<section id="H45E4DC7E1BED47A689DFD5660DE26343" section-type="section-one"><enum>1.</enum><header>Authorization of appropriations for United States Merchant Marine Academy infrastructure and facilities modernization</header> 
<subsection id="H3A51018217B04416AC9EDFC2D04EA9EF"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text> <paragraph id="H0ED7ADDCE8F14722A98116E4963A8BB8"><enum>(1)</enum><text>The United States Merchant Marine Academy plays a critical role in training service-obligated licensed merchant mariners to operate commercial vessels, in peacetime and during times of conflict.</text></paragraph> 
<paragraph id="H1175B9C6C03A4694BA9AC8EEAF224C86"><enum>(2)</enum><text>The United States Merchant Marine Academy is 1 of the 5 Federal service academies and plays a critical role in maintaining a domestic, commercial maritime industry, with each graduate having a commitment to serve not less than 8 years in the foreign and domestic commerce and the national defense of the United States, which may include service on a merchant vessel documented under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/121">chapter 121</external-xref> of title 46, and graduates make up more than 80 percent of the United States Navy’s Strategic Sealift Officer Program.</text></paragraph> <paragraph id="HACC9C64D5FBB477F9A4207FF9192EA6D"><enum>(3)</enum><text>The United States defense readiness relies on a strong investment in educating and training militarily obligated United States Merchant Marine officers at the United States Merchant Marine Academy.</text></paragraph> 
<paragraph id="HD5A9DF992C3044F3BBFAA062ABCBA0B1"><enum>(4)</enum><text>Most of the facilities at the United States Merchant Marine Academy date back to the Academy’s founding, have not been modernized since, and are not conducive to the immersive training and demanding coursework today’s Midshipmen are required to complete.</text></paragraph> <paragraph id="HE7428388C9A548F1A96102F443C8A84A"><enum>(5)</enum><text>Rehabilitating and modernizing the campus infrastructure at the United States Merchant Marine Academy is necessary to ensuring current and future generations of Midshipmen receive a first-class education.</text></paragraph></subsection> 
<subsection id="H7CED908AA94746CB9BA56193E3B6DF2E"><enum>(b)</enum><header>Sense of the House of Representatives</header><text>It is the sense of the House of Representatives—</text> <paragraph id="HCC6C507DCBD749B08198919C94364B47"><enum>(1)</enum><text>to ensure that the United States continues to have a sufficient number of service-obligated licensed merchant mariners to meet current and future national security needs, the Maritime Administration and the Department of Transportation have a responsibility to provide suitable academic, training, and dormitory facilities at the United States Merchant Marine Academy by rapidly implementing a comprehensive plan for campus-wide modernization in accordance with section 51329 of title 46, United States Code, (referred to in this section as the <quote>Campus Modernization Plan</quote>) and providing sufficient accountability and oversight to ensure that milestones in such plan are met;</text></paragraph> 
<paragraph id="H5B5CEE4B7F4443E9968A6FE577484600"><enum>(2)</enum><text>in developing the comprehensive Campus Modernization Plan for the United States Merchant Marine Academy, the Maritime Administration, and the Department of Transportation should utilize, to the maximum extent practicable, the <quote>Merchant Marine Academy Full Speed Ahead Plan</quote> developed by the Maritime Security Infrastructure Council as summarized in the Congressional Record, dated February 28, 2024;</text></paragraph> <paragraph id="HD20FFCD3CE644F1984C8B7B609255635"><enum>(3)</enum><text>given the conditions of the United States Merchant Marine Academy as of the date of enactment of this section, a comprehensive, campus-wide modernization is needed to significantly upgrade or replace facilities throughout the campus; and</text></paragraph> 
<paragraph id="HD6A862BB9AE64C8CA8AD59093250C96E"><enum>(4)</enum><text>the Maritime Administration and the Department of Transportation should identify opportunities to utilize design-build contracts to increase delivery times and reduce costs.</text></paragraph></subsection> <subsection id="H56B85F49E0AA45C5B1DFCF06BB7820CE"><enum>(c)</enum><header>Campus modernization plan</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/513">Chapter 513</external-xref> of title 46, United States Code, is amended by adding at the end the following:</text> 
