which was referred to the <committee-name committee-id="HED00">Committee on Education and Workforce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To improve education outcomes by empowering parents, States, and local communities, and for other purposes.</official-title></form><legis-body id="HAD9AEB1BFCD949988DFB1B42778DFDBD" style="OLC"><section id="H5485D1F2C21F4395A63E6FA1ED1A8597" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Make Education Great Again Act</short-title></quote>.</text></section><section id="HA6A19C29F65344F8A358790B32A5C63E"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="H43C37907AF2D463787C6FF214E1155FD"><enum>(1)</enum><text>Parents, as the primary educators of their children, should have meaningful choices in their children’s education, including public, charter, private, and homeschooling options.</text></paragraph><paragraph id="HCFEBE292BE214F94B46E5CE4C307A56C"><enum>(2)</enum><text>Federal overreach in education policy has led to decreased local control and has not demonstrably improved academic outcomes for students.</text></paragraph><paragraph id="H1490DD3A804E4083A21BB697C6A52420"><enum>(3)</enum><text>Restoring educational decision-making to parents, States, and local communities will foster accountability, innovation, and better educational results.</text></paragraph><paragraph id="HAAEE841BEA3B4473A388F4415A61B6D6"><enum>(4)</enum><text>Policies that respect parental rights and State sovereignty are essential to ensuring that schools effectively serve students.</text></paragraph><paragraph id="H67DFBB3102CD4E2381DE5501A8C52598"><enum>(5)</enum><text>The Federal Government should remove unnecessary regulatory barriers and support policies that allow parents and communities to pursue the best educational opportunities for children.</text></paragraph></section><section id="H6F3A3B2081BF4F6C95DB2465F2CA9D10"><enum>3.</enum><header>Authorities of the Secretary of Education</header><text display-inline="no-display-inline">The Secretary of Education may, consistent with applicable law—</text><paragraph id="H6C72664EAEA943AB8AFDF7A14E221930"><enum>(1)</enum><text>take steps to ensure that Federal education funds empower parents and local communities rather than Federal bureaucracies;</text></paragraph><paragraph id="H6B50FC5D95074BB4B23C0733ADBDE018"><enum>(2)</enum><text>review and rescind, revise, or amend regulations, guidance documents, and policies that limit parental rights or State and local control over education;</text></paragraph><paragraph id="H41A635D63A2A4D11B895CB6A687C6636"><enum>(3)</enum><text>promote policies that support school choice, including expanding access to education savings accounts, voucher programs, and charter schools;</text></paragraph><paragraph id="H7A6621062FE44297A890CECEECB48E6A"><enum>(4)</enum><text>identify and reduce Federal administrative burdens on States, school districts, and educational institutions;</text></paragraph><paragraph id="H6212E33F4EF84C04BD2C36E25C58C85C"><enum>(5)</enum><text>collaborate with States and localities to encourage high-quality education practices while respecting State and local decision-making authority;</text></paragraph><paragraph id="H5748FF73539647AC9401A53E0CBF6532"><enum>(6)</enum><text>enhance transparency regarding educational content, policies, and funding so that parents and communities can make informed decisions; and</text></paragraph><paragraph id="H4861AF674DDC4F10B6D17A9F362A55B6"><enum>(7)</enum><text>ensure that Federal funds are used in a manner that supports student achievement rather than Federal mandates.</text></paragraph></section><section id="HF3F490BC21C646349A50EDCA5BDBF10A"><enum>4.</enum><header>Spending limitations and reporting requirements</header><subsection id="H3857191748D748C3B2948587FB434A96"><enum>(a)</enum><header>Authority To reduce spending</header><text>Notwithstanding any other provision of law, the Secretary of Education may, as appropriate to carry out this Act, obligate or expend less than the total amounts appropriated for education programs, provided that such reductions do not violate statutory requirements for mandatory funding.</text></subsection><subsection id="HBDFBD7D6777446A8A3A144DC32D62044"><enum>(b)</enum><header>Reporting requirement</header><text>Not later than 30 days after the end of each fiscal quarter, the Secretary of Education shall submit to the Committee on Education and Workforce of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate a report detailing—</text><paragraph id="HFF6B2A9984A246D99FBF43746CF26D35"><enum>(1)</enum><text>the total amount of appropriated funds not obligated or expended during the previous quarter;</text></paragraph><paragraph id="H0AE1C4F283264EBFB85289170F915DB4"><enum>(2)</enum><text>a description of the programs or activities affected by the reduced spending; and</text></paragraph><paragraph id="H1CAC6D337AEB441A805424A5FAF64528"><enum>(3)</enum><text>the rationale for the decision to withhold or reduce spending in each case.</text></paragraph></subsection></section><section id="HBFD8DB9FACBC489CB0A660227D2ED091"><enum>5.</enum><header>Rules of construction</header><subsection id="HC61E146A861F499689BD16DFBD10C538"><enum>(a)</enum><header>No Federal mandate on States or local educational agencies</header><text>Nothing in this Act shall be construed to mandate, direct, or control a State, local educational agency, or school’s curriculum, standards, assessments, or policies.</text></subsection><subsection id="H9CA572057EDD468F89B29BDB907DFF4D"><enum>(b)</enum><header>Parental rights</header><text>Nothing in this Act shall be construed to limit the rights of parents to direct the education and upbringing of their children.</text></subsection><subsection id="H42459E6149694F9FAB5AB9820364EA8F"><enum>(c)</enum><header>State and local autonomy</header><text>Nothing in this Act shall be construed to preempt or limit the authority of States and local educational agencies to determine education policy, except as required by Federal law.</text></subsection><subsection id="HA54C6D45FC0943D3965608AB77AA103E"><enum>(d)</enum><header>No new spending</header><text>Nothing in this Act shall be construed to authorize new spending by the Federal Government beyond existing appropriations.</text></subsection><subsection id="H8CDC32D56D4C4E87B8F8FFCEE5969074"><enum>(e)</enum><header>No effect on homeschooling</header><text>Nothing in this Act shall be construed to regulate, restrict, or otherwise affect homeschooling.</text></subsection></section></legis-body></bill>
