external-xref>); or</text></item><item id="H480AB6F06FD14E3B99018D0CD2C4085B" commented="no"><enum>(bb)</enum><text>using an assigned yield floor similar to the limitation described in section 508(g)(6)(A)(i), as determined by the Secretary.</text></item></subclause><subclause id="HF49A2DCB81864FF98DA6C416ADF7DAB9" commented="no"><enum>(VIII)</enum><text>Allow prices and yields used to establish coverage in other Federal crop insurance policies to be used as prices and yields for whole farm revenue protection policies.</text></subclause><subclause id="H31775CF86249403790B30BE37CA5E012" commented="no"><enum>(IX)</enum><text>Establish a process for records and acreage reports submitted by producers for the noninsured crop disaster assistance program established by section 196 of the Federal Agriculture Improvement and Reform Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/7/7333">7 U.S.C. 7333</external-xref>) to be accepted as documentation for the requisite actual production history for whole farm revenue protection policies.</text></subclause><subclause id="H6AB3377D4FDC4EBEB76D01EFA448BE95" commented="no"><enum>(X)</enum><text>Increase agent incentives to market whole farm revenue protection by—</text><item id="H971C8804BF174ADF94AB21D653BB64CA" commented="no"><enum>(aa)</enum><text>providing annual additional administrative and operating subsidies, at a rate determined by the Secretary, to approved insurance providers for any new whole farm revenue policies written in a given year; and </text></item><item id="H6EDF702DB8A24A94AD6207FBD9C3F997" commented="no"><enum>(bb)</enum><text>with respect to a whole farm revenue protection policy, requiring approved insurance providers to pay to the agent who sold that policy an amount equal to the total administrative and operating subsidy earned on that policy.</text></item></subclause><subclause id="HFA2CA61DD9FE4A2088A0AF0E85A1B35B"><enum>(XI)</enum><text display-inline="yes-display-inline">Require approved insurance providers to accept or reject applications, by written decision, within 75 days of receipt of the application, with failure resulting in a reduction by 15 percent of the amount of the administrative and operating subsidy that the approved insurance provider receives from the Corporation for that policy.<italic></italic></text></subclause></clause><clause id="HCE96CCCC62B54A83B1ACFAA4D3E656C4"><enum>(ii)</enum><header>Administrative improvements</header><text display-inline="yes-display-inline">Not later than 18 months after the date of the enactment of the <short-title>Save Our Small Farms Act of 2025</short-title>, for purposes of improving the plan developed under subparagraph (A), the Corporation shall carry out the following activities:</text><subclause id="H5FD1C30EBD7C4BD39E5250FAFDAFF6B7"><enum>(I)</enum><text display-inline="yes-display-inline">Create and maintain a web-accessible tool for producers to locate agents experienced in selling a whole farm revenue protection policy.</text></subclause><subclause id="H62D015290D074E5488B5C115F607FEFA" commented="no"><enum>(II)</enum><text>Provide additional educational and training opportunities to approved insurance providers and insurance agents, which may include entering into agreements with 1 or more entities—</text><item id="HE73442BD89944B109B8F93D006E59A94" commented="no"><enum>(aa)</enum><text>to provide technical assistance to interested producers;</text></item><item id="HCEEDCD76A4BD4DEEA13A1F6533F01EF7" commented="no"><enum>(bb)</enum><text>to conduct education and outreach to agents and insurance providers; and</text></item><item id="HFCB5EE94CCAD4BF1B1CA1E844FDA2835" commented="no"><enum>(cc)</enum><text>to develop best practices for underwriting.</text></item></subclause><subclause id="H1ED7AD5F21834BCD8522AF6D40214F0F"><enum>(III)</enum><text display-inline="yes-display-inline">Conduct a pilot program to create a pricing library for agents and insurance providers, also accessible to the public and entities that provide technical assistance to farmers using data from—</text><item id="H7BA4720EC4AC46D8BDC92D3D78BAC9A7"><enum>(aa)</enum><text>the Agricultural Marketing Service;</text></item><item id="H768267E2C6D049A2B58AD850CCEF34FB"><enum>(bb)</enum><text>the noninsured crop disaster assistance program established by section 196 of the Federal Agriculture Improvement and Reform Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/7/7333">7 U.S.C. 7333</external-xref>);</text></item><item id="H518CD5DCD90346A1B21FA637BC2A7695"><enum>(cc)</enum><text>approved policies of the Board;</text></item><item id="HC5E6E6971458472D83B8C3CB92AC3B6D"><enum>(dd)</enum><text>land-grant colleges or universities and other institutions of higher education;</text></item><item id="H54C480AC3BE54ED4B92261F4C0D8FAFE"><enum>(ee)</enum><text>grower boards or commissions; and</text></item><item id="H2C59111FB385445E92555E80BF25C4BB"><enum>(ff)</enum><text>other relevant sources, as determined by the Secretary.