<quoted-block id="HAF9D26B6B4324483955C2DCF4DCE7C45" style="USC"> 
<section id="HA6D3C430FC6140BC9F24A6BB756EE2EC"><enum>51329.</enum><header>10-year campus modernization plan</header> 
<subsection id="H8298F681A597487BA4F3FF0B3EC1F844"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this section, the Secretary shall develop and begin to implement a comprehensive Campus Modernization Plan (referred to in this section as the <quote>Campus Modernization Plan</quote>), informed by the <quote>United States Merchant Marine Academy Full Speed Ahead Plan</quote> developed by the Maritime Security Infrastructure Council as summarized in the Congressional Record, dated February 28, 2024, to carry out a campus-wide modernization at the United States Merchant Marine Academy.</text></subsection> <subsection id="HEE22208D271A42698F15D5BE3F0EB82D"><enum>(b)</enum><header>Objectives</header><text>In carrying out the Campus Modernization Plan, the Administrator shall prioritize the following objectives:</text> 
<paragraph id="HDC44056A3A2A4CD7B2CFC58C26C11B0D"><enum>(1)</enum><text>Promoting modern education best practices by constructing learning facilities that leverage state-of-the art technologies and learning best practices.</text></paragraph> <paragraph id="H9C7FD453A6524402B8DDF2122372609F"><enum>(2)</enum><text>Providing Midshipmen with access to facilities needed to pass the United States Coast Guard License Exam for Third Mate or Third Assistant Engineer Unlimited.</text></paragraph> 
<paragraph id="HEF9B8EF7976F4C00A49417DAF1C45FB9"><enum>(3)</enum><text>Ensuring Midshipmen have access to facilities sufficient to enable Midshipmen to maintain physical readiness standards required of United States Navy officers.</text></paragraph> <paragraph id="H1617F4A4973148A6AAC7C6FD0F34A5BB"><enum>(4)</enum><text>Developing campus infrastructure to ensure the Academy attracts a diverse pool of applicants.</text></paragraph> 
<paragraph id="H19B3001E85674762894BCF81E57421C7"><enum>(5)</enum><text>Providing facilities that enable industry engagement and continuing education opportunities.</text></paragraph> <paragraph id="H2EB95BB2EF86421BB05622A58620E685"><enum>(6)</enum><text>Maintaining a safe and secure campus environment for all Midshipmen, which shall include any facilities or infrastructure needed to meet the requirements of sections 51326, 51327, or 51328.</text></paragraph> 
<paragraph id="HCCC8684B76474A45B79FF97ECC10FEAF"><enum>(7)</enum><text>Implementing, to the extent practicable, the facilities and infrastructure recommendations in chapter 4 of the report titled <quote>Organizational Assessment of the United States Merchant Marine Academy: A Path Forward</quote> issued by the National Academy of Public Administration in November 2021.</text></paragraph></subsection> <subsection id="HA5BFE67C62C44B2BB7E0A33752D64255"><enum>(c)</enum><header>Inclusions</header><text>In meeting the objectives described in subsection (b), the Campus Modernization Plan shall include—</text> 
<paragraph id="HC1E4714D597F420CA0BB042AF6F3435C"><enum>(1)</enum><text>construction of new facilities or significant renovation of existing facilities to provide—</text> <subparagraph id="H3CD654DFE47C4C3B9106AF90000B52DF"><enum>(A)</enum><text>Standards of Training, Certification, and Watchkeeping applications laboratories;</text></subparagraph> 
<subparagraph id="HAA18B96A9A6C4094B5B37D9B1E59988C"><enum>(B)</enum><text>a Safety Of Life At Sea training pool;</text></subparagraph> <subparagraph id="H99708DCB04AF4356938C14DD06163EAB"><enum>(C)</enum><text>engineering powerplant laboratories;</text></subparagraph> 
<subparagraph id="H00DAFC8FE8AA497F8B0ECFB3E2DC4710"><enum>(D)</enum><text>athletic facilities that meet the needs of both male and female students;</text></subparagraph> <subparagraph id="H24F684CB55D04005BBFF390F6B64619D"><enum>(E)</enum><text>enhanced waterfront facilities, to include a new pier;</text></subparagraph> 
<subparagraph id="H7460601BE4F74C77B3BAF97C8F8290D3"><enum>(F)</enum><text>a visitor welcome center and main campus security office building;</text></subparagraph> <subparagraph id="H2F466DBF0D9344C9B8BDBE92641E2F24"><enum>(G)</enum><text>housing facilities for senior staff and faculty; and</text></subparagraph> 
