section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Financial Technology Protection Act of 2025</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="H22FF5545720848FB821D5BD53B2D12C3"><enum>2.</enum><header>Independent Financial Technology Working Group to Combat Terrorism and Illicit Financing</header><subsection id="H555902498F3D49E29B2C004BCA1573D8"><enum>(a)</enum><header>Establishment</header><text>There is established the Independent Financial Technology Working Group to Combat Terrorism and Illicit Financing (in this section referred to as the <quote>Working Group</quote>), which shall consist of the following:</text><paragraph id="H392AA981CFE147A9A11A7B357F2866D6"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary of the Treasury, acting through the Under Secretary for Terrorism and Financial Crimes, who shall serve as the chair of the Working Group.</text></paragraph><paragraph id="H77353DD464C44AF4937F94D2DD331BF5"><enum>(2)</enum><text>A senior-level representative from each of the following:</text><subparagraph id="H49891578059D42AFB4030EB630EAF413"><enum>(A)</enum><text display-inline="yes-display-inline">The Department of the Treasury.</text></subparagraph><subparagraph id="H4E6BEE30741B45D1B4F3F89FC6E09C78"><enum>(B)</enum><text>The Office of Terrorism and Financial Intelligence.</text></subparagraph><subparagraph id="H6BBB9D41CEFB44C3BC9F978BC5ADDB88" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>The Internal Revenue Service.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA57082C505EE4CB2AD687E10EBFF999C"><enum>(D)</enum><text display-inline="yes-display-inline">The Department of Justice.</text></subparagraph><subparagraph id="HE8FC347193654DE68FB84660CBFA45FC"><enum>(E)</enum><text>The Federal Bureau of Investigation.</text></subparagraph><subparagraph id="HDC32F205CF89452AB12D7CDAE48352D0" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text display-inline="yes-display-inline">The Drug Enforcement Administration.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA73FC550BCEB4B38AFEE6FD20C01FD93"><enum>(G)</enum><text>The Department of Homeland Security.</text></subparagraph><subparagraph id="H387EE102A13B428098AD1F185D106E41"><enum>(H)</enum><text>The United States Secret Service.</text></subparagraph><subparagraph id="H9D58A8BF8DD64329A4582489820DB114"><enum>(I)</enum><text>The Department of State.</text></subparagraph><subparagraph id="H5FB7ABE5DFD4478998D8B48EF9EB54FF"><enum>(J)</enum><text display-inline="yes-display-inline">The Office of the Director of National Intelligence.</text></subparagraph></paragraph><paragraph id="H41899BEA18584F4086C7E4E06D1B102E"><enum>(3)</enum><text>At least five individuals appointed by the Under Secretary for Terrorism and Financial Crimes to represent the following:</text><subparagraph id="H4CD9505B87F54AEBBF75F779F6957166"><enum>(A)</enum><text>Financial technology companies.</text></subparagraph><subparagraph id="H64BA2423E65D4FF9A1C89C5239D1106D"><enum>(B)</enum><text>Blockchain intelligence companies. </text></subparagraph><subparagraph id="H086CD7E911E64D0FB8C3BF7E1F179E35"><enum>(C)</enum><text>Financial institutions.</text></subparagraph><subparagraph id="HECAA847F8DB1479CBFFC798F35F07CE8"><enum>(D)</enum><text>Institutions or organizations engaged in research.</text></subparagraph><subparagraph id="H907203C2060B4322A0F6CB0F25E0C35F"><enum>(E)</enum><text display-inline="yes-display-inline">Institutions or organizations focused on individual privacy and civil liberties.</text></subparagraph></paragraph><paragraph id="H347D1E5A29AD4EF0A04FFFD2065B86E4"><enum>(4)</enum><text display-inline="yes-display-inline">Such additional individuals as the Secretary of the Treasury may appoint as necessary to accomplish the duties described under subsection (b).</text></paragraph></subsection><subsection id="H6FAF83601D044528963C73C67F367BBB"><enum>(b)</enum><header>Duties</header><text>The Working Group shall—</text><paragraph id="H94664E0B2C564AA2A0306140C187B494"><enum>(1)</enum><text display-inline="yes-display-inline">conduct research on terrorist and illicit use of digital assets and other related emerging technologies; and</text></paragraph><paragraph id="H98CF658D140845FCBDA1B79F107A581E"><enum>(2)</enum><text>develop legislative and regulatory proposals to improve anti-money laundering, counter-terrorist, and other counter-illicit financing efforts in the United States.