</text></item></subclause></clause><clause id="HDC49CFEB72B04022ACFFEB85EDD6BA11"><enum>(iii)</enum><header>Availability of pricing library</header><text display-inline="yes-display-inline">The Risk Management Agency may, as determined by the Secretary, offer the pricing library described in item (aa) to agents and insurance providers in connection with policies other than policies developed under subparagraph (A).</text></clause><clause id="H14CB13F3E82B42CFA4445C777F93590F" commented="no"><enum>(iv)</enum><header>Public report</header><text display-inline="yes-display-inline">Not later than 18 months after the date of the enactment of the <short-title>Save Our Small Farms Act of 2025</short-title>, the Board shall make publicly available a report describing the decisions made by the Board with respect to each modification described in clauses (i) and (ii).</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H2B1C38E2F4CA4A3C92BA34EFD230A68C"><enum>(3)</enum><text>in paragraph (18), by adding at the end the following: </text><quoted-block style="OLC" id="H5E1CA1F60458413490B4B8A719542FE1" display-inline="no-display-inline"><subparagraph id="HE63BAA140F474542BF2279F1175F40E9"><enum>(D)</enum><header>Continuation of plan</header><text display-inline="yes-display-inline">The Administrator of the Risk Management Agency shall continue to offer the micro farm insurance plan offered pursuant to subparagraph (A)(ii) in all States and counties of the United States.</text></subparagraph><subparagraph id="H13F953FCB6784E7B8ED56A23FC9A5C99"><enum>(E)</enum><header>Modifications to improve effectiveness for micro farms</header><text>Not later than 180 days after the date of the enactment of the <short-title>Save Our Small Farms Act of 2025</short-title>, the Corporation shall implement the following modifications to the micro farm insurance plan offered pursuant to subparagraph (A)(ii):</text><clause id="H257A3C8D61774FE597BADBAA6E6525F7"><enum>(i)</enum><text>Allow vertically integrated operations to access coverage under a micro farm policy.</text></clause><clause id="H2C25F5DBD84E42468FB0A484DED87F12"><enum>(ii)</enum><text>Allow producers with a micro farm policy to also purchase crop-specific Federal crop insurance policies for crops insured under the micro farm policy.</text></clause><clause id="H3D5C6A901B204FDD9E4E9F9097A49F2F"><enum>(iii)</enum><text display-inline="yes-display-inline">Expand the maximum approved revenue to establish eligibility for a micro farm plan of insurance to $1,000,000 or more, as determined by the Secretary.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section commented="no" display-inline="no-display-inline" id="H2F79917FECF34DED8EAFAF3724AB5D69" section-type="subsequent-section"><enum>4.</enum><header>Single index insurance policy</header><subsection commented="no" display-inline="no-display-inline" id="HA363E22F8EB84200995154D318BFFAFE"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 522(c) of the Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1522">7 U.S.C. 1522(c)</external-xref>), as amended by section 3, is further amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H248CE682F96C442FA78907964E96A1F7"><paragraph commented="no" display-inline="no-display-inline" id="H43F9BDD537124229B1AC243BE2D9E258"><enum>(20)</enum><header>Single index insurance policy</header><subparagraph commented="no" display-inline="no-display-inline" id="H864A46370DD948C79AC1908832BEE50E"><enum>(A)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this paragraph:</text><clause commented="no" display-inline="no-display-inline" id="HF0A6754CA25942ABB600EF239ECCE281"><enum>(i)</enum><header>Covered crop or commodity</header><text>The term <term>covered crop or commodity</term> means any crop or commodity (including a specialty crop) on a farm except timber, forest products, animals for sport or show, and pets.