R. 2425</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250327">March 27, 2025</action-date><action-desc><sponsor name-id="F000246">Mr. Fallon</sponsor> (for himself, <cosponsor name-id="H001081">Mrs. Hayes</cosponsor>, <cosponsor name-id="V000134">Ms. Van Duyne</cosponsor>, <cosponsor name-id="G000589">Mr. Gooden</cosponsor>, and <cosponsor name-id="N000026">Mr. Nehls</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and Workforce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To protect babies and young children in childcare settings by strengthening transparency and safety requirements.</official-title></form><legis-body id="HA714DE32F61E4FD096A9F114A7A56A02" style="OLC"><section id="H8F8D44CEBDD449428D9FDC2592B3E3FC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Kairo Act of 2025</short-title></quote>.</text></section><section id="HF81986D4468B409385DB66210E6CAC73" section-type="subsequent-section"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this Act:</text><paragraph id="HBD0F4AEC1CFC47B2BE43C0B6F7097CBE"><enum>(1)</enum><text display-inline="yes-display-inline">The term <quote>certain child care provider</quote> means a center-based child care provider, a family child care provider, a sectarian child care provider, or other provider of child care services for compensation that receives any amount of Federal funding towards providing child care or early learning programs, including but not limited to Child Care Development Block Grants and Head Start funding.</text></paragraph><paragraph id="H20A05784883144338EBAE778AB78FCDF"><enum>(2)</enum><text display-inline="yes-display-inline">The term <quote>Center-based child care provider</quote> means a provider licensed or otherwise authorized to provide child care services for fewer than 24 hours per day per child in a non-residential setting, unless care in excess of 24 hours is due to the nature of the parent(s)' work.</text></paragraph><paragraph id="H7A973E71D08B4BC6917B487AEE63B647"><enum>(3)</enum><text>The term <quote>family child care provider</quote> means one or more individual(s) who provide child care services for fewer than 24 hours per day per child, in a private residence other than the child's residence, unless care in excess of 24 hours is due to the nature of the parent(s)' work.</text></paragraph><paragraph id="H59BC6594D50F42659ACCE76EDAB1882F"><enum>(4)</enum><text>The term <quote>sectarian organization and sectarian child care provider</quote> means a religious organization or religious provider generally. The terms embrace any organization or provider that engages in religious conduct or activity or that seeks to maintain a religious identity in some or all of its functions. There is no requirement that a sectarian organization or provider be managed by clergy or have any particular degree of religious management, control, or content.</text></paragraph></section><section id="HF356D440961046BF851A2A004D2DB5EB"><enum>3.</enum><header>Parental rights as a condition of funding</header><subsection id="H923FB3DD0FAB4ADEB98A4E553081C16C"><enum>(a)</enum><text display-inline="yes-display-inline"> Any provider receiving Federal funds towards providing child care or early learning programs, including but not limited to Child Care Development Block Grants or Head Start funding must develop a parent’s bill of rights for child care that includes—</text><paragraph id="HE770BC0DB5D2482BA9F9594591D175DC"><enum>(1)</enum><text display-inline="yes-display-inline">contact information for the state child abuse hotline and agency responsible for investigating suspected abuse, neglect, or exploitation in a child care operation;</text></paragraph><paragraph id="H76FFB08F533548B09F8F101C23A2BAA1"><enum>(2)</enum><text>information on how to access the State’s electronic database, if applicable, of child care monitoring and inspection reports as described in section 658E(c)(2)D) of the Child Care and Development Block Grant Act;</text></paragraph><paragraph id="H836CEE870E4D4306B100AF875D25FB85"><enum>(3)</enum><text display-inline="yes-display-inline">for Head Start and Early Head Start programs information on how to access monitoring reports conducted by the Office of Head Start;</text></paragraph><paragraph id="H4F2CB2B091D842E08CA700E98E7A9091"><enum>(4)</enum><text> access to review such child care facility’s written records concerning the such child;</text></paragraph><paragraph id="H7F94DDF17FCE4A9FBCD28F1AA7021A39"><enum>(5)</enum><text>receive from the child care facility, upon request, the responsible state agency’s inspection reports for the child care facility and information about how to access the child care facility’s compliance history online;</text></paragraph><paragraph id="H52D9834347124E59969A8AC97B936FF5"><enum>(6)</enum><text>compliance by the facility with a court order preventing another parent or guardian of such child from visiting or removing such child from such facility;</text></paragraph><paragraph id="H36EDB3D190D54FA8BA0A0F0AF3D1ECBD"><enum>(7)</enum><text>the contact information for the division responsible for regulating the child care facility, including the division’s name, address, and phone number;</text></paragraph><paragraph id="H3063B2618E384668874245A9C3DC2914"><enum>(8)</enum><text>access, within 2 business days from time of written request, to any video recording of an alleged incident of abuse or neglect involving such child if—</text><subparagraph id="HB987BA426B724D12AD28080568423847"><enum>(A)</enum><text>such a video recording of the alleged incident is available;</text></subparagraph><subparagraph id="H6D383C6D1478417BAD7370D48203A4C2"><enum>(B)</enum><text>such parent or guardian is prohibited from retaining any part of the video recording depicting a child who is not the child of such parent or guardian; </text></subparagraph><subparagraph id="H38E7471014CF48D5A240669FEDE46318"><enum>(C)</enum><text>the parent or guardian of any other child captured in such video recording receives written notice from such provider of a request for access to such video recording;</text></subparagraph><subparagraph id="HAB40ED5183A84CB5B7BA5A42A85350DB"><enum>(D)</enum><text>a copy of the child care facility’s policies and procedures; access to review such provider’s—</text><clause id="H48C190F2D2A747FE966EA5CB8983D527"><enum>(i)</enum><text>staff training records; and</text></clause><clause id="H2943C0E8888D456E8A495923621C4140"><enum>(ii)</enum><text>any in-house staff training curriculum used by such provider; and</text></clause></subparagraph><subparagraph id="H11B993DC8FAE4D55A2AFA7FF0BECA671"><enum>(E)</enum><text>freedom from any retaliatory action by such a provider for exercising any of the parent’s or guardian’s rights under this Act.</text></subparagraph></paragraph></subsection><subsection id="HDEE2ECA069D24C42982B1D3776A60A7B"><enum>(b) </enum><text display-inline="yes-display-inline">A child care provider shall provide the parent or guardian of a child for whom it provides child care services a written copy of the rights listed in subsection (a) no later than 45 days after the effective date of this Act; or not later than the child’s 1st day on which such services begin after such effective date.</text></subsection><subsection id="H98513193D04142B081313085595DEDA9"><enum>(c)</enum><text>This section does not affect the ability of a law enforcement agency or a local- or state-run child protective services agency to access a video recording as part of an investigation of an incident depicted in such video recording. </text></subsection></section><section id="H87CDA53B61B14F3CBEE68EEDB810AB8D"><enum>4.</enum><header>Notice of requirement to comply</header><text display-inline="no-display-inline">Not later than 30 days after the effective date of this Act, the Director of the Department of Health and Human Services will direct the Office of Child Care (OCC) and the Office of Head Start (OHS) to make all current and future potential recipients of Child Care Development Block Grants and Head Start funding aware of the new requirements. </text></section><section id="HD36850EDAB4F40359CD0B631CE65F1B2"><enum>5.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act shall take effect 30 days after the date of the enactment of this Act, the date of the enactment of this Act.</text></section></legis-body></bill>