</text></paragraph></subsection><subsection id="H0C38FAA03F504676ABDF6B3EE68031ED"><enum>(c)</enum><header>Reports</header><paragraph commented="no" display-inline="no-display-inline" id="H7691EF2E6B704F619E7F03D89F16AFE9"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, and annually for the 3 years thereafter, the Working Group shall submit to the Secretary of the Treasury, the heads of each agency represented in the Working Group pursuant to subsection (a)(2), and the appropriate congressional committees a report containing the findings and determinations made by the Working Group in the previous year and any legislative and regulatory proposals developed by the Working Group.</text></paragraph><paragraph id="H718784C530BC442F9211C75AE6B61F23" commented="no"><enum>(2)</enum><header>Final report</header><text>Before the date on which the Working Group terminates under subsection (d)(1), the Working Group shall submit to the appropriate congressional committees a final report detailing the findings, recommendations, and activities of the Working Group, including any final results from the research conducted by the Working Group.</text></paragraph></subsection><subsection id="H8A19E6AA315D4E349ACBA44EA0A79B9A" commented="no"><enum>(d)</enum><header>Sunset</header><paragraph commented="no" display-inline="no-display-inline" id="HCB5F727E78C04BFD8EC2552179B8C1C5"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Working Group shall terminate on the later of—</text><subparagraph id="HD97D7E5340574276B31C38AF762361E8"><enum>(A)</enum><text>the date that is 4 years after the date of the enactment of this Act; or</text></subparagraph><subparagraph id="H0FF262BB039C47948F721652AD2875D5"><enum>(B)</enum><text display-inline="yes-display-inline">the date on which the Working Group completes any wind-up activities described under paragraph (2).</text></subparagraph></paragraph><paragraph id="H2BCC547EB09B40A69DCEC27099B86D83" commented="no"><enum>(2)</enum><header>Authority to wind up activities</header><text display-inline="yes-display-inline">If there are ongoing research, proposals, or other related activities of the Working Group ongoing as of the date that is 4 years after the date of the enactment of this Act, the Working Group may temporarily continue working in order to wind-up such activities.</text></paragraph><paragraph id="H119BB150F4774715B2FF43BF24484A5F"><enum>(3)</enum><header>Return of appropriated funds</header><text display-inline="yes-display-inline">On the date on which the Working Group terminates under paragraph (1), any unobligated funds appropriated to carry out this section shall be transferred to the Treasury.</text></paragraph></subsection></section><section id="H5D01B8044CCE40D895C64993B1A7DEF5"><enum>3.</enum><header>Preventing rogue and foreign actors from evading sanctions</header><subsection id="H46104DCB18384FDCA8583D2CBD788BD7"><enum>(a)</enum><header>Report and strategy with respect to digital assets and other related emerging technologies</header><paragraph id="H04AC94E21CC54B3B81A9305218F6007B"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the President, acting through the Secretary of the Treasury and in consultation with the head of each agency represented on the Independent Financial Technology Working Group to Combat Terrorism and Illicit Financing pursuant to section 2(a)(2), shall submit to the appropriate congressional committees a report that describes—</text><subparagraph id="H0B4BE83DD55D4A94A8D7530392674C29"><enum>(A)</enum><text>the potential uses of digital assets and other related emerging technologies by States, non-State actors, foreign terrorist organizations, and other terrorist groups to evade sanctions, finance terrorism, or launder monetary instruments, and threaten the national security of the United States; and</text></subparagraph><subparagraph id="H5E4A42D9EA30413DA6806A5EEF11CDD5"><enum>(B)</enum><text>a strategy for the United States to mitigate and prevent the illicit use of digital assets and other related emerging technologies.</text></subparagraph></paragraph><paragraph id="H71B06A0F07144F739F2F65BAD704B813"><enum>(2)</enum><header>Form of report; public availability</header><subparagraph commented="no" display-inline="no-display-inline" id="HE7812335F79B42969344720CB3D0C4AE"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The report required by paragraph (1) shall be submitted in unclassified form, but may include a classified annex.</text></subparagraph><subparagraph id="H58712CFF328B463C83CABA2E9D63664C"><enum>(B)</enum><header>Public availability</header><text>The unclassified portion of each report required by paragraph (1) shall be made available to the public and posted on a publicly accessible website of the Department of the Treasury—</text><clause id="H25C1C3C0FD534DA097ADDA89C91BED91"><enum>(i)</enum><text>in precompressed, easily downloadable versions, in all appropriate formats; and</text></clause><clause id="HFCE26235DB8A4C13842E5276236823C2"><enum>(ii)</enum><text>in machine-readable format, if applicable.