</text></clause><clause commented="no" display-inline="no-display-inline" id="HB7D903E744E544D2A2CB18C491CA5701"><enum>(ii)</enum><header>Covered policy</header><text>The term <term>covered policy</term> means the single index insurance policy described in subparagraph (B)(i).</text></clause><clause commented="no" display-inline="no-display-inline" id="H7632F1CFEF174291888156481BC76441"><enum>(iii)</enum><header display-inline="yes-display-inline">Covered weather condition</header><subclause commented="no" display-inline="no-display-inline" id="H7750402E6C18439EA36B5B87C43E5FAA"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>covered weather condition</term> means any of the following weather conditions that are found to be closely correlated with agricultural income losses: </text><item id="HA6FDA946D23C4294BB88F86F57772D5F"><enum>(aa)</enum><text>High winds.</text></item><item commented="no" display-inline="no-display-inline" id="H5838F44B7E5246A6B12F721E8F041034"><enum>(bb)</enum><text display-inline="yes-display-inline">Excessive moisture and flooding.</text></item><item commented="no" display-inline="no-display-inline" id="H4415F66689994F0E940A0D29406E7A59"><enum>(cc)</enum><text display-inline="yes-display-inline">Extreme heat.</text></item><item commented="no" display-inline="no-display-inline" id="HC0E8663A802C42E48C45B51E93EC94AC"><enum>(dd)</enum><text display-inline="yes-display-inline">Abnormal freeze conditions.</text></item><item commented="no" display-inline="no-display-inline" id="HC030212C307041749C47DD6CF64325DD"><enum>(ee)</enum><text display-inline="yes-display-inline">Wildfire.</text></item><item commented="no" display-inline="no-display-inline" id="H9CAB07241FF445708A229FDFC8406487"><enum>(ff)</enum><text>Hail.</text></item><item commented="no" display-inline="no-display-inline" id="H77430D8C2D7B4CE1BDB3D967852C9C7C"><enum>(gg)</enum><text display-inline="yes-display-inline">Drought.</text></item><item commented="no" display-inline="no-display-inline" id="H41A71E3DB4AA42ACB63FDE69B50F33DD"><enum>(hh)</enum><text display-inline="yes-display-inline">Any other severe weather or growing conditions applicable to small-scale farmers, as determined by the Secretary. </text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="HA9E6DA918B854DACBC7C49F639137F93"><enum>(II)</enum><header>Data</header><text display-inline="yes-display-inline">The existence of a weather condition described in subclause (I) shall be determined by indices that prioritize using data from the National Oceanic and Atmospheric Administration, as available, but may use other federally or State certified weather data sources, public and private satellite data, and weather and climate data and models, if necessary, as determined by the Secretary.</text></subclause></clause></subparagraph><subparagraph id="H3702F4C281294E89974EFB2DFC814070"><enum>(B)</enum><header>Policy</header><clause commented="no" display-inline="no-display-inline" id="HEA567386CA9347FBA979698305676338"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The Corporation shall carry out research and development, or offer to enter into 1 or more contracts with 1 or more qualified persons to carry out research and development, to develop a single index policy to insure against agricultural income losses due to 1 or more covered weather conditions. </text></clause><clause commented="no" display-inline="no-display-inline" id="HCCB382FD368E4DEDAEA4663E2E13B3AF"><enum>(ii)</enum><header display-inline="yes-display-inline">Coverage</header><text display-inline="yes-display-inline">Research and development on the covered policy under clause (i) shall require that coverage is available in all 50 States (including Indian Tribes), the District of Columbia, American Samoa, Guam, the Commonwealth of the Northern Mariana Islands, the Commonwealth of Puerto Rico, and the Virgin Islands of the United States.</text></clause><clause id="HA176B3592A6447D690CABA678851740A" commented="no"><enum>(iii)</enum><header>Option to buy-up or buy-down</header><subclause id="H4B3ECDF3B86545B5A2F1345FE4959604" commented="no"><enum>(I)</enum><header>In general</header><text>Research and development on the covered policy under clause (i) shall consider permitting a holder of the covered policy to elect to buy-up to 150 percent, subject to subclause (II), or buy-down to 5 percent, of the median county-level adjusted gross income for farms, in 5-percent increments, to reflect the income of the individual farm business of the holder insured under the covered policy.