<subparagraph id="H0E9EC71ECF7D4BD68D8A2C7ECCFBD3CE"><enum>(H)</enum><text>sufficient parking facilities for faculty, staff, and campus visitors;</text></subparagraph></paragraph> <paragraph id="HDEEFE2060B214FBCA98E22CFD7C5AF6F"><enum>(2)</enum><text>upgrades to all classrooms and laboratories with modern information technology infrastructure;</text></paragraph> 
<paragraph id="HDAB571169E9D45C7BF773A2C61F50495"><enum>(3)</enum><text>a campus-wide upgrade and retrofit of—</text> <subparagraph id="H1E5766FFA76B4DC7BE3383B3A6066EF8"><enum>(A)</enum><text>the electric distribution power grid;</text></subparagraph> 
<subparagraph id="HBCEC6300F4734F7398BC97C7CCD6B4E7"><enum>(B)</enum><text>the sanitary sewer system piping;</text></subparagraph> <subparagraph id="H48C392ED260C4EE380C94B3C57C21210"><enum>(C)</enum><text>the storm drainage system; and</text></subparagraph> 
<subparagraph id="H45181A591B4A4EC1B1A500147D63146A"><enum>(D)</enum><text>the drinking water system, including development of a separate and redundant fire suppression system; and</text></subparagraph></paragraph> <paragraph id="HD3B491E32D7F43DD971CFE8F5E301523"><enum>(4)</enum><text>renovations of existing campus facilities to ensure all campus facilities—</text> 
<subparagraph id="HA594FEE8C1F74082BF0BE5A1A9EAC2DB"><enum>(A)</enum><text>are structurally sound;</text></subparagraph> <subparagraph id="HFFF275DEA38D4222B2678C1A5BC09430"><enum>(B)</enum><text>have reliable heating and air conditioning systems;</text></subparagraph> 
<subparagraph id="H276A04D40E93463BBA07C9C97A07D72B"><enum>(C)</enum><text>have functioning plumbing and electrical systems;</text></subparagraph> <subparagraph id="HB0233A2221B04242B76CEE4DB2ADE7AF"><enum>(D)</enum><text>are protected from the elements, including through roof replacements and window repairs or replacements, as needed;</text></subparagraph> 
<subparagraph id="HC01A6B51762A4E738E91D3ED02976890"><enum>(E)</enum><text>are accessible in accordance with the Americans with Disabilities Act of 1990; and</text></subparagraph> <subparagraph id="HC2C9956A5A6C4BB2BCEEC3459CE08E7A"><enum>(F)</enum><text>have working fire alarm and fire suppression systems.</text></subparagraph></paragraph></subsection> 
<subsection id="HC7FC7243D8D94724850C9946E1CE29FB"><enum>(d)</enum><header>Requirements</header><text>For the duration of the Campus Modernization Plan, the Administrator shall ensure that the Academy remains fully operational.</text></subsection> <subsection id="H3B1AB67D909447C5BFBCA19258693328"><enum>(e)</enum><header>Use of a Federal construction agent</header><text>Consistent with the requirements of section 3515(d)(3) of the James M. Inhofe National Defense Authorization Act for Fiscal Year 2023 (<external-xref legal-doc="public-law" parsable-cite="pl/117/263">Public Law 117–263</external-xref>), the Administrator shall seek to enter into an agreement with a Federal construction agent to carry out the Campus Modernization Plan authorized under subsection (a).</text></subsection> 
<subsection id="HEAA12EAA4A0B4406B990F03C7118186E"><enum>(f)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Secretary of Transportation, out of the Maritime Security Trust Fund established under <external-xref legal-doc="usc" parsable-cite="usc/26/9512">section 9512</external-xref> of the Internal Revenue Code of 1986, for fiscal years 2026 through 2035, for the phased rehabilitation, modernization, and construction of facilities and infrastructure at the United States Merchant Marine Academy, in accordance with this section, including the Campus Modernization Plan authorized in subsection (a), $1,020,000,000 of which—</text> <paragraph id="H90C45C9EBCE14DD59BD82F4AD1DFAA6E"><enum>(1)</enum><text>$54,000,000 is authorized to be appropriated for fiscal year 2026 for design and planning purposes, which shall be used for the development of a design-build plan for the phased rehabilitation, modernization, and construction of facilities and infrastructure at the United States Merchant Marine Academy in accordance with the Campus Modernization Plan; and</text></paragraph> 
<paragraph id="H644B56856AAF45DAA48A4908FB1441FC"><enum>(2)</enum><text>for fiscal years 2026 through 2035, $107,333,333 is authorized to be appropriated for each fiscal year for construction and contingency purchases necessary to execute the Campus Modernization Plan.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HA20AAFA127534C639162177302AE4912"><enum>(d)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/513">chapter 513</external-xref> of title 46, United States Code, is amended by adding at the end the following:</text>