</text></clause></subparagraph></paragraph><paragraph id="H15DC8798A0E04C179BD1CA0D498016AA"><enum>(3)</enum><header>Sources of information</header><text>In preparing the reports required by paragraph (1), the President may utilize any credible publication, database, or web-based resource, and any credible information compiled by any government agency, nongovernmental organization, or other entity that is made available to the President.</text></paragraph></subsection><subsection id="HCD6B69087ACE497D8FC99733BF8E3131"><enum>(b)</enum><header>Briefing</header><text>Not later than 2 years after the date of the enactment of this Act, the Secretary of the Treasury shall brief the appropriate congressional committees on the implementation of the strategy required by subsection (a)(1)(B).</text></subsection></section><section id="H7270EC2FA4FB4CB3A564A79801BB9FAD"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HFB2BE130262E49269AA208A11A747B80"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph id="H9FAF788097EB4A68ACB64F6BE0CB9BC9"><enum>(A)</enum><text>the Committee on Banking, Housing, and Urban Affairs, the Committee on Finance, the Committee on Foreign Relations, the Committee on Homeland Security and Governmental Affairs, the Committee on the Judiciary, and the Select Committee on Intelligence of the Senate; and</text></subparagraph><subparagraph id="HAC170634FB0A48BA9F06F3152067CD44"><enum>(B)</enum><text>the Committee on Financial Services, the Committee on Foreign Affairs, the Committee on Homeland Security, the Committee on the Judiciary, the Committee on Ways and Means, and the Permanent Select Committee on Intelligence of the House of Representatives.</text></subparagraph></paragraph><paragraph id="H0F21CBC74EF74B23A2E494237F54F470"><enum>(2)</enum><header>Blockchain intelligence company</header><text>The term <term>blockchain intelligence company</term> means any business providing software, research, or other services (such as blockchain tracing tools, geofencing, transaction screening, the collection of business data, and sanctions screening) that—</text><subparagraph commented="no" display-inline="no-display-inline" id="HB4DCC061FFB6462182A27A921CFFBAB5"><enum>(A)</enum><text display-inline="yes-display-inline">support private and public sector investigations and risk management activities; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4201D4769CDB428691B96252F010DE81"><enum>(B)</enum><text display-inline="yes-display-inline">involve cryptographically secured distributed ledgers or any similar technology or implementation. </text></subparagraph></paragraph><paragraph id="HE754DCC7D4AE4AC5BD389069B47201BD"><enum>(3)</enum><header>Digital asset</header><text>The term <term>digital asset</term> means any digital representation of value that is recorded on a cryptographically secured digital ledger or any similar technology.</text></paragraph><paragraph id="H45F16C3C6CE54DB9B30A83DAAF2EA1C0"><enum>(4)</enum><header>Emerging technologies</header><text display-inline="yes-display-inline">The term <quote>emerging technologies</quote> means the critical and emerging technology areas listed in the Critical and Emerging Technologies List developed by the Fast Track Action Subcommittee on Critical and Emerging Technologies of the National Science and Technology Council, including any updates to such list.</text></paragraph><paragraph id="H44E3FA9CD9D1445A8E3E1422023F4213"><enum>(5)</enum><header>Foreign terrorist organization</header><text>The term <term>foreign terrorist organization</term> means an organization that is designated as a foreign terrorist organization under section 219 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189</external-xref>).</text></paragraph><paragraph id="HDEED9F2EF8384E5BA57D5B0D6524BA51"><enum>(6)</enum><header>Illicit use</header><text>The term <term>illicit use</term> includes fraud, darknet marketplace transactions, money laundering, the purchase and sale of illicit goods, sanctions evasion, theft of funds, funding of illegal activities, transactions related to child sexual abuse material, and any other financial transaction involving the proceeds of specified unlawful activity (as defined in section 1956(c) of title 18, United States Code). </text></paragraph><paragraph id="H0713FB1A2DF642038976ABBDB67525F9"><enum>(7)</enum><header>Terrorist</header><text>The term <term>terrorist</term> includes a person carrying out domestic terrorism or international terrorism (as such terms are defined, respectively, under section 2331 of title 18, United States Code).</text></paragraph></section></legis-body><attestation><attestation-group><attestation-date date="20250721"