</text></subclause><subclause id="HA53CAD926BDD4DE19CDFCA7022986C6A" commented="no"><enum>(II)</enum><header>Limitation</header><text>A holder of a covered policy may buy-up under subclause (I) only if the farms of the holder insured under the covered policy have at least 3 covered crops or commodities.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="HA35788105CC14C3C9D95AAC2E596AD25"><enum>(iv)</enum><header>Priority features of policy</header><text>In carrying out research and development on the covered policy under clause (i), the following features may be given priority:</text><subclause commented="no" display-inline="no-display-inline" id="HFB5FD71B372A43D588E7D168A69AD38D"><enum>(I)</enum><text>Agricultural income losses under the covered policy include—</text><item commented="no" display-inline="no-display-inline" id="H2114B5DB89D14A17831038AAEC4556F7"><enum>(aa)</enum><text display-inline="yes-display-inline">losses for all covered crops or commodities; and</text></item><item id="HB91E21139D474865BD0BB47ED7590A67"><enum>(bb)</enum><text>losses to the value of packing, packaging, or any other similar on-farm activity that the Corporation determines necessary to remove a covered crop or commodity from the field.</text></item></subclause><subclause id="HB991D2D80DFF48D6A7C359354B72465E"><enum>(II)</enum><text>Payments are made under the covered policy not later than 30 days after the occurrence of a covered weather condition in the county in which the applicable farm of the farmer is located or an adjacent county.</text></subclause><subclause id="H565524256B60469684FE96878ACB59E1"><enum>(III)</enum><text>Provision of seasonal coverage periods.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H8F67B5DFEBF54E96890ED2BB71AC9EFC"><enum>(IV)</enum><text>Provision of special consideration to concerns facing individual farm businesses—</text><item commented="no" display-inline="no-display-inline" id="H4EEE759F73DD41A0B1EB6C7F09E5556D"><enum>(aa)</enum><text display-inline="yes-display-inline">that have less than $350,000 in adjusted gross income; and</text></item><item commented="no" display-inline="no-display-inline" id="H3403CFE730F94EF9B5BA474F85BDA0A5"><enum>(bb)</enum><text display-inline="yes-display-inline">with respect to which a farmer is an underserved producer (as defined in section 508(a)(7)(A)).</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="H1CDC49C3B90042BEB0A3C087A9A8FF22"><enum>(V)</enum><text display-inline="yes-display-inline">Paperwork requirements are reduced for farmers seeking to obtain a covered policy.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H04261C3296984CED8D4EF3CD8FA42533"><enum>(v)</enum><header>Consultation</header><text display-inline="yes-display-inline">In carrying out research and development on the covered policy under clause (i), the Corporation—</text><subclause commented="no" display-inline="no-display-inline" id="HF1011EAB5103491ABB25223CF4997E4B"><enum>(I)</enum><text display-inline="yes-display-inline">shall hold stakeholder meetings to solicit producer and agent feedback; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H46A763634054447CABA9D28F987E3D20"><enum>(II)</enum><text display-inline="yes-display-inline">may consult with licensed actuaries with experience developing index policies insuring agricultural production. </text></subclause></clause></subparagraph><subparagraph id="H86794A2DB4EB43DC99B5843B7E1E2562"><enum>(C)</enum><header>Report</header><text>Not later than 1 year after the date of the enactment of this paragraph, the Corporation shall make publicly available a report that describes—</text><clause id="HC8331E5D724A47C48AE76B3D3467AAA5"><enum>(i)</enum><text>the results of the research and development carried out under this paragraph; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HAFE747AB866F415FBB812E77D5F2FF94"><enum>(ii)</enum><text display-inline="yes-display-inline">recommendations to Congress with respect to those results, including—</text><subclause commented="no" display-inline="no-display-inline" id="H53A02322547345C09D72E1897376BF21"><enum>(I)</enum><text display-inline="yes-display-inline">any challenges to developing the covered policy; and</text></subclause><subclause id="H199E17992FAC4147A85788A95F60A76B" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">options to address those challenges.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HA23AAC1F9D4C4683AE3996DBCD1142D7"><enum>(b)</enum><header>Technical amendment</header><text>Section 531(a)(18) of the Federal Crop Insurance Act (<external-xref legal-doc="